It's really not particularly good evidence and I doubt you have only one time a year to add her. There are many qualifying events. I'd specifically ask if her arrival in the US on her visa would be a qualifying event. If so, no need to put her on the plan now. Use other more compelling evidence of bona fides instead.



my employer has 2 options for enrollment: once a year, or within 1 month of the marriage. So I knew there wasn't any change of her getting a visa in '07, so I opted to wait for Jan open enrollment. But my insurance doesn't care about her immigration status, only if I'm willing to pay the premiums.

I have to option to add my wife onto my insurance (and only get one chance to do this per year). It would begin in jan. 08.


While it's really clear this is thowing money down a hole, since there's little chance in hell of her visa going through anytime in '08 (and she has her own insurance), hard to argue its needed for the purpose OF insurance.

However, I started thinking perhaps it IS a good idea and can be used in the "proof of relationship" stuff where they want shared bank accounts, etc... since we obviously don't have that. Figure it doesn't look bad that the wife will have insurance upon arrival as far as further demonstrating ability to support her (my salary is well above the minimum requirements..)

anyway, any opinions are welcomed.... has anyone used this in his/her arsenal of proof?


(btw, I've already checked and they can still cover her even without social security number)

Where do you live now? And where is your spouse? Just explain more please.

Where would your interview take place? If your interview will be in your country of origin then im sure they know of this culture and they wouldnt be surprised. However, since you are married, they expect you to be together under the same roof unless there is a reasonable reason like working in different cities or something like that.

I would say, they will also ask for wedding pictures. Do you have any? If the wedding is so private and you guys are not living together then they might suspect fraud ( wedding for the sake of GC). Good luck

if you have a pending i-130 immigrant petition, don't try a B1/B2 visa, unless you are a special case in the sense that you'll go back to your country after your visit in the US.

the embassy will say that you are not disqualified right away if you have a pending i-130,... but in reality you will be rejected right away at the interview, so you have maybe a 0.1% chance of getting it.

So just thinking ahead on things that we my husband and I may be questioned on in interview...

- On my hubby's birth certificate his uncle is listed as his father because his real father was not in the picture. Furthermore, in order for my husband to be able to enter kindergarten in DR he had to have a "father" designated on birth certificate. As a gesture of kindness and to allow my husband the opportunity to enter school my husbands uncle (mothers brother) signed as his father on birth certificate. So now my husbands surname is the same last name twice (e.g. Martinez Martinez ). His biological father passed away a while ago. Im wondering if they will ask why he has the same surname twice and if his parents are related or siblings. If so, my husband and I plan to answer honestly and advise them of why his uncle had to claim him as his son. Do you think this will be a problem?

so i have done it , I submitted the  big I-130!!!!!!!!!!!! Now the wait begins, just looking for some insight , I made an appointment and met with an immigration officer this morning  before i mailed petitions. I guess I should say that the calls I am trying to print the history for are Video Calls, not phone calls.

They do not retain a history of video calls, I believe mine are retained because I pay per call from a skype subscription.

You can log in at skype.com and go to your usage history and it shows each call made you can then download it in excel format. 

How did you make copies of your Skype call history? The only method I have found is to use a screen capture and that will be well over 200 pages. I use Skype on an iMac.

You can print them off on normal paper.  You could try laminating but it's a very hot process and could ruin the photos.  Or you could do the self laminating strips.  Or just put them in a baggie. 

I just stopped at office depot and found the self laminating sheets and think i will do that. Right now I have them in photo sleeves but they line up right at the top of the page so wit acco fasteners they would be whole punched right thru. Great suggestion

Thanks for the tips, yes I have 95 pages of call history on Skype and some Viber chat transcripts. 

The petitioner needs to establish US citizenship via photocopies of birth certificate, entire passport or naturalization certificate.  You do not need to send in both photocopies of your birth certificate and passport.  It's a good idea to send a photocopy of the beneficiary's birth certificate but they really do not need his a photocopy of his passport.  You also do not need proof of no criminal records at this point.

 

(remember that everything is photocopies (not originals) wink.png

 

I wouldn't bother with the binder because they're going to take everything out of it and put it how they want.  Best idea is paper clips and binder clips with coloured sheets (if desired) between sections. Or ACCO fastened.  We just put it all in a big pile, with a binder clip, slipped it in the envelope and off she went.

 

They really do use folders with the two holes at the top for everything (I saw my file at my interview.) 

 

Do you have anymore evidence like emails, chats, skype etc?

I am writing looking for some last minute tips or insight anyone may have. I am finalizing my husband and I's documentation and supporting documents for the spouse visa with the I-130 form. I will be including in my packet the following:

 

I-130 form

Birth Certificates (mine and his)

Passport Copies (mine and his)

2 x 2 Photos (mine and his)

G-325 A Biographic forms (mine and his)

email notification form

Marriage certificate

Proof of no criminal records (husband)

Joint Account Documents

Hotel and Flight Itinerary (for each trip I have made to DR)

Boarding Passes 

Western Union funds transfer receipts 

Photos 

Letters of Testimony (from close family and friends)

Passport entry stamps

 

So far that is what I have and it is quite a substantial packet and I currently have it compiled in a rather neat binder with tabs on the side and all photos in photo sleeves. I was wondering if anyone knows if the preferred method to compiling packet is to use ACCO fasteners or is the binder fine. It is a 3 ring binder so pretty easy to disassemble. Please also let me know any tips you have after reviewing the above list of documents being submitted. I appreciate all the help

Dont change anything on ds230 keep it as is..so you are saying they havnt accepted birth certifi from Saudi right? so i think all you gotta do is to provide them an additional explanation letter saying even though the original hospital certificate is from saudi but KSA rule doesnt allow an expat to becaome thier citizenship therefore by nationality as per her parents nationality from PK shes PK national wrigth sumthng like this..but shes pk national there fore she has a NADRA issued offical birth certificate from PK ..now shes gona go thru a round of AP for sure just a name check n finger prints check migth end in 6 months time hopefully. Also contact NADRA i think they have some sort of NOC that even though birth is from saudi but shes now PK national with a PK birth registration..

 

for example my son is US national and born..now i have registered his birth here from NADRA AS WELL AND GOT A birth registration letter from them..

dont make it complex for them just provide them simple explanation in simple words with confidence..

Non-Saudis requirements for obtaining Birth Certificate:

  1. Original Birth Report by the relevant hospital.

  2. Parents' original passports and a copy of each.

  3. Parents' original Residence Permits and a copy of each.

  4. All documents provided must be valid.

  5. The specified # (87)-application form duly filled.

A provisional Birth Certificate valid for one year will be issued for the newborn. The original Birth Certificate is issued after a year having required medical vaccinations are completed

Huge Mistake..for delays in visa issuance...all you needed is a Pakistani Birth Certificate regardless of the fact she was born in Saudi..for PK birth certificates all you need is her mom n dads pk id card copies...all know that Saudi dont neutralize anyone for their citizenship. She has PK passport? and a PK id card? if yes all you gotta do is to provide an explanation letter with PK birth certificate..let me know if you need more info

 

 

Yes she has Pakistani passport and Pakistani ID card (in card NADRA written my name as husband)

 

Problem is  in I-130 and DS230  and related application has her birth location listed as KSA.    If I listed Pakistan it become false info and can be subject to rejcted.

Hello I am in need of percise help for my diffcult situation.   Not sure how to proceed, please help if you have experienced similar problem or knows proper solution to my problem.

 

 

NVC just issued Sept 27th interview date for my wife CR-1 visa to local US consulate / Embassy in Pakistan.   In check list they have mentioned all docs are OK however they listed A (obtain the original document ) next to my wife's birth certificate requirement. 

 

My problem is that my wife was born in Saudi Arabia, when her father was on posted in PIA position in Saudia Arabia. Then later she moved back to Pakistan 2 months after her birth, she is now Pakistani national, at the time of NVC processing when they requested original birth certificate I did sent original hopistal issued birth certificate however it was not accepted as a original document and now they want to get offical birth certificate from Saudi Minister of Foreign Affairs. I have looked on the Saudi site, there is a process out there for foreign national birth certificate  however they do ask for many things including original hospital issued birth certificate.   But that certificate is with NVC and may go to the US counslate, I called NVC and asked them if there is a way I can get that document back and they have not yet provided me any conclusive answer like if I can get back, all they said try US counslate later when we transfers these items to them, no other information was provided.

 

 

I am bit worried if they loose this document or if they don't give me back this document  or if saudi foreign affair does not issue me a needed birth certificate what will happen next , what would be a way to come out of this strange situation, when I asked NVC they don't have any answer for me, just said then you might have to get letter indicating that this document is not obtainable however they also said it is not true in my situation because it is obtainable for my wife as she is borth after 1968.  

 

 

 

Can someone help me please I am  very concerned here

My wife's CR-1 interview is scheduled for next month, checklist I have received from NVC states that  I must acquire original birth certificate of wife during interview.

 

It is strange situation as my wife was born in Saudi Arabia while her father was posted on PIA job in Jeddah.  She moved to Pakistan 3-4 months after birth, she have KSA hospital issued birth certificate ( which I then submitted to NVC), now even NVC have original they still stating gets the original document from different authority but they are not returning me hospital issued certificate, neither they know process how to get it back they keep telling me contact local US consulate, but also they are not telling me any time frame when these documents will be transferred to them (US consulate), if I have to get anything from KSA as official, which I doubt would be possible anyways, but I still need this document issued by hospital but NVC has no defined process to return back me that document as I am stuck here.

 

I already wrote to NVC and US Consulate seeking additional help but no response from both parties, it is over 2 weeks now. My father in law tried to contact KSA consualte in Pak and they did not helped either.   

 

My question is what is the alternative option I can use so my wife still get visa.  

 

She has Pakistani NOIC NADRA issues card, with my name listed as husband

She had Pakistani passport

She has metric certificate from Pakistan

Her hospital certificate by attested by Pak Embassy in KSA

 

 

Any guidance would be appreciated as we are running near time of interview it is now near less than month and I would like to avoid any delays if possible.  

 

PLEASE HELP

I filed my I-130 for my spouse back in May, and I used my maiden name as I had not changed my name yet. I was considering going through the name change process now, but I was wondering if anyone had any advice on the issue. Will it slow down or affect the processing of my husband's visa in any way? Or would it be wise to just wait until the visa is processed and approved before making any changes? Thanks in advance!

I've read and re-read the forums regarding K-1 visas and I thought I had a good handle on what was the right process for my Canadian husband and I to take. Well, on two separate occasions while crossing the border between the US and Canada,  we have had a border agent on the States side tell us that we did not file our paperwork correctly. Both agents stated that we should have filed the K-1 visa, and that by not doing so, our process is going to take much, much longer than the 9 months processing time that I was told when I called the USCIS processing center (this was before the shutdown). So I guess I want to put it out there to all of you who are much more knowledgeable about this process than I am.  My understanding of the process was that we would not need the K-1 visa, as it is a travel visa and because there is a travel agreement between the US and Canada, it was unnecessary. Therefore, my husband came down here and we got married in the US. Did we file incorrectly by not filing the K-1 visa first? And if so, what are the repercussions/what actions should we take? We received one NOA back in May when our application was received, and we have not received anything since. Any advice you may have for us is really appreciated.

The visa fee is non-refundable.

The interview you can prepare each other for, and I would recommend that the US Citizen is present for the interview. They may not let you in the room, but your presence will be known, and it will make a very positive impact.

I don't know about Bosnia, I went through Argentina which was a very easy consulate (very low immigration rate, Argentinians tend to stay in Argentina). 

Go over the standard interview questions (a search will find a post with them for you), go over the facts, make sure you're both on the same page.

This depends on the consulate. Some will allow you to pay online, some only in person. Some will allow the US Citizen to pay, some only the beneficiary. Some require only cash, others will take several forms of payment.

 

It is best to use the "Google Custom Search" in the top right hand corner of the screen and see if anyone else has asked a similar question for the consulate or embassy in Bosnia.

They change the Alien Registration Number (ARN) when they put your petition into the system. :) 

You're still in for a few months wait... so sit back and relax... you can get restless again after about 5-6 months. :P

Its the 'Status Updated Date:' which changes often for my case.

I also sent them (two days back via. the online contact form) updated employment letter and pay stubs for my I-134 which I had included with my initial application.

 

Then likely someone just added them to your file! No worries, just means someone was updating or looking at your case. :)

I have a similar situation, often the status date updates on ceac website.  My fiance's interview date is on the 29th of Sept.

The status remains 'Ready' but the date updates.

 

Is case or file update related to status date update?

 

There's two dates on there: "Case Creation Date" and "Status Updated Date". The "Status Updated Date" means an IO is working on it or "touched" the file. Likely because you have an interview coming up!

When they change the case creation date, it usually means that they will issue it within the next few business days. The status will change to AP for a short time while the process the paperwork and print the visa out into your passport. Ours took about a week.
