I've been in regular contact with the Immigration Visa Department at the U.S. Consulate in Naples via email and I recently asked them about the supporting documentation.

 

Here is what I gathered:

  • Bank statements showing checking and savings account deposits for the past year, the day I opened my account, my current balance, my average 12 month balance.
  • Official letter from my employer on company letterhead stating that I am employed full-time and what my annual salary is and signed by my boss.

The IV Department said that I also need to provide my tax returns.  My company gave me my recent w2.

 

So that is sufficient according to Naples.

It could be safe to say that if the country isn't covered under the Visa Waiver Program it is considered a high fraud country.  Although I'm sure there are different levels of fraud.

I lost almost all of my paperwork in a flood not too long ago. Luckily I scan everything or keep digital copies, but still. :c I had to go get copies of my birth certificate, divorce decree, and custody arrangements when filing the I-129F. :c

 

I only have digital copies of things, so that's why I'm asking.

 

Since the Naples Consulate asked for my tax returns I'm just going to give them the entire packet from H&R labelled Income Tax Returns.

 

I'm pretty sure you would need to have paper copies of the returns.  So I would go ahead and have them printed off so you can turn them in with your i-134.

I've been in direct contact with the U.S. Embassy in Naples IV Division and even though I said I have my w-2's they still asked for tax returns as well.

 

I also have the H&R Block documents for this past years filing, but in paper form... no0pb.gif

 

Ok I'm listing everything I have, except the tax returns but I will have those as soon as I narrow down what exactly to send.

 

  • Checking and Savings account statements from bank with "official" stamp and signature of an officer (shows date account opened, current balance, average 12 month balance and deposit history)
  • Letter of employment from employer on official letterhead signed.  States my salary and that it is a full-time position.
  • w-2 from current employer

U.S. Embassy Naples still asked that I provide tax returns when the i-134 is submitted.

Sorry to dig up an old topic, but I was told to provide my tax returns in addition to the long list of other documents I have already (bank statements, letters from employer).

 

When they ask for tax returns they simply want the 1040 form and not the entire package of documents my tax people gave me after filing this year, correct?

I am very familiar with the concept but it depends case by case.  If you met your fiance 6 months ago and are getting married now, you better give all the information in the world because they're going to be looking long and hard at your application.

 

I get my information from USCIS tier 2 officers and the IV department at the embassy I am applying at.  I try not to rely on what people have written here via their experiences because it is always completely different.

I didn't frontload the petition and when I last spoke with a tier 2 officer, I asked her about it and she said it isn't necessary.  If you have quality basic information that they ask for you should be good.

Follow the instructions given by USCIS and Department of State and you'll be fine.  Given, Europeans tend to have it easier than other nationalities wishing to marry Americans.

 

From what I can remember when I sent my application at the beginning of May we sent:

  • Two letters of intent to marry, both signed and dated and included how we met and even our desired wedding date in the letters.
  • Photos of our 7 years worth of passport stamps of the visits.
  • A letter stating that my fiance was in the U.S. visiting me at the time we applied but had no i94 number because she entered on the VWP.
  • 60 photos of us, time stamped since 2007 until now (we went a little overboard on it, USCIS and the Embassy agreed but I think it'll get the message across.)

Ect ect ect,  Just follow the instructions and make sure you fill out the paperwork correctly and you'll be fine. :)

My wife's visa has been pending since july 12th 2007.

Contacted congressman, vice president, senators, and a BAD lawyer.

My case is with and adjudicating officer and has been for one month or so. This is all the info I have been given. crying.gif

I can relate with you completely. Stress on marriage, emotions, anger, sadness, etc.
Very soon is all that anyone can say to me. But how soon?
It seems like one year means "soon" for a F'd up beaurocratic "system?"

My fiance has a degree in microbiology. Should he answer "yes" and then just write university degree in microbiology?

My fiance had his interview in Havana on June 21 (I went with him.) The officer really scrutinized our case as we both have applied for K-1 visas before (mine was in 2004 and his ex-girlfriend had filed a 129-F but never completed the K-1 process.) However, we were told at the end of the interview that his visa was approved. They requested that he bring them a copy of his CV, and that once they received that, the visa should be ready within a week. He asked the officer if it mattered that the CV were in English and Spanish and she said that either was fine. That same afternoon, he delivered his CV in Spanish to the Interests Section, but was called soon after to say that it needed to be in English. I delivered it the next day and was told that the it would now take up to 2 months to review his case. My fiance was not deterred and since the woman who interviewed us had told him to come back in a week, he went today to inquire about the status of his visa. He was told that our case was being investigated and that they had to wait for additional approval from DOS before issuing the visa, which could take 6 months. They said that he should check back in 10 days.

I am feeling so discouraged now. I sent a message to someone I know at DOS to see if there is anything we can do to expedite the process. I am not sure if our case has been flagged because of our prior applications or because of his occupation- he is a microbiologist. It seems that only people of certain professions need to submit their CVs.

If anyone is in the same boat, I would love to hear about it.

What evidence did you submit? I submitted photos, travel invoices, chat logs, email, phone bills, letters, etc. if you have those, that should suffice. In the meantime, you should also begin to collect more evidence. If your application goes so far as they grant you an interview, at the time of the interview, you will need to submit more evidence. If you travel to Cuba before then, make sure you take a ton of photos to document your trip. Good luck!

I never received the confirmation letter. It does make you super nervous the day of the interview as they start calling names and assigning numbers- we were at the end of the list! But we had no problems. If you can get a copy, great. If not, don't worry too much about it.

The US Interests Section in Cuba gives you a sealed envelope which YOU are NOT to open EVER (and the medical is in there)...It's opened by the officer at point of entry (POE) into the US, but they won't likely want to make copies for you (even if you remember to ask with all the excitement).

Not sure of your timeframe, but maybe you could still ask the doctor in Cuba for a copy before you leave. It seems ridiculous, because they already have a copy of your medical exam from that envelope at POE, but the AOS application requests a copy too. You might have to go to a civil surgeon here, and have the whole medical done again before you can submit AOS papers.

I don't want to be a "downer", but even the VJ guides suggest making copies of the Medical for AOS. Try getting a copy from the issuing hospital if at all possible.

One other thing...ja ja. Be sure to make copies for yourself of all his medical stuff before going to the interview. They will take it at the US Interests Section, but you need copies for Adjustment of Status (AOS).

I don't think the embassy is probably aware of the problem since most people try to find a solution on their own. I think each municipality has a designated hospital-- my fiance lives in Santo Suarez and his hospital was really backed up. Our interview was in June and his appointment was for July (we paid to speed things along). Supposedly, other municipalities had shorter waiting times. He can try to see if he can get it done somewhere else, but I am sure he will have to pay something to do so.

In Cuba- it's such a rip-off. The people who work in the hospitals tell you that so that they can sell you earlier appointments. You have two choices: 1) you can tell your fiance to talk to the person who schedules the appointment and pay $80-100 CUC to get an earlier appointment. BUT make sure that he actually gets the exam done. Or 2) you can go to your interview without the medical forms and hand them in later. However, you will have to wait for the visa.

I don't know-- since the medical exam is only 2 weeks after your interview date, maybe it won't be so bad to wait. I don't know if it's worth it to try and pay for an earlier appointment.

I still think you can and should apply for the K-1 visa (if you are inclined to get married now, then do so and go the CR1 route.) If you have doubts you can try calling USCIS to explain the situation and see what they say. You can also try contacting the ex to see where in the process they were. In any case, I don't think her previous application will jeopardize your application now. As I said before, it will complicate things a little-- longer than normal processing times and greater scrutiny-- but I don't think that should preclude you from trying and suceeding.

Hi- I don't think it will be too much of a problem but it will most likely delay the process. My fiance had a similar situation- a previous girlfriend had filed a petition on his behalf but broke off the engagement before the process was finalized. He has no idea where in the process they were as he was never contacted by the embassy. In any case, the previous petition delayed our NOA2-- it took 6 months and in our interview they asked us a lot of questions. They will definitely question her intentions. But that being said, I think you will be fine. Just expect a possible longer than expected wait for approvals and make sure to have a lot of evidence supporting your relationship. Good luck!

If you scheduled the interview you don't need to worry. It neans the case is already there or arriving shortly. Obviously, it will be there before your interview in December.

If your fiance hasn't done so already, he needs to pick up the packet and get moving on all he needs to do before the interview- the chequeo medico is the biggest headache. Good luck!

Yes- according to the new immigration laws in Cuba, starting tomorrow, he should not need the permiso de salida to leave the country. However, who knows how everything will play out especially with regards to immigrating to the U.S.

In any case, according to the US Interests Section website:

"I was unable to travel to the United States during the validity of my visa. Can I get an extension?
No. Fiancé(e) visa holders who are unable to travel to the United States during the validity of their visa for reasons beyond their control should ask a family member or associate in the United States to contact our Visa Information and Appointment Scheduling Service at 1-866-374-1769 to schedule an interview appointment to be considered for a visa renewal. The beneficiary should take this step only when s/he is ready to travel to the United States."

And:

"What documentation do I need to bring to be considered for a visa renewal?
Beneficiaries are required to bring (1) recent passport style photograph, current medical examination results and current police records (for applicants 16 years of age or older), valid passport, a nonrefundable visa fee (please see our chart under consular fees) and the travel packet issued to the applicant by the U.S. Interests Section. In addition, beneficiaries will need to demonstrate that they were unable to travel during the validity of their visa for reasons beyond their control and evidence that demonstrates that the bona fides of their relationship."

Hi-

You don't need the appointment letter. I know it would give you peace of mind to have it but don't worry. Just show up to the park on the date you were told. We showed up at like 5:30 AM. They start assigning numbers at around 5:45. The K-1 visas were the last so we were really sweating but everything worked out!

We included a lot of pictures of different trips I took to see my faincee in Spain, (Not sure you need that many) but we included at least some from each trip. In the back of the picture we put the same exact thing you did , Thats it , we did not attach any additional papers to the pics. Just make sure you include the cover letter and follow everything else you need to include as the advice here that is what we did.... Let me know any other questions you may have :) Good Luck!
