My love has been in the US for almost 1 full month.  My how time flies! We are set to be married on Friday (yay!!) and then back to processing paperwork (boo!!).  He already has his Social Security number and is getting use to the transit system in NYC.  Next on the list is getting a learners permit and then drivers license. We are enjoying every moment of it. 
 
For those still waiting keep the faith.  Our filing journey seemed like an eternity but now feels like a very small faded memory.

Coming from the guy that has only waited 3 months...of course, he's upbeat  There's people still waiting from December and earlier. I'll be congratulating them when they're approved.  What they are going through is so unfair.  USCIS is unfair.  I don't care right now if this insults you,  You'd be disappointed too every time you saw files filed AFTER yours getting approved but I guess you'll never know that feeling.  But I'm one day closer to my love...if you think that helps the situation, it doesn't.  Anyone who has seen my posts will see I've remained positive but at least up til now the CSC approvals haven't been rubbing it in our faces that they've gotten approved because they know it's hard for the Vermont filers as we know we have to waits months longer than you.  It's bulls&^% and we all know it.

 

Chill out.  I seriously doubt anyone is rubbing anything in your face.  In case you missed it, this is basically a visa update site for those who wish to join it.  By people telling you that they're approved they're giving you the only hint of where USCIS is at.

 

And anyways, you're a Canadian-American couple, right?  That's easy compared to other relationships.  So go relax somewhere and come back with a level head.

Just go to their website -- most congress people/senators have a link for constituents who have immigration questions. You will fill out your contact info and someone from their office will send you an email with a link to a form that you need to fill out and fax back giving them permission to make inquiries on your behalf.

it is exactly 90 days today that i received my NOA1, 10 days past the estimated rime frame that VJ said I should likely get my NOA2, and VJ says that TSC is currently processing K-1 with and NOA date of 2/10/13; my NOA1 is 1/31/14.
 
Do i call and look for an update? what specifically should i ask? or do i not rock the boat and wait another month???
 
any advice would be awesome.




If you are from New York, isn't your service center Vermont? They have a wait time of 5 months for I-129F petitions....

Thanks ladies. I am aware there is criteria for an expedite. I did not just ask for one simply because he lives is cuba. I did make the request unDer extreme emergent situation. My post was seeking general information froM those who have filed an expedite request and the time it took for them to hear back regarding that request and whether anyone had a request denied and were able to appeal. I have evidence to support my request I just haven't hearD anything from TSC

 

Well, good luck! I hope it works out for you.  You may want to get your congressperson/senator involved if you haven't already. Getting the I-129F approved is just the first step.  Last I checked, the wait for an interview appointment in Havana was about 5-6 months.

Based on your timeline, your case is not considered outside normal processing times. For expedite requests you usually have to fulfill certain criteria- like financial hardship. Do you meet the criteria? As for service requests, they usually don't do anything until your case is outside the normal processing times and then they just tell you to wait 60 days for a response. For what it's worth, it took 7 months for my husband's I-129F to be approved.

Well if you check the NYS DMV, you definitely need the Social Security Card and other forms of ID which includes a passport with the I-94 and other things.  It does not explicitly say he must have a GC. For the SS wait 2 weeks from arrival, print the I-94 and then go to the SS office. It was easy breasy and all he needed was the I-94 and passport with Visa in it.  Good luck with everything!

Hey there,

First post here and I'll be honest i've never used a forum before so Hi!

My fiancé is from Florida and I'm from Australia, he has been here in Australia with me on a working holiday visa for the past year and is here till February.

We submitted our case (K1 fiancé visa) to USCIS and got approved, and the last we heard our case was being forwarded to the NVC.

It's only been 9 days since the NOA2 so right now I'm not in panic mode, I emailed the NVC and asked if they have received our case and I got the stock standard response of your case may have been lost its not here etc etc email NVCresearch.

My questions are:

What is the standard time frame we can expect NVC to receive our case within?

Will we be notified by them when they receive it? If so, how? via email or snail mail.

Will calling the consulate in Sydney, Australia about this help me in any way?

Living in Australia makes calling the U.S a bit tough and my fiancé is here with me - can we ask one of his parents who reside in the USA to call on our behalf?

Should I just continuously email the NVC every three days asking where our case is?

Should I contact USCIS and ask them about the location of our case?












I know its still early days in regards to waiting for the case to fly around the World - I would like to locate the problems sooner rather than later though!

All sounds perfectly normal! Our NOA2 was October 22nd and the consulate here in Auckland didn't receive until over a month later. Though we were processed by CSC which it seems suffers more delays shipping to NVC at present.

 

You definitely don't need to be hounding the NVC or the Consulate yet... just wait it out and if you've still heard nothing when four weeks is up, give them a call. You can call the DoS from Skype for free, and it is the petitioner who needs to call.

 

One the Consulate receives your file, the beneficiary will be notified. I received a letter in the mail with packet 3, but Sydney may send via email - you should be able to have a look around the forum and find out.

 

This is a great time to research what the contents of packet 3 is for Australia and start getting all your paperwork together. It may take longer than you think - if you need to renew a passport or apply for a birth certificate copy, for example - so the sooner you get started the quicker things will move once Sydney receives your case. I was able to return my packet 3 the day after I received it as I spent the month after NOA2 compiling everything that the Consulate needed, and the medical and interview were subsequently very fast to schedule.

 

The best news is that the longest and most frustrating part of the wait (USCIS) is now over - so just try and relax and prepare yourself for the steps to follow.

Doh! That was the issue thanks smile.png Status says ready for interview. I'll stop obsessing over it for awhile as I'm sure the wheels of bureaucracy grind slowly

 

It will likely go through alternating periods of "Administrative Processing" and "Ready" over the coming days as they prepare your visa and file for POE. This is all totally normal.

 

Immediately prior to the visa issuance, you may find that your case created date updates to the current day, and "Immigrant Visa Application" at the top changes to "Non-Immigrant Visa Application", that'll be the final update before the status changes to "Issued". For me, it was two days between when the case created date changed and when the status changed to "Issued".

Our K1 interview was this morning in Athens. It went well and was approved!

 

I have tried to confirm this on the CEAC website, but the case number we have on our documents is 4 numbers too short and is not coming up as valid. I contacted the Athens consulate and they simply said they would call us when the visa was ready. 

 

Questions:

 

Does it always take 10 business days? We (perhaps rashly) booked our flights to the States for 2 weeks after the interview date, so 10 days will be...close!

 

Is there a way to get updates through the CEAC website? Any other Athens petitioners faced the same thing with an invalid case number?

 

Also, they gave my fiance her chest xrays back and told her she will have to present them to immigration officials when she lands in the States?!? This seems strange and as far as I know x-rays can't go through the x-ray machine at the airport, so how should we carry them?

 

Make sure you select 'Immigrant Visa' from the drop down menu as the K1 is processed by the Immigrant Visa section. It sounds like you might be looking under Non-Immigrant Visa. Your case number for CEAC should be three letters followed by 10 digits.

My gosh, they're not lying when they say things move much faster post-NOA2. After waiting for USCIS, it's a little bit of a shock!

 

The Auckland Consulate received my electronic file on Monday, my physical file Tuesday, and today (Thursday) I received packet 3 (which I had largely already prepared, except for the DS-260 which I completed this afternoon). I called the doctor to book the medical around midday today and was given a midday tomorrow appointment! As the doctor is a couple of blocks from the US Consulate here in Auckland, I plan on returning Packet 3 to them on the way to the medical. Now I'm hoping for a visa in my passport before christmas.

I'm so sorry to hear that :( And yeah I do think it's a possibility that that's the reason you're still in background checks. One of my friends has the same name as a suspected terrorist and a few years back, when he entered the USA, CBP held him for almost 48 hours until they confirmed it was an error. He missed his connecting flight and the conference he was supposed to speak at. Craziness.
 
I'm not sure what else you could do in this case except wait it out. Once they've run all the checks they need to, and they see for sure he's not the same guy as your cousin, I'm sure the approval will come. I would suggest appealing to your senator/congressman but I think they usually refrain from getting involved until it's outside normal processing times. All I can say is, hang in there...



In a way it's sort of a relief to have a possible reason in mind for the hold up rather than just going crazy with the unknown!

I'm just hoping for at least an NOA2 before my contract with work is up in mid Dec, so I can at least see a clear path ahead for getting back to the States. So, fingers and toes... :)

Yikes - this had never occurred to me until now, but my USC partner (who has a rather common first name but very uncommon last name) has a distant cousin in Ohio, almost the same age with the exact same name as him, who has an extensive criminal record. A quick Google shows that he was indicted by grand jury on drug trafficking charges in 2012, and that he's just been in court this month for theft.

 

Could THIS be why we're stuck in background checks?

Timewise, we're still in good shape because i do not plan on moving over the ocean before June 2014, but not hearing something... (als "ALL" other July-filers got processed so far) drives me crazy. I checked the cases before and after us and they're all processed *jealous!*

Same here, but at CSC. They're now processing late Sep filers while ours hasn't been touched since July. Only a handful of July filers at CSC on VJ haven't received their NOA2.

 

Today for the first time we called USCIS just to see if they might have a suggestion as to why our case is taking longer than others. The rep actually voluntarily escalated us to a Tier 2 officer unprompted after my USC partner asked a few questions. We waited on hold for three hours (yes, HOURS) for the Tier 2 rep to then recite generic answers to us and then hang up.

 

The Tier 2 rep said that we're in background checks, that she can't tell us anything more or estimate when something will happen, that our timing is completely normal, and that despite what it might look like, most July filers haven't yet been approved. She then got sort of angry at my partner for calling while inside posted processing times, and then disconnected the call.

 

That was it.

There are about 28 July filers who haven't received NOA2s according to Igor's list. So much of this immigration process seems to be based on luck and it's anyone's guess why they process some cases quicker than others. :( It will all be worth it once you're together though. Keeping my fingers crossed that you'll get yours soon - we are rooting for you!

At least half of those 28 haven't logged in to the site for quote some time (yes, I check, haha!) so I imagine that's why they're still on the list as unapproved.

At least before we had a date to look forward to (VJ's estimated date of adjudication) and so it was easy to forget about it and be patient. But now that those dates are way in the past, and I have literally no idea of when to expect anything, it's much harder. I don't know if it'll be next week, next month, or next year! I've been wondering if we can cancel our petition and file another.

My contract at work is up at the end of the year, and going by the initial estimates I thought the timing would work out perfectly for my departure, but now it's looking like I'll have to start looking for something else. Considering it took me 8 months to get my current job due to the current market, I'm terrified of the prospect. My USC partner is here in NZ with me until early next year, and I didn't ever think we would have to do the distance again.

Oh, USCIS - this is one tough process. And after enduring DOMA, I thought everything else would be easier.

Hang in there - it's really tough (I know, I've been there) but it will feel so good once you get that approval.  Just a question - are you with CSC, TSC, or VSC?  From what I've seen, California and Texas are moving through, but I haven't seen much from Vermont, though I could be wrong.

We're at CSC, so they're now approving petitions with NOA1 dates almost 2 months after ours.

I just don't get the logic behind which cases get pulled out next, and why some sit there with no change. Is it that they initiate background checks on a whole box of petitions at a time and don't process any from the box until they're all done? Or is it something else?

It was weeks back that batches of petitions around our dates were being approved so I can't work out if it's even likely now that it will come without us having to wait 5 months before opening an enquiry.

Well it's been almost a week (it's Thursday here in New Zealand) and nothing, so I feel like maybe that one didn't work.

I'm so confused.

It's a weird feeling: I'm not upset or angry about other people receiving NOA2s and moving ahead with theirs, as everyone else is on this difficult journey too - but I just don't understand. I don't understand how cases filed almost 2 months after us are already approved while ours hasn't even been picked up since July.

I know we're still within the 5 months stated processing time but it's little comfort when you factor in human emotion and watching other people get processed and approved after 1 month. We've already had to endure being unable to even file for a visa due to DOMA, and the waiting feels like little more than an extension to that!

Sorry for the rant - I desperately needed to get that one out!

It seems it just random can be a batch assigned to lazy officer it makes no sense since now 08/15/13 applications are being approved. Was yours transferred to Texas? Did u check online on uscis.gov the status. I recently saw an application go from RFE on 09/18/2013 to Initial processing due to a bad address . Nope I'm at CSC, so going by dates should have been processed even sooner! Yep I check on USCIS every day. The cases 2 before mine got RFE in early Sept, and the one after mine got approved in late August. My last update was July 24 (alien number changed), which was 2 days after my NOA1.
