IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Line #17 Question

Maybe I am seriously overthinking this but I have a question I-130 Section C - Line #17

I am the USC, is the information that goes in this line about me or my alien spouse?

The example Form I-130 I found on this site indicates that the USC's info should go here and that is what is confusing me.

I am terrified about making a mistake at this early process.

Any advice is appreciated.

That information is about your spouse. So you would list yourself (because you are her spouse) and any children that she has.

yes, we have filled i-864 to NVC and got approved. So, I should take I-864 packet copies too

Oh, sorry, I'm not sure about that. I haven't dealt with the NVC (we're DCF).

HI, Can some one please send me the checklist of all the documents i should take for CR1 interview in London. I am not too clear about the financial side. My husband is a self employed person.
Please advice>>

Have you filled out/had a look at the I-864 yet? The instructions to the I-864 will have most of the information you're looking for. It tells you exactly what you need.

Just wait for your letter to come through, really. You could have a look at the D-230 form just to familiarize yourself.

Realistically, I'd say you could be looking at an interview in January/February if my timeline is the norm.

Fees wise it's bare minimum £210 for her medical (make sure she's got her MMR and Tetinus jabs through the NHS if possible and proof she got them) and another $400 at the time of interview.

She will also need a ACPO police certificate to get her medical that's something you could apply for now (£35).

You will be assigned a case number from the London Embassy within 3-4 weeks of your I-130 approval. They'll mail you a letter with it.

I got mine in the mail about 2 weeks after approval.

Okay, I'm getting mixed answers here. We are both living in the U.K., therefore we filed at the chicago lockbox, which was forwarded to the VSC. My understanding was waiting for a packet from them through the post to fill out and submit. Is thus not correct?

Go to the London Embassy website search for form D-230 fill out Part I (part II you do at the interview) also find form DS-2001 fill that out. Do you have your LND number yet? Once you get your LND number phone Knightsbridge doctors and set up an appointment then you send the forms D-230 Part I and form DS-2001 which is your notice of readiness to the Embassy and they will assign you an interview. DCF/Lockbox is a different thing from dealing with the NVC.

Some of you did your homework. I am a USC living in the U.K., but under six months. Therefore I had to file in Chicago instead of the local embassy. I live here as a resident, that way we could be together as soon as my army contract was over. Quick question though, if we got our NOA2 via case update through the USCIS website, when do you guys think my wife will get her interview at the consulate?

Did you send out your packet 3 yet? (or D-230 Part I and DS-2001) Did she have her medical? They will only schedule the interview after all that is in.

Question is, why do some go to Cali and others to Vermont?

If you're a USC currently living in the UK and you filed an I-130 it was either through the Chicago Lockbox or DCF. Or have you been living here for less than 6 months? I know that the Lockbox is supposed to be super fast.

Did the CO specifically tell him that you will need a different Joint Sponsor? Did they give him instructions on couriering any paperwork back to them at all? Were you at the interview? I agree with Nich-Nick, e-mail the embassy and find out exactly what the issue is. Best wishes for a speedy resolution.

If I am interpreting the intent of your question correctly, it doesn't matter how long they have lived in Spain, there is no USCIS field office in Spain. The OP's USC spouse will have to send all paperwork to the Chicago lockbox.

I know there is no USCIS field office in Spain. I was just asking.

Well, anyway, with that said from what I understand the Lockbox is pretty quick.

As the two previous posts stated, you will need to take care of your outstanding legal obligations before you think about petitioning an I-130.

IR-1 / CR-1 Spouse Visa Process & ProceduresINTERVIEW SCHEDULED!!!

Thanks guys! so I called the London embassy today (£1.23 per minute!) and they basically had no clue about my case (brill!)

Bit confused as I thought they scheduled the interview but ive obviously got it wrong?

I asked him about emailing to ask for an earlier date and he told me to email londoniv@state.gov

He told me I dont need to write anything special in the subject line, but in the depths of my memory I have a feeling I read something about needing a special code when emailing?

Does anyone know what im on about?!

Yeah, I was given an e-mail address last I called before my interview and they said just to e-mail and that I didn't need any code. I sent an e-mail to the address they gave me and it went through just fine. So just e-mail them and ask for confirmation that the e-mail was received.

IR-1 / CR-1 Spouse Visa Process & ProceduresLondon Interview tomorrow!!!

Hi everyone,

Thanks for all your good lucks! The interview went Ok, except they were apparently missing one part of the affidavit (which we defiantly sent) so I don't know if it got mislaid but we have to send it in again and then we should be all set. So it's been very busy trying to get it couriered over to me so i can courier it to them asap. So not quite the outcome we hoped but, nearly there. Just a little frustrating as we went over everything a hundred times and the agent seemed to look over it for about 10 seconds. But the additional paperwork they need will be with them on Tuesday, and she said once they have received that there should be no problems. Just need to find out what kind of timeframe we are looking at...

Hope everyone is having better luck than us!

Oh no! These things happen though. I'm sure if it will be with them by Tuesday you'll have visa in hand not long after. How was the embassy? x

IR-1 / CR-1 Spouse Visa Process & ProceduresSpouse Visa and Cosular Processeing

@Ryan H, Thank so much for all your information. I definitely feel like marriage under the VWP will be the way to go for us, even though that means another time apart after we are married. Seems to be the cheaper route with a lot less hoops to jump through (and filing fees to pay!) than the K1 visa. Do you have any idea how much the AOS and IV bills cost, just to have an idea of what to expect? Is there anything else to pay for (after the I-130 filing fee and those two bills?) when it comes to getting the green card? Just trying to get a ballpark figure that we can work toward! Again, thanks for your help!

UK Medical £210 (only if he doesn't need any immunizations such as MMR or Tetanus- I'd try to get those on the NHS if he does need them)

Basic courier fee for 1 passport £14

IR-1 / CR-1 Spouse Visa Process & ProceduresSpouse Visa and Cosular Processeing

Thank you all for your replies so far. It's definitely helpful. I see now that I will need a visa to enter the UK as a visitor to marry my boyfriend there. I thought that in order to marry a non US citizen, a Fiance Visa must be obtained through filing I-129F. Is this still true or has this changed? I know that when my boyfriend comes to visit, he comes via the VWP because he is from the UK, but I was under the impression that the VWP was for tourism/visitors only and that you could not get married if entering the country this way. Can someone please verify? If he could come to California under the VWP and we can legally marry here in the US, that would be ideal so family/friends can attend. He could still go back to the UK before his 90 days expires and we could apply for a spouse visa using Consular Processing as I previously mentioned?

Also, can someone clarify what it means to pay the bills required for the AOS and IV bill? In terms of being a sponsor for the AOS, I am a homeowner and a teacher in Los Angeles County with a gross annual salary of approximately $50,000. I assume this will be sufficient to apply as sponsor?

Thanks again for your insight and advice, everyone. It is much appreciated!

He comes to the US on a VWP and you get caught up in the moment and you just go get married-- that's ok. There was just an interesting thread not long ago about this very thing involving a UKC and adjusting status from the VWP after getting married to a USC in the US.

Immigration law is seemingly complex. I just went the long route of finacee visa (to the UK) so I can't say definitively what goes as far as that, I just know that it can be done.
