K-3 Spouse Visa Process & ProceduresVSC anyone??
Yep I'm still waiting.
Thought maybe something was up after those 2 touches in the start of last week, but here I am still hanging on.

Anyone see any activity at VSC? approvals, touches, etc.??

Please send me some an approval this week. Please. Pretty please. I go to see my wife June 5 and I need a reason to drink way too much.

I'm dusting off my pitchfork and torch and heading up there Memorial Day weekend. Oh sure, I'll be shouting, "She's a witch!" just because that's what you do, but they'll know what I'm really going on about. wacko.gif

I'm afraid they won't even process the k3 at this point and will go ahead with the k1 delaying me even more!
As you can see by my timeline.......i f%$#ing filed in July and I'm really angry.

Apparently my case is with an adjudicator.....i have never received a RFE........and got touched 4-29 and 4-30 on the I130 but none on the I129F.

What the hell is going on there?!?!?!?!?!
I really wish somehow a suit could be filed against them, but they seem to be able to do whatever they want.
Lets see.

"WAIT" is a word I just can't deal with anymore.

I dont mean its the countrys fault , I mean it looks like Brazil is one of those countries that USCIS does not like to deal with for some reason, I have not seen any people from Brazil on here that had an easy case this year, in 2006 seems like everything was fine but not this year. I will be on 6 months in 10 more days, I dont even have a touch. Jon is at 10 months and you were at 8. It just doesnt seem like its the back log thats the problem, seems as if the country it self is a coutnry that the USCIS officers know will take more time than other pettitions so they put them off forever. Maybe its all in my head wacko.gif

I hope this is not true. Either way I'm here suffering and desperate. I really am not ready to move back to Brasil and my wife really wants to leave Brasil, but its time to start reconsidering our life's path. crying.gif unsure.gif

Either way thanks for sharing the info, looks like I might be moving soon, my wife refuses to wait over a year, she has asked me to move there if we get close to the 1 year mark, so if the next couple of months nothing happens looks like ill be going through Brazilian immigration.

I missed my first year anniversary crying.gif Missed birthdays, crying.gif etc. Don't be sad about missing 4th of July, its not as important as the previously mentioned.

I would love for my wife to be here in August, but lets see what happens here in the next week or so.

For applications arriving now, we're scheduling interviews for the end of july.

Hi everyone!

I woke up this mourning just to casually check my e-mail, not expecting anything from the USCIS. So I checked my e-mail and found, in the middle of alot of junk mail, two e-mails from CSC saying that my I-129F and I-130 have been APPROVED!

What happened last week was I called Senator John McCain's office in Tuscon, AZ, since I live in Arizona. I talked to his secretary, and gave her all the information about my case, and how I filed in September and was delayed. The secretary told me that they will do everything they can to help me. They contacted CSC last week, CSC replied them the next day and told the secretary to give them 30 to 45 days to make a disicion on my applications. So McCain's office called me and told me this and the next day I recieved a letter from them jsut stating in writing what they told me over the phone. I have to call them to update and thank them for their help. Now only after a fews days of them calling the CSC, I am approved. I should have called them earlier for help. Anyway now on to the NVC, God Willing!

Elijah

Congratulations Elijah!!!!!! Nice way to start a weekend.

Congrats Elijah! I was told the same thing from my congressman's office.(that within 30 days we should hear something).
My case is with an adjudicating officer is what they were told, so I hope to hear some good news this week. Please!!!!
Well I'm not gonna hold my breath on that. I've learned to not get my hopes up when it comes to dealing with USCIS.

Congrats again.

Alright then! Is anyone prepared to have a guess at when they think we may receive NOA-2????????
It would be interesting to see what some of you think. The VJ website gives a much better idea as to what is really going on than those USCIS processing dates. So I would really appreciate your input.

Vermont Service Center
I-130 - filed Sept 10th 2007
I-130 NOA-1 - Dec 27th 2007
I-129f NOA-1 - Jan 18th 2008

From what I can see from other approvals on this site we should be hearing something anytime now. But I am trying not to get my hopes up. I am thinking they will both get approved together, both got touched on 9th April.

Maybe we should start a sweepstake on approvals, then other forms of gambling, then drinking, more drinking! Anything to numb the pain of this load of old bollocks we are all going through right now! Trying to stay positive but hard when nothing continues to happen. Oh well - soon hopefully. It is good to hear from others in the same situation so we can all help each other a little bit.

Cheers
Dave

My good news(i hope it is) is that my congressman's office was told that my case is currently with an adjudicating officer.

she was OFFERING help and volunteering what she knew. she didnt owe any of us anything. She simply wanted all of us to feel the hope that it made her feel - so if you thought it was all "fluff" with no real "report" then you didnt have to post a response to her. I for one am thankful that she found hope, did her information give me hope-no...but I am glad it gave her hope and I am more than glad that she wanted us to feel that SAME hope. I didnt want to show how down i was to my husband bcz i knew he was feeling the same there without me. But however finally our case was approved when we least expected it. You wont believe exactly the day before it was approved husband called RFE line and we were told they will take 30-60 days to assign an officer to our case and that was the day i felt like i cant wait any longer.

But the next day it was approved. So pls dont rely on misinfo USCIS gives. Im sure you will hear of good news very soon.

Thankyou for your posting .... you certainly gave me a giggle today, it's been a while since I had one of those .... I too am a joking sort of person, but I'm sure everyone would agree, there are jokes ..... and then there are 'jokes'.

However, it really looks like you are a USCIS worker trying to calm down the masses by pretending to be one of the cases that actually went by the book .... lulling others into a false sense of security, helping them to ignore the prospect of their file being left in a dusty old box full of spiders and cockroaches etc.

If however, you are a real filer (which I doubt), congratulations on your approvals .... I can pretty much put money on the fact that the way you wrote your posting probably went down like a sh*t sandwich to most people on here (like you wanted) .... especially this part of your signature .....

"My satisfaction level for USCIS AAA
It appears everytime USCIS touches a file, some action is taken. In my case, approval notices are sent everytime they are touched. This leads me to conclude that if your petitions are touched without action, something is missing, something is wrong...something is causing delay. This also leads me to believe that too many touches without action is bad news"

K-3 Spouse Visa Process & ProceduresUSCIS nullify LIFE ACT
QUOTE (ninjarocket @ May 29 2008, 09:22 AM) <{POST_SNAPBACK}>
I was thinking of sending a letter to one of my senators incorporating the following text. I thought other applicants with unusually long I-130 wait times might be interested:

I'm a ......... and filed petitions for Conditional Residence (CR, case # ......, July 10, 2007) and spousal (K3, case # ......, Sept 06, 2007) visas last year to be reunited with my wife by allowing her entry to the US. Unfortunately, we have been subjected to unusually long wait times compared both to other applicants (e.g. those registered at visajourney.com) and to the published USCIS processing times (i.e. on the USCIS website). My long wait is caused entirely by a recent USCIS procedural change in which the department of homeland security (i.e. USCIS) decided to nullify certain benefits of the immigration law introduced in the 2000 LIFE ACT.

To reunite families of US citizens separated by the long wait times encountered with their I-130 CR (alien spouse) visa petitions, a new visa category (K3) was introduced as part of the LIFE ACT, signed into law by the president in December 2000. The intended purpose of the K3 visa (as outlined in the LIFE ACT) is to facilitate family reunion by enabling the faster entry into the US of a spouse (and/or children) while their I-130 petition awaits adjudication. As stated in the LIFE ACT, the K3 visa is not intended to be dependent on the prior approval of a I-130 petition (which can sometimes take a year or more) as that defeats its original intended purpose. Recently, however, USCIS began circumventing the LIFE ACT by changing the processing procedure. In contradiction to the requirements of the LIFE ACT, K3 visas are now conditional upon the prior approval of an I-130 CR. While this matters little to the vast majority of I-130 petitions that are approved in just a few months, those applicants with very long I-130 wait times (such as myself) are now completely disenfranchised from their rights to the benefits introduced in the 2000 LIFE ACT.

well i'm right here with you.
almost the same timeline as you.
this is an outrage, although I don't know how much of a difference a letter such as this will do.
the facts stated are very true, but I'm convinced that USCIS and DHS care nothing for us or our families.
its just a business.
i've contacted congressman, senator, and vice president and none of this is making my approval come any quicker.
soooooo.......
we wait as usual.
I feel like i've done everything I can do, all for nothing???

I hope we(meaning you, me, and anyone waiting this long) receive an approval soon

bless

yea its still on the desk of the officer awaiting his decision. #######?!?!?!?!
my congressman's office called today only to get the same dumb f#$@ing answer.
he will call again thursday and won't stop until we are approved.
this guy is great as far as calling and putting on some pressure, but is it actually working????

i asked how long it could sit with an officer, and he said not too long.(from his previous experience)
how long is not too long??

IT'S ALREADY BEEN TOOOOOOOOOOOOOOOOOOOOOOOOO LONG.

Gogo.......if i didn't spend 3500 already on a no good lawyer, maybe i would follow your lead.
Unfortunately I can't afford any more legal assistance, nor do I trust any of them.
I hope you have some success with yours.

Did you ever receive a letter saying that you would receive a decision within 45-60 days???

I received one on April 14th, and today my AMAZING lawyer said that she received an email saying the same thing.
Little does she know that I already knew that info long before she did. I'm not speaking with her or returning her emails. And she has no concern whatsoever. Interesting huh?

Well I'm only asking if you received one to know if it was a lie or not.

Have a good day.

302 days since my NOA1 of I130. 266 for the I129F. I'm so sad and angry.
This is really unacceptable. What more can I do? other than wait.
My lawyer has no answers. Each time my congressman calls, they say it is with an officer who still needs to make a decision.(which i guess is good)
How f$%#ing long does it take to make a decision, especially for those couples waiting this long.

I'm saddened even more when I'm seeing all of these VJ members being approved when they filed LONG after me.
I guess I should be happy for you guys, which I am, but it hurts. It really hurts.
If there was a problem with something I would have received an RFE, and I have received none.

Sorry it's my last complaining i will do this week. More to come i'm sure in the next week.

What do you know about what factors in your case are complicating the decision?

Thank you all for the support and ideas.
I'm going to pursue the ombudsman idea and VP letter on Monday.

I really appreciate all of you.
Thanks.

hi jonbless
i too feel so sad and so bad.. still no approval... for almost 10 months!!!
have you made any service request and if you did, what did they tell you!!
we plan to do that this comings weeks if we dont have any good result by then...
i too don't know what more we can do...
God help us all...

Service requests have been made. I received a letter in response to the service request made on the 129F on April 14th which said......

"Your case is currently under review. You should receive a decision or notice of other action within 60 days of the date of this letter"

Like I said in a previous post.....the word "should" is probably their scapegoat in the case that I don't receive a decision within 60 days.

My congressman here in Brooklyn has also sent a letter requesting action to be taken on my petition. The reply they received to this letter was that my case is currently with an adjudicating officer. A follow up call was made today, when he was told that the officer still needs to make a decision.

Pushbrk..............I do not know anything about the factors in my case which are complicating the decision?
I have not been told anything more.

Also my senator (hillary clinton) has yet to reply to me. They told me they would contact me when they send a letter to USCIS. I called her office again today only to get the answering machine which I always get. Left a message and will wait to hear from them.

I basically feel like I've done everything I can do and that I'm being punished for doing the right thing.
I now consider leaving this country once again in order to be with my wife. Not the best option, but we are both very desperate.

Bless

send a letter to the ombudsman office complaining about the delay
send a fax to the vice president, personally can vouch it did work for me though it took a month but i reacted as soon as my dates were current. VP office is a gem compared to the senators i have dealth with. most senators i spoke to were clueless about immigrant petition didn't even know what K3 visa was and kept questioning me why i filed a fiance visa when i'm married. anyways

goto the ombudsman site and download the form and send it by fedex to the address on teh website not to the address on the form, it makes a huge difference i.e. the inclusion of Via Courier Service:
Citizenship and Immigration Services Ombudsman
Attention: Case Problems
Department of Homeland Security
245 Murray Lane
Mail Stop 1225
Washington, D.C. 20528-1225

http://www.dhs.gov/x...dhsform7001.pdf

Send a letter to the Vice President requesting his help with your case.

best wishes
M

My question was "What do you know about the factors in your case......?" not what has USCIS told you?

For instance, some people are aware of certain red flags that might cause delays. Sometimes you get stuck in name checks because you formerly had a security clearance or worked in sensitive security areas. Sometimes its an issue of a common name or something amiss in documentation.

Usually people with cases hung up, have some idea why that might be. Do you?

I have no idea of what it might be. None of the mentioned above seem to apply to me.

Same here, 280 days since NOA1 ...the hubby called but the rep who answered seems to be annoyed that we called even just to check on what's happening. They said just to wait.

Maybe someone needs to start a new thread for people waiting more than 250 days?
