If you look up the step by step guide to remove conditions it says that you should not submit evidences you have already submitted in your first application. The documents should cover the period from the date you received the conditional green card to the filing of this petition.

I was finally approved!!!

 

For some reason we had an interview to remove the conditions on the 3.5.14. It was the same interview as for the first one we had for the conditional GC. 

Today (3.12.14) we got the approval letter!! Can't believe it really happened!

From all those cases who got transferred to a LOCAL office, were there any who got an interview? Or any who got approved with no issues?  

My status states "The CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED was transferred(09/17/2013)and is now being processed at a USCIS office." 

It doesn't state which office it was transferred to, so I'm confused. Any idea on where it was transferred to?

CanadaNever Recieved Packet 4 now showing no appointments mtrl

I think I'm in the same boat with you as we were notified September 30th of our appointment and given packet 3 before that via email.  I believe our "packet 4" including appointment letter was an e-mail from them telling us our medical and interview dates (october 16th).  The problem is I want to confirm this as they never mentioned packet 4.  Seems like we'll just need to print off the e-mail and bring it to the consulate.

Just found information on the USCIS site that speaks to child entering the US within 6 months even thought other sections speak to 90 days?  which is it really?  I need clarity as i plan to POE on as CR1 on August 6 and travel back for my daughter in December.

it might help to read a piece of information on the uscis site that speaks to being ale to add them to your wife petition if they came within 6 of your wife.  Updated date on it is more current then the info on the site that refers to 90 days.

'Conditional Residence and Removing Conditions

If you are petitioning for a step-child and have not been married to the child?s biological parent for 2 years at the time the child receives permanent residence, the child will be granted conditional permanent resident (CPR) status. Form I-751, Petition to Remove the Conditions on Residence is used to remove the conditional basis of permanent residence. (Note that Form I-90, Application to Replace Permanent Resident Card is NOT used for this purpose.)

If your spouse and child became CPRs at the same time or within 6 months, the child can be included in your spouse?s petition. If the child became a permanent resident more than 6 months after your spouse, or the child was granted CPR status independently of your spouse, the child will need to file a separate Form I-751.

Form I-751 must be filed within the 90-day period prior to the expiration date on the conditional resident card. If you fail to file during this time, your spouse and/or your child?s status will be terminated and they may be subject to removal from the United States. We did not get a notice for BIO either, I called Tier 2 ISO, she stated BIO current due to I 90 in September of 2012, (they are good for 15 months). She did not mention a refund, so the only negative is a non track-able receipt number. Oh yea the waiting.

I think you should be able to call them again and get the valid reciept number...? I am in the same boat...my 30 days is up in a few days and I will call to find out what happened to our FP appointment letter...we had an i90 FP done a few months ago as well.

Thanks Christi85 for your suggestion, we'll keep our progress posted but it does look like we'll have to get his passport stamped near the expiration date.

I have heard of people getting their BIO letters before NOA letter in other forums...Give it another week.

Hi everyone,

 

My husband became eligible to apply for ROC on 4/25/2013 and here is our current progress.

We have mailed out our I - 751 packet on 4/27 which arrived at the Vermont Service Center on 4/29. Our check cleared on 5/10 and I-797C NOA for a biometrics appointment for 6/12 arrived today (notice date 5/15).

 

We never received our first NOA letter and would like to find out if anyone has suggestions on how to recover that first NOA. Planning on calling the customer center on Monday but wasn't sure what else to do. 

 

 

 

ROC timeline

 

Eligible to submit I - 751 on 4/25/2013 (GC expiring on 7/25/2013)

Mailed out I-751 on 4/27/13

i-751 arrived at Vermont Center on 4/29/13

Check cleared on 5/10/13

Biometrics appointment letter received on 5/18/13

Biometrics appointment date 6/12/13

 

 

You still have time before they even stamp the passport.  If you call prior to 30 days, they just ask you to wait 30 days and call them again...I called them with regard to my BIO appointment and the fact that I hadn't received the letter after 27 days, and they told me to wait 30 days.  I waited 30 days and called again....was eventually told that no BIO appointment needed due to an earlier application that reguired BIO last summer!

Hey everyone

 

I had a quick question. My BIO appointment is set for May 29th at 11:00 am. Do you think it'd be possible for me to come in early? lets say 9 am? or so?

Most centers don't care if you go early, even a few days earlier, but I've heard that some centers are picky and won't let you enter the facility until the correct time.  Getting there at 9 a.m. for an 11 a.m. should not be problem....Just in case, have a legitimate reason handy!  :)

Quick quesiton:

The last letter of my name is spelled wrong in the biometric appt letter that I received. My name was spelled correctly on the NOA letter though. So, I am not sure if I need to call them to correct the name or if I should just let them know when I go for the bio appt? I am assuming they can correct the name there. If I have to call any number, could u please provide the number which you guys call?

CSC has never been quicker for us. When we were going through the K-1 process it was insanely behind VSC. Now it's time for ROC and what do you know, CSC just arbitrarily stops working again. mad.gif

According to uscis.gov; CSC average processing time for i-751 is 7 months vs. 7.6 months for VSC

Ugh, stupid California Service Center! I really wish I lived in the VSC range.

For the longest time, CSC was faster by 1 month, on averge from start to finish, than VSC; but I guess they slowed down...

You are supposed to get a letter with your appointment date and time in it.  The letter usually comes 1-4 weeks (or longer) after NOA1 arrives...

Forgive me if I missed this but the bio letter is referenced. Does the USCIC give you the appointment date or just tell you that you are clear to make an appointment?

Thank you shezam and vitukas for your replies!!!! I just talked to the post office guy and he said there's nothing he could do about getting info about my package :-(. So yes, I could only wait now... I jusy hope the check will be cashed in before May 12 so I can relax a bit. I wish both of you the best with your applications as well.

I also want to ask something. Together with the form i751, I had the bank statements, tax paperwork of the last 2 years, an email saying my husband add me as a beneficiary to his life insurance, credit card bill with both our name, water bill, car insurance With both our name, joint saving account, and like 80-100 pictures. Do you think thats enough evidence for th3le Uscis?


To me it looks like you have good deal of evidence...It's funny how it works, sometimes you can over due it and send in 150 pages and get an RFE and then some people send a 20 page package and had no issues at all!

I just sent my I751 application last week Tuesday and it were supposed to be delivered the next day. But I have lost my receipt with tracking number sad.png So I cant be sure that the application is delivered. And the check hasn't been cashed yet. My GC is going to expire May 12. What should I do no now...? I probably wont be able to receive my NOA before May 12 . And I wont be able to make sure that the application has beeb delivered. Should I resend my application..?



Check with Post Office and see where that goes, but do NOT resend your application.  99% chance it got there; just give it a couple of more weeks...hang in there!

And the same happened to us as well...We moved in August 2012 and filled the on line change of address....They sent us the reminder in February 2013 to our old address! We did get our NOA1 at the new address on April 6, 2013 and just waaaaaiting to get the Bio letter!

I know you are Canadian, and I am sorry to correct you, but: Yes, you can use a GC to enter Canada (along with your passport, of course.)

 



You didn?t say anything about having a valid passport with you (on your original post) for when you entered and you asked about a green card only.

 

Canada always requires a Passport or an Enhanced Driver?s Licence to enter by land, sea or air.  The Green Card is not in place of a Passport, just the need for a Visa.

 

So does the US. So do I would say all the countries in the world. It was implied that I will have my passport. If I didn't have my passport... my bigger worry would be getting back in to the US.

But you didn't prove me wrong, you cannot enter with just a green card and I answered. You never said you planned to use a passport. You asked about an expired green card and NOA and I answered no you cannot use those to enter. Which is correct, you must have a valid passport. With your green card the passport is what allows you in with the proof of US residency.

 

Did I not mention the option of getting visa? Did I say something about a dog eating my passport? Of course I will have my passport with me! I travel abroad and I know you need a passport to enter the US and any other country in the world.

 

You didn't really answer my main issue... thanks for your insight though.

You asked if you can use your green card to enter, you cannot use just a green card. You never asked about using a passport.

 

I proved you wrong and now you are just being belligerent.

You cannot use a GC to enter Canada. It is ONLY for entering the USA.

This really mostly applies to people like me who, without their GC, would need a visa otherwise.

So, I will be taking a cruise soon that will end in Canada. I have my I-751 NOA in hand, and by the time of my trip my GC will be expired. I know the US customs should not have a problem with accepting my expired GC and my NOA, but I am a bit worried about entry in to Canada.

 

I can get a visa-free entry in to Canada because of GC, but otherwise I would need a visa. Do you guys think that the Canadians are fairly aware (and may be their systems are linked with the USCIS?) to verify that my GC was extended by 1 year? Should I get a visa just in case?

Yeah I just checked the mail today and the RFE was in the mail.. The date one the letter was 7/29 though.. I will post when I send the RFE response..

Good luck. We sent about 10 bank statements (full statements, color copies) from different months over the course of the 2 year period.

FYI: I put in my receipt number on the USCIS site and looks like they already mailed my new card and it should be delivered to me on Saturday August 3rd via Priority mail.

 

So total time from day they received it to day I will get my card will be exactly 110 days.

 

Also, I didn't do an early bio. I never thought it made a difference to do an early bio... and this confirms it.

Also, I agree with the earlier poster about tracking when NOA is received. It kinda freaked me out looking at all the trackers online and noticing everyone getting theirs in a couple of days where as I hadn't received mine in like almost two weeks. So we should track when the NOA is received in addition to when it was generated.
