PhilippinesHELP WITH MY I-130
So did she come on a spousal visa(CR-1) or a fiance visa(K-1)?

K-1 Fiance(e) Visa Case Filing and Progress ReportsPetitioner not the Sposor
It's country specific if they will allow a co-sponsor.
The Petitioner is always the Main Sponsor though, and will need to fill out the I-134 and later the I-864.

K-1 Fiance(e) Visa Case Filing and Progress ReportsExactly 6 months yesterday, no word from USCIS (NOA2)....
The only tip I have for you is to ask for a tier 2 person, asking for a supervisor, when you try to call the (dis)service line, as you probably know by know the first human you talk to is nothing better then a trained monkey, even though that's kind of an insult to trained monkeys.
Were you able to put in a service request since you are beyond the normal processing time?

And of course you are allowed to call them yourself.

I really hope you get through USCIS soon!

Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresMarriage without full-blow wedding

American Consulate in Republic of Georgia said I had to do Ministry Justice. They said a church wedding would not do it alone.
I got the idea from no one............ It's what was told to me

I was reffering to the part of marriages outside the US would not be valid for immigration purposes. Not true.
I'm thinking the meaning was that a church wedding still needs to be registerd, which is true.

Most US consulates require a marriage certificate through Ministry justice. they don't acknowledge marriages outside US. They want more proof I assume...........
you can always redo vows in America

Where did you ever get that crazy idea?
Totally not true.

We also had a small court house marriage, mainly so we could start the immigration process, we had a bigger celebration on our 1y anniversary.
So for immigration that is all well and ok.
If your spouse-to-be is questioning your commitment that's something you have to deal with before hand.
Having pics from a civil service is sufficient as "wedding pics".

IR-1 / CR-1 Spouse Visa Process & ProceduresVisiting the US on the VWP while I-130 is pending

No problem! I was wondering what he should say when he first comes in, like if he should say right away that we are in the process of petitioning for an immigrant visa, since they'll be able to see it if they check anyway. Most people say that you should just answer their questions very concisely though and not elaborate further unless they ask (which they inevitably will since he'll be staying for a couple of months).

I don't think he should give up any information unless he feels the initial contact with the IO is starting to go "wrong".
I don't remeber exactly the question I was asked but something she asked me made me worried about being pulled into secondary so I then told her that I was applying for an immigrant visa.
As long as he keeps his cool, tells the truth and has evidence to back that up I honestly don't think he should have any problems. I sure hope so!
Good Luck!

To the OP, sorry if you feel like your thread has been de-railed, not my intention.

My story, I wen't to see my husband during the process but we were further ahead, I already had my interview date and everything, which was set for about a month after my return date (and I only stayed for 2 weeks). Wasn't pulled into secondary but I was fast to point out to the first officer that I was in the process of applying for an immigrant visa and that she could see my NOA's etc if she wanted to.
She waved me through after stamping my passport.

Hopefully your husband will have a similar, and easy, POE.
If possible, try and do POE in Dublin, just to save him a long flight back if denied entry.

Good Luck!

90 days in country, and in EU its the same probably similar in UK, if all that was needed was to cross a border and get a stamp and restart the clock like OP did in Berlin trip, then who would need an Immigrant VISA?

Also, take a look at the VWP purpose, business and tourism, not living with your wife/girlfriend.

Yes, maximum 90 days per visit, 180 days maximum per year. Which is what she pointed out that she knew.

Obviously she had the appropriate visa or equvivalent to be granted 6 months stay in the UK, she left for a week to go see a friend sometime during that stay, intended to return to the UK, stay the rest of her originally granted 6 months, then go home. No overstaying, no laws broken, but wasn't able to because they thought she was trying to pull a fast one, even though she wasn't.

Who would need an immigrant visa?
Perhaps someone who would actually like to be a resident of that chosen country, have a job, pay taxes (not that anyone likes that), go to school, live a normal life? And be able to do so legally. That's who I would think needs one.

The VWP allows you to VISIT the US, what you choose to do while you are here,if allowed in, (as long as you aren't doing anything illegal) they couldn't care less about. Visiting (not living with) your S/O, spending all you money in Vegas or spending 2 weeks in WalMart, all legal things to do.

The OP mentioned the 180 days NOT in relation to how long he could stay before accuring a ban, but in relation to how many days you are allowed to visit the US on the VWP in a year.

And as I see it, she wasn't playing "fast and loose" with immigration laws in Europe, since there honestly wasn't an intention to overstay or awade any laws.

IR-1 / CR-1 Spouse Visa Process & ProceduresTravel shortly after entrance
It will NOT be an issue.
CBP at my POE even told me that if I wanted to I could hop on the next flight out of there after getting my stamp and be able to return without any problems.
Of course I didn't since I was quite excited to see my hubby, haha!

You could have turned around and went back right after you'd entered if you would have wanted.
2 weeks out of the US is totally fine.

After she enters on her immigrant-visa she could turn around and leave the same day with just that visa being stamped. It will serve as a temporary GC for up to 1 year.

Does anyone know if I need to leave the US before we file the I130?
I am planning on leaving after we get married but can we file the I130 before I do so? Or will we have to wait until I´m back in Sweden?
I´v been looking around and can´t seem to find an answer to this..

IR-1 / CR-1 Spouse Visa Process & ProceduresGetting married on a touristvisa.
Me and my american fiancé got engaged a couple of weeks ago.
We have been thinking about the fastest way for us to be able to be together...
Would I get in trouble if I traveled to the States on my tourist visa ( visawaiver-program) and got married to him there?
The plan was for me to then go back home to Sweden and wait there for him to file the I130 and when that gets approved I would come back over.
I have heard that you could get in trouble if you travelled on your touristvisa with the intent to get married but does that apply even if I plan on going back afterwards?

I´m new to this site so I´m not sure if this has been a topic before but I would really appreciate some feedback!

I am planning on taking my (then) husbands last name after we get married.
Anyone who knows how this works since we are getting married in the US?
Should we still file the I130 paperwork under my maiden name because that´s what it´s still gonna say in the passport that I have then?

Hopefully the questions made sense or that you all understood what I mean..

What type of visa are you getting? You mention getting married in the US so are you filing for a K1?

I got married in Senegal and took my husbands last name. I came back home and changed all my documents including my passport, social security card and driver's license. THEN I filed the I-130 paperwork for the IR1/CR1 visa.

How are you getting to the US to get married?

We are filing for a CR-1 visa after we get married in the US.

I´m travelling in on my touristvisa, under the visawaiver-program and then travelling back to Sweden after the marriage.
So I have to wait with filing the I130 ´til I´v come back to Sweden and changed my name there?
Is it possible to change my name later ( after I´v received the visa) to his?
