Hello JV Petitioners.
I have a question on VSC processing. As you can see from my time lines, we recently filed the 2 petitions, and already the waiting is grueling, what I want to ask, does anyone out there think I may have a NOS#2 on any of the 2 petitions by September.? I have been apart from my husband since Dec. 2, 2007 and I know its truly not long, but to me and him its been a eternity. Im planning to leave U.S.A. Sept 5th for a trip to Paris, to see my husband and hopefully make a baby,for Im not spring chicken, Im 43, and I have a great careeer in the import section for over 15 years here in Houston, I have worked "with" not for USC and I know there is no hurry up in the world of DHS.
Is there a chance of any kind of a approval by September??? Otherwise, I feel I may give up my world here, and make a new world in Paris, which sounds good, but I do not speak the language, and I love my country. But my heart is elsewhere.

How are you guys finding out about your interview dates? Is the embassy e-mailing them to you. I'm doing a K-4 so I don't think the nvc sets the date since I had to send everything to the embassy in kingston. I've sent them two e-mails and I haven't gotten any response not even a "no you don't have a date yet" I know for hubby once they got the ds-230 I had a date within three weeks.

Well as far as the K3 vs CR1 visa....I think many people will tell you to go CR1 if you are at this stage now. The only problem is since the new fee hike back in July 2007, the K3 visa route didnt have an additional fee payment. So the idea is that once you submit that I-129F to apply for K3 you cannot go back to CR1. USCIS is supposed to forward only your K3 (I-129F) approved application and save your CR1 (I-130) application for when your husband arrives and decides to adjust status. I have heard that some people are still having both their I-130 processed at NVC while their K3 visa moves on to the Embassy.

I would strongly suggest you do the CR1 if still possible. You can call the NVC once you get a KNG# and ask if your CR1 visa is still being processed and that you want to abandon the K3. The reason I encourage the CR1 is because its not that far behind the K3 and in the end you will be DONE for 2 years. With the K3 you will have to file AOS within 90 days and that fee is $1010 or so! The CR1 has fees in total of $470 during the NVC process. Your K3 will also have fees during the NVC/Embassy stage...same as every other visa. That includes police certificate...medical...and another visa fee of $100. Its just a really expensive and time consuming visa and I estimate that you may be approved only 2 months earlier than the CR1 would....if that.

So if you want to rid yourself of immigration for awhile especially after your husband arrives CR1 is best. If 2 months means more to you then stay with the K3.

I can tell that your NOA2's came really late because you filed an I-129F a good 3 months after you filed your I-130. Filing for that K3 actually hurt you because it put you in the October priority dates instead of July. This is why I think your CR1 will be approved around the same time as your K3 making the K3 not the best choice right now.


I am so glad I came across this post.. it has answered so many ? for me.. I only have one more, since both our K3 & CR1 was approved for my hubby, but not for my step daughters( because I didn't send the Fee for their CR1 for them sad.gif didn't know I had to pay for all three) but they are approved for the K3.. what will be the cost once they all get here?


With the K-3 you have 2 years to file for the AOS not 90 days that's the K-1. Also with the K-3 you can file for the EAD so they can work, which as been a big help for us. Since he will be paying for his AOS. I believe the k-4 visas are the same to adjust as the k-3s $1010 and a little less for the second. But be careful as once he gets his green car, Kingston will not approve the k-4 visas for your stepdaughters. So if you want your step-daughters to come with him. The K-3/K-4 visa is best. if not go with the CR-1 for him and then he can file for them once he gets here.

Well on average the CR1 only takes 10-12 months. Many people were getting it done in 9-10 months before this fee hike, so it really isnt' that long. I estimate 10 months for my process...God willing. Some people take longer cause they had a few RFE's, didn't use shortcuts, abnormal security checks...etc etc. I on't understand how the K1 visas are so much faster on average....those seem to be the easiest way for fraud to happen and I would think they would be scrutinized more. I'm not against those that do K1's..let me just put that out there, cause people get sensitive...but i think about it and if a person wanted to move to the US for "false or wrong" pretinses the K1 is the EASIEST way to do it. All you have to do is propose to someone or get someone to propose to you. There's no other legal binding, no checks and balances, thats it. You could get here and flee if you wanted. Of course you'd be considered illegally here, but when has that stopped people before. We all know that you can live perfectly fine in this country without a valid visa. So for USCIS to approve those petitions faster is odd to me...I'd think it would be the other way around.



Hey Marlita...I hear you. It does seem like to me that there should not be as long a wait period as there is for a CR-1 versus the K-1. But that's a debate for another day. What I do hope is that the wait time for CR-1's could be cut down to 6-7 months. I know it's wishful thinking, but gosh...waiting for a whole year to be with your spouse is enough to drive anyone mad!! I was explaining this whole visa process & immigration thing to my co-workers the other day. They were all like, "Why doesn't your husband just come over? Doesn't he have a passport?" I was like YEAH, but it isn't that easy. I said to one of them that I understand why people do it illegally. It's easier, and in some cases, there seems to be LESS risk than doing it the right way!! Go figure! But I have to believe that God's will will be done, and until that day comes I will wait...


haha, my co-workers were saying the same thing, i think that's because American's are just used to getting up and going and assume the rest of the world can do the same thing.

Yeah, I was thinking August too. I hope. Our 1 year anniv is in Aug. So is the IIN number the same for both AOS fee, and IV fee? Once the online system is up...James Shortcuts will be almost obsolete. This will save so much time and money. I just send my forms priority and not overnight...they get there in 2 days.

Most all of this I already knew, except for Step 5...thats interesting. Anyway, I am a bit confused about the payment of the $1010. Is that the same amount of payment to lift conditions on all other visas too? And as far as K3 being faster thru Jamaica...usually not. I think K3 works for some African countries most and maybe a few others. Countries like those wait to give out interviews on immigrant visas almost 6 months AFTER completion at NVC...Jamaica doesnt wait that long (praise God), usually only 2-3max. So essentially the CR1 catches up to the K3 in the end.


K-3 doesn't have the intermediate steps like the AOS bill and things like that, so that is where it is quicker.

It is the K-1 for which you have to file the AOS within 90 days, NOT THE K-3, THE K-3 IS A TWO YEAR VISA. If you want you can do the K-3 and then file for the EADand get a SS#. Then your spouse can help with paying for the AOS. And it is a two year re-entry VISA so no Advance Parole is needed.

yes it is a bit redundant, because at the end you still have to pay the $1010 for things you don't need, but if done right, no two year green card is needed. i.e. by the time me and hubby file the AOS, we will be married for two years and he will get a 10 year green card, so no lifting of conditions.

When I first joined VJ, I read where you could pursue K-3 AND CR-1 at the same time, so technically hubby could have came up here on his k-3 and went back for his cr-1 interview.

Oh. But I guess this does not mean that NVC has received the file yet. I sure hope it is not 8 weeks.

The "bar code cover letter" is what you can print out after you've paid the invoice.  Yes you can work on the packages and simply add the bar code letter to the front before sending after your invoice is paid.  In fact, I recommend that you do it that way! 


I'm wondering if I can pay the visa fee now or do I have to wait for the embassy to have the case first. I am the petitioner. Do I have to send the barcode to my fiancé after payment? Does he need this for the interview or medical?

It probably depends on which Embassy you are at.

 

The Italian consulate in Naples says that all medical exams are to occur the day before the interview in Naples at one particular doctor's office.  I would double check with the embassy, plus the instructions should be in the packet 3 they will send you.

Hi-

I don't think you need to worry about renewing the visa. The carta blanca process shouldn't take too long once he gets the baja approved from his work. My fiance completed the carta blanca process in less than a month and that included extra time for processing because his father is a military person.

But in case it does take longer than the six months, I found this info on the US Interests Section website:

"Immigrant visas are generally valid for six (6) months from the date of issuance. Immigrant visas cannot be renewed. Under limited circumstances, it is sometimes possible to replace an immigrant visa when the applicant?s failure to travel was beyond their control. Waiting for a family member to receive a visa or parole is not considered beyond an applicant?s control."

And also:

"Immigrant visa holders who are unable to travel to the United States during the validity of their visa for reasons beyond their control should ask a family member or associate in the United States to contact our Visa Information and Appointment Scheduling Service at 1-866-374-1769 to schedule an interview appointment to be considered for a visa renewal. The applicant should take this step only when s/he is ready to travel to the United States."

I got my case number 7 business days after it arrived at the NVC

 

 

Look into members timelines with ur type of petition and that will give u a rough idea. good luck with your journey!
