So,this is a question from a friend of mine who is getting ready to send the I-130 in.

She only has a copy of the front of her husbands (the USC)BC. How important is it to have a copy of the back if it is blank?
Her husband is currently deployed and she has no way of getting her hands of the original.
What would be the best way to resolve this? Any tips?

If I understood you right you are filing for a CR1 and you only recieved the first NOA and your case is till with USCIS?
Then you still have some more work to do until you get to wait for your interviewdate.

Not sure how your husbands deportation will come in to play in your process, hopefully someone else can chime in with regards to that.

Normally it's only the foreign beneficiary that has an interview BTW, but I have heard of them scheduling the USC petitioner for one under certain circumstances, not sure if this will apply to you.

I dont think its important to get a new passport. All you have to do is to do a change of name and manke sure you have it publicized in one of the dailies. Just take the newspaper along with your other evidences to the embassy for your interview.

So she should then get a new passport in her new legal name?!

I don't think Removing Conditions on you husbands Green Card will have any bearing on his son being able to stay in the US with you guys.
You would have to file a seperate petition for him, and I'm not sure this can be done with him staying with you in the US the whole time.

You can request to get them back at the interview.

Shouldn't be a problem. One of my police reports was in my maiden name, and one in my married name. No problems at all. I just put my maiden name under "other names used" on the I-130 so they figured it out.

It's not recommended to just send random forms to the USCIS until they ask for it since they cannot guarantie that they will actually catch up to you file. I think you would just have to wait until the RFE get's to you in the mail.

I'm not a 100% certain but if he entered without inspection you will not be able to adjust his status, since he has no status to adjust from.
Applying for a visa at a US Embassy in his homecountry will require him to leave to US, and when doing that he will incure atleast a 10 year ban from the US.

One thing to keep in mind is the current back-log at the Montreal (I think it's Montreal)consulate, which is the only consulate in Candada that's processing CR-1 visas.
Choosing a CR-1 instead of a K-1 could add some time to you waiting.

I visited my husband on the VWP in april and the only thing I brought with me was copies of our NOA's, NVC bills payed and my interview e-mail. They were never asked for though but a good idea to have as much evidence of you doing it "the right way" as possible.
The officer asked me what I was doing in the US, I said I was visiting my husband. She asked if he was a USC, I said yes. She then looked suspicious at me and asked how long I was staying. I said, only for 3 weeks as I had my visa-interview to go to.
She said, OK, let me in without looking at anything I had with me.

So if you bring atleast a NOA1 with all the rest of the evidence that he is returning (as you listed) he should be able to come over! He's lucky to be able to be processed in Ireland, shorter way home if he would be denied, which I doubt!

I'm not actually sure if we "officially" filed for an expedite but my husband (USMC) contacted his congressman and after he recieved a letter from my husbands "boss" saying he could deploy at anytime,the congressman made an inquiry with USCIS, we got our NOA2 very shortly after that. I have nothing but wonderful things to say about the congressman, such an awesome and down to earth person. After I got here we were able to meet him and thank him in person.

I'm not sure under which other circumstances an expedite is granted but I do hope you have a valid case and that you'll be able to be with your loved one soon.

The K1 is a different category, does not have the same requierments as the CR-1, no need for the "love-story".

You will say Yes to the Are you in the US right now question but there is also a section, I think it's Q22, that asks if you are doing AOS or not. On that question you just put which consulate you will want to be interviewed in.

I think the OP is trying to go visit during their process, wants to change her last name (filed her paperwork with her new last name probably) so she needs to get a new passport. Which will require her to file a new ESTA with that new last name.

To the OP, as I said, I went through the exact same thing, and everything worked out fine. One tip I have though is to bring all the proof you have of filing the CR-1/IR-1 with you when you go to visit so you can show at immigration if they start questioning you.

I was thinking the same thing, according to the OP's timeline he filed his I-129F 2009-12-31 but if his divorce wasn't finalized until July 2010, that's where the problem is. I was under the assumption you have to be free to marry when you submit the first paperwork.
