If he was born in Capital, no need to worry about Ministerio de Relaciones Interiores.

Just get another Police Certificate (Con excepcion a la ley 51 del codigo penal) and Birth Certificate and get them legalized.
Ministerio de Relaciones Exteriores is downtown, close to Retiro, Esmeralda 1212. Its pretty painless, check hours on line, anticipate up to 2 hours wait, they can do all your docs at once. Here is the web site.

I don't seem to understand because my husband went to EL REGISTRO CIVIL to ask for his birth certificate. It's the same location where we got married by court. that is what he submitted. I don't know if that's the same location like THE MINISTERIO DE RELACIONES INTERIORES. Does he have to take them there to get them legalizeD? because he sent it the originals .



Yes, you are right, birth certificates and marriage certificates are emmited by Registro Civil of where the person was born/marries but they ALSO need to be then legalized at Ministerio de Relaciones Exteriores, another location.

Was he born in Capital or Provincia? If he was born in provincia, before Legalizing, it needs to go through Ministerio de Relaciones Interiores. I know its confusing but these details make all the difference between a smooth ride and stupid RFEs.

If he did not get additional original/certified documents, then at this point it would be faster to get new ones and legalize them. I asked for 3 of everything just in case.

Yes, the bottom of the Police Certificate will say "emitido con excepcion al codigo penal 51". Otherwise it will not be accepted.

Did you have the Birth Certificate and Police Record legalized by the Ministerio de Relaciones Exteriores? If not that could be it. Also if the birth certificate was issued outside of Capital Federal, it must first be legalized by Ministerio de Relaciones Interiores.

Not sure what "con excepcion a la ley 51" means, dont really care, all I know is that it is required and needs to be requested specifically as so when the beneficiary goes to Registro de Antecedentes Penales. They knew exactly what we needed.
Many people have been delayed because of this and not legalizing docs.

We did both and had no problems and a quick NVC case closed.

Ok I did get the paperwork in the mail but hadn't realized the D 3032 was included! Like I said my husband filled it out tonight. So tomm I will send it first thing. After I send it, will they send me paperwork for the IV Bill? Or can I print out the application and start filling it out? Also, do I send the police certificates along with the IV Bill? What should I include with the IV Bill and the cost? Sorry for the questions..thanks again!



The DS 3032 will take about a week to process, then you can pay the IV fee online.
You should get an email once the agent has been assigned, but I would just use your NVC# and Invoice# and keep checking online to see if the payement has been generated. IV fee just changed its $200 something (was $400 something).
Not necessary to wait for anything by mail. Just print I-864 and DS 230 forms online, gather documents and get your AOS and IV packets ready.

YES you will need the police certificate to send with IV packet. NOT BILL, BILL YOU PAY BEFOREHAND ONLINE, print the bar coded cover sheet that will go on top of the packet.

WOW now thats different. I never heard of the AOS bill generated without the DS-3032 being sent in. So you went from cae# and your case online was already waiting and you paid. WOW.

The DS-3032 is the agent assignment. This is where all correspondence goes to that the Beneficiary assigns. The email must come from the beneficiary's mailbox.

Since you paid the AOS you should be getting the package online or should have already got all you need (petitioner's income info all that) Read the guides on that.

The IV Bill is the Visa Petition. Beneficiary needs to get Police report from every wheer they have lived since age 16 for 6 months, Birth certificate, biographical pages of passport, 2 passport pics, DS-230 form Part i signed only.

Please read the guides though. Congrats seems you guys got to jump over a step.


Actually you CAN pay the AOS before sending the DS 3032,it is automatically generated when you get a NVC case number, then ofcourse you need the Invoice Number to log in :D You just cant pay the IV until the agent has been chosen.

Here is the DS 3032 Choice of Agent template. Have the beneficiary plug in the correct info, triple check it and send it in the email body, not an attachment.

Once the agent is chosen the IV (Immigrant Visa Application) fee is produced. It will show PAID in just 1-2 days.
Make sure to print both AOS and IV bar coded cover sheets.

If you are planning to get married and have no doubts about the relationship, I absolutely recommend the CR-1 route. The K-1 is really for people who are unsure and want some time to live with their S.O. in the US before committing to marriage. If you're not someone who needs a test period (and there's no shame if you are!) then the CR-1 allows you much, much more freedom and flexibility, costs less in the long run, AND preps you for citizenship sooner. Considering that the timelines are roughly equivalent now (6 mo vs. 8 mo, give or take) you're much better off going the CR-1 route.


I agree :thumbs: And your time frame sounds good even your case doesnt get expedited. We decided to go the NR1/CR1 route because we were not in a rush, 100% sure about marriage and moving to the US together and the flexability is key. With CR1/NR1 you enter the US as a permament resident, you can travel, you get your GC in about a month and are ready to work which was important to us. With the K1, your looking at up to several months without the possibilty to work.

You can most certainly file while living abroad. That it was I am doing from Argentina (We married here as well). Considering all the costs involed in this process a few extra bucks for international postage is not a big deal. DCF (Direct Consular Filing) is much quicker and available for many countries but it varies and in many cases, such as Argentina, DCF requires that the petitioner be a permanent resident of that country, which I am not, never was.
So check with the US embassy where you and yoru fiance are living.

If you file while abroad, but not DCF, you need to maintain/be able to prove your permament domicile is in the US. You need a US address for paperwork. In my case I used my US address for all forms and on the 1-130 I also listed my current, albeit, temporary address in Argentina where it asks for the last address lived togetehr with your spouse.

Short answer, YES you can!! Good luck!!

Could be a simple English mistake. It is important to clarify but let´s keep in mind that many VJ users are not fluent English speakers.

I am a July 9th filler, and just got my NOA2 last week....don't panic, when I got my NOA2 there where lots of fillers after our date that got approved before us but keep in mind that each adjudicator has his amount of cases to process and not all of them at USCIS finish one month at the same time....(does it make sense?)

there kind of funny at nvc we were approved 2/7/13 and i called every day after a week past., but every time i called they said they have'nt received it. finally one person there told me to email a scan copy of my noa2. once i did that, the very next day when i called they ask me a few details about me and my fiance like name date of birth and email address, and told me they just received it and gave me our case number. u can try this if you like. just go to nvcresearch@state.gov and email a scan copy of your noa2. then call the next day, it just might pop up like mines did. like i said there kind of funny that way. good luck, and may God bless you

That's good to know! I think package 3 is different for each embassy and I am not able to schedule an appointment in advance...but still, my embassy fowarded me package3 even thoug they haven't received my case yet, so we have everything ready!

Call the at 603-334-0700 and be prepared to give them the receipt # from your approval letter (NOA2) if they have it they will ask you your name and birth date and his name and birth date. Then if you ask they will give you a reference # that you will need for future contact with the embassy. They will mail you a hard copy as well. Today the lady said within the next 2 weeks they would forward it to the embassy then the embassy will contact beneficiary. It's good to have the # just to keep track of your paperwork. OMG!!!!!!!! Why my husband decides to admit during the medical to smoking weed 4 years ago is a mystery to me.. I coached him forever and urged him not to ever tell that but he did... After all this waiting he does a dumb thing like that... So will we be denied help!!!!!!!!!!!!!!!!!!!!!!!!!!!!! I am so devastated a mind is a terrible thing to waste... Why does he not use his mind...that's only common sense.. so depressed now


I just had my medical this week, and because I am so curious I asked my doctor what do they test exactly....he told me that since Obama administration, they just care about tuberculosis and blood test for syphilis...not even drug tests, or HIV. I don't think the doctor will make a point on that, but that is my personal conclusion since what they only care now is about those two things (tuberculosis and syphilis).

Don't be too hard on him, this process is so hard and sometimes anxiouness take control on us!

There is no reason to be hopeful....you will get the visa if all in both backgrounds is normal and you have a legit relationship and the evidence to prove it to a total, but trained stranger, the Embassy CO.


It should....but the same thing happened with my work visas, also had all the documentation from employers, etc and where everything was supposed to go smothly and I lost time, money and had a horrible time.

Hi everyone!!! It is my first post, but I've been following VJ for months and we love it!

I just got my NOA2 this week after almost 7 months, and of course we are very happy. The thing is, I have 2 H1B (business visa) for real employers that wanted to hire me while I was in the US (in 2010) that were denied, and a tourist visa cancelled. I don't have a ban because I haven't overstayed, but it may look like I want to get married just to inmigrate.

What really happened whas that in the process of waiting for my work visas (lawyer specifically told me that I could wait inside the US), I met my fiance. Of course we were sad when I had my visa denied and had to live... but we kept in touch, he came last year to visit me and he propose!!! Then we traveled again later the same year just because we missed each other.

So what I wonder is if we got our NOA2 does it mean that they have checked my background already or I can still have problems at the interview? I have tons of proof, pictures, affidavit, etc etc...

Everyone must have vaccinations. At least 4 of them are required before you POE. you may only need 1 dose based on your age. As long as your get 1st dose you are fine.

Because I have to send a checklist to the embassy with a sworn statement saying that I have all the documents ready in order to get an appointment date, so I don't want to go there and then having troubles for supposily not having everything....

Hi to everyone! According for what I've read in some forums here, vaccines are not a requirement for K1 visa applicants (just for AOS after entering the U.S.)...but when I called one of the authorized doctors here in Argentina, she told me that I need 4 vaccines. One of them is "chicken pot", which I already had, but no vaccine....
The thing is that for this one in particular, there are 2 dosis for adults and with 4 weeks of "waiting" between the first one and the second.

The only thing missing is my medical examen, wich will be on Tuesday(and then interview scheduling time!!!)...could the doctor be wrong about it? Or it depends on each consulate? I don't want to wait a whole month just because of one shot of a vaccine for something that I already had.

Thank you for saying that. I felt the same way when I read the posts. He did congratulate them, but after waiting over 5 and 6 months it is very frustrating, never knowing when something is finally going to happen. But receiving our NOA2 was the best part of the whole process so far!

You really need to keep track of every time you speak to her, and if I was you, I would plan a few more trips to go see her. I lived in China for 8 months and I had 10-months of SKYPE video chat after I returned to the U.S. and we still ended -up with a 221G at the interview. Granted they asked for 3-items but surprisingly, they requested more correspondence evidence. Also, just a heads-up SKYPE video chat is way better then, instant messages, you get to see each other and interact, plus it's free. And, SKYPE keeps a chat history for you, so when your ready you can just print it out... I found it to be way better than just see letters.

That is exactly what we did last June 2009, they cashed our check right away and sent our NOA1. We didnt hear anything until four months later when we were denied. We didnt get an RFE or any chance to make things right. Hopefully it wont work out like that for you guys.

I want to give some hope to them who received their NOA1 on 24 th of june and last touch was en 10th of july!! YESTERDAY WE RECIEVE OUR APROVAL NOTICE NOA2!! We havent seen any touchs or modification online only the notice in the mail! maybe as soome of you indicated the system is not working.

Well now we start with the second part of the procees gathering documents, certificates, etc. We think the things are going to be faster from now onwards.

We are thrilled and panicked to announce that we have just received the e-mail notification saying that our I129-F petition has been APPROVED! HOW DID THIS HAPPEN?? We received the NOA1 exactly four months ago (December 10th). We were expecting it to take at least 8 months or more considering all of the information you guys have been posting and with the USCIS national average processing time creeping upwards. I am deeply sorry for all of you who are still waiting the NOA2 and filed before us. We don't know how this happened. It is completely unfair. However, we are very nervous about the interview and need your help. First of all, our case status went from "initial review" to "post decision activity." What happened to the "decision" stage? Is this normal? Will the next packet of information be sent to my house in the US or will it be sent here to Buenos Aires? Also, I have read in some posts that the beneficiary was asked during the interview what their fiancé (me) does (I assume this refers to job/where they live). I have been living in Argentina for the past 10 months and have way over-stayed my visa. Will this raise red flags in the embassy's eyes? I only did it so I could be with my fiancé but now I'm worried this will affect their decision to give us the visa! Any ideas?? Assuming we didn't get approved without having to do the interview, how can we start preparing? I found the information on VJ about the interview to be unclear.
