Well, I can see why they won't be replying today due to the fact that it is Lail-a-tul qadar...night of 26th ramadan and the 27th ramadan here in Paki.....then probably a really long wait till they can reply to anyone because of the weekend plus 3 days of Eid....I believe the embassy is closed on all 3 days. YIKES! But oh well.....I'll just have to wait. *shrugs*

It feels like I'm already in AP....and dealing with the oh so dead DOS......I shouldn't have to feel like that so soon.....it's not fair! We haven't even had our interview yet.....

I understand what your talking about!!! I emailed ISL to reschedule an earlier interview for my husband and they emailed me back and told me that my case was not in ISL, so i got upset and called NVC and they said they didn't send my case to ISL yet I asked them when??? NVC said they don't know when they are sending it to ISL and told me call back in a couple of weeks??? I got soo madd this is not fair so I emailed NVC and they didn't reply to me.

My husband's interview is OCT 28, 2009 and I wanted to spend my birthday with him oct 22 but if NVC doesn't hurry up and send my case to ISL then we won't be able to get a sooner interview date....

I called ISL and some one answered and they transfered me to an auto recording i got so madd just hung up so I emailed ISL and they acutally replied to me if you want I will give u 3 email addresses for ISL to make sure they reply to you.....



You'd think they would have a little bit more sense than to just give us that sh1tty answer.....not forwarded...blah blah. I mean they know the case WILL BE forwarded, they might as well just reschedule and get us off their backs!!!!!!!

I'm sick of not being able to get a hold of anyone on the phone or get any replies....if you could give me those other email address's I would be really appreciative! happy.gif

Got my interview date yesterday by email.........October 16 at 8:00am, although I will be calling the embassy to see if they will reschedule me any sooner...what with the delivery being so close by and having to travel by plane and whatnot..... have a few questions for you guys though...by what time do you guys think Haseeb and I should go to the embassy in ISL? This is the very first time either of us will be traveling to the islamabad embassy (I know that's sorta sad, even though I'm a usc I usually get my dad to deal with them though..lol). Any tips on where we should go, when to get their and how to get wherever(like whats-up with the bus that takes you to the embassy???? I don't get it)....completely clueless here so any suggestions......would be great! biggrin.gif

The main difference between the two would have to be the green card process/permanent resident process. W/ K-3 basically you do not receive the green card/permanent residency while in Pakistan right before you plan to travel to u.s or during or immediately after POE like you do with the R1's (I believe that is the case with both k-1 and k-3....plz let me know if I am mixing the two up, it's been a while since I had done the research). In fact with the K-3 you initially just get the visa to travel to the u.s but will have to begin your permanent residency procedure from then onwards, and the main problem w/ that is that your visa could very well expire before your green card process would complete....meaning you would have to leave the states and go back to pakistan and get a new visa to come back...if that were to happen, and you hadn't applied for a visa extension or whatever it is you would do in that case. That is mainly why people choose to go the R1 way, because the entire procedure.....meaning visa and permanent residency become one and the same....and no more extra time wasted or worries spent over it. Less time to wait and fret.

Other reasons would include the extra expenses of the green card and the entire process of mailing to the nvc again (just like during the visa process). With the R1 visa's, the cost is basically included with the visa fees..............if I remember correctly, you have to spend more money with the K visa categories once you are in the U.S because you will be taking the green card route completely separately.
Not to mention the extra time it would take...for example if your visa were to expire before you were to receive your green card you would have to end up going back to your country...(buying the tickets) and then most likely re-apply or extend your visa and then come back. Other than that.....some of us just don't like the idea of still having something bothering us like having to go through another long and difficult procedure with the nvc or consulates and whatnot after all this visa mess....we'd rather just have our SO's home with us safe and sound.....and no worries on what will have to happen next to keep them there...as permanent residents. For the R1 people....next (major) step after POE.....would be citizenship............rather than permanent residency, so you see why R1 is preferred lately over the K visas.....although many people still believe R1 is slower and K's are quicker although they may be more expensive.

A few years back actually, the truth was that the R1 visas DID in fact take MUCH longer than they do nowadays (yet we still complain...lol) Actually, 5-6 years was the average, I believe...and I've even heard upto 10 years in some rare cases!!! That is why they decided to come out with the K visas which made it so a U.S resident or citizen could be with their loved one quite a bit sooner....back then the K visas took round about 2 years as compared to the lengthy upto 5-6 years for R1s. They were somewhat more expensive, the K visas. But, they were much quicker as you can see because the nvc and consulates were not required to deal with permanent residency with the K visas....they were more so like visiting visas really. But recently...in fact not SO recently, but recently enough that is...the R1 visas, though cheaper and known as much more lengthy....have caught up. Leaving only an average difference of......maybe about 2 weeks to a month...that's all. So.....really, R1 and K visas are different yes.....but if you look at it closely, the only REAL difference is NOT that K's are quicker or easier......BUT it is that K is more expensive in the long run...not to mention the heartache of still having to go through the hell of waiting for nvc and whatnot after you have your loved one with you...and the fear of having to ween yourself from them if need be...if visa were to expire.

So yeh......those are the main differences that affected my decision when deciding on which visa to apply for for my Haseeb. I knew I wanted to be with him ASAP...and money wasn't a problem either....but I also knew I didn't think it was rational to put myself and him through more misery with this process after the POE. Now, inshallah after our POE the only misery we may have to deal with may be.....waiting for his SSN and drivers license and then 5 years down the road we can start thinking about citizenship too if we like. happy.gif

After reading everything in this topic I'm officially TERRIFIED! I am trying to prepare myself for AP as best as I can...but honestly if we get put on it(khuda na kare) then I don't know what to do. First things first I'm 13 weeks pregnant.....meaning that if we get a case complete in late Aug-Sep...I'd be lucky....then afterwards of that Interview would most likely be scheduled in Oct.....thats 6 months expecting for me....then if (khuda na khasta) we get put on AP (allah na kare) thats a whole nother 5-6 months....and I can't have the baby here in Pakistan because that would cause a hell of alot of issues incl. the fact that the baby wouldn't be citizen....and I've been planning on having the baby in the U.S as it is best for the baby ofcourse.....plus I've seen the medical procedures they have here in Pakistan for prenatal, delivery, and after care and I really really do not think it would be a good idea for me to stay here and have the baby....even the best of best hospitals here, are just plane sad when it comes to their maternity wards.

And it's not like I can go to the U.S to have my baby because I would have no one to stay with.....my father certainly wouldn't like keeping me at his place....even though my mother couldn't be any happier if I were to stay with her throughout my entire pregnancy and later even.....but honestly that's impossible because of my father. So....I would have no place to go...or stay...or anyone to help me out during the last stages of my pregnancy.

I am just praying and praying that Allah and our Mola would have mercy on us......I have gone through enough hell in my life to just be with my husband.....and now it's just painfully ironic that I may have to do the same just to go back to the U.S to be away from him for my babies sake. That's so depressing for me.

My husbands name is Syed Haseeb Akhtar Gillani....his fathers (don't know if it matters) is Syed Akhtar Hussain Gillani.....yeah, thats like probably half a red flag...lol, his fathers name.But IDK if they care about that. Other than that, my husband's age is 21 and.....my brain tells me the younger the worse because most terrorist are usually younger brainwashed teens and barely adults. So thats one creepy thought. Other than that there is nothing about my husband that could strike red flags....but then again with the ISL embassy......I don't even think they care when they put ppl on AP.

I've been thinking about sending some sort of expedite letter....but honestly, if AP is such a must-have-must-do sort of thing....what difference will me telling some supervisor that I'm about to have a baby going to make really? Plus...I have no clue who or how I would even send the expedite letter.....I can even send plenty of doctors notes and ultrasounds and whatever else tests they would need.....but I just get the feeling that my expedite request would just be floating around the embassy gathering dust.

Something that may or may not cause AP does worry me quite a bit......should I or should I not go to the Interview with my husband??? Loads of people are telling me I shouldn't because the embassy would prefer it if I were in the U.S "waiting" for my husband...rather than being here with him already and pregnant. Most people I've asked say that I should show it as if I am still living in the states and need him to come and support my preggo self blah blah.....I REALLY REALLY dislike this idea...as I want to be at the interview with my hubby and I want to prove that we are a REAL loving married couple...about to increase the population of the world soon by 1.lol. I want to be there so they can see how much we support and care for eachother, and I also don't want to lie like everyone here in Paki wants me to. IDK if it would cause any issues but tons of pakistani people that have gone through immigration procedures with ISL embassy are telling me the same that since I had no actual job in the U.S and only sometimes freelanced...sewing and tailoring...and mostly only made less than $500 a year in cash nonetheless...and can't provide any taxes to support that I am somewhat self employed/freelancing or whatever.....that this will probably cause AP on our case if I show up to the interview and prove that I am not in the states actually working.....this doesn't make much sense to me but most people I've talked to here in Paki about my situation say the same old thing.

But I also think that since my mother is joint sponsoring my husband....and since I provided a letter of exclusion from taxes since I don't obviously make enough to be required to file them...that everything should be fine on my side. And that if I do show up at the interview all pregnant...maybe that might make all the difference in their decision on whether or not they feel like putting us on AP?

What do you guys all think.......should I go...or no?

Another thing: When you send petitioner's proof of US Citizenship you can either send the certified birth certificate or copy of non-expired US passport. You don't need to send both, just send either one. Also please see a minor change in the bold letters in your sample letter. Hope my reply is helpful to you.


Do we still need to provide beneficiary's/relatives birth cert. or passport copy? I read in the guides that this is not required any more?

It says this on my husbands passport/visa....does this mean that my husband only has a year since the POE date to file unlike the 2 years mentioned in the wiki? My husbands GC (resident card) expires on Nov 27th, 2011....shouldn't this be the date I should count back 90 days from to file?

Also, what is AOS interview again....I can't seem to remember exactly...was our adjustment of status interview done when we were interviewed by the guy at the JFK airport? Is this something we have to do still....I'm sorry I'm so confused, but it has been a long while since I've read up on this stuff.

What is best, should I refer to the expire date on my husbands GC (resident card) regarding filing for I-751 or should I try to figure it out according to the info on his visa (which is confusing me beyond my limits right now)?

Well, Ive read all of the guides on both types of visas and pretty much understand the differences. One is a immigrant visa and one is not, one will get my spouse here with green card in hand and the other one will make him wait a few months to get it after we file to adjust status. One will permit him to work as soon as he arrives, and one will require him to get his ssn and his ead first, which may take a couple months or more. One is generally a bit slower....I'd say round-about CR1= Total of 1 and half years .vs. K3= Total of 7-9 months, which makes k3 obviously the quicker one, am I right?

For the cr1 I will need to simply file my i130 and wait for noa1 and then noa1 which may take a total of 6 months or more. Then when the case is accepted and transferred to the nvc it may take another 6 months...or more to go on and then we would be sent the DS packets and other requirements. Then interview???

For the k3, I would need to file the i130, then after receiving noa1 I believe...I would need to send in i129f?Then same procedure....please do correct me if I'm wrong???

My question is.....would it be better to go with both? I don't think my husband will have any problem getting his ssn, ead and then his status adjusted if need be. But I also want to go with the cr1 visa because of the ease of mind it provides. But my main issue is...getting him here as soon as possible. What way would be best for us?

If we were to go both ways....how would we do this? Where can I learn how to step by step do both in proper timing, so that I can also make some time to go see my husband in pakistan and possibly add some living together time....or evidence of an ongoing marital relationship? I'm very confused and hoping for someone who could possibly just shine some more light on this for me....I really miss my husband and need him to be with me as soon as can be. luv.gif

What if I get a private mail box? It's better than a po box to deal with over-sized mail (or anything in a package basically)...and they forward mail to any international address I choose....for a modest fee of course. They email you when you receive mail and accept mail from all and any carriers. It think it's our best bet really...not all that expensive either...depending on how long I use it. But still....I still can't shake the worry.....what if my going for 2 months does complicate everything? I'm kind of confused now because everyone is saying something different......does it take a couple of months....or half a year? If I used a private mailbox to get and forward my mail to me....wouldn't I be able to stay in Paki for longer, if not the entire time since I would not be showing that I am in Paki technically? Seeing as I would be using the private mailing address to receive mail couldn't I just receive and mail things out from paki whenever I needed to? I could mail things by just placing my return address as the private one....I would be doing that anyways once I buy it.

The only issue I see with the idea is that if I buy it for like 6 months or 12 months...and god I hope not....if my process takes longer than that time, where would the mail go and how would I change my mailing address so I could receive the mails? But that could be cured if I just rented it out for more time...

Also, does the mailing address have to be the same as the domicile/resident address your living at, or can it be different? Where in the form would I put that if it were different....because I think they only ask for the resident address....I don't remember seeing anything for the mailing address if it were different?

oh.... sad.gif so I geuss DCF would not be a good idea then. *sigh*.....it's just so hard to swallow the prospect of not being with my husband for such a long time. Since it isn't advisable to go or be in Paki while the case is with the NVC....that only leaves me with after filing the i130 and waiting for the noa2. Is there any way you could get email notification or a call in Paki or something for the noa2? Because I don't trust my mother to send me my mail, even these important documents and I don't necessarily trust carriers to get my mail to me either. Plus...I'm afraid that if my father sees these mails...he will open them for sure and figure out what I am doing and make a huge fight out of it. I just wish there were some way I could just get the mail directed/redirected to my address in Paki without so much of a fuss.

so should I do that then? file i130 and go to Pakistan for 2-4 months...and come back and do the rest then? Being a month or more late to sending in the info the nvc requests won't harm our case will it?

So there is no way I can apply from Pakistan is there? My being in the states is probably mandatory right......I hope not. Is their any part of the process where it would be ok for me to do it sitting in Pakistan?(During i130-noa1-noa2 while getting mail forwarded to me in paki, or afterwards sometime??) Like couldnt I just use my Pakistani address.....or would that just complicate my case more.

Well I don't think I'll be filing the i129f because that would be for the K3 visa and I'm applying for cr1. So would it be okay if I left directly after filing the i130...or would it be smarter to wait to get my noa1 so I can keep track while I'm overseas. When should I plan on coming back? Would I be able to stay there until he gets his visa and we can go back to the states together?

My parents don't want to help me at all so I can't ask them to forward my mail to me either, nor anyone else would have access to our mailbox.

Also, would the procedure/visa type change if I were to go to Paki and file from there (keeping in mind, I will also be using a joint sponsor who is permanent resident in the U.S.). I think that going to Pakistan and taking care of it from there would be much easier for me, because my husband would be with me to help with everything....where-as I don't have any means of transportation here in the U.S and can't get anyone to drive me to the post office....they would get suspicious and lets just say bad things would happen. Any chance I could do this entire process (exactly as I would here) from Paki? What would be different, if anything at all?

I just went to the Wiki and checked out LingChe's shortcuts and they were EXTREMELY helpful....but I still have one question, what if I want/need to travel to Pakistan to spend some time with my husband during this procedure? I need to see him so that we can take pictures to prove we're still together and also possibly open a joint account and live together for a month or two in order to fit the on-going marital relationship/bonifide marriage requirements. With so much to do....all the tedious work...filing...mailing...getting mail.....how would I leave for Pakistan for a month or two without basically putting the whole cr1 process on hold? What if I missed any noa's or rfe's or any other important things...what if they arrive sooner to my home address? would there be any way I could get those things mailed to my address in Paki for the time ill be there for? Would my going to Paki make things possibly go slower or take longer? Couldn't I just use Pakistan address so that everything can be mailed back to me at that address somehow?

I am living with my parents and they are supporting me at the moment. Does their income count towards my income level? Does it ask for total household income or just what I am making. Can I include my parents income level since i am a student and living with them.

I will be using a joint sponsor and what ive read about the req's for a joint sponsor it says that their entire household income incl any from other household members counts for them. Is it the same for me, even if I am not making any income?

I want to use emails for evidence also but am worried that if I translate them myself(they are in roman urdu. meaning urdu language written in english) they may not be excepted as evidence. The only photos of us together are from the wedding and after of our short marriage life we got to spend together...would that be okay or will there be a need to prove our relationship before the marriage. We don't have much except for chat logs and emails and cell phone bills from before we got married mostly because as a muslim couple...we weren't allowed to be seen together in the first place. Do you think explaining that could help? Would supplying 2-3 affidavits of his relatives incl. 1 or 2 well established names in Pakistan's affidavits be good enough if all of this is all the evidence we will be supplying.

What do you think I should do for the translating of the emails and chat logs?

Should I send the evidences with the i-130 and then later with the i864 also? or how/when would it be best to send evidence?

I was just wondering how much of this process can be taken care of online? Like what things can be emailed or billed online and would that be faster than mailing every single thing? Anywhere I could find more info on the online part of the cr1 if that's partially( or heck, if I could do the whole process online that would be awesome) even possible? What I basically mean is.....I'd rather do as much online then everything offline.....if its easier or quicker. seeing as I don't have a car and it's quite difficult for me to find time to go to the post office(added to that the fact that my entire cr1 process needs to stay a secret from my HM's....or they would be furious). In this time and day I'm surprised that every single part of this process isn't taken care of online... wow.gif . lol.

I am going to be sending in my i130 soon and just want to clarify a few things. What is the difference between a copy and a photocopy? Does a scan taken on your computer and then printed out in color/b/w count as a photocopy? Where can I get photocopies made of my docs.

Also, I really don't want to send in originals of anything...so what things would i need photocopies for, both for the petitioner and the beneficiary? I know my passports bio page and birth certificate must be a photocopy am I right? I won't be sending in the passport bio page and birth cert of the beneficiary just yet will I. I will need to send in my affidavits for the bonifides of the marriage, photos of our wedding, chat logs and phone bills showing us calling each other. I'm very worried....

I am worrying quite a bit but I believe for all good reason.....I know I will be filing as unemployed but using a very good joint sponsor in order to balance that out. I mean, I can afford to support my husband because my parents are willing to help us out financially as much as we need for as long as we need....but they just don't want to become the sponsors for their own personal reasons. Other than that we already have jobs lined up for my husband, not to mention his all online business's, which never fail to put at least $5000 in the bank each month, plus the amount of support he has here from his relatives is tremendous. I just wish I could prove these things in the application...so that the unemployed bit would be somewhat less questionable. But the only types of things they ask in the i130 are, place of employment...emplyers name...and such. Since I will be putting N/A in most of the questions like this.....I believe that'll just get my petition straight up declined....seeing as they don't seem to ask whether you have a joint sponsor or not and they only care about YOU and YOU alone....thats what worries me.

Basically, I worry that since the form for filing asks nothing about the sponsors....the only things I believe they will see are the unemployed and the N/A's......I wish there were some place I could put that I have a very good and responsible joint sponsor and also have a place of residence and things like this. I just don't want my petition to get immediately denied the first glance it gets...

This is why I'm asking about whether anyone has actually gotten their petition denied....because I believe once you've gotten passed the USCIS part....everything's as near to smooth sailing from there as is possible. I mean, of course there are more and more chances of being denied and such from the nvc, embassy or consulate but, atleast from then on they know about the sponsor and everything and the pressure and attention gets pulled off the unemployed bit. Seeing as, even if I did get a job in Pakistan while I'm there, I don't think that would even count if I put it on the petition (that is if I decided to file from there. Since using DCF is impossible from pakistan....I think I will not be doing that. I'll have to file from here and then go.)

So yeah....if anyone can give me any details on their experiences with denials...especially if anyone can tell me what the chances are of being denied due to employment or the lack of it, really.....maybe that'd worry me down some... dead.gif

What I mean by "petition", in this topic, is =filing and not getting your case transferred to the NVC, or having the USCIS decline your petition.

Right, I've been told to make sure nothing is left out or done improperly in my petition as to not get it 'straight-up' declined right?? I'm sure everyone here has also been told the same....well...that's the point, really. But....I was just curious...has anyone ever actually gotten their petition for spousal immigration (preferably cr1) declined?

I'm sure if there are any at all.....at least a few must have been Pakistani petitions....what with all the need for such long AP's and the likes. Any Pakistani's.....would be grateful if you gave details...as many as possible. As to why, how, when, and what reasons for the decline.

Also, this post isn't just for those who got their petition declined first thing (meaning... either, USCIS declined or filing and not getting your case transferred to the NVC). This is for ANYONE and EVERYONE who has gotten their spousal immigration (cr1) case declined at all, throughout any part of this process. Please speak up....telling us what went wrong, or what the reason was may seriously help out us new filers quite some, I'm sure. So it would be really helpful of you. good.gif

I've already had my husband personally go to the embassy there and discuss the matter and they say they are the ones who eventually told us the only way to become a permanent resident is to go through a two year process, only if your parents are both nationals. Not to mention I called many many times and am fed up completely with the ignorance they show, I'm assuming, every customer.

I'm going to be staying in Pakistan with my husband throughout this entire process because, well....no better way to put it...I just haven't got much reason to stay here for the whole period really. But reasons aside...I will not be able to use DCF while in Pakistan because I've found out that it is basically impossible to get a legal or permanent residency in Pakistan. The only way is if your parents are nationals, and even then it still takes round about two years of living there, so thats not very helpful at all. So I will be getting my mail forwarded and using my parents address (where I currently live....and is my residence, no question about it) to file with.

Basically my question is....will my living with my husband and not filing through DCF cause any problems, now or later? What kinds of problems/questions will the nvc, consulate, or interviewer have that I may have to be ready to answer?
