Photos do not need to be a certain size, and they do not have to have dates and every single person in the photo listed. I sent literally 4 pictures, no specific size, didn't put dates or the names of the other's in the photos with us. The only thing I did was put my name and my husband's, with our DOB in case they were misplaced. I have also seen many others in this forum merely print them on regular paper, no need for even photo paper. Photos are only secondary evidence and don't hold as much weight as primary evidence, photos can be staged...

The only photos that need to be a specific size are the passport pictures, they must be 2 inches by 2 inches, in color

 

Yes, I understand that I was misinformed, I will correct this moving forward. *salutes* ;D

 

Perhaps the service I used misunderstood, or decided to take the "safe" route in having people print out their photos on photo paper and label them for one reason or another, regardless I will keep that in mind.

 

As for how it was an aggressive response, the tone and wording was a bit aggressive, when I was only asking for confirmation and perhaps elaboration. I'm sure the person didn't intend it that way, however tone is conveyed much more rigidly in text as vocal pitches cannot be heard, so how things are worded have a lot of impact, I think many people are not mindful of that.

I was told regular paper is acceptable with the Visa interview but not acceptable for the initial petition.

 

I wonder if that was a "safe" response because some IO's are picky.

On July 1st I sent in our K-1 Visa case to the Texas lockbox for processing.  I quickly received my receipt number from the California Service Center (dated July 10th) and am able to track my case using the uscis website.  Each time I check the website I will get a status update that indicates the case is progressing without issues.  No problems there.  However, the majority of my "evidence of ongoing relationship" and my "proof of meeting over the past 2 years" was returned to me.  Here are the items I included in my "evidence packet"

 

1) I made photocopies of my plane ticket stubs with dates and destinations clearly visible

2) Photocopies of letter and envelope that I sent to my fiance December 2012

3) Photocopy (in spanish) of an original letter and envelope that my fiance sent to me June 2013

4) Color photocopy of a photo souvenier from my trip to visit my fiance in March 2013

5) Photocopies of my passport stamps to Mexico to see my fiance (2 trips: August 2012 and March 2013)

6) Color photocopies of movie tickets and museum tickets from my trip to visit my fiance in March 2013

7) 5 Original color photos from my first time meeting my fiance (clearly labeled with date and location and names) - RETURNED

8) 18 Original color photos from my second trip to visit my fiance and his family (also labeled clearly) - RETURNED

9) DVD documenting my second trip to visit my fiance in March 2013 - RETURNED

10) Facebook data files saved to CD (most correspondence was done via facebook chat and all messages were included on the CD) - RETURNED

11) Two color screen shots from Skype video chats - RETURNED

 

Items 7, 8, 9, 10, and 11 were all organized and packaged in a zip-lock bag. However these same items were returned to me with a letter that stated they were not in a correct "format." I am unsure whether this means I did not label clearly of if that formats such as DVD and CD are not acceptable.  Most surprising was that my color photos were returned to me.  I followed all directions I could find regarding sending AND labeling evidence and so I was surprised to receive back the photos.  Note: they did NOT send back our passport photos... those they kept smile.png

 

Items 1, 2, 3, 4, 5, and 6 were kept in my case file... but if I were an immigration officer I would want more evidence.

 

I have the 1800 number to call for questions but so many people complain about that being a dead end as well.  I just wanted to post on here before I stared freaking out. 

 

I assume they will want photos at some point to prove our relationship and so I guess at this point I expect a RFE.  However, if this happens, I am hesitant to send the photos, DVD, etc because they were returned before.  I could print out all the facebook messages but I feel like that is overloading (3000 pages of messages!), isn't it better to give the a facebook data CD they can look at if they choose? Any suggestions?  My fiance and I are also working on getting our phone records printed as well... but like I said the majority of our correspondence is via Skype and facebook chat.

 

Any suggestions are welcomed.  Thanks!

 

 

Photos must be 4x6 on individual photo paper.

They should contain the names of everyone in the photo on the back (indicating if its Left to Right. or Right to Left), a date, a location, and a brief description.

 

DVDs/CDs inadmissible, electronic evidence is not allowed, must contain a paper trail.

Data files for FB & Screen shot of skype calls: Print these out, on paper -- also this is more the stuff they're looking for when asking for "proof of ongoing relationship".

In Ohio, all I had to do was get on the internet and make a request for assistance. Then they sent me a letter saying that I needed to fill out and sign an official request and write a letter about my situation and everything pertaining to my case, including case number and a copy of my NOA-1. They then did an inquiry to USCIS and told me that I can request an expedite and send in evidence as to why I am requesting it. Then I send it directly to the Senator and they pass it to USCIS.

All this was within 2 weeks. I just have not had a moment to put together a convincing letter at the moment, at the time my sister was killed and it has been downhill since. I am trying to get it together enough to send to the Senator though.

I hope this helps at least a little.

I applied for a tourist visa when my I-130 was pending. I got approved right away. As long as you can convince them that you're not gonna overstay your visit. I had an employment letter with me, saying that I was going to be on leave for a specific date to visit the US. I showed my pay slip and then I was done.

As long as she can prove her ties back to her home country then she should have no problem.



you know this is the inconsistancies that peeves me the hail off.... we were told by USCIS point blank tourist visa for spouse are VERBOTEN. That's nazi lingo for NOT PERMITTED.

I wonder if we should waste money on another try for that.

Did you stress the fact that the 6 months deadline is up and that still nothing has happened. To explain: USCIS says that they will do everything possible in order to get cases approved within 6 months. And even though there is all this back up emphasizing this did help my hubby and I when our 6 months deadline was up in February. We called on the day of the 6 months deadline and just kept on pressing that matter. BUT we were very polite about it while still being persistent that the regulations still apply and that we were very surprised what was going on. About 2 days later we had a touch and about another 2 days later we were approved. But there are no guarantees. And especially we did file after the date that USCIS still has posted on their website.



I think the PRE 8/1 world and post 8/1/07 world are 180 degree differences.

They've abandoned that timeline. The don't look into your case and they are more unwilling to even speak to you.

I'm sorry guys, but yes, that does cover the fact that families are split apart by an unjust immigration system .... the voice of the I-130 applicants has actually been very quiet (oddly enough), to the right people.
Sure, I see lots of discussion about it on this website and the odd fax going to Senators and the White House .... but really, not much else.

Migrant workers are protected from unjust immigration systems .... i.e. H1-B's, who are able to bring their families to join them very fast.
The situation that is happening at VSC currently could very well be viewed as a violation to this section of Universal Human Rights. Family petitions are being ignored.

Those with children could at least fall under this and have the system sped up for them ..... it must be horrible having a child cry for its Daddy or Mommy every night for a year or so, just because Vermont are constatly working on Fiance visas ..... a lot of which are applied for by guys who have literally 'purchased' their brides off the internet.... before I'm jumped on, not all of them are, but there is more than a fair few.

So, yes, there is perspective .... a lot of it!
My view of the bigger picture, is obviously a little broader than the miserable people on here who think that it's acceptable for children to feel so much pain.
Whether a tank drives down the street of the child ..... or the child cries itself to sleep every night because Vermont has decided to ignore family petitions ..... to me is very much of a muchness.

Your hue and cry though hasn't a thing to do with children. It has to do with the fact that YOUR petition is taking what you think is too long.

It's true the family immigration process in the US is too long and drawn out. But the fact of the matter is that you and the posters to this thread have suffered no injustice compared to a true human rights violation. Look to Myanmar and other countries where their governments are so unkempt they can't even help their citizens if you need proof of that.

Lets up the ante in riddiclous arguments:

This the office which apparently covers the U.S.

Migrant workers (the H1-B's) are protected under Human Rights Law and are therefore able to speed through the system due to the allowance of expedite under family reunification ..... with them, it's just a given.

I know that family is not something that the Human Rights people have done a lot of work on, but if enough of you contact them, there may be something they can do to ensure that I-130 petitioners are treated at least equally with the other visa types.

They're also pretty hot on discrimination .... and if you look at the timeframe between a family under I-130 or I-129F (CR1/IR1 or K3) being together compared to I-129F (K1) or the H1-B's there is a massive discrepancy ..... and if there's children involved in your case, then they should be willing to listen .... I hope.
