I read that article this morning, but I smell more than one rat in this kitchen. Who would want to come to the US on the promise of getting a waitressing job? It's also much more common in a forced labor situation for the employer to NOT help the worker resolve their immigration status. Once the girls get their green cards then the employer has little they can use to pressure them. The sham marriages are a strong clue to me that these girls knew exactly what they were getting into. Mobsters are usually pretty smart about the way they run their enterprises. They don't leave incriminating evidence, and they don't leave witnesses who could testify against them without incriminating themselves. If the girls were truly innocent victims with inside knowledge of the scam then that would seem like a huge loose end - not exactly the way the mob usually does business. Not to mention that girls who are forced to work as strippers usually make bad strippers.

I strongly suspect the government offered the girls immunity in return for their testimony. It would be really ironic if they offered them a shot at a T or U visa in return for their cooperation. Federal law enforcement agencies have a nasty habit of dangling these visas in front of illegal immigrants with a questionable moral background, only to renege after the prosecution has been finished.

I thought about mkat when I read this article. :whistle:

I should point out that we had never applied for a K1 in the first place. Tip of the hat to you K1ers-- you have to go through an awful lot to get that visa, which is why I always try to offer you my most sincere congratulations when you finally receive it! :)

Well, I found the love of my life in Korea. She is American, I am Irish. Neither of us ever went there to 'find a foreigner'. So, to answer, I would do it if I happened to meet someone of a different nationality to me, yes. But, I wouldn't go out of my way to 'find' someone to love who was foreign.


My thoughts exactly. If I wanted a specific 'breed' I'd get a dog.

Hi there,

I have a couple questions about the Affidavit of Support--

First off, I never realized while living and working in the UK for the past 3.5 years I was supposed to be filing tax returns, so I just completed those forms and sent them out this week. That said, I do not make enough to sponsor my husband anyway and my income is foreign earned at this point and will there for end when I move back to the US.

I plan on using my father and step-mother as Joint Sponsor and Household Member for our application as we will be living with them once we move and between them they make well in excess of 125% of the poverty guide line.

My questions are these:

1) Do I need to wait for the IRS to process my tax returns and obtain a transcript because they were late, even if there's no way I will meet the monetary requirements to sponsor my husband? Or would it suffice to just bring copies of the returns I filed along with copies of my P-60 (W-2)?

2) I realize that as the petitioner I am obligated to submit an I-864 even if I am unable to meet the requirements such as domicile, I don't meet the requirements but my dad (who has agreed to be the joint sponsor) does. My mail still goes to my parents address (ie. voter/bank stuff), my drivers licence has this address, as well as my passport. Will this be enough evidence that I plan on regaining domicile in the US? Or do I not need to prove much since the joint sponsor is domiciled in the US?


I apologize if this post doesn't seem very concise, I do hope someone can make sense of it though!

I am the petitioner and I originally used my married name (as instructed per visa call center), I have not changed my Social Security card yet and my passport is still in my maiden name. When I received my letter of approval they had addressed it to my maiden name. So I got the message-- I will just use my maiden name from here on out through the process. Bum info. from that visa call center!

After your I-130 is approved you'll receive packet 3 and schedule your medical exam then. Your spouse will need to get a UK police certificate in order to schedule the medical though.

How did the medical go? Sorry I didn't see your question about mine at the time. It was very smooth and professional. I saw two medical staff, a doctor who gave me the examination and another who took my x-ray. I had already got the immunisations I needed (MMR and TDAP) in advance on the NHS for free, so I didn't need to see the nurse. I was there maybe an hour and a half, much of which was spent in the waiting room.

My police certificate took a similar length of time. I got my interview date two weeks after my medical, so hopefully he will either have his date now or get it in the next few days.


Your timeline is encouraging. Our process is very similar to your own. I married my husband (UK citizen) in 2008 and moved to the UK. Got my permanent leave to remain here last year. We just filed our I-130 in June and we were approved in August. He's going for his medical the week after next and we're sending out the DS-2001 this week. It seems like everything went very smoothly for yourself. Do you mind my asking when questions your were asked at the interview? I'm incredibly anxious! Many thanks in advance :)

I moved to the UK and got married here 3 1/2 years ago. I have used my married name the entire time, however, I haven't changed my SS card yet. I called that visa call center and they told me to use my married name on the I-130, I did. When I got my I-130 approval in the mail it was addressed to my maiden name, so I took the hint- that's the name I should be using for official purposes.

and some countries DO need to see front loaded evidence of the marriage at the time they submit the i130 or they will get plenty RFE for it..

n btw it won't matter if your married 1 month or 20 yrs they will expect to see some kind of relationship information regarding everything i just posted... otherwise you will either get a request to submit taking more time to issue visa or a flat out denial and the case sent back. Ive never seen anyone issue just a marriage certificate and get a visa... there is a lot more info the CO expects to see.


From Instructions for form I-130:

OR Your husband or wife has lived outside of the United States, after the marriage for a period of at least 2 years.

I just mailed in my marriage cert. (been married 3 1/2 years) with my I-130 and copies of all my UK visas and both of our passport pages and we were approved.

Her husband is in the United States Air Force and from what I understand, has lived out of the US for a length of 2 years.

1) Either line is fine--normally USC & LPR is quicker, so I recommend that one
2) No--never need that again
3) No--you can wait a couple of months and call USCIS and they will return documents--usually
4) No--GC and SS# do the trick
5) She will be taken to a special area for new immigrants once she reaches the first CBP agent. She will be processed--it will take from 5 minutes to an hour depending on how busy they are. Once processed, she will get an I-551 stamp in her passport, and then she can go to pick up her luggage. And she will go through customs with the customs form she filled out on the plane, or she can fill out a new one if she misplaced it.
6) Buy plenty of flowers and smile a lot when she runs into your arms. There is ABSOLUTELY no secondary processing. Once she leaves the immigration area and enters the baggage claim, she is on US soil, and your new life starts at that very moment. It's wonderful !!!

I am in a similar situation where I am relying heavily on a co-sponsor. I am under the impression that I (since I am the petitioner and there for have to sponsor my husband) also need to show my tax returns and employment information. Even if I don't, I'd rather be safe than sorry come the interview. I imagine they will be most interested in my co-sponsor's documents and tax returns though.

It's a pretty simple process, I had to do it, but I also have Foreign Earned Income Exclusion. He might have to pay back taxes and a penalty depending, from what I've read. Have a look at the IRS website. http://irs.gov

Hi everyone,

We just got our interview date in the mail today (woohoo!). Now I am starting to torture myself and go over all our documents and forms over and over. Maybe because there's nothing to do but wait that I am starting to feel slightly neurotic!

My dad is my joint sponsor-- he's employed and makes well over 125% of the poverty guideline as required per household size. I have copies of his 1040's (all filed on time) and all w2's for the 3 most recent tax years and copies of his pay stubs.

Question is: Do you think I should have him get transcripts as well, just as a precaution? I mean I am one for following directions down to the ground and it states you don't need transcripts if returns have been filed on time and you have the W2's but, you see, paranoia is setting in...

Can anyone please put my mind at ease?

A little bit of a breather. But one thing I'm not getting thus far. You see, I'm living in the U.K. with my wife. Is this going to be an issue? Everyone else seems to be living in the U.S. and waiting for their better halfs. Stressful stuff.


My thoughts are that it would be even less of an issue that you two and living together in the UK. You have the visas in your passport to prove that you moved here to get married.

I am a USC who moved to the UK on a fiancee visa, got limited leave to remain and then permanent leave to remain. I've been here 3.5 years now. At this point we are waiting for our interview letter, fingers crossed we'll get it in the post soon!

Is that letter from the Embassy? It might be some kind of generic letter... We filed DCF so therefore never dealt with the NVC that's why I'm asking. The letter we got from the Embassy doesn't mention anything about bringing the medical results because they were forwarded by Knightsbridge. I wouldn't worry about it. So cool you finally got your date!!!

The example Form I-130 I found on this site indicates that the USC's info should go here and that is what is confusing me.

That information is about your spouse. So you would list yourself (because you are her spouse) and any children that she has.
