I understand your feeling of frustration. That happened to me yesterday and hours later I was approved. I even called the USCIS yesterday to see what was going on. You should try to get your petition expedited. That's what I tried to do last Thursday and the Friday morning they emailed me letting me know that my expedition was denied because my petition was already with an adjudicator. So try getting it expedited. Whether or not you decide to do it, your petition will soon be approved.

So thank you guys..Like I said I would PREFER people who are from Jamaica and familiar with the Jamaican embassy. Yes I know it's the U.S. Embassy, but the way things are done varies from country to country. Look up Administrative Reviews and you'll see how some people are dealt with.

It's really funny to see how some people use the internet to feel important. For your imformation my fiance was denied based on he wasnt able to prove a bonafide relationship. As far as his charge it was dropped due to no evidence and was wrongfully arrested. He was released from prison and case dropped. That is why I went ahead with the interview. Since you guys are such immigration attorneys then you shouldnt be on visajourney.com. I dont care how many stars are on your names. OK? this is why I would rather take advice from people who ARE familiar with the Jamaican embassy and how it works.

It appears you are tying to spin or interpret what the notice says. If they are sending it back to USCIS, then the visa has been denied. See my earlier post. Yes, it is irrelevant that they did not stamp his passport. They don't do ANYTHING to the passport when denying a visa. What you need is an actual copy of the notice your fiance was given. When you read it and interpret it literally instead of "favorably" you'll understand that what I told you earlier is correct.




Look I dont need your negative feed back. You're not familiar with the way things are done at the Jamaican embassy. I wasnt there at the interview I'm repeating what I was told by my fiance. OK so I would APPRECIATE if you dont add your two cents in this. Thanks

Oh ok. Maybe something to do with only one visit. idk. but they do not stamp his passport. if he got approved they would take the passport for visa printing and would have gave him a DHL slip at the DHL window as that is how they ship the passport with visa in it back to him. you need to get in touch with the embassy at the kingstonIV email address ASAP. oce the petition expires Im not sure what happens but i would do anything possible for you or your congressman or woman to get in touch with the embassy this week, you may want to call dos at 202-663-1225 or the number i have for kingtson consulate/embassy who u really need to get in touch with is 876-702-6000. I never called them so not sure if anyone answers, but def email them until they respond. Good luck

Sounds like the IO didnt think it was a bonified relationship from the proof presented. Have you contacted the embassy to see if they will do another interview with you there? Im confused from your timeline though it says you were approved 11/01 and are writing this post today? Did you already have another interview? How many times did you visit him and did you go to the first interview? you might want to get your congressman or woman involved and try not to let it get sent back. When does your petition expire? Do you have any more info from your fiance on the questions asked. Is there an age difference or any redflags?




Well, now that he finally read the paper to me, I emailed the U.S. Consulate in Kingston requesting a new interview date. His interview originally was supposed to be on the Nivember 1st but had to get rescheduled to December 23rd. I only visited him once in July and that was because I started a new job and didnt have any time off to visit him. And he informed the IO that's the reason why I only came once. I would have went again in November but decided that it would be best to save the money and put it towards his paperworks because I felt strongly that he would have passed his interview in December. The petition expires on December 28th. No I am only one year older than my fiance. They asked him to write my name on a paper three times. Then he asked him to show him proof and my fiance showed him pictures phone records western union receipts. He asked him why we dont have anymore pictures and my fiance told him because the othre pictures are in his phone. Then the IO said to him well they have to do a background check on me( the peitioner) for further evidence. Then he gave my fiance a white sheet of paper stating that he wasnt convinced it was a bonafide relationship and that the peition will be sent back to the USCIS for further investigation then resent back to the Kingston Consulate. He gave back my fiance his passport book. But, my fiance believes that he wasnt denied because they didnt stamp his passport book which I think is irrelevant.

My fiance went on his interview on Friday. After providing his proof of relationship, Immigration Officer asked him for more proof. My fiance asked him what more proof can he give? He had phone records, Western Union receipts, Pcitures, Letters, and Proof of my last visit in July. The Immigration Officer asked him why didnt I come back after July? He told the immigration officer because I started a new job and couldnt get the time off from work. So the immigration officer told him that they will have to conduct a background check on me for more evidence. They handed him a white sheet stating that enough evidence wasnt presented to believe that we were in a legitimate relationship. The officer told him that after they do a background check on me they will call him back and make sure he doesnt lose the paper because he will have to bring it back with him to the embassy when they call him back. I am totally confused. Is this the Ap process or what? Was he denied or what? I was told usually when a person is denied their passport is stamped. His passport wasnt stamped and my fiance said during the interview they fingerprinted him. Please somebody let me know what this means.

My K1 petition was approved on October 29th. However, the notice of action I received said that my petition was forwarded the U.S. Consulate. I'm totally confused? Isn't it supposed to go to the NVC then the US Consulate? Someone please let me know because when I call NVC they are telling me to contact the US Embassy in Kingston. How can I when the NVC has to assign a different case number?

Well actually, the K1 petition was approved by the USCIS in August 2011. However, the K1 visa was denied in December by the Kingston Embassy.

She is correct. When a person uses the VWP, then the person cannot appeal a denial of the adjustment of status. It's a straight denial.



I didn't say she was wrong. re-read the comment. She said the person shouldn't have gotten pregnant. Who is she to make that decision for anyone? Hold your horses. Like she's entitled to her ridiculous opinion I am too. As far as the VWP, I have no comment on that because I didn't have that experience. But, as far as extreme financial hardship, I do have experience on that.

Financial hardship. I basically showed how waiting months for a petition to be approved would effect me financially. And that I was expecting a child and needed my fiance to be here so I can adjust his status allowing him to work immediately. Check out my timeline. I think people should take the advice of others with a grain of salt because cause someone doesn't get approved for one thing doesn't mean someone else won't. It's all about having a valid argument and more than enough proof to prove it.

She can try to apply for the expediate but they will deny it. The same thing happened to me. Looking at it now, extreme hardship would be matters that are life threatening. Being pregnant can be a hardship but its not an extreme situation. Again it wont hurt to try but just tell her not to get her hopes up



I applied for extreme hardship and got approved for an expedite recently in October. And I'm pregnant. All you need is a valid argument and evidence.

Nevermind my timeline. My wife is already a permanent resident for 10 years. =)  Of course thanks to all the help from members of VJ.

 

My question pertains to my friend's situation as I am assisting him in his process. Through my own, I have gained some experience about the AOS, but not through Fiance visa.

 

I hope all of you can be kind enough to offer some opinions on how to approach this.

 

My friend is a US Born Citizen and met a Canadian citizen. He currently lives in NY and his girlfriend in Canada. They met while she was going through her training in the US. They wants to get marry but not sure how the legal process work. Currently, She visits from Canada once a month for a week or so and return. In return, he also visits Canada for a few days here and there. there is no type of visa that is required for their visits.

 

After going through the process, I know its illegal for her to come to the US and adjust status that way so therefore, that's why I recommended for him to apply for K-1.

 

1. Is there a duration of how long they have met to apply for the I-129f? From what i've read, its 2 years?? please correct if I am wrong.

2. If the process require at least 2 years for them to know each other before submitting the application, what option does he have if they've only known each other for 1 year?

I vote you send the documents in as soon as possible. In turn you will have over half a year wait for a interview and they revise the forms online very often. Sending a document in after the revision has come out because you wait 3 or 4 months to be ready will only cause more and more delays as you will have to send everything again with new signatures on the new documents.

I've read on here numerous people suggesting that if you don't receive your NOA2 by the estimated time, you should "call your service center" and ask to speak to a "Tier 2" person. However, I cannot find anywhere online a direct phone number to the Vermont Service Center to try this. Any help? Does anyone have a valid phone number to speak to an actual human in Vermont?

While we are right in our expected time window for receiving our NOA2 just now, I cannot help but get a little nervous when the timeline shows several people from Mexico who had applied after us have already received their NOA2. I hope we were not passed over.


There is no calling the Service Centers directly.. only emailing them. The Vermont service center e-mail is vsc.ncscfollowup@dhs.gov

When you were told to call the service center people may mean calling the national service center at 1-800-375-5283.

One way. Unless you plan on not getting married. Buying a two way will only help if you have fully refundables which are expensive in themselves. What will happen if you buy the cheapest two way is you'll have a credit for the airline for the reutn trip and fees to go with it. so in the end it wont feel so cheap.

I think when they talk about transmisable diseases they are including mroe serious things. This that can clearly be found in your blood stream during a blood test. The civil surgeon is not a gynocologist. I would put yes because you shouldn't lie but I doubt you will be denied entry into the U.S. based on that. Relax and keep in mind you arent doing anything wrong and your not comng into the states to spread diseases, it's just something that happens.

Hi everyone,
I am new to this and have been getting all the documents and information together to file the I-129F for the K-1.
And I am already confused, I just got back to the US after spending over 6 weeks with my fiance and had my fiance sign and date the 4 pages of his G-325A. Happy that I have that to send off with the I-129F petition.

Now, I am home (I am the petitioner) and I see there are new G325A forms, so I downloaded it, filled it out on my computer (for my biographical information) and now see that the new form is only 2 pages long.

I used an older G325A edition for him, as the new one was not available when I went to visit him earlier this summer (according to USCIS, previous editions are accepted). So, I am confused, the USCIS website on the "forms" page says that the G-325A is still 4 pages, but when you download it, it is only 1 page, plus the instruction page. So, right now his G-325A has 4 pages of biographical data (with different codes on the bottom), and mine only has 1 page of data. How can this be?

Anyone else, have this problem, or know what I may be doing wrong?

Any help would be appreciative, as I am trying to get this first step done right and begin the process.

I will be sending of of my petition for K1 fiance by week end and I am curious if anyone has ever filed for a fiance that uses the passport for the country they were born in, but not where they are currently living?

My fiance lives in Antigua, but travels frequently and only with his passport from Guyana, which is where he is originally from. He is an Antiguan citizen, but simply prefers using his Guyana passport, as he never applied for an Antiguan passport. Will this cause any confusion or slow the process for us? Anyone ever deal with anything similar. I am trying to best prepare for this process as much as I can. Thanks!

It does arrive via snail mail. If you use online banking, however, you can view your receipt number and begin tracking the case status on the USCIS website. The receipt number is printed in the endorsement area on the back of the check, so you can find it by viewing the check image on the bank's online banking website.

6 months to leave and then 3 months to marry.

To clarify further: Leave within 6 months of visa date and then once they enter into the US, then 3 months in which to marry.

Thanks, I think I will take a little of everyone's advice, I will see if I (petitioner) can get emailed when the embassy sends it out. And my fiance said he is going to try to "butter up" the guy who delivers mail, and hopefully if they e-mail me, we'll at least have an idea of time, as to when he may get it and then maybe stop by the post office as a last resort. And yes, hopefully it will all be there, in the past everything has always been opened and gone through.

I complain about the post office in Brooklyn, and yet in the big scheme of things, I guess we got it easy and should not be complaining!

Hi,

Is anyone else going through this process with the worry that that their beneficiary will not receive the packet from from their consulate/embassy?

I have been on the phone twice today with the NVC and once with the consulate, who told me to call back NVC, who told me to call the consulate and now the consulate is not answering the phone. I can't seem to get a good answer as to what to do.

I just found out today that our petition went from NVC to Barbados, that is the consulate that serves the island of Antigua, where my fiance lives (yes, good news). Once it is received at the consulate in Barbados and processed, they send out the packet via air mail to Antigua.

The problem is that my fiance just moved to a new village in Antigua a couple of weeks ago. And basically in Antigua you only get your mail, if the person delivering the mail that day, happens to knows who you are and where you live. There are no address house #'s in Antigua, only the person's name, street and village. Being that he is new to that village, its a ####### shoot if he will get the mail. Then, it is even a larger ####### shoot if Antigua will even return the packet to Barbados, if it does not get delivered to the intended recipient.

I have dealt with their mail system myself and many things I sent to my fiance over the years have gone "lost". Utility bills are just tucked into homeowner's fences, not a reliable system at all!

Anyone else been through a situation like this and can offer any help or ideas to deal with this? We are both concerned that he will never get the packet from the consulate???

First, we have the visa. We got it about a month ago and my fiance was given vaccinations at the medical exam in Barbados (where his consulate is) before the interview. But, he was told he has to get two more vaccinations (TD and Varicella) a month from then (which is now in his country, Antigua) and then another one six months from the original date (which would be when he is in the US).

Our problem is that he has been told from every clinic he called in Antigua that they do not have the varicella vaccine. What do we do??? Going back to Barbados is not really convenient nor cheap to do just to get a vaccine.

Anyone have a similar experience or have any advice?

I guess i am confused, yes we have the visa, but he was told he needed to follow up with these three other vaccinations. He is not in the US yet, he will be here in April. So, we should have no problems if he comes without these follow-up vaccinations, as long as he gets them here (which I guess will be expensive).??


If you have the visa and your in the US - just get the vaccinations here, have a CS fill out the 693 part for vaccinations and go from there.

Ok, I think I understand. He should be fine in April, when he comes at POE, we will just have to have the follow-up doses of the vaccines complete for his AOS.

But, he was told he has to get two more vaccinations (TD and Varicella) a month from then (which is now in his country, Antigua) and then another one six months from the original date (which would be when he is in the US).

Our problem is that he has been told from every clinic he called in Antigua that they do not have the varicella vaccine. What do we do??? Going back to Barbados is not really convenient nor cheap to do just to get a vaccine.

Anyone have a similar experience or have any advice?

Ok, in trying to find out an answer. I just called USCIS' 1-800 number that is specified to call for change of address.
This is what I found out: If you have a pending application (which is my case)
Then to update the change of address for the beneficiary you:
Need to send a letter to your local office or service center (for me that is VSC)
In that letter provide the beneficiary's new address, but in the letter ALSO INCLUDE BOTH the Petitioner and Beneficiary's Names, Date of Births, and Receipt # for the pending application.

By the time the case is approved, the beneficiary's address will have been updated in the system and that information will be forwarded to the beneficiary's consulate.

From a place like Japan, that doesn't require a tourist visa for her, I'm wondering, if she just said when they ask her, 'I'm here to visit my boyfriend' if that would cause any problems. It wouldn't be lying.


My thoughts exactly. She doesn't have the regular proofs (she lives with her parents, and she's quitting her job this month), but if she shows bank statements, phone contract, etc., and is upfront with whoever questions her when she enters, then all will be fine. I read a lot of VJ member anecdotes of people in the same situation, who were never asked anything outside of the usual "what's your purpose / where are you staying / who are you seeing / when are you leaving" string. So yeah, staying positive :)
