Hello all,

I got some excitment to share. My fiance had her interview on Friday, May 18 and she PASSED!

I am super happy, the time has come finally! I would like to thank everyone for all the help they had provided me when i was in tough and confused moments.

They told her the she should have her visa and passport mailed to her by next FRIDAY, i hope nothing goes wrong in between now and then.

I am starting to look at some airline tickets. Does anyone have any good sites i should look at?

Thx

Congrats

You can probably visit. I suggest you read some of the discussions about visiting during the process. Also, please update your profile to show the country you're coming from. Nobody is suggesting you're trying to commit fraud. We're just answering your question.

Ok. Thanks. I will be visiting. And I'm from Jamaica

If your husband already filed the I-130, no you cannot enter as a non-immigrant and adjust status. It's visa fraud.

I can enter on my tourist visa though, right. I haven't traveled since we got married and never thought about that. We have been married since may and just filed the paperwork on the 12th. Honestly I was not in a rush to move ther. Being my grandma is sick but my husband is ready for me to come home.

Entering the US on a tourist visa or VWP with intent to immigrate is immigrating fraud and can lead to a lifetime ban. Clearly you have immigrant intent with a USC husband and daughter AND an I130 pending

Your safest bet, wait for the I130 to process and apply for the spousal visa

Good luck

Thanks.
Will wait for i130 . That wasn't a problem anyway since I was always able to travel back and forth.

Not trying to commit fraud. Just wanted to see what my options are. I have always had my tourist visa. I have been traveling to US for 8 yrs now. If I wanted to commit fraud I could have gotten married here and not return home. I have been doing everything legally. I just wanted to know if it was legal to try and adjust status while I'm here.

My daughter finally got her paperwork saying she is a USC. I was traveling back and forth to see my husband while my daughters paperwork was being processed. We are gonna be traveling tomorrow to be with my husband for Christmas. Bcuz things was taking so long with my daughters paperwork my husband filed an i130 to see which one would come through quicker. I want to know if I have to wait for the i130 to finish process or can I adjust status while im there.

I dont know how it works there to add the name under lease agreement, but I think, it is not that necessary for your case.

You already seem to have stronger case, so everything would be fine. :)

May God bless you both! :) Happy Holidays! :)

Thank you... Happy holidays to you too

My husband and I have never really lived together. We both traveled back and forth, when I'm in the US we would stay at his Moms apartment and when he visits in Jamaica he would stay at my home. I own a house but we never put his name on the deed since we plan on selling it once I'm approved to move to the US. We do have a car in both our names but we were wondering if it's possible to get a lease in both our names seeing I don't have a social security number?
We do have strong proof of a bonafide marriage and the relationship before the marriage, but we don't want to leave any stones unturned. We have been dating since 2008 and we have every receipt of gifts we bought each other. Pictures of every function we ever went to. Pictures with family and friends. Phone records, emails. Affidavits from both our Pastors plus we have a child who is 2yrs old but not relying on that alone. Fact is we love each other and don't care if I'm approved or not since he is willing to move to Jamaica with me.
Is it possible to get a lease in both names?
About to go to the airport now...
I'll be home for Christmas...lol

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed help on my sad complicated case

I read the entire soap opera and I will say what I have to say. If you think I'm being judgemental or worse... go ahead.
This whole ####### pisses me off beyond understanding and I'll tell you why. When the "guess the country he is from" started, roughly after page 5, MENA/ muslim countries were the first on the list. I went thru all legal avenues to get my fiancee, from Egypt, approved. The main reason we did is because we love each other genuinely and we want to get married. There was no need for third parties or marriage brokers. I proceeded with caution, later to find out, he was proceeding with caution too. And that was a relief, I must say.
All this said, the first question that comes to my mind is, why on earth is a 22 year old involved with marriage brokers and other immigration workers (putting it lightly)? BECAUSE HE WANTS TO MIGRATE! If a 19 year old blonde hottie came to his life thru a marriage broker, HE SOLICITED HER (or at least someone to marry for immigration purposes). The 3rd party didn't put a gun on his head, neither did she, to marry her. So, the victim story is b#$%^&*t. There, I said it.
The second question that comes to my mind is, why on earth this story is full of patches to victimize himself and minimize his involvement, including to the extent of claiming drug usage... and what not? Because he knows he is guilty of fraud. If you are in the country and you are a victim, you call the police and build a case. You do not divorce and find a new wife, who I will dare to call a new victim.
I am not apologizing telling it like it is. If I sound harsh, so be it. But like the previous poster, I have 0 tolerance for #######, and that goes on both ends: the USC and the immigrant. Like the 99% of us here, we do things right and some of us, even so, get denied.

So to the "victim": stop dancing around the truth and tell it like it is, or start looking for another war zone to live in.

Nicely put

I didn't want it to be fake , the guy who fixed the whole thing got all the money and he even didn't give my ex anything , so she was told she had to blackmail me to get money she. Told me later everything even though she was a pathological lier , of course I knew after a couple of days that the whole thing was a fake but living on her promises that she would come and live with me and make it real coz she loved me , all that made me wait and give her chances after chances and support her until I learned she was doing drugs from her ex , that's when I left without even waiting for my social which was on the way , It was in the mail 2 weeks after I left , I know y'all think I am not honest but that's what happened

Ok. How long ago was that? How long have you known your new wife? What time limit did you set in getting things done? These are stuff the CO are looking at. If you seem to be doing things in a rush and the fact that you already applied and for whatever reason did not finish the process is gonna send up red flags.
I think you should try to let things die down and then retry or they might bar you permanently from the country

He does not sound honest and it's not a matter of being judgmental. If you are seeking help from a forum, we are a family of people who are willing to help in whatever way we can. When you break the law be straight up and honest about it. He tried to put one over on the CO and he caught it. I think he is trying to put one over on us.
He wrote that his first wife and friend took money from him and that's all they wanted then later he's from a country that arranges marriages. He knew what was going on and willingly participated in it.
I am all about honesty, and will turn a listening ear when the details are clear.

However my advise would be to get to know your new wife. Give stuff some time to cool off. And then reapply. When you do things in a rush it will come off as fraud.
Save up for a good lawyer and try again

I didn't wanna go inti a lot of details coz its a long story but i didn't want the marriage to be fake , they just got along with me until they got money so I was a victim , I was 22 at that time and very naive trusted everyone , my ex was a very manipulative innocent looking girl , she just convinced me that she really wanted to marry me , she was pretty 19 old blond that any guy at that age would fall in love with
The troubles began in my country before she was here , I met her online And she came to from America just to say me ,, we spent just a short time together thinking that it would only be short time before I get fience visa , now we are stuck , plz dont judge , just help If anyone could

How sure are we that this person is not trying to get us to help him to commit another fraud? He lied to a CO thats why he was denied.
When I have a 2yr old daughter at home and have to be finding evidence of a 4 yr old relationship so that my daughter can have her father in her life every single day I am not gonna help someone who went through the wrong tunnel find his way to the right one. He should have done things legally like everyone else... If his new relationship is real be honest on every single application. Don't lie. That's what got you where you are right now. If you are honest then everything will work out for the best

I don't think anyone is trying to be holier than thou. After reading what this person posted it's obvious he went into the first marriage knowing it was a fraud. The CO obviously saw that and I think once bitten twice shy. I don't believe he didn't know first marriage was a fraud and when ppl do stuff like that it makes it harder for ppl who are in it for the right reasons. Im sorry but I don't feel sorry for ppl like those.
This is just my opinion...

IR-1 / CR-1 Spouse Visa Process & Proceduresdecided to take early dna testing before the interview , result is negative..what to do?
It is obvious that this person does not care if the child is his biologically. He loves the child and wants him to be a part of his life. He is asking advice on how to go about how to do that, I think that's what we should give him advice on and not how he wants to deal with his personal relationship with his wife.
I think you should be honest in your immigration proceedings, let them know the child is not biologically yours, and see about filing for him as a stepchild. I suggest you seek the aid of an attorney if you can afford.

IR-1 / CR-1 Spouse Visa Process & ProceduresMarriage in US -> Return home -> CR1
I got married on one of my visits to my husband then went back home. I came here for a visit during Christmas and we found out my husband had to do major surgery, we contacted Uscis and was granted permission to adjust here thus my staying. Getting married is legal on tourist visa as mentioned its the approach you take after the marriage that can cause a problem. Intent to stay after marriage can cause problems. I had no intention of staying and had to prove that even though my husband was sick the doctor certificate was not enough

I'm trying to understand what they are telling you. I don't think child support has anything to do with immigration other than a spouse knowing you have a child support order and how much the child support is. The questions being asked by an IO are asked to validate your relationship.

I guess someone else can add more to this as I too would like to know
