I just read a thread on here yesterday that kind of ties into this, it was about someone traveling back and forth between the US and Canada. Basically, what was said is that as long as your visa has been processed at POE you are ok to travel back and forth.



Can someone please confirm this.

As far as I'm aware, there should be no problem with your husband traveling to the UK and re-entering the US with his visa. If you look at the fine print on the visa I'm sure it says something about "upon endorsement serves as a temporary residence permit for 1 year".

San Diego, I've lived there, is pretty safe as such things go. I'm not sure I'd be that worried in Oakland, however Oakland can be pretty bloody rough.

The firearms thing is a very European (or maybe just non-US?) way of looking at it. The good news is that your odds of getting shot, while slightly higher in San Diego than some other random places, is still really really low. Far lower than the media may make one think. :)

Like I said, I wouldn't be even slightly concerned with that. :)


I completely understand your anxiety about guns, I think most Europeans inherently feel that way. My mother and father-in-law are petrified of the gun thing with GH moving to the US.

Social security is never free. I live in France where we're supposedly lucky with our healthcare system, and I don't complain about it. But to have that, I must witness 21% of my gross income fly away to retirement, health, unemployment organisations before it hits my bank account. Everybody pays to be insured, except for a tiny fraction of people who really can't, and they are NOT where the deficit comes from.
What I find unacceptable in a system of private healthcare companies, is that after you've paid for years, they deny your rights for any ridiculous reason they can find. I lived in another country that had a US like system and it happened to me a few times. I was very, very pissed.

As for unemployment benefits: in my country where unemployed people are supposed to be happy, they do end. And finding a job is way harder than in the US!

So I think your idea of a "welfare" society is not really accurate.


OP's not in France, he's in the UK-- where I've seen people better off being on the dole than working.

Bottom line is: if he really likes the way of life in the UK then, being totally honest, he probably won't have an easy time adjusting to life in the US.

I'm sure you can fill out the medical form you need in the waiting room and you should be fine with your LND case number.

With regards to the vaccination records, my husband had got some of them (you records are destroyed on the NHS once you turn 25 we were told) from our GP and I remember thinking they didn't look terribly 'official' but they seemed to be fine for the medical.

Did you start the course of your MMR jabs?

Ohhh, like you're just using it as a template? Well if that's the case then I would just take out that last part. If I'm kind of understanding things right whoever put that example up put in that last part to be cheeky and catch people out (maybe?). Anyway, you are clearly NOT circumventing immigration laws if you have petitioned/are petitioning for an I-130.

I just read a recent thread on POE (of course I can't find it now). But what a lot of people here were saying is that it's very easy and they don't ask you many questions due to the fact that you would have recently gone through an interview at the embassy.

However, I see you were issued your visa in June 2011 and you're just going to the US now. Kind of similar to us, we won't be returning to the US until the beginning of February. I'm not sure, but I'm thinking they might ask why we waited that time to come back to the US? Which is easily explained, but that's one of the only questions I could see a CO really having.

You need to take in consideration the household size (are all your siblings living at home along with your nieces?). You can also use those other members of the household's income in addition to your father's income to meet those requirements.

I am going to start filling the application for my suppose, I have a lot of questions.
first: do I have to fill out all the questions on the I-130? even if they do not apply to my suppose? like (C-11) it ask about previous marriages, she was never married before, so would I need to write "n/a"? or leave it in blank?
The other question I have is, we got married in the US last year, but she returned to her home country days after our marriage, where she is right now waiting for the whole process to start, she came with a tourist visa (never over stay) question (C-14) does this apply to her? (She is not here anymore)

You put "n/a" which means "Not Applicable" (which you can also put). If your wife is living in Panama you put "not applicable" for C14.

I changed CO to CBP officer in the original sentence because Consular Officers have nothing to do with US border entry procedures, that is the purview of US Customs and Border Protection (CBP).


I meant "Customs Officer" I have seen it referred to on here as "CO" as well before.

Ok, so if I (as a Canadian) can visit the US legally for 6 months in a year, could my husband move to the USA, establish domicle and I could "visit" him for 6 months, file my I-130 and then return to Canada for the remaining wait for my Visa? Could I do this if I file for the I-130 here in Canada or will they disallow a visit to the USA for such a long period based on the fact that I am applying for immigration?

I have read about Montreal being tough on proving domocile. My biggest worry, but if my husband has to move first I am prepared for it. If we can show that we have already leased an apartment, opened bank account prior to moving, I am hopeful that will be enough?


The CO could refuse you entry if they're not satisfied that you really intend on going back to Canada.

If you wait to file in May (after your anniversary) you can save yourself some hassle. If approved you will be issued an IR-1 visa which is a 10 year green card upon entry of the US. You also would qualify to file DCF and you should get the visa in about 5 months which would coincide with your moving date.

Just an aside-- you will need to get police certificates from both ROI and the UK.

Ok, I've read through this whole thread and it seems to me your BIG question is: once you file your I-130 can your husband stay in the US with you until the interview. The answer is maybe yes, maybe no. He, I believe, will need to go back to Canada before the interview anyway for his medical exam and there is a chance that upon trying to reenter the US he could be refused entry.

Also, keep in mind you will most likely need a joint sponsor for a CR-1 visa.

Are you a USC currently living in the United Kingdom married to a UKC looking to file DCF? If so, then you will probably need your parents to cosponsor your husband for his IR-1/CR-1 visa anyway as you will have to prove your intent to reestablish residency. There will be no Adjustment of Status (AOS) for him if it is IR-1/CR-1.

I also lived in Glasgow for just shy of 4 years, I filed all my foreign earnings using the Foreign Earned Income Exemption. They were mostly interested in my Dad's taxes as he was my joint sponsor. If you need anymore help message me :)

You're Point of Entry or "POE" is the very first point where you enter the United States after going through customs.

For example, my husband's Point of Entry will be Boston, MA, but we will then have a connecting flight to Buffalo, NY.

Give yourself enough time in between flights to allow for this. I agree with iwaiting, read the reviews for your POE, it might give you a better idea of how long a process it is. It's a busy time of year to fly in general.
