yes, send everything they're asking for. I was surprised too to see they were asking for the rest of the docs too so I emailed them and I was told to send all those....So I did

K-1 Fiance(e) Visa Process & ProceduresHave the visa, what's next?
Does the state you will reside in ask for SSN to get married? They didn't ask for SSN in NE, so we got married first. It took me a lot of time and effort to convince the officers that just because I got maried my visa did not change into K3 and that I was still eligible for SSN(those guys really need some training!) Anyway, I think getting SSN before marriage might be less stressful...but either way, it should be just fine!

K-1 Fiance(e) Visa Process & ProceduresEngagement Ring at U.S. Embassy Interview

My wife did not have an engagement ring at the interview and it was never mentioned. She's trying to convince me that a 2 ct. one is necessary for Removal of Conditions.

oh, that can't be so. I am sure she will only need a simple wedding band, 'cause it's true that all married people wear bands.

As for the engagement ring at the interview, I wore mine, but the CO didn't even notice, while another Romanian girl wrote in her review that the ring was looked at during her interview. It is not a requirement...so, don't worry; you guys will be approved without a ring on the finger

IR-1 / CR-1 Spouse Visa Process & ProceduresUSCIS response vs. VisaJourney statements

Hey, I just thought about this. What if we sent a petition to USCIS with like an overwhelming number of names for cases not approved or in the process? Send that to Congress or Senators. I bet yall there would be a trillion petitioners all over the US.

Sign me up for this! I am more than willing to petition them. I know I've got no reason to ###### and moan because I've been waiting far less than more of you here, but this whole distance thing is already starting to affect my marriage and I'll be damned if USCIS ruins my marriage.

IR-1 / CR-1 Spouse Visa Process & ProceduresWho is waiting for CR1 longer then 1 year???

Oh,it is a pitty that they are so slow,i am just curious weather they have enough people to make this background checks, because seems that 1)that don't have enough people that do this job or
2)they don't care that couples are waiting.

In both of this cases i guess they should have hire more people and especially those who is waiting for CR! don't make to wait longer then those who is making only a K1

It will be a year waiting for the noa2 aug 15. Not much you can do. They say they are doing background checks

waiting for four years only

4 years?? Oh my God.. I am really starting to get infuriated at how long they take.

the A-number would be from you (which you dont have). You shouldnt have a case number yet unless you have already submitted the I-130.

The US citizen's blocks should be blank for those......that is what i did. I did this before when i applied for a K-1 about 8 years ago.

If the US Citizen ever had an A number, they would provide it where asked. If forgotten, write Unknown.

hmmmmmmmmm to be or not to be showed on the G 325?

Yes, the US Citizen files a G325a for themselves. See bold above.

IR-1 / CR-1 Spouse Visa Process & ProceduresRegarding G 325 Form
Hi all

My wife is a USC and she submitting Form G 325...My questions are:

In the box "File Number" and also in the "Alien Registration Number" (at the end of the form) should she mention her A-number resulted from her green card until she become a USC?

Or if she already has the US citizenship doesn't have to file out that boxes ..(or put NONE)??

She has to submit 4 copies of new available G 325 form and send them with the hole package? Where on the USCIS's site can I see that request, cuz I'm confused?

Thanks in advance and any suggestions will be greatly appreciated !!!

Hy all

If my wife is submitting the form I-864 (affidavit of support), she has to notarize that? What about the affidavit from a householder (I-864A)?

Regarding I-864A at question 11 (Federal income tax information)

It's ok if the householder attach the photocopy of her Federal tax FOR ONLY THE MOST RECENT TAX YEAR? cuz she doesn't have the rest of the period (the second and third most recent tax year). Can that be an issue? Can my wife take an RFE if she cannot show the second & third recent tax year?

Any information will be greatly appreciated!!

Right. Other and then specify I-130 for BOTH.

We did status as PR for both. Which was silly. But obviously it's not an issue since the I-485 didn't go along with it. The G-325A was clearly accompanied with a I-130. It's not that hard for them to understand.

Ohhh ok Sachinky...I got it...I will check Other and then specify I 130 Petition for both...

Other. And then specify: I-130 petition. This is according to the sample form on the website.

We made the silly mistake of checking Status as PR as it seems to be the most logical choice, so we called up USCIS and ensured that they understood we were pursuing a CR1.

Hi all..

Ok Sachinky, so let me tell u what I understand from this topic (correct me please if I'm wrong )

When the petitioner (the US citizen) submit the G-325A Form for himself he has to check: Other, and then Specify: I130 Petition - I wrote it exactly how it fits in the space available in the petition if it's filled out on the computer.

When the beneficiary (the spouse of US citizen) submit the G-325A Form for himself he has to check: Status as Permanent Resident

Thanks all in this matter!

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion regarding POE
I've got my visa in passport (CR-1 VISA)

I wondering if my entry in US can be denied, even though I have an immigrant visa issued by US Embassy in Bucharest?

I ask this because I had an overstay on a previous tourist visa. (I reported this fact to the consular officer at my interview and they didn't seem to have a problem with it, since my overstay was less than 18o days)

Is there any possibility to be denied entry at any POE in the US?

Thank you for your time!!!

You are very welcome! Best of luck to him at the interview! You don't have to wait for the interview date. Write the letter and date it (I don't know, it can be dated August 1, 2010 or something like that) and send it to him with the I-134 (don't forget to send some pay stubs and letter from your employer  ). It's important that the new letter of intent is dated AFTER you got the NOA 2 (that's why it is good if you if you fill in your timeline)... I am sure it will be just fine!

hi everyone,i have a question,do i have to send a letter of intent for myself or just my fiance?when i file the i129 i send a letter of intent,so do i need to send another one to the embassy?thank's

When you file the I-129F you have to write a letter of intent, stating that you are willing and legally able to marry your loved one within 90 days upon arrival; your fiance has to write a letter. So, the file needs to have 2 letters of intent! When the file is approved and it gets to the embassy, the US petitioner will write a NEW letter of intent, dated closer to the date of interview... Good luck!

US Embassy and Consulate Discussionpolice clearance from Israel
hello everyone!

We have just received our NOA2 and are working on the papers I need to take with me at the interview. I was checking the DS-230 and at no. 30 I am asked to write all the places I have lived in for at least 6 months...Does that mean I have to get a police clearance from Israel where I lived for 7 months in 2009? I tried to find any past posts that would answer to my question, but couldn't find any  . I thought I need a police certificate from places I lived in for at least 1 year, not 6 months...and I don't know what to do now.

I would really appreciate your help with this... :help:

Hello Aleksa & Nico,

Thanks for the reply.
I am sorry I gave the wrong application no. The correct one I129F. My case status says:

On July 26, 2010, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). I did not get a interview. This update is a post decision update. So I don't think I will have an interview as they have already approved this petition.
How will the US consulate contact me? Or do I approach them? How can we know if they have received my visa?
All the documents you listed above have alreday been submitted to them, except for the medical exam. The packet 3 and 4!! is that post approval procedure?

NVC will forward your file to the Consulate that your fiance stated in the I-129F. Once the file gets there, the Consulate will send you packet 3, containing instructions and forms that need to be filled out. That's how they contact you. You can contact the Consulate if you want to, call them and check if your file got there, but you have to wait the packet 3 from them.

Following their instructions, you will send back what they ask you to and either wait for packet 4 OR you call the Consulate for an interview appointment (procedures are not the same with all Consulates). You WILL have an interview! In the meantime you need to get your medical, police report etc. You will bring these with you at the interview! You will also bring the I-134 form, affidavit of support filled out by the US petitioner and supporting evidence for it. It doesn't matter if you guys sent that form already at USCIS with the I-129F. You have to have one with you at the interview!

Bring everything I mentioned at no.3 in my previous post with you at the interview! It doesn't matter what they have already. Take with you all proof you can get. Your I-129F was approved, but it is not a visa. You still need to convince the consular officers of your bonafide AND ONGOING relationship...

Please go to VJ guides, K1 flowchart for more info. It's all in there and it will help you a lot!

Best of luck

US Embassy and Consulate DiscussionI-134 approved and waiting for K-1 Visa

Hello VJ and all,

I just checked my case status online and learnt that my I-134 has been approved without an interview. It says its at post decision level and the application has been approved and sent to National Center. My fiance (US citizen) filed for me in Feb 2010. It was a long wait!
I am confused about the following, and would appreciate if you could help me with these questions, Thanks in advance.

1. How long does it take for me to receive the K-1 visa and when can I fly into the US from the date it says as I-134 approved (online case status)?

2. I am a UK citizen but of Indian origin. I am currently visiting India and plan to be here for another 2 months. Do I have to go in person to the US consulate at UK to receive my K-1 and then fly to US from there? Or I can visit US consulate at New Delhi, India and fly to US from India after receiving the K-1 Visa from New Delhi?

3. What all do I need to show at the consulate?

4. The USCIS website says they will contact me when I can go to the US consulate of the foreign country. How do they contact me? I mean by what means do they communicate? By postal letter, phone number?

Thanks, would appreciate if you can provide me information on these concerns.

Regards
PC

Hi,
I am a bit confused here; are you saying your fiance also filed the I-134 form with the I-129F? Are you sure this is true? In any case, he will need to send you another I-134 form and you'll have to take it with you at the interview. You said your case was approved (it was the I-129F that was approved!) with no interview...There is NO interview at this stage; the only interview you will have is at the US consulate. Now, regarding your questions:

1) Your file is sent to NVC, where they do a check-up on your fiance (the petitioner); that usually takes about 1 week (more or less). Afterwards, NVC will send your file to the US Consulate and that's when you will receive packet 3 with the forms you need to fill out and some more instructions. You send back what they ask you to and you either wait for packet 4 or you call the Consulate to set a date for your interview (and this also answers your question 4)...

2) on the I-129 F that your fiance filled out there was a question regarding the Consulate you would like to have the interview at. What did your fiance write? That's the consulate where you need to go.

3) your fiance will have to send you I-134 with evidence of support (letter from employer, pay stubs, assets etc.), original papers (divorce decrees, birth certificate)and a renewed letter of intent. Then, you gather proofs of ongoing relationship (passport stamps, boarding passes, photos, emails, chat logs...anything that links you two together, fill out the needed forms, get your medical exam done when packet 3 arrives and get a police clearance from every place you lived in for more than 1 year.

Good luck and check the guides on VJ here for more info!

It looks like everything is OK  . Your salary seems enough, but if you have a retirement account, you can attach a letter stating the sum etc. I think you are fine though!

In the example forms on this site I noticed that you can leave all the other spaces blank (deposits etc). It would be great to know if others have other opinions or have done differently...

US Embassy and Consulate DiscussionSome Questions about Packet 3 and onward!

Okay so I have been looking at some timelines and most people have quite some time between getting Packet 3 and sending it back. Do you have to wait to do your medical before you send it back? And another question, can you set up an appointment if you know what hospitals you can go to ahead of time before you get the Packet 3?

Also is the contents of Packet 3 the same for every consulate or do they differ? And if they don't can anyone tell me for sure what comes in Packet 3, mostly what forms can be filled out now and not have to wait for it to actually arrive? If it helps my fiance is going to the Dublin consulate if P3 is different for each one!

We really want to be as ahead on things as we can so seeing anyway we can cut out time! Thanks so much for any answers. Really appreciate it:)

Looking up at instructions and forms...

DS-156 has an space where it's said that the beneficiary understood all questions in the form and all of them are true...then it's said signature and date

DS-157 doesn't even have a gap saying signature

DS-156K i understand reading the instructions that mustn't be signed.

The question is... the 3 forms shouldn't be signed? in case some of them have to be signed...which one?

Thank you all!!!

I signed all my forms except for DS-156K and DS-230 part 2 (the only forms that they say they have to be signed and dated in front of the Consular Officer)...

US Embassy and Consulate DiscussionTermination of Prior Marriages

Hello

My fiance' and I are looking for advise and understanding for the following statement on the U.S. Embassy of London website.

My fiance' is from Eastbourne, UK. and we are currently trying to get all the documentation that is needed for his interview packet.

On the website for the U.S. Embassy in London under Instruction for Immigrant Visa(K)Applicants applying for a visa in London.

Step Two: There is a link that states "Assemble all the documents required in support of your application".

We are confused with the Termination of Prior Marriage statement below.

Termination of Prior Marriages: Married applicants must obtain an original marriage certificate, or a certified copy, bearing the appropriate seal or stamp of the issuing authority.

Do we need the original Marriage certificate from a 1979 marriage that took place in Finland? My fiance' has been divorced since 1996. He has check with his Ex-wife and she doesn't have it. They have both tried to contact Finland to obtain documention but they have been unsuccessful.

Any advise on if the original Finnish Marriage Certificate is needed would be greatly appreciated and also if it is whom do we contact to apply for a certified copy?

thanks in advance for any help you can give.

Debbie

At the Consulate in Bucharest they only asked for certified copies of my fiance's divorce decrees...

US Embassy and Consulate DiscussionNeed interview help...
She will need:
I-134 --affidavit of support

supporting papers for the affidavit: 1)letter from your employer, stating the job, the date you were hired, salary etc, 2)the latest pay stubs; 3) tax returns (I heard 2 tax returns would be enough); 4)if you can show some assets (bank accounts, IRA etc) even better...

renewed letter of intent (dated closer to the possible interview...and signed, of course)

a copy of the file you sent to USCIS (all the forms, your birth ceritificate, everything)

make sure you save the boarding passes from when you come to Romania, but I would not recommend that you guys show photos from your informal wedding to the CO at the interview. It will take a hell a lot of time and effort to convince them it was informal.

Mult noroc! Best of luck!
