I am going to bringing Jeanie over to the UK in November, would this effect the K1 process or cause any issues with her entering the UK?

 

Oh and some good news our K1 has been approved by the department of homeland security and has been forwarded to the department of state. Yayyyyyyyyyyyyy!

I'm anticipating getting my K1 visa interview/approval early next year..might be a silly question, but hopefully someone can assure me.

 

My passport expiration date is November 2015. However I noticed somewhere it said that one of the things to bring to the interview (and that the K1 visa goes in) is a passport that is valid at least 6 months after your intended stay in the US...well the intention of the K1 visa is to permanently reside there!

 

Should I renew my passport now before I get the new K1 visa (and then later, the green card) so it has a new 10 year expiration? Will  t be an issue getting my K1 visa then green green card issued in a passport that expires in just over a year?

You still have 2 years before your passport expires. If you get approved next year, you still have another year. If you are worried that your passport will expire while in the US on K1 visa, can't you visit the Australian Embassy here in the US and renew your passport?

 

Yes I can renew passport in US at Australian Embassy I believe but these wording had me alarmed:

 

To schedule a nonimmigrant visa appointment, you must have the following information and documents available:

  • A passport valid for travel to the United States with a validity date of at least six months beyond your intended period of stay in the United States (unless country-specific agreements provide exemptions. If more than one person is included in your passport, each person desiring a visa must submit an application;

Seeing as my intended period of stay is...permanently...does this not apply for the K1 visa interview?

K-1 Fiance(e) Visa Process & ProceduresNVC - what happens between NOA2 and Packet 3?

Hi guys,

 

We're applying for the K1 visa from Sydney. The I-129F was processed in CSC. We got the NOA4 on November 18th. Just wondering from here...does the NVC email the petitioner/USC when they have received the application? And then again when they send it off to the Sydney US Consulate? How do we receive correspondence from the NVC? And I understand I should try calling them to receive the case number before hearing from them, so I can track the progression?

 

And then when the US Consulate in Sydney receives it, would they email the Packet 3 email to the petitioner/USC? Nowhere in the I-129F petition package was my email (as beneficiary) listed...so they wouldn't have it. Would I call up the NVC before they send it off, and give them my email to pass onto the Sydney US Consulate? Help! I just dont want to freak out that I am missed out on receiving Packet 3 because they dont have my email....people are telling me that my email should have been listed in the I-129F package somewhere...but it didnt ask for it anywhere did it? Am I missing something?

 

I'm going to get my police check done tomorrow, and then after getting case number will schedule medical exam asap.

Hi everyone,

 

Sorry if this has been covered before! I called the Sydney medical centre (Dr Waks) yesterday and was told that the medical report is valid for 6 months from the date of the medical. My main question is - do I need to obtain K1 visa, go to US, get married, and file for AOS within those 6 months? Or do I just need the K1 interview/visa approved within the 6 month validity?

Advanced Parole has risks also.  You better read up a lot.  I would honeymoon in the States.  Risking 1 year+ for spouse visa (which has happened to honeymooners) is way too great.

 

The honeymoon is actually a trip we won in a competition, which is kind of once in a lifetime kind of opportunity!

 

Is Advanced Parole the same thing as the application for I-131 'Application for Travel Document'? 

 

I'm under the impression that at time of filing for AOS after marriage, that I include I-131 (to be able to leave and re-enter US before AOS is approved) and I-765 Application for Employment Authorization (to be able to look for a job before AOS is approved). And the risk is that these take a while to process.

 

Is this incorrect?

Hi guys,

 

Hoping anyone can answer my question!

 

I am anticipating getting my K1 visa approved in February 2014, then enter US in June, and the marriage will be June/July. After which, I will file for Adjustment of Status straight immediately after.

 

We do have an overseas honeymoon booked for November however. Does anyone know how long the AOS process takes, or if you are able to leave and re-enter the US while it is still pending and status not yet changed to Permanent Resident?

 

Oh and also, is it roughly 3 months after filing for AOS that  I can legally work? 

 

Any help would be appreciated, thank you!

I received my passport with k1 visa in the mail yesterday, along with the big yellow envelope thats all taped and rubber banded up instructing not to open it. I have not been given further instructions (the Sydney US Consulate did not email me anything else).

 

I understand at POE (most likely LAX) I have my USC fiance who will be travelling with me, stick together, and hand over passport and yellow packet to the officer. 

 

The yellow packet instructions on the front says to attach the Xray to it...but my xray is so large, i can only put it in my checked luggage! Has anyone had any experience with having to show xrays at POE?

 

Does the officer give you back the documents that are in the yellow packet? I understand my medical results are in there.

 

I only have a photocopy of the medical DS-3025 that the doctor gave me at the time I did my medical. Is this all I need for AOS or will I require anything else?

 

We are planning on flying to Michigan and then having civil ceremony a week later, then file for AOS (and EA and AP) as soon as we get marriage certificate back.

official documents (divorce decree, birth certificates) must be accompanied by certified translations supporting evidence (bus tickets, rent proof, reservations) do not need to be translated. This is because official documents are "hard evidence" for your case used by USCIS to build and store your case. Supporting evidence are "soft evidence" that just give an impression to your interviewer about your relationship. Your interviewer is required to be fluent in spanish, also, those things will be returned to you at the end of interview or when you pick up the visa. This is speaking from experience as an approved fiance visa holder :-) best of luck!

That is more than fine, I was nervous about the affidavit of support, but they didn't say anything to me, they barely even looked at it.
The reason for that is, in K-1 visas, we will really be proving the affidavit of support during Adjustment of Status (that is the next level of paperwork that you will start on once your fiance arrives to the US). That later affidavit (form i-864) is much more through, but even for that, that letter meets all requirements.

When I file for my k-1 Visa, my significant other and I will have to fill out and sign the g325 form. She lives overseas and I heard that the form must be in original form. Will we be able to have her print it, sign it, scan it, and send it through email? will this work? same goes to the letter of intent. How did you guys do it? If she has to send it through mail, that would take a long time. And would I be able to sign it for her?

 

Umm..My fiance actually sent it in the mail. But I don't see any problem with her scanning it and then you printing it. As long as its signed by her you should be fine. I don't think they care where it was printed lolz :)

I am soo excited I got my approval yesterday, July 25, 2013 after waiting 6 whole months. So Now I need to fill out form I-134 but I have a question. Last year I was going to school and working part-time so my dad included me as a member of the house hold in his tax papers because I wasn't making enough money to file on my own. But starting Feb 1, 2013 I had a full time job that pays higher than the poverty line. So for the supporting documents for form I-134, are my pay stubs enough? or should my dad also fill out the I-134 and Co-sponsor me and my Fiance?

I think the right way will be to fill out one I-134 from you as a primary sponsor and one from your dad as a co-sponsor for your fiancee. Fill all requered information on that and attach suppurting documents such as income tax, pay stubs, bank acc etc. your dad has to provide his information on his affidavit of support and has to provide yours on your affidavit for support for your fiancee. That's how I think it is. cause I recently filed my petition and I will deal with it later. I might be wrong in my thoughts but would like to know more on this, because I have almost simmilar situation like yours. But I also have a quistion about it. If the co-sponsor is married DOES HIS WIFE HAS TO FILL ONE I-134 FORM ALSO?

hey just want to say be prepared for a journey with this filing..it takes patience and support from your fiance and love ones but also know that visa journey site is here as support as well.....with that said u have need Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship....so if u just seen your fiance once,i would recommend going back to see him another time and take and while there take photos with his family and friends ....good luck !

Hi everyone,

 

I'm trying to pin down exactly what is the deal with a temporary work authorization for K1 visa holders.  I've learned a lot on these forums, but I'm still not clear on the details.

 

Several people have posted that you can come in, wait 10 days, and then apply for a social security number, with which you can work for as long as your K1 is valid (90 days).  (is this 10 business days or 10 regular days?)

 

Others have talked about getting a work authorization stamp on your 1-94 when you come in on the K1 visa, and a couple of people have mentioned that they only give these stamps at certain POEs (like JFK airport?).

 

Lots of people agree that its a great idea to get married right away and file the EAD + AOS, but that the EAD takes 2-3 months to come through.

 

Does anyone have any information on this?

Hmm, I'm not sure but the advice I've gotten on this is no, not to file the K1 while the fiance is here and that once you file the K1, the fiance shouldn't come into the US until the K1 comes through.  I think the reasoning is that once you've expressed an interest in immigrating by filing the K1 visa, the authorities will be dubious about letting you in on a tourist visa.

 

overstaying i believe would mean overstaying what her limit is on her tourist visa.
