His trip is a work trip and was not booked with the intention of marrying. The lawyer said plenty of people arrive here on a VWP and have a girlfriend or boyfriend here as well, and don't want to leave so decide to get married. It is all about intention, not about gaming the system.


But your are planning on getting married when he comes here right?
And then adjusting his status from within the US?
I would say that qualifies as intention.
Just my opinion though,someone with more experience with this route can probably give you more help but I would be careful,just because people do it all the time doesn't make it legal..

He is already able to come to NYC on the VWP, and we would get married in that time frame. So getting a separate thing is not necessary for him. The lawyer said that:

1) He comes here on the VWP (it's for his work)
2) We would decide to get married (he recommends waiting about two months)
3) We file the CR1, B1, I765, etc.
4) Six to eight weeks later, with no leaving in the interim, he would get his interview time
5) At the interview, he gets his Conditional Resident (CR) stamp, work and travel authorization and temp greencard
6) 21 months later, we file for his permanent greencard with new paperwork.

This is straight from the mouth of the immigration lawyer, who has 30 years' experience. I kept saying, "But I thought we'd have to be apart for six or seven months while it's processing," and he told me that with the CR1, that is not true.



Coming to the US on a tourist visa, or VWP with the intentions of actually coming to immigrate is illegal.
So I would recommend getting a different lawyer...

Ok, my wife is here on a CR-1 Visa. I know I need to apply for something else to for her to stay here, but I'm not certain if it is AOS, or a removal of conditions. Which application do I need to submit - An I-698, or I-485, or I-751? :help:


You would have to file the ROC, 90 days before her 2 year GC expires, there is no AOS in the CR-1 process.

it only goves ma an internal error when i try to go to my portfolio, though.

When you get that error message,in that same window - type in the homeaddress of USCIS again,click on check your case updates, sign out,and sign in again and it should work. I used to be forced to do that.

Yes, I think your idea, listing the actual 6+ month addresses on the form and then referring to your attachment for the others, sounds like a good plan.

Personally I would list them all - but that's just me. If you are going to include info I just think it's a good idea to include all info.


Oh,I was planning on listing it on the attachmentsheet, I just didn't want to list it together with the +6 months adresses on the actual form..
All the adresses wouldn't fit on the form anyways so it's either listing all of them on the attachment sheet, no regards to the lenght, or just keep the 6 or more month adresses on the form, and only the "gap-adresses" on the attachmentsheet.

I'm almost getting myself confused while writing this...hope you understand what I mean!

That's a good point yohino. If you only look at the form instructions, you would believe that the gaps are irrelevant - because, as you have both mentioned, it only states that you should list the places you have lived for 6 months or more.

In the RFE it says - There must not be any gaps greater than six months - personally? I would list every country I lived in and the dates. An attachment, noted on the actual form is a good idea I think.


I was thinking I would leave the adresses and dates on the actual form as they are, just reflecting the places I'v lived for more then 6 months, then on the line under write " Please see attachment sheet for gap".
I kinda don't want to list my Austrian adress there since I don't want them to get it wrong and think I need a PCC from there, eventhough I was only there for 3 months. So I don't have one...

What do you think about it?

Yes you are right, places you have lived for 6 months or more.

On the top line, what did you enter, is it where you live now? If so did you write from date to present

Did you remember to put the 'present' in there?

I can only guess at what the mistake is because I can't see what you entered on the form :)

Forgetting to put 'present' in that last line is a common mistake.

We haven't sent our papers in yet, I just caught this thread and it sounds like I could get an RFE to for having a +6 month gap in my entries.
I entered my adress where I lived for 2 years in Germany, then for the coming 10 months there is nothing stated since I lived 3 months in Sweden, another 2 1/2 months in Germany, then 2 months in Sweden again and then 3 months in Austria. After that I have my present adress listed.
I'm just trying to figure out if I'll get an RFE if I send it in this way so I can make changes to it to avoid that!
But I'm not sure what changes I should make..
Should I add it to the attachment sheet I have in there, stating my less then 6 months adresses, explaining it or what should I do.
Would hate to get an RFE just because I followed the instructions and just put down the places I have lived for 6 months or more.

It looks to me like you left a gap in the residency area.

You may or may not have to submit more police certificates. They put that in there in case you do. So for instance, let's say that you left a 12 month gap, by mistake. Let's say that in that 12 months you were living in Australia, but just forgot to write it down.

They are saying if that is the case and you haven't submitted all the police certificates you should have - send those too.

If that is not your case, just make sure you do not leave any gaps in residency and send them a new copy of the DS-230, Part 1.



So even if you haven't lived at one place for longer then 6 months,but the gap between the places I have lived for 6 months is longer then 6 months, I mean, if I lived at one place for 3 months,and then another place for 4 months right after, and then a place for 6+ months which I have filled in, what do I do about the gap in the middle?
Since it says to just list the places I have lived for more then 6 months?

No, I want to know where I send it to after. Whether I send it to NVC or if it is brought to the Embassy or if we send it to NVC AND bring it to embassy.


The AOS and IV package is sent to the NVC, with originals. It is advisable to bring copies of everything to the embassy,just to make sure they have everything, and that you will be able to get your original documents back, if you so wish.

mustafa1232 - Wrong, the visa they would apply for is the CR-1, they have not been married for 2 years already, which is the reason people get an IR-1 for.
They are not doing DCF,so the application would not be made at the embassy in Japan, but with the USCIS in the States.
Please read through the OP´s post thoroughly before posting, as incorrect posts can be misleading.

To the OP :
Just have him bring evidence that he would be leaving the US before his autorized stay is expired, as Penguin_ie listed and he should be OK!

I got here last July 2009 and i got my Green card that is good for 2 years.

My question is, can i start filing a petition for my mom or dad(atleast) or do i need to be a citizen first?

or can my husband petition them?


Sorry LPR´s are not allowed to petition for their parents, only US Citizens.
And I'm pretty sure your husband can't petition for them either.
Just have to wait until you are a USC.

Hello,

I have the very same case. My husband is being deployed since last thursday.
We have been wondering exactly the same as you, so we called the NVC and we asked them if we had to change the adress, etc. They said we do not need to, because anything they are going to send to us will be by e-mail.
However, do not do the same mistake that we did : have your husband take a copy (and the orginal of the documents too if he can, or if he can give them to you) of everything with him.
The reason why ? After sending the AOS package and the IV package, I thought we just needed to wait for the interview. Well, I just got my interview date, and now I am very confused cuz the embassy specifications says to bring all the documents related to the I-864 to the interview while the NVC says I do not need. As I have not managed to get any info yet (seems that no one has been interested in my topic except like 2 ppl so far), the only piece of advice I can give to you is to be more prepared than us.

I'v been wondering why no one has been able to answer these Q's - I can't be the first one with a deploying husband.
I'v made sure he'll send copies of everything he is sending to NVC, and everything regarding 2009-taxes which I will bring to the interview.
I was also sure that if you sent everything to the NVC you don't relly need to bring copies of it to the interview aswell, only for if you want your originals back. I just wanted copies for myself. Thank you for your tip, now I know it's even more important he sends me those copies.
The address change has been my biggest concern, so thank you again for sharing the info you got from NVC. I would have called them and asked soon but I hate hate hate that constant busy-signal,haha.

I hope you are doing ok with your husbands deployment, I know how stressful it all can be.

Hi guys!

I hope someone can help me with this.
My husband (USC) and I just found out that he is being deployed in may.
We are in the middle of our journey ( at the NVC-stage) and have decided to try and delay my interview until july so I will be able to travel to the States in december when he gets back (it is 6 months you have to travel on your visa right?).

When he leaves he will not keep the house he has been living in, which is the adress that has been on all our paperwork so far. When he is getting ready to deploy, is it ok to do an adresschange and list his parents address?
What is the procedure to get the address changed?

We are hoping to be done with NVC before he leaves ( incase there are any RFE's) and then just getting in touch with the embassy to push my interview back a month or two, depending on when NVC appoints the "original" interview. This should be doable right?

I hope someone has some answers or suggestions, I would love to hear them!

The letters need to be in English, if you can have them write in English, then great. If not, have them write in Swedish and have them translated

Your employment letter should say - according to the guidelines the CBP gave me when I was denied entry
It should be on company letterhead by your boss or HR dept.
The date it was written
The date you started working
Your salary (optional if you ask me)
Your position title
Your immediate boss and contact information
Your expected return date
Address of employer - if not on letterhead.

Your letter from your landlord should say - again according to the letter CBP gave me
landlord name and contact information
date letter was written
date you moved in
date of termination of the lease
rent amount paid
address of the residence

Your lease and letter from employer are good, what about utility bills? bank account information? Any obligations coming up (wedding invite, doctor's apt card, etc).

Hi guys.

Due to my husbands upcoming deployment we have decided to slow our visajourney down and are shooting for an interview in july/august instead.
I'm planning on going to see him in the US for 3 weeks before he deploys and I'm terrified I'll be refused entry, that would just break my (and my hubbys) heart.

So my question is now, what should the leter from my employer and landlord say?
Should I just bring my employmentletter and rent-agreement, which both are in swedish, or should I have them write a letter in english and explain that I'm expected back, or should I have both... or ... or ... or.

I'll also be bringing a letter from my husbands "boss" saying when he is deploying etc.. and our NOA's and the e-mails from NVC and the e-mails I'v recived from my embassy discussing the possibility to change my interview date.

I really need some help here, as I'm getting really upset just by thinking of the possibility to not see my husband before he ships off to Afghanistan.

Ugh....I hate this already, and we haven't even technically started yet :(

So we sent our package USPS priority on Feb. 3/10, and had delivery confirmation for it arriving in Chicago on Feb 5/10. I was assuming that likely meant they would start reviewing it/working on it in some way the following Monday, and I was sort of expecting NOA1 maybe like a week or so later or something. This just seemed like the timeframe that a lot of people were dealing with, so I was hopeful. We still have seen no movement at all on it - our cheque hasn't been cashed yet....and no mail at all from them. I'm just kind of feeling bummed about it, as I thought this was almost the instant gratification part of the whole thing, as most people received theirs really fast! So it's been exactly 2 weeks now since I assumed they started working on it, and nothing yet. I know that's nothing really, in the whole scheme of things, but it seems like it to me right now! Ugh.

I guess I just wanted to vent for a minute - I'm just bummed. All I want is to get going on this!! :(


Just give it another couple of days, I was feeling the same way before we got our NOA1.
The thing is, all these NOA1 dates you see on peoples timelines is the date that they recived and "started" your application, it then takes a while to get it in the mail. So the NOA1-date in you NOA1 will be earlier then when you actually recieve it.
I'm not sure if that made any sense at all...I hope you get my drift!
Just hang in there and I'm sure it'll come soon!

Nothing about

The reentry permit comes into play from 1 year on up to 2 years (maximum) absence.

Up to 6 months, the "default" (for lack of a better term) assumption is that you intend to maintain your status as an LPR; from 6 months on the I,O. at the airport *MAY* assume you abandoned your residency in the US and you would have to show that this is not the case.

I agree with PushBrk that you should not anticipate encountering any problems.

I was under the same impression about the re-entry permit, good I was on the right page there.
The reviced plan is now to stay in the US an extra month or so with my in-laws so my time out of the country won't be more then 6 months so there is a less chance of getting into some kind of trouble.

Hey all.

So, today we found out that my husband isn't getting deployed in early may but in late july instead...
We were now thinking of going ahead with my visa-app and are thinking if we get an interview for may I could fly over there asap after that to spend time with him before he leaves.
I would then like to go back to Sweden and wait out his 7 month deployment.
Would this be possible or would they refuse me entry (saying I abandoned my PR-status) when I try to return again? Would I have to get a re-entry permit? Cause I read somewhere that was only for staying out of the US for more then a year. But I also read that even if you were gone for less then a year you could get in trouble for it.
Does anyone know?

You can send in the application to remove conditions on her conditional GC 90 days before it expires. So check the date her GC expires, count 90 days (not 3 months) back from that and you'll know when you are able to file. You HAVE to file before it expires.

Actually no, my wife has been American Citizen since she was 5. (She is 26 now.)

Her parents became citizens long ago, when she was 5, and therefore she got the citizenship in that process. In the form I130 we stated that she is a US citizen and got the citizenship because of her parents. Also, we included copies of the US passport she currently holds.

We have asked the congressman for help and will be calling tomorrow to USCIS to ask them to check with them.

Then this is weird,cause it sounds like they have your petition under LPR-status. Hopefully you can get this corrected by calling them and making sure they know she is a citizen!

I'm thinking the same as Scott, did your wife recently become a citizen? If so, did she request to update your petition?
To me it sounds like your process is like the one for LPR's petitioning a spouse.
Since this is not the case, you really need to get ontop of things and make sure they get notified that your spouse is indeed a USC and you are not required to wait for a visanumber to become available.

You did get in touch with your congressman/woman right?
Make sure they know about your suspicion that your case may be treated like a "LPR-case". Hopefully they will be able to help you!

Okay here I go... I'm just wondering what you all think concerning my situation. I'm trying to prepare myself for the "financial support" part of my petition for my wife who is currently in the Philippines. My issue is that I have only had my career for about two years now. In each year I have made around $55,000 before taxes. Prior to that, (the 3rd year, which i believe I'll need) I was in school full-time, for my current career. I worked part-time during school. But I made no where near the amount that I would need in order to petition my wife. How will this affect me? Should I have concern? Will my two past tax returns be sufficient evidence to prove I can support my wife? Thank you all.


Don't worry, current income is what is most important, that you didn't make the acquired amount 2-3 years ago,since you were a student, will not impact your case.

Thanks for your reply and re-confirming that you cannot order your transcript *too soon.* My friend is a dolt as it seems. The only time anything changes on my tax is the day I file it, usually at the begining of January. So ordering it after that should be fine. Sweet. I'm getting all my geese in a duck, or is it ducks in a goose. I'm making plenty of copies of various things and making sure that I have copies of everything while my lovely wife also has copies of everything that I have. This way we never have to wait to mail something to each other and have to mail stuff back and forth. Thank goodness for internet.

Looks like you got your NOA2 only after three months NOA1. That's pretty good deal. I hope I get mine in 1 month, which won't happen. But I keep dreaming. Not that I'm hopeless without my wife or anything just yet. But I do miss her and would love to have her beside me now, and always. :P

Though I haven't received NOA1 on my hand, I know I will have it on my hand soon. The 355USD check was cashed and it has a case number. I can check my USCIS case status already and I have signed up for email alert. :) I think I will have my NOA1 on my *hand* today. It was mailed from California on Tuesday. I figure it takes 4/5 days to move a piece of mail across the country. No worries; so far.


We recieved ours a little faster then what was the norm at that point since we got ours expedited. I'm real happy for the folks nowadays that tend to get them even faster then that though! USCIS is the worst part...just stupid waiting. At NVC atleast you got some control over how fast things will go!

I don't think you need to worry about ordering the transcripts to early, since they are taxes you have already done and won't be changing. And if nothing really strange happens, you should be a the point of sending them in well within those 6 months.

As for the recent "early" approvals from USCIS, I think it's kinda the norm now, to bad it wasn't like that when we filed..

And you should probably write a new topic when you have new questions, but only after you have read the guides thoroughly and searched the boards to see if the questions you have have already been asked/answered.

And as to peoples NOA1's being about 9,? days from being sent, the NOA1 date will be dated the day they sent it out,not when you recieved it,so it's off by a few days. If you know what I mean!

Well, in most cases NVC sets up the interview in the second week of the month for the following month. So the interviews for June would be set up 10-14 of may, if you are sending in your documents next week you will almost certainly not make the cut-off date. Which would render you to wait until the July scheduling in the second week of June.

If I were you,I would wait until they ask you to e-mail the DS3032,cause they are accepting them really fast nowadays, just so you don't confused them or anything. But I think it might be possible to send it before you get the e-mail. But I would just wait the extra day.

Hi, I'm currently residing in Ireland with my husband (he is Irish). I'll be here during the rest of the visa process. So my question is, can we use our address here to put on the DS-3032, or should I just put the address where my American mail is currently being sent too and forwarded from? Also, if I have him email the ds3032 do we still have to provide a bar code? thanks


I would say put your american address on it,since you need to maintain residence, it won't really matter though,you won't (or shouldn't even want to) get anything via snailmail.
If you e-mail it you won't need a barcode or anything, just use the template here on VJ and you'll be fine!

NVC is going to schedule you for a july interview most likely.
When it's scheduled you can call the Embassy and see if they can move your date up, it worked for another member interviewing in FFM.
They might be full,but it can be worth a try!

5 months is what the USCIS regards as within normal processing time.
Things have sped up lately but I'm guessing your atleast another month away from you NOA2.

CR-1/IR-1 DOES NOT FILL OUT the I-94.
