i have the same situation.. go to the passport agency close to you in india with your marriage certificate and birth certificate and they will change the name for you, tell them you want to apply for a new one ... now it only take less that a week to get a new passport in india.

in my case i used my wifes maiden name and she just had to endorse that i am her husband in the passport with is a seal and my name and 1st magistrates signature

Ok heres a question and I dont really want to start another thread as this seems to be my home base.

So for those of us fortunate to have received a NOA1 and whether it be from CSC or VSC (yes we know postemarked Chicago) but heres the question - Looking at USCIS timeframe, and yes bumps head against wall, promised not to do that anymore, but CSC and VSC still show diddly squat for I-130 applications being moved forward - i.e,, sitting on July 2007 for VSC and August 2007 for CSC - this has not changed for months fyi......

So now that we have a NOA1 - what timeline are we looking at- in other words if applications are being scanned, what is actually going on in Vermont and California that there has been no movement whatsoever -

Challenge anyone ???? I promised myself darn I would not even consider their website anymore, but went in to look up NOA1 number and I know its not in system yet till end of month at least, but glanced at CSC and VSC and was just thinking........what are they doing??? mad.gif mad.gif

This IS the plan. The supervisiors I'm sure encourage longer and longer waits. They want us to move and or give up. And the average american supports this. Hell, joe six pack would probably endorse sending applicants to Guantanamo Bay prison for life or execution.

FFS they are cruel and mornic in the same sentence....they will put a trace on you HOHOHO and you will get the famous email stating, in order to find your application please supply your receipt number.... I got this and said FO, sent it to the Omsbdmn for review....just showing him that I was calling because I DID NOT HAVE A RECEIPT NUMBER and they would trace down my application - I got this answer back from USCIS for the receipt number in exactly one week. When they say you are not in the system, of course not, neither are we even though we have that elusive NOA! - go figure that on the keyboard.....Totally out of control they are now.

p.s applied today at USCIS for a job, think I may get kicked out of the system because of pending I-130? Oh wait, no its not in the system yet. All will be good kicking.gif I will get the job because the time that they do background check and such my I-130 will be wandering around the country so I just ordered an "APPROVAL STAMP" actually got two with tons of ink.....

that's what all the "be patient" crowd does not understand. we all know it's going to take a hell ov a long time... BUT if your packets are LOST or not, we don't know. IF they are lost, we will have to start over, losing months, perhaps a year... At least when you have a reciept you know you EXIST in the system even if it takes 5 years. With nothing, you may as well not have bothered getting married yet.

When did you apply for I-130 HOHOHO? Hopefully USCIS will update receipt processing dates this Friday. Keepin fingers crossed.

I'm trying to look into possible immigration myself to a non hostile towards families nation. I'm ok with waiting 2 years but 3 to 5 years is f'in impossibly retarded. My county is FAILING me. Thanks for nothing so far. What course of action should one take if you wait 6 months and do not even get in the system? YOu don't know if you packet has been flushed down the fn toilet or not. I do have a "postal service" reciept.

I'd be shocked if there's anynews at all for the rest of 2007... remember, those lazy workers that drag ####### have 208 holiday parties to go to this month.

Thanks Rip, yes I have that page in my favs - I actually have two applications in but as you can see from my rantings from previous post, there are a few of us just looking for confirmation of receipt after 90 days plus. Have USCIS doing a trace now and they were more than happy to proceed with that little request, probably just to keep me happy for another thirty days :-). I am not really worried about the process after that I know that will take time, I just want to make sure that the application has not been blasted off into space somewhere and we will have to reconfig the whole package - oh wait we have a lawyer, they can do that goodie.

Our lawyer is pretty much with it omg surprise and did mail both since your receipt on the sending shows proof of delivery to USCIS. Its been discussed in other threads, would I have done it, I would not even had a clue at that time what an I-129 or I-130 was so i hope it helps. It all went to Texas and then its being airlifted to or has been to California sometime before 2020. lol

Spoke with misimmigration today, they are working on September 3rd apps btw.

I still think its completely unfair people are moving ahead of me in processing just because of where I was "told" to send my packet, Vermont.

I mean what the heck, we are probably better off there than here cause no one but people that are in the same boat or have been totally understand what a screwed up mess our government has become.

I am calling USCIS on Friday, yeah I will give them the week to get their act together and tell them exactly what I think about their new fee increase and how they handled it. Dont worry, no names yet. Its just pure bs as far as I can see. No husband, stress waiting for a damn NOA1 - I mean a NOA2 would like Thanksgiving dinner at Camp David.

I think this is not about destroying marriages. They have made a mistake, they admitted it, they admit there is a back log. Now all we can do is be patient and wait. But please, we all deal with the same slow process here but still each of us is affected differently. There are NO quotas (as far as I know) for spouses or children of US citizens. I don't think it is time to panic yet. In any case. Once our cases are in the system it should not be much worse than the usual wait. At least it doesn't look that way yet. Lets not panic and keep our hopes up.

Sadly congressmen don't give a flying flip about it. I'd expect that to be a huge waste of time.

My 90 day deadline will come in two weeks. I expect to hear nothing and maybe 2 weeks later I expect them to issue another no answers update saying to wait another 15 weeks.


By the way, I read USCIS were REALLY busy last week: they had Halloween parties to go to and were getting down making hillarious costumes making fun of stupid feriners. wonderful. wacko.gif

Where did you get the information about 2 to 5 years? As far as I know the process has never taken that long for most nations. A while ago it was over a year but it seemed only in rare cases did it take longer. Why do you have to scare and worry people who are already stressed out about the situation? There is no reason for that. I think we should support each other and not add even more stress to the whole thing. USCIS has already admitted it is going to take them longer. There is no reason to make up stuff about waiting times when there is no proof!



Just basing it on reading these tons of assessments. Timeline is clearly a minimum of 1 year after the case is begun. I still don't even have a case number. Check will have expired and once i resend it's going to be a whole new waiting processs. Since they seem to have quotas now for family visa (I think I read that somewhere) + the extreme amount of new filings, there is no reason to expect things to move as fast (slow!) in the future. It likely will be slower. So factoring in all that, and the likely possiblilty that they will deny for quota reasons (add to the fact my wife is Muslim), and re-applying all over again, perhaps once, perhaps twice... that it can take 5 years.

I've seen the timelines on loads of people here. I've never read so more horror stories.

The USCIS should just say if you married outside the usa, plan to move there, cuz we are going to F with you unmercifully and make it as difficult and expensive as we can to protect merica from your spouse. USA: closed for immigration.

You will be given an opportunity to send a new check at the original filing rate and filing date to resume processing of your application. Romania's food isn't THAT much different than ours. They just wouldn't eat those foods at the same time of day or in the way we'd prepare them. Most of America's foods are a mish-mash of European dishes. :)

Having been in an abusive marriage but having stayed in it, I can say this... there is no magic way to walk the middle ground.  What you really want, I'm pretty sure, is for him to change.  It's very hard to realize that's not going to happen.  You can't say "Sweetheart, I love you, but if you don't change I will not file your ROC" and have him say "Oh Darling, I want my green card so much, suddenly I want you so much."  You probably tried, as I did, to "get along by going along" but there's going to come a certain point where you may have to do things that will antagonize him beyond the point of no return.

 

This person is correct he won't change.

 

His abuse is not your fault. My ex-husband was extremely abusive as well, so I know the story. You two get in a fight, he gets physical (I got physical back, thanks to a decade of MMA training). The next day you're shaken, bruised and terrified it will happen again, trying to figure out how to get out, but he's price charming; doing everything for you, and treating you how he did when you fell in love with him. You continue to be nervous, but eventually he wears you down with his good behavior and your walls lower again, and that escape plan slowly becomes less important. You make excuses for him, it was only that once, and he swears it'll never happen again... so you decide to stay (for me, it was for our children). Then it happens again... sometimes it's not for years, other times months. Sometimes they threaten you and your loved ones if you leave, or don't do what they want. 

 

Manipulating you gives them a sense of power, as they feel they have no control over themselves or their lives. Leaving you always jumping, and wondering when the ax will fall, is easier than putting forth real effort in a relationship. They never have to take responsibility because they shoulder it all on you. If you start to think for yourself again? They just jar you with another outburst, so you're too terrified to fight, and just walking on eggshells to keep the peace.

 

Now that I'm married again to a very loving, affectionate, man in a healthy relationship... I can tell you this. You can find love again, you deserve it, and what he's doing is NOT okay, and will NEVER be okay. He's not a man, he's an overgrown child throwing a temper tantrum and blaming you for it.

 

Contact a woman's shelter, they will be your biggest asset when defending yourself in court for a divorce and for immigration. The police reports and the pictures is very helpful. Start seeing a therapist, that can also be used in court/immigration to prove abuse, and that you're seeking treatment. I also personally recommend it as it can help a TON.

 

Move out right away, go stay with someone where he cannot get to you, friends, family, women's shelter, a hotel, anything; things will only get worse from here - not better. If you own a home together (i.e. your name is also on the mortgage), continue to the pay the mortgage, if you lease/rent have the landlord remove your name from the lease. Shut off any utilities in your name, remove your name from any and all joint accounts, any joint loans you'll need to continue to pay for your credit's sake. File for divorce immediately. He legally cannot sell/give away a THING once you file for divorce... marital assets are to be split evenly if sold, and cannot be done without your permission. Get a divorce lawyer who is familiar with immigration. If you have children, remove them from the home with you. File for temporary emergency custody if he's the biological or custodial father. The police report and abuse case should be enough to grant that. Get a restraining order.... trust me.

 

Gather as much physical evidence that committed immigration fraud, any emails, voice-mails, IMs or texts he sent where he stated that he entered the marriage for a green card. Record with video ANY INTERACTIONS between himself and yourself. Encourage your family do so as well. Video is admissible in court as evidence. Voice recordings can be altered, video is much more difficult. If you catch him on video claiming this it is fantastic evidence.

 

You don't have to worry about the RoC, he can file it himself, but you need to protect yourself and your loved ones. 

 

This is how I managed to do so with my mentally unstable ex. Any evidence you can gather of him admitting to visa and GC fraud, pass along to immigration. They will investigate the matter and will likely deny him an RoC if not remove him from the country as soon as they get their hands on him.

 

Good luck, and I hope you nail the wanker to the tree for doing this to you. Your love is not expendable, and you deserve the happiness he so hollowly promised.

I've been in limbo for 1 year now, with nothing.

At present time there is no immigration. So there is nothing to wait for.

Maybe an overhaul in the department next few years may mean VSC is open for business.

There's no course of action either. Sucks.
