Well, basically, me and my fiance have been together over a year...we met in person in the UK (I'm american but I'm legally allowed to be here). We live together and have for the past 6 months, but now I want nothing more then to go home to California. He'd also like to live there having visited in Dec with me for 2 weeks right before we moved in with each other. My question is...if I want to apply for a fiance visa so I can get married at home, how do I go about doing so?? Am I allowed to apply for the K1 without being in the US..and if so...what happens when I need to show that I can support my fiance?? Im just a bit confused because it seems that everyone is seperated while applying...and seeing as it takes so long ...we wanted to make sure that being seperated for however long it was...isnt the case..help!?

Congrats to all who are moving forward.

Still no NOA2. We filed over four months ago. No Request for Evidence either. Very frustrated and distraught.. our plans for the Fall are falling apart.

Since we want to move together this Fall. Does anyone know if it is possible to apply for a different Visa or to cancel the K1 Visa and apply for something else (like an au pair visa) so we can live together. I am very aware that it is illegal for us to marry on a non k1 visa..

Consider all the options first before thinking of stopping the k1 process. Call USCIS; if you don't get an answer, write to your Congressperson! USCIS officers have to answer to a Congressperson's inquiry in 48 hours...There have been so many cases that got approved just days after the Congressperson intervened. So here's our situation:

My fiance is American. He is 45 years. He divorced 3 times before. His first and 2nd marriage were 6 years last. And have 5 kids from both of them. While the 3rd one is only 1 year since his ex was abusive physically. No kid from her. We knew and talked each other after he separated from her for 6 months. The divorce decree just came out last week. He doesnt need to wait to remarry again for certain time since the Maryland law doesnt requires it. Then he file the K1 for me.

So guy, do u think we will get red flag?.


Unless he brought his former wives in the US through K1 visa...I don't see why several marriages (even 3) would be a red flag...

I am curious as to what the best procedure for obtaining international police reports would be? My woman lived in Amsterdam for a year so how do we get the police report from there for the K-1 process?

I assume the best thing to do is call and ask for someone who may speak Russian or English in the records department?

Any insight is appreciated.

I am new...I am sure that you can tell. Lol. I am American, and my fiance is English. I live in Tampa, FL. We have just started the process of getting all of our ducks in a row to file the I-129F, and I realized that I don't even know where exactly I should be sending it! I am sure this is a no-brainer for the weathered pros. But I am new to this game, so go easy on me. :blush:
Also, anyone else with an English fiance on these forums? If so, can you tell me a brief summary of your experience, the good, the bad, the ups and downs?
I know that each case is different. I can state with pride that neither of us should have any hang-ups during this process. We are both free to marry, I make well over the income needed, and neither of us have a criminal background.

Now that THAT is out of the way...you guys can hit me with your experiences. I love hearing other's stories. It helps me to better understand this entire process just a little bit more.

Indeed, your case doesn't sound complicated at all... You'll have to file to the USCIS center in Vermont, but just as the previous VJ fellow advised, read the guides carefully and check the portal (UK embassy reviews etc). Everything you ever wanted to know is there already. Best of luck! :thumbs:

Does the Nebraska service center process I-129 forms? or should I send it to the Dallas Lockbox? On the processing times for the Nebraska service center it just had a date from a few years ago, leading me to believe they no longer process these forms...


The Nebraska Service no longer process these forms. My fiance lives in Nebraska and he sent our file to the California Service Center; we got approved in 66 days. Good luck! :thumbs:

My fiance and I applied last May. I (the beneficiary) filled the G-325a in ALL CAPS, while my fiance didn't. We had no problem whatsoever. ;)

what is the average length of time the second notice of action is sent from the first notice of action?

There are still March and April filers that haven't gotten their NOA2 yet. I know this waiting time is terrible, but hang in there... The previous posters were right in that you cannot call USCIS anytime soon, but if you don't get your approval by October, i would call the congressman to make an inquiry on the case. Best of luck! I would only add that the I-134 and the new letter of intent need to be signed in blue ink (so, no scanned or faxed copies). Also if either of you was married before, you should have the certified copies of the divorce decrees! I, the beneficiary, also needed Police Clearance from places I lived in for more than 1 year. Maybe it's the same in the Philippines... Congrats again! :dance:

I sent only the forms and brought everything else with me at the interview. The DS 156K is the form stating that you will marry the finace(e) that you name there...so the only "supporting evidence" for it should probably be a new letter of intent. I guess it won't hurt if you send copies of whatever supporting evidence you can think of, but even if you do...make sure you have everything with you when you have the interview. Her numbers of year 2009 on 1040 is $19076(after income) and on 1099 it is total gross $25837($19455 salary + $6382 other income), as she worked few months in 2009.But this year she will make good enough.

For some reason, I cannot find the poverty guidelines for 2010. Hoping that they are not all that different from the previous year, the requirements in 2009 for a household of 2 are of $18,213, as it shows in this link

Look, you need the GROSS income (not adjusted, not anything...GROSS income); for that, at the interview you guys will have to bring tax returns (for the past 2-3 years), letter from the employer stating how much the USC earns annually (gross income), paystubs that show both the gross and net income. That's what we had at our interview and it worked perfectly. You can bring both 1099 and 1040A forms at the interview, but the consular officers will look at your GROSS income, BEFORE taxes, to establish if you are eligible or you need co-sponsor. Gross income means before taxes; net income is after taxes. You will have to be able to provide data about your gross (before taxes) income. The letter from the employer will have to state the gross income.

We chose k1 because my fiance was married before and even if the divorce was final in January, he wasn't allowed to remarry until July. we opted for k1 because we wanted to start our journey asap. I think that otherwise we would have chosen CR1 as well, for all the reasons you have already mentioned. Adjudicating CR1 doesn't take that long either... cases seem to get approved much faster these days and now it's only a couple of months difference from K1 (of course, each case is different), so with a bit of luck, you two could be together in just 7-8 months.

This is wrong. She can get married while here on a B1 visa (or any other visa or VWP entry) with absolutely NO problems in the future UNLESS, she tries to stay and adjust status from that entry.

She can come here, get married, file for a CR-1 visa while here, return to Ukraine when her permission to stay has expired and do her interview there. The only time this is a problem is when someone enters with the intent to marry AND adjust status to AVOID the immigration process. She would not be avoiding anything and there is no restriction on a CR-1 as to where the marriage must occur. You do not need a visa to get married, here there or anywhere for that matter. There is also no requirement she be out of the country to file for a CR-1

The only thing to choose is how quickly she wants to be authorized to work. K-1s get you here faster but you are only half done. Cr-1s take longer to process but come with a green card. How important is working to you? If you can wait for a while, or have no intent to work, then go the K-1 route. There can be other considerations, but those are usually the main ones.


Back in February, I contacted my embassy in the US about this issue and the consular officers there replied that I would be misrepresenting myself if I came in the US with a B1/B2 visa and got married (even if I intended to go back to Romania) simply because I would be lying at POE when asked what my purpose of visit is. If at POE I reply "I intend to get married to my fiance", the officers would send me back on the first plane.

Of course, the OP is free to make a decision and I didn't claim to hold the absolut truth... I only shared what I knew (wrong or right) even if I didn't write the entire story. Good luck and lots of happiness, regardless of the path the OP chooses to follow! :thumbs:

I'd like to ask for some help in our situation. My fiance and I have been together for almost 3 years now. He visited me once and I visited him 2 times. I'm from Ukraine but I have B1/B2 5 year multi-visa. I've been to the US 4 times (business and visited my fiance). I'm going to be in the US soon to visit my fiance for at least 3 months (but doing business as well).

We're now searching for the best possible way to be together permanently. I wonder if it'd better to apply for K-1 and be with him during the period of wait (I can enter up to 6 months or travel several times using B1/B2 as I have business in the US as well) or would it be better to get married after a couple of months me in the US and apply for CR-1?

We're looking for the best possible way which would allow us to stay together permanently in the US and not being separated for a long time.

Hi,

You can find a helpful comparison of the types of visas at the VJ Guides sections. Now, if you decide over CR1, I think it is important to know that you guys should get married in Ukraine. When you enter the US and declare your visit purpose as business and/or tourism you will have to do just that. Getting married while on a B1/B2 visa is very tricky and can cause you lots of problems in the future. Good luck on your journey, whichever path you will take! :thumbs:

I completely agree with this. The process to adjusting to the married life is hard enough in itself; if she doesn't look like she's committed to make the relationship work now, how do you think she will be committed to being married? My husband and I both agree that love is an action, not mere words. She cried and told you she loved you when you told her about your doubts, but she didn't care about your feelings when you were waiting for her for hours online... The signs are there!

It's normal for us here to suspect her of fraud, but even if this wasn't a K1 visa process, the signs of serious incompatibility are still there! Just remember that you want to marry this girl and be with her for the rest of your life... Are you sure you want to do that? Best of luck!

Hi, I am the 46 year old..... To everyone who has had wonderful supportive comments, thank you!! It is nice to hear comments that help alleviate the stressful process we all are enduring. To those of you who don't agree, isn't it wonderful we live in a country where you have the right to your opinion and I for one am glad you do not get to make laws. As a human citizen we have the right to pursue life, liberty, and happiness. Fortunately, here in the US, we are within the law. So, please do not judge, what you do not, or can not, understand. She is as mature as woman 3 times her age. I guess the joke is on me if you want to say I act 3 times less my age. ;) However, our relationship was born from a wonderful friendship in which we talked for hours without seeing one another physically or knowing each others ages. We became friends because we liked each others company and conversation. We grew into our love as it stands today. Maybe if more relations were born from the same pattern, they would last longer. We plan to fight for our relationship and appreciate everyone's struggles to achieve their own personal happiness while being made to jump through many legal hoops.

Our story is similar to yours and the age difference between my fiance and I did raise some questions and suspicions at the interview... but I answered honestly to everything I was asked (and plan on doing so for AOS, ROC etc.) and they couldn't deny us the right to be together. Just be ready for any possible questions, check the Brazilian forum to see how harsh the Consulate is and you should be just fine!

Wow, how heartbreaking! My wife and I met 15 months ago in China. Ten (yes,10!!) trips to China and 150,000 flown miles later, We found ourselves at the embassy in GuangxuoAttached File  IMG_1194.JPG   73.56KB   297 downloads for her interview. As you can imagine, we had hundreds of photos, receipts, etc. as evidence that our relationship was legitimate. We even had a wedding ceremony this past february in her hometown. I even lived with her last summer in Shenzhen.
The interviewer was incredibly RUDE and gave her less than 3 minutes of his time. He barely looked at a little of the mountain of evidence and denied her with a "blue" form. He told her that she needed phone records and that was all we were missing.
This sounds like total BS to me. Had he spent three minutes with both of us ( I was waiting downstairs! ) he would have easily seen that ours was a legitimate union. After talking to many people ( including her friends, all of whom were passed with barely a thought! ), we were told that maybe our age difference (she is 29, I am 48) was a factor in the denial. My greatest worry is that this man was not being truthful and has no intention of approving us. As you can see by the photo, neither one of us appears our age. Anybody have any thoughts/comments/suggestions would be greatly appreciated.


Make sure you do not mention this at the second interview, if there is one. If this comes up, be sure to mention it's an "engagement ceremony"! Also call yourselves other endearing names, even fiance(e) in front of the officer, not husband/wife. This is a trap that many fall into and there have been cases of denial based on this only.

Subscribing to what everyone already said, your case was not denied...Keep calm and provide all the extra proofs they might need. Best of luck! :thumbs:

as long as you guys have strong proofs of bona fide relationship the age gap is not that much of an issue. the CO in Bucharest did notice our age difference and commented upon it (I could even sense a bit of a sarcasm there), but we have a solid relationship with lots of visits in 2 years so he just had to approve us. Your fiancee should be ready to answer questions if they arise, but I am sure she'll be approved ;) .

We met on June 15, 2008 and the longest time we were apart was 7 1/2 months (July 2008 - mid-February 2009). It was hell, but it made us realize just how strong our love was. After Febr 2009, the longest we had to be apart was 4 months; after that, separations got shorter (60-70 days) and now we are happily married and we'll never have to say goodbye again in airports! Hello, I've tried reading the faqs but it's still not clear what the best option for me is:

My current situation is I am a US citizen (if it matters, was born in China, moved to US when I was 8, now 23 yo). My GF is a Chinese citizen, we met 2 years ago, and she is now in UK studying. If we want to get married and have her live in the US, I think we have 3 options:

1) I apply for Fiancee visa, have her go back to China, etc.

2) I have her come here, we get married, she goes back to UK to study, I apply for marriage visa.

3) I go to UK, we get married, I come back and apply for marriage visa.

Of these three options, which do you think would be most effective for getting her here by end of September or as early after that as possible?

If you apply for fiancee visa, she doesn't have to go back to China (as far as I know)... Her visa interview can take place in London.

We chose the K1 (fiancee) visa because back then it seemed to be processed quicker (and it was)...but seeing how things go now IR1 would be the way to go if I were you. Once she's approved, she won't have to adjust status (and that will save you guys $1,070) and the adjudicating time frame is around 6-7 months, very similar to K1 now.

just like others have said, the age difference will come up at the interview. At the end of the day it's all about the proofs you bring and how you handle the questions. Technically 15 years is not that much, even if your fiancee is just 20. You might want to check reviews for the consulate in Guatemala...Just so that you know what to expect...Wishing you best of luck...

I agree with baron555 here. we got married at the courthouse in front of the judge and 7 people (friends and his family) and we'll marry in church + reception in Romania when we can afford it (the entire immigration process + AOS didn't come cheap, as we all know...). I asked one of our friends to record the 6 minute ceremony for my family in Romania and that was it. At this point, it is all about priorities indeed...

oh man, visiting twice in 7 months is too much for them? Considering the CO's comment, he surely doesn't know what it's like to be so far away from your loved one! US government should keep CO's families in the US, instead of facilitating the move for their wives and kids. I wonder if then they would be more sympathetic! Geez! Sorry for the rant.
