Hey guys!
The rfe says "submit evidence that you and your fiancé have met each other at some time during the two year period from July 31,2010, until July 31, 2012".
Me and my fiancé met in the begining of 2010. I came back from Yemen in the end of February.
By July 31,2010 I was in USA, but we talked and send letters.
So is it ok to send photos from January and February 2010.

My opinion is if your co-sponsor has adequate income to provide sponsorship for all his household and your fiancee then you just send them yourpart time status letter from a job. You will need full time for your I-864 form when you will get marry and when you'll send papers for status adjustment. Good luck on your case!

I don't think you are looking at it incorrectly.. nor am I trying to scare you.. I had something similar, but different and ordered my criminal report from the state just in case which came back clear.
Go forward with your filing .. should be ok.. it's just those types of crimes I know can be scrutinized a little differently

what will you do when your pending turns into a conviction whilst your petition is pending?


Don't know yet. But still this kind of conviction that I might get is not on the list of the instruction for I-129F, where they ask if I am convicted in one of the following.... I found great website www.avvo.com where you can ask lawer a question and I got 3 responses from lawers and all of them said that this is not the type of conviction that might denied my I-129F. They only look for some serious sexual abuse convictions for the application. It would have been different story if my fiancee had any kind of convictions. It is much more difficult this way. I understand that my trouble doesn't make me a good moral history but anyway I hope everything is gonna be fine.

They never ask to mention anything like that in any form. they only ask convictions from the list they provide in the form. If they asked to mention that anywhere I would have mention. There is no sence to hide anything with USA social system. everything goes on your SS#!

Hello everyone! According to my case situation, I found out some unkown steps and quistions about Criminal Records and K-1 visa petition. Maybe somebody had already experienced such things and can give suggestions on it.
Situation is that I have criminal record for marijuana posetion in 2008. At that time I still had Green Card. April 2013 I got my citizenship and couple weeks later I got into a trouble in different state. I was arrested and my case is still not done. In the worst scene I am looking for a misdemeanor for the Theft from a motovehicle and get on probation in PA or in good scene I will dismiss it. Depends on how good lawer be on the last court day. I filed my petition for Fiancee and on a form I-129F they are asking if I was convicted of one of those convictions which they listed on the form. And none of them looks like it is my case. BUT my courts still pending and I am still not convicted in anything. The only thing is that that arrest might be shown somewhere in the national criminal backgroud check. I am not sure How it works. If somebody have an idea about it, post replies on this topics. Thank you everyone.

Well I knew that but if only I had understood that the amount of 125% of the Poverty guidelines is for the Form I-864 is required for all family-based immigrants .... That's why I Called, National Customer Service Center (NCSC) ... but the representative told me the form I-134 nonimmigrant cases did not have a poverty guidelines Such as the I-864 ... I explained that the 3 people is the 23.162$ Poverty guidelines, that if for I-134 was the same amount that the I-864, but she said not so I told her that if my boyfriend would have problems in his interview with the form I-134 filled only with the $ 20.989 that I did, she told me That I Would not Have to Worry About That.
That's why I ask you, if she has reason in what she said, because the representative told me that he had consulted with her ??supervisor and she confirmed the same thing that for the form I-134 dont have any poverty guidelines exact for nonimmigrant cases..
I dont know What I do .... With the answer for the representative, If is true or not.

I'm very confused about, The Form I-134 is Used for K-1 and K-3 nonimmigrant cases, .. Form I-864 is required for all family-based Immigrants.
I called, National Customer Service Center (NCSC): 1-800-375-5283, where a representative told me that for I-134, did not have a list amounts such as the I-864. only in the interview they wanted to know if He has anyone here in the U.S. with whom he could count, something like that was how The representative explained to me. I asked the representative that if my boyfriend could have any problem if I will do her co-sponsor of him with the amount that I Did, she said no, that would not have problem because they dont ask a specified amount that I would not have to worry about that, but I do :wacko: .
Well I have a daughter and the last year I made 20,989$ and I want to be the co-sponsor of my boyfriend, His interview is in October in Lima and I applied form for K-1 Fiance Visa's,
Now!! I can do tell me please ... since it is also a bit difficult to find a co-sponsor now, my family can not help me because they also have depends, I can I be the Co-sponsor of my boyfriend? or if you believe that He would have problems when you get your interview?

Dearest VJ,

 

I've seen similar threads, but not quite the same: Does anyone know if it's a problem for me (a US citizen) to go live with my fiancee (a Turkish citizen) in Istanbul while we complete the K-1 visa process?

 

We fully intend to come to the US together as soon as we can, but I'll be leaving my current US residence in the meantime, and probably changing the address on our K-1 application to my parents' house in the US.

 

I received our NOA1 in late February 2012, so we could be waiting in Turkey for a while (6 months?). Do I need to tell the USCIS or State Department that I'm moving abroad or can I just consider it a long visit?

 

Anyone have similar experiences or foresee any complications? What should I be ready to say and show at the Turkish and US airports? I'm not trying to subvert the system at all -- just trying to see my lady...

Dear Visa Journey Community,

 

I've read some posts related to this issue, but I still have some lingering questions... My Turkish fiancee needs to obtain an Italian police certificate (because she lived and studied there for a year and a half) in preparation for her K1 visa interview at the US embassy in Ankara -- but we're not quite sure how to do this.

 

Someone cranky at the Italian consulate in Istanbul said to do it online, but that doesn't even appear to be an option (as far as we can tell anyway). Going to Italy to get the the certificate in person is also basically out of the question, so it doing it by mail seems to be our best bet (consistent with VJ member postings).

 

Our plan (per US and Italian instructions online) is to send a written request (application attached), photocopies of my fiancees passport and permesso, fees (16.00 stamp + 7.08 processing = 23.08 euros), and a self-addressed stamped envelope to the Ufficio del Casellario Giudiziale della Procura della Repubblica in Rome.

 

My remaining questions are:

 

1) Do we have to state our reason for needing the police certificate in our written request (i.e. K1 visa application)? There's no space for it on the application form, but some sources suggest you need to give a reason...

 

2) Does 23.08 euros sound like the correct fee? (It seems to cover the official stamp on the certificate and expedited processing.) And what payment methods do the Italians accept -- money order, international check, etc?

 

3) How do we pay for the return postage from Italy when we're in Turkey? We can't put Turkish stamps on it, and we can't buy Italian stamps in Turkey -- right? And what size and weight of envelope do we pay for?

 

4) Finally, the US State Department says to send our request to the office in Rome, but my fiancee lived and studied in Milan while she was in Italy. Do we stick with Rome or send our request to the local office in Milan?

It sounds like you may not be quite ready to send off the forms. One of the requirements is that each of you are free to marry. Divorce decrees are the proof they want to see. If you were divorced three times, then they want all three decrees...the whole thing and signed by the judge. Do go over the guides again to see if you missed anything else.

We're you divorced in the UK? I ask because you called it decree absolute. But you are the US citizen if you are applying for your fiancé, so I was curious.

 

I'm just picking up my fiance's expressions. LOL!  I'm the US citizen, and thankfully, only married and divorced once.

I have to be the main sponsor no matter what....
Get a letter and first pay stubs as soon as possible to show them...and include my mother as a co sponsor, and if i have to put all of her dependant, inluding my father, and then can i show their income tax which is 44k, for both of them? Thats what is in line 22 in their 1040....
Or i can show only my mom's income?
And why my mom can't be the main sponsor? Is that the rules they have? Or it just would be better if ill be the main and she's a co-sponsor?

I guess that's the reason every USC on VJ doesn't just go hang out in their fiance(e)'s country to wait for the visa. They need to be at home working and showing they can support their other half when they finally arrive.
 

You right, but we are working here and have job positions there waiting for us, can support ourself but can't prove it:(....i didn't know anything about i-134 before, that's why "lost" right now

Yes, I think you're going to have problems. Can you find another sponsor who makes more and is not already sponsoring somebody? Either that or go home immediately and get a really good job (though it's probably too late for that).

Hello guys, i just got my NOA2 on April 30, and now thinking about all the papers for the interview. And when i started thinking about i-134 i realized i have some problems:(

I live with my fiance in Ukraine for the last year, while waiting for the i-129f and obviously i'm not working in US and i don't have incomeTax, i dont have anything i can show them except 10k on my bank account....

I was thinking that my mother can be a sponsor, but im not sure - Can she be the main sponsor? or i have to be a sponsor and she can be a co-sponsor?

if i have to be a main sponsor....i read some topics here, that people not getting approved because of that(little or no income with co-sponsor)

I am really confused and nervous about that....

 

Other thing if my mother can be a sponsor - she already gave an affidavit of support to my grandma like 3-4 years ago, does it mean that her income have to be more then they ask for?

she has an income of around 17-20k plus 10k in bank account, payed off car, worth 20k and house worth 350k with mortgage of 150k....

 

So the big Question is : What and how should i do? What would you suggest, to get as more chance as possible to get an approval?

Hi everyone.

My name is Justin and i live in the Dominican Republic for a couple of years now.

I met my girlfriend here and after 1 year and 3 months  together i want to start doing the visa process and go back to the states. Although im preparing myself to do the visa im actually taking all the time posible since im not going back to U.S.A. until next year (2014)

just some concerns on filling out the visa.

 

1.One of the requierments is to have seen each other in the last 2 years. Do we have to have a relationship for 2 years? or have known each other for 2 years? or the time we have wouldnt give us any problems.

 

2.One of the questions in the G-325 A (Biographic Information) aplication it asks us where have we lived in the last 5 years. I have traveled many times in the last five years over 5 places and in the aplication only has 5 empty slots to write down. Do i have to put every place i went to vacation and make an extension of that question or is there a time requiered to actually be conisdered a place i use to live in. (most places i was there for a week or 2)

 

These are just some of the questions that i have and i just started doing the visa papers and since i have time i want to take as longs as posible as long as i get everything right

Why are you calling the service centre ?
why don't you get your congressman to ask on your behalf ?? or better still, get them to put the pressure on for an approval .... at 235 days, I wouldn't mess around with calling the misinformation line anymore.
They have to reply within 48 hours to your congressperson ..... some are not helpful, and some are, it just depends on who you get.

cmoncada.........I'm at 302 days so I know how you are feeling. Maybe a bit worse actually.
Your congressman should be able to help to put on some pressure and get some info as to where your case stands.
Mine found out that my case is with an adjudicating officer awaiting a decision. Although I wanted him to force a quick approval, which maybe is impossible, this was more info than anyone has given to me thus far. He is starting the campaign of calling on my behalf each week in hopes that this pressure will push it along. I pray that it works.

Call them if you have not heard from them!!!!!! I have to do this a number of times each week because everytime I've been told that they will call me back they never do. So call! We pay taxes which pay these congressman, and congress gives money to USCIS, so they are there to work for you. I feel bad calling and calling, but its the only way I have found.
