For healthcare decisions you would need to have a health care proxy in place. That would give her the power to make medical decisions for you should you be unable to make decisions for yourself.

piece of advice... since your fiance is living in Florida; just include both in your affidavit the name of state that you will be married where it is legal...
 
as regards to owning of property. I dont think it is possible as state law will not recognize you as partner; thus owning a propety together would not be possible; you both would still be consider single in that state and state taxes will be filed separately.


The last part is not correct. Even if the state does not recognize your marriage and considers you single, you can still jointly own property. You would just have to stipulate that you want the deed to the property to show joint ownership. (We had to do this in California may years ago when same-sex marriage there was not legal).

Meet him first then decide about the K1. I would say its too early to think about K1 before meeting. I respect online love stories (i myself one of those people who fell in love before meeting my now husband)  but meeting the other person will reveal way more of their personality and intentions. Im only saying this out of love and concern for visa journey member's and after reading horrible stories on this forum. Im not saying your boyfriend is gold digger either but its better to be careful than sorry.   

 

After you meet and you decide he is such a great guy then file K1. K1 take 6 to 8 months so you can visit him during the process and by the time he has his interview, you will have a record of two visits, plenty of pictures etc etc

I know that NOA means Notice of Action, but my thoughts were that they're not really making any additional "actions" as it's a decision for approval/denial, the NOA2 could be used as a notice for when they fwd your approval to VSC, which would TECHNICALLY be an action. tongue.png

 

The gov't likes to be extremely particular about things (as former military I know ALL too well) so I figured I'd ask and know than assume and perhaps be wrong. smile.png

I'm just trying to understand the process, so if these are stupid questions I apologize in advance.

 

I applied for the K1 visa in the middle of April, We got our NOA1, and I haven't heard a THING since, so I guess to ease my mind, as well as to know what to expect:

 

1) Is there a typical time frame in which someone may get an RFE (I know that not everyone gets one) and if so, when?

2) Will you get a NOA2 if you're denied?

3) On average, once you get approval via NOA2 notice, how fast (range wise) does it take until your fiance(e) has their interview? I also know this is one of those things that depends on the country.

 

 

Also, I know once you get your fiance in the country, you have to apply for your adjustment of status once you're married, how many of you are saving up for that prior to them coming to the country (because it's about $1070), and how many of you just planning on putting money away once they're here?

 

For those of you outside the I-129F journey and onto the AoS, how soon did you apply, and what would you all recommend being the minimum amount of time after the foreign fiance's date of entry on the K1?

But they state: "Which occupation do you intend to work in the United States?"

From my understanding of that question, they're not asking where he plans on working, so much as what does he plan on doing for work: Construction, Sales, Retail, Warehouse/Shipping, Delivery Driver, etc.

 

If you're unsure, you might be able to use "To be determined" or the like.

 

I'd check with some of the more experienced VJ'ers, though.

A friend of mine applied for a visa for his Philippine fiance, and he used "RapidVisa" which is basically a paperwork service -- they don't offer legal council. I asked him a million and one questions and went with it myself. 

 

They cost about $350-$400 for their service (depending on if they mail everything for you or if you mail it all yourself). Here are some of the pros and cons for those of us less confident in our understanding of the legal process:

 

Pros:

  • They review everything to make sure you have what you need for evidence and everything is filled out properly.
  • You can fill out everything using their MUCH simplified online forms, which are step-by-step and accessible to you and your fiance (providing he/she has access to the internet)
  • They have people there who have BEEN through the visa process themselves who are available to answer your questions when filling out their online form, you can even chat with these people via online chat program!
  • They're MUCH cheaper than a lawyer.

Cons:

  • You still need to review your personal information for discrepancies, they only check to make sure you have all the evidence in order and everything is filled out -- they don't check for mismatched information or typos.
  • In come cases, that can be $350-$400 that could've gone towards the AoS fee, as the process isn't as complicated as it seems at first glance.
  • They're not experts so if you have any questions you'll want to check the information they give you.

 

My personal thoughts:

I work a LOT of hours, I'm a programmer and I work for a small company, so I'm one of FEW programmers with FAR too much work :P. I was grateful for a service that didn't cost me my firstborn child and provided a simplified way to apply that I understood. I liked having someone there, where I could log in and just ask a bunch a questions about the paperwork process if I was unsure.

 

In my personal opinion; I don't think lawyers are really needed unless you have a unique scenario which legal representation may be your best shot at getting that K1 approved (i.e. criminal record, a visa ban from a previously overstayed visa, etc). When I first joined I saw a user's post that was a guide which was pretty awesome somewhere in the depths of this forum by now, I would say do a search on "user guides" and see what others have to say. You're the only one who can make that decision for yourself, but I would recommend doing some research so at least it's an educated one!

 

Just a few thoughts, I'm not very far along in the process so don't take what I say as any sort of fact, I'm still a newbie too! :)

Just sign as you normally sign anything else. My husband's signature is not even his name. It is what looks like a fancy, strange version of the first letter of his name and then some kanji characters. His signature is accepted everywhere. He had no problems on any of his immigration forms, as his signature is consistent across all of them.

I've heard conflicting information about this, some people are saying black ink for signatures, some say blue. I signed in blue ink, and so far my petition hasn't gotten an RFE... emphasis on "so far"... but I know people who've signed in blank ink as well and haven't had any issues either!

 

I would recommend whatever type of ink you choose to sign in, that you make sure you (the petitioner) signs on a magazine or the like so the imprint of the pen is visible on the paper.

 

As for typing in the application information, that would be ideal, since you'll know it's legible and there will be no issues reading it.

I only signed my middle initial and nothing has been sent back.... yet.

 

From a purely legal standpoint, you can sign an "x" as your "John Handcock" and it's still considered a signature and it's still legally binding. I'm not sure how the USCIS feels about that... but legally it's still binding.

 

I did read that it's best if you fill out your application in black ink and sign in dark blue ink (as well as sign on top of a magazine so the signatures are imprinted in the papers) that way they know the signatures are legit. happy.png  

 

I don't think signing your middle names makes a difference, but if you're not sure go ahead and sign them if you haven't sent your paperwork in already, just to be sure and for your own peace of mind. Think of how many people's signatures are completely illegible! laughing.gif

The fees to the USCIS (K1 application fee) has to be done via check or money order in USD only.

 

The fees to the embassy for the visa will likely have to be paid for in advance. The US petitioner will likely have to pay them via a bank wire, but how this is to be paid will be provided to you in the package you get from your embassy, as it's different for every consulate/embassy. You can search for information on visajourney about the process for your local embassy/consulate for more detailed information, or perhaps a more seasoned VJ'er who has experience with your local consulate/embassy can tell you more in detail.

Ok I am new to VJ, and I have been reading post after post. I have read the K-1 guides and checklists. I have also read the Dominican Republic Portal. However, I am still confused about the fees. I have broken it down to the following based on my situation (K-1 Visa)

 

1. I-129F-$340

2. $350 Medical and Vaccines (vaccines optional)

3. IV packet-$240? ( i am guessing this is the packet that contains DS-230, DS-156, DS-157)

4. Visa Application $160 + $15  (i seen this somewhere,but not sure if this is #3?)

5. Consulate $80

6. Domex Courier $12.50

7. Immigrant fee (POE) $165

8. Marriage License fees $72 (in my area)

9. I-485 + I-765 $1010  (includes biometrics, I don't intend to file for AP, because fiance wants to stay in US)

 

Can anyone tell me if I am missing anything? I know I will have more fees when we file for permanent residency, but for now these are the fees I can expect? By the way, it would be really helpful if all these fees were posted somewhere all together by type of visa. I realize that the fees may change, but I had to jump around in different posts and read the consualte interview situations to find out about some of these fees. Another thing that would be helpful is if the checklists were updated to show the fees that are associated with each step.

 

Also, I am on the Dominican Republic portal, and I can't find any button to post a topic there. I can comment on a topic already posted, but I am not sure how to post one on the main page.

 

This is a breakdown of the fees I was told about from the paperwork service I use:

 

I-129F: $340.00

Medical Fees (beneficiary); $200.00-$400.00

Visa Fees: $240.00

Marriage license: (varies on state) + cost of wedding officiate, check your state regulations

AoS Fees: $985.00 + $85.00 (biometrics)

Remove Conditions: $505.00 + $85.00 (biometrics), if the AoS is applied for prior to being married for 2 years.

 

Note: You don't have to apply for the AoS within any timeframe -- but your foreign spouse will not be able to work until you do, so it's recommended you apply asap.

As far as I am aware (correct me if I'm wrong) you'll need the following to prove income at the interview:

 

  1. The most recent years' tax return (you can attach the last 3 to be extra cautious)
  2. Letter from Employer, with the company letterhead, stating your income, how long you've been employed there, what your job is & whether the position is permanent/temporary.
  3. Most recent pay stubs.
  4. I-134 filled out.
  5. Bank statement from the last 12 months.

There may be more, but that's what I was told you'll need.

Can one have their interview in the U.S.? Or does that have to take place in the émigré's home country?

 

My girl friend will be visiting on a tourist visa. If all goes well and we do decide to wed I am curious if she would have to return to Manila for her interview.

 

The interview, medical & paperwork you'll need to gather will require her presence in her home country.

 

She will have to return once your petition is approved.

I work a lot of hours so I appreciated the peace of mind and the guidance and moral support they offer.

 

The service cost me $400 (because I had them mail it for me, so it covers the cost of overnight delivery) at RapidVisa. A friend of mine had married his Filipino wife and another his wife from Japan. They both used the service and recommended it to me. :)

 

I don't know if it's worth it for you, but because I'm so busy all the time, I appreciated having the assistance.

 

You fill out your petition using their online forms, which fills out all the appropriate information (that you provided) on the application -- its very much simplified. They'll check your petition and make sure its all in order, but if any information (like DoB or Addresses, or PoB, etc) is incorrect you'll have to catch that. They won't know what it's supposed to be.

 

I would say its helpful to those who are really uneasy about doing it themselves or who lack the time to do all the research. smile.png

 

Certainly cheaper than a Lawyer!

I used a paperwork service to check my app, and on the G-325A I put in N/A for the ARN on both, and for the names, the name of the person who's information the form was for.

 

So for me I put my name in the bottom and N/A for the ARN.

 

For my fiance I put his name in the bottom and N/A for the ARN.

 

I haven't (yet) gotten an RFE, but that doesn't mean I won't get one.

I would recommend that you verify this with an immigration lawyer so you don't waste time and money on a K1 visa filed too soon.

 

If you are indeed legally able to marry according to immigration laws, then the government does not care whether you were divorced for 10 years or 1 day before you filed. So long as you are free and legally able to marry according to immigration laws.

 

You will have to have met your fiance(e) in the last 2 years.

You both must be free and able to marry, provide all divorce certificates, annulment certificates, death certificates, etc.

You must be sponsored by a U.S. Citizen.

You must be willing to marry within 90 days of the beneficiary (foreign fiance(e)) of entering the U.S. on the K1 visa. If you do not marry within that 90 days you'll be deported, and possibly face a permanent ban.

  2. Phone logs
  3. Emails
  4. Letters or mail you sent back & forth
  5. Screen shots of any cam2cam conversations
  6. Facebook screen shots of your engagement annoucement
  7. Facebook screen shots of any interactions
  8. Affidavits from family and friends about your relationship

That should just about cover it. It's not required that you go there to visit him/her while your petition is pending, it looks good but it's not required. As long as you can prove that you two have been in consistent contact that should do enough. :)

This user is completely correct -- I misunderstood your question.

 

One of the base requirements is that you met within 2 years prior to filing the petition. You can however mail in a copy of your passport with the stamps supporting when you met your fiance(e), however it will only be counted as evidence if the stamps are within 2 years of filing the petition.

 

The visit while the petition is pending can be used as evidence of the ongoing relationship if you're approved, which will be required at the interview. So keep that info. smile.png

I visited her and meet her once again while my petition was pending. Can I send pictures, airline ticket, copy of passport with entry exit stamp of my visit while my petition was pending If I get a RFE or will it create further confusion? 

 

 

I heard mixed reviews on this one...

 

You can wait for an RFE or you can send it in (just make sure you keep a copy of what you send in, in case you get an RFE after).

 

What I heard people do is send it into the USCIS office that their petition is at and they put their receipt number at the top of every single page. Some people had success with it, some people didn't.

 

If your case has been transferred recently and you didn't yet get the letter in the snail mail telling you where it's now at (because the emails are not always right) I would wait until you have that so you don't send it to the wrong place. :)

The entry/exist stamp on my passport was not clear when I tried photocopying it. So I did not send it. I just send airline ticket and few photographs as proof of In Person Meeting.

 

I had that issue but then I scanned it under the "photo" setting and it was crystal clear.

 

You'll likely get an RFE but that's not the end of the world. Just prepare for it now and send it out once you get the paper. smile.png They'll put your case on pause and as soon as they get the documents they need they'll finish processing it. You don't go to the bottom of the stack.

 

When I sent mine I sent the following as evidence of the relationship:

  1. Scanned copies of my passport -- all pages... even the un-stamped ones.
  2. Photocopy of my return boarding pass.
  3. Photos of us together:
    • 2 were time stamped (taken from my webcam on my pc), which corresponded with passport stamps
    • 2 were with his family
    • 1 was at a restaurant we ate at every day and accompanied by the receipt for that restaurant, which had a date and address, that corresponded with the passport stamps.
    • 1 of which was me standing in front of his city's sign at the train station.

Tunisia would be considered a high risk country for fraud so you will need a considerable amount. The best is to add a variety of documents and small snippets from different days, weeks, and months since your petition was approved. It's better to be safe than sorry and might also prevent delays.

I had to meticulously organize mine for my own sanity as I was assembling because I was paranoid I would forget something... I even had those sticky tab things that you can label to mark off different sections. I read somewhere about putting them only on the bottom of the pages, I don't know where I read that or why it said that, since they do indeed just take everything apart when they get it.

 

I think it's inadvisable to just print pictures on paper because its so easy to tamper with them (although its not a lot harder to tamper with them before you print them on photo paper, but I think they idea is that it looks like you just went to a shop and got them printed direct). I also read that if you can print them with the date mark showing from the camera's stored information, that can be nice to verify that they were from the past 2 years.

 

I haven't (yet) gotten my NoA2 approval, but I presented 2 photos of us together with a timestamp, one photo of us in front of cafe martinez, and the receipt from cafe martinez, which had a date/time that all corresponded to my passport stamps (also provided photo copies of). I was also advised to only print the photos on photo paper. I went out of my way and had them printed at walgreens, because the quality is usually better.

How about photos?  Is it ok to just paper clip them all together and send it in a seperate envelope?  Has anyone just printed their photos on paper instead?

 

I was advised to put all the photos in a zip lock bag and clip it to the papers. :)

 

I was told I should also write the date, place, people in the photo and a brief description on the back. Typically "Myself, my fiance (name) his father (name) and his mother (name) outside his home in (place) on (date)" or the like. :)

As far as I'm aware they dissemble it, scan it into the electronic system, and put it in it's own file. They will remove it from whatever you put it in, to assemble it in the standard format they use.

 

If you want to organize it so it's easier for yourself when getting everything together, more power to you. But as for them some simple paperclips and post-it notes or cover pages, indicating what is what are fine. :P

I lost almost all of my paperwork in a flood not too long ago. Luckily I scan everything or keep digital copies, but still. :c I had to go get copies of my birth certificate, divorce decree, and custody arrangements when filing the I-129F. :c

I have PDF copies of my Tax Return from H&R Block or TurboTax. Will that be sufficient, or should I get W2's from the previous years from my employer? I've been with the same company since June of 2010, so I have plenty of records, including a digital copy of every single pay stub since I started.

I've been reading that they're taking 6-8 weeks to assign case numbers for the K-1 because certain politicians told them to focus on pushing other types of cases through.

 

I may be mistaken though. I hope they stop with that soon. :c

Thank you! The thing is I flew to Cuba, so any ATM receipt or statement is nonexistent there. My luggage claim tickets are not in my name but my daughter's since they choose anyone's name.

 

 

Someone correct me if I'm wrong but these may be of assistance in proving you were in Cuba on the date(s) you indicated:

  1. Boarding passes under your name for the date(s) you indicated
  2. Bank Records showing a transaction in Cuba on those date(s) (call your bank, and ask)
  3. Hotel Itinerary under your name showing you stayed in Cuba on those date(s)
  4. Train/Boat tickets in your name showing you were in Cuba for the date(s) you indicated

Oh names was suppose to be on the photos? I did not put our names on the photos and we was approved and i just received the noa2 yesterday!......Now i am a bit worried something will go wrong 

 

If you're already approved you likely won't have too many issues. The adjudicator thought your evidence was enough to approve you already. If you submitted passport photos they likely already know what you look like. smile.png

 

Just make sure you have what you need for the interview! Congrats!
