We are thrilled and panicked to announce that we have just received the e-mail notification saying that our I129-F petition has been APPROVED! HOW DID THIS HAPPEN?? We received the NOA1 exactly four months ago (December 10th). We were expecting it to take at least 8 months or more considering all of the information you guys have been posting and with the USCIS national average processing time creeping upwards. I am deeply sorry for all of you who are still waiting the NOA2 and filed before us. We don't know how this happened. It is completely unfair. However, we are very nervous about the interview and need your help. First of all, our case status went from "initial review" to "post decision activity." What happened to the "decision" stage? Is this normal? Will the next packet of information be sent to my house in the US or will it be sent here to Buenos Aires? Also, I have read in some posts that the beneficiary was asked during the interview what their fiancé (me) does (I assume this refers to job/where they live). I have been living in Argentina for the past 10 months and have way over-stayed my visa. Will this raise red flags in the embassy's eyes? I only did it so I could be with my fiancé but now I'm worried this will affect their decision to give us the visa! Any ideas?? Assuming we didn't get approved without having to do the interview, how can we start preparing? I found the information on VJ about the interview to be unclear.

Bummer!!! Im ready to send my I-130 packet on monday. Tomarrow Im getting the Translated Marriage Certificate and its done. Wondering if I should I wait until after the shutdown??? Thoughts?? So frustrating and I havent even officially filed yet!

As a general guideline, she should get the police record when you recieve NOA2, upon approval of I-130.

NVC deals with general procedures for all cases and are not familiar with each and every country's specific guidelines. It would be impossible!!!:) For country specific information refer to the Consulate page. This is where they specify about the police certificate. (I dont know where she got 5 days from?? Its always 3,6,12 months depending on where) Have your wife get 2 copies, legalize both. One gets sent to NVC, then they forward all documents to embassy where the interview takes place. Technically the embassy will recieve all original/certified documents but just in case always get 2 copies.

Once your through NVC you will recieve the interview letter, checklist and specific requirements for Buenos Aires.

In Argetnina, the police record is valid for 6 months.
VERY IMPORTANT ALL CERTIFICADOS DE ANTECEDENTES PENALES (POLICE RECORD) MUST BE REQUESTED "CON LA EXCEPCION LA LEY 51 DEL CODIGO PENAL" OR IT WILL NOT BE ACCEPTED BY NVC.
I have read accounts of people being delayed for this reason.
The certificate also has to be legalized by the Ministerio de Relaciones Exteriores

I recommend the email format provided by Deeee. It worked like a charm for us and processes in about a week. Make sure and follow the format exactly, plugging in the correct information. The email should be sent from Beneficiarys email, in the body NOT as an attachment.

Ummm. Well, I can certainly imagine that I will be interested in different threads after I am done with this stage. So, you will probably hear little from on threads about this particular type of subjects. Look for me on Embassy topics and later I will be found on the AOS forum.

I don't know that I have seen anyone "belittle" your case. They simply have pointed out that you are making statements about how they should feel when they are waiting far longer than you had to. I see them more as pleas for a little empathy and understanding. Being only 120 days in myself, I can only imagine what July, August and September folks are feeling. My heart goes out to them. I have urged many to join me in applying whatever pressure we can to try and fix a broken system. Maybe its Quixotic, but if everyone maintains this type of attitude and pressure instead of displaying utter complacency, maybe things will change.

You talk about not being done with USCIS. Okay, fine. AOS will be a walk in the park. Why? Because I will be with my family. Maybe we will get a little frothy in the mouth if AP and EAD take much longer than is expected, but the AOS is just paperwork. The longer that takes, the more layers of proof of our genuine relationship we'll have. It will cause the gates for the other visa hurdles to stretch out a bit, but okay... we'll be together. We'll be living our lives. Much much different. Again, I think (and forgive me if I am mistaken) this shows a lack of empathy on your part. Of course, as I say it, my own words haunt me... maybe it is lack of empathy on my part... I constantly say everybody's case is different, and I suppose the same could be said for AOS... I admit that I don't personally see it, but I will reflect on this. Sorry if my hypocrisy has offended anyone. I will atone after a period of reflection on this aspect of the process.

Okay, back to USCIS-bashing :)

First of all, good luck and don't get nervous!!! I am just telling you about my personal experience, ok?

 

- I just had pictures from two visits (we have been together for 3 years, but not even one single pictures with families or friends at the time of interview)

- They didn't ask me things about him (they save that for the green card interview you will have together here after you get married), they just asked how we met

- I saw my husband (at the time fiancee) 7 months before the interview. The fiancee visa requirement is that you must have to meet each other in person at least one time int he past 2 years

- I didn't fill the DS-230 part II. I believe (not sure) that part is for another visa

- Some people that were having their interviews the same day as mine, had so many pictures and big albums, that the consular officers told them to keep the album and just give them a couple, specially because the whole album won't fit through the window that you'll have between you and the CO

I don't know how is in Brazil...but I am form Brazil, and I lived in Argentina for 7 years, including during my visa process. The Embassy in Buenos Aires did'nt ask me for any proof of residence in Argentina during the interview (actually they didn't ask me before neither), I just took my brazilian passport where the visa was stamped.

You will have to go back and have another "certificado de antecedentes penales" done, when you go mention that it has to be done with the article 51. You will have to pay again but it doesnt cost extra for the article 51 part.

Hello!
We received our NOA2 and we also have our case number now because I called the NVC but we have not received notice from the Embassy or the packet 3, so my question is, can we have the medical exam done before receiving the packet 3? Or is there something in the packet we have to take to the exam? Our consulate is Buenos Aires, Argentina and before they give you the interview date you have to send a photocopy of everything requested in the packet, even a photocopy of the medical exam envelope. Im hoping that we can do the medical exam now because Im hoping it will speed things up. Also, is there anything we need to take to the exam?

Hi Ashley,
I see on your timeline that you took the packet 3 to the embassy the day after you received the packet? I know you said we would receive a list of doctors for the medical exam therefore we would have to wait to do the medical but I did see a list of the doctors for the medical exams in Buenos Aires. Is there something from the packet we have to take to the medical exam? Do you think it would be too much of a risk for us to do the exam before we receive the packet? Also, do you know the immunizations required?
I called NVC today and our case has already been forwarded to the Embassy so we are excited that we are seeing movement after waiting for so long! But we also want to have EVERYTHING ready the moment we receive the packet so we can keep this progress moving along as fast as possible. And, I plan to take the copies of everything to the Embassy myself like you had suggested just to save a few days or so.
One thing I was not completely clear on was, does the embassy give you an interview date or do they give you a choice at all?
I just wanted to thank you for your first post on this topic because you gave such wonderful and clear instructions to what we will be going through next! Your post has helped me understand everything much better!! So thank you!

Thank you so much for the info. We just received our NOA2 after waiting a painful 6 months. I have a few questions for you since you have already been through the process. Can we do the medical exam before receiving the packet 3 or is there something in the packet that we need to take to the medical exam? Could you tell us all the fees you paid after your NOA2, everything you can think of that you had to pay for pertaining to the visa(before starting the AOS process). Also, one other thing I was not clear about, after sending all the requiered photocopies for the packet 3, will the consulate give you an interview date, or do we call and set up an interview date?
Thanks for any help you can give us! Im sure I will have more questions in the future.

My fiances k-1 visa interview is in less than a week, and he is getting extremely nervous that they are not going to treat him fairly and that they could deny him for any little reason just because they are having a bad day or whatever. He is worried that they are going to treat him differently because they are from the US and he is from South America.

My opinion is completely different because we sent in a ton of proof of our relationship, we havent gotten any RFE's, I will be with him at the interview, and I assume I can sit right in during the interview which would mean they would not be able to just randomly treat him unfairly. But if anyone can give us any advice or words of encouragement or anyone who did feel that they were treated unfairly during thier interview, I would really appreciate it so I can show him and calm his nerves! THANK YOU!

I would email them again, they usually got back to me within a few days to a week. We got our interview date 5 days after we hand delivered our packet. But, I have also heard of cases where they didnt hear from the embassy for a few weeks and when they finally heard their interview date was only a few days later. So, if I were you I would start getting everything ready for your interview now.
