i was just wondering if one only needs a court record if they have a criminal record...if my fiance has never been to court, does he need to somehow prove that? or does the police record take care of that?

You've got your work cut out for you and a very steep road ahead. Collect any and every document which illustrates that you were in Cuba during the time you declared.

If you cannot provide a Cuban visa, admission stamps in your passport, or military orders verifying that you were in Cuba during the time you claim, then you have no primary evidence to submit. According to the RFE, secondary evidence is useful when it supports the primary evidence submitted. Based on what you've written, USCIS may have ample reason to decline the petition.

You might consider speaking with an attorney who has experience with Cuban immigration. Florida is a good place to start the search. Be prepared for many hours of work, research, talking to people, and spending some money. Get a realistic perspective about your situation, and what needs to be done. USCIS has given you a couple of months to respond. Get to work, kid.

Got my RFE in the mail today and reads: Need intial evidence that I have met my fiancee in person in the past 2 years. Include pictures, boarding passes, passport stamps or military papers.....I did send pictures as evidence so why this RFE?
I no longer have my boarding passes or ticket reciepts, but I can obtain a copy of my frequent flyer statments that indicate flights numbers, dates of travel with my name and account number...Would this be OK? My passport does not have any stamps because Cuba does not stamp US passports, so what else can I use for evidence of meeting? E-mails, phone records, disc or tapes are not considered evidence for them...PLEASE HELP!

send anything you can think of...you must have used a credit card at some point, to book the flight, to withdraw from an atm while you were there...to charge things while you were there...send the frequent flyer miles and get reciepts from the airline companies...it could take a while, but give them enough hassle and they will give you itineraries and/or copies of the tickets

Has anyone here ever requested for an Infopass more than once?

We got our NOA1 last January 2007 and got a notice that our K1 was being transferred to local USCIS office on March 15. We had an Infopass last April 3 and asked what was going on but they just told us to wait and they will get in touch with us. We haven't heard anything since then. It's been almost 4 months.

Would it be alright to request another Infopass appointment for August just to find out what the heck is going on? All inputs would be greatly appreciated!


you can request one, sure...but its not guaranteed that they will be able to help you...if you end up going, dont go just before lunchtime...between 12 and 1pm there is almost no activity bc everyone goes to lunch...i made that mistake myself the first time =)

basically yea, it means that your case has been updated online...once you get your case # you can check this on the uscis website...if the 'last updated' date has been changed since the last time you viewed it, that means that you have been 'touched' and someone has done something with your petition

btw im 22 and my fiance is 23 (will be 24 next week)...i definitely do not think it is an issue as far as this visa is concerned

as far as i know, if you are referring to the petitioner, even if they come to the interview, i dont believe that they need a birth certificate...i know that the beneficiary will need an original of their birth certificate, but the petitioner us citizenship was verified with packet 1, and the copy of the birth certificate...i hope that helps a little

I see folks travelling internationally to meet their beloved(fiance/fiancee) ones.

I thought it would be a good idea to share this information.

You can register with the State Dept [ https://travelregist...s/ui/index.aspx ] and this information can be looked up by the local consulate and can serve as proof that you travelled to the intended country but this may not be used as proof that have met your beloved one..

Any thoughts?

sure...you just have to find out what the qualifications are for france...you will probably need to have a job lined up (sponsor) in france before any work permit can be granted...once you have those two things, you should be able to get a work visa in france...definitely double check that info though on an French government visa website...you can also contact the French Embassy here in the US, they should be able to provide you with the info

im in basically the same situation as you are and im braving it alone...ive come to realize that nothing is definite in this process...it can always go either way...some ppl have been in our situaiton with success and others with denials...if you decide to brave it alone, we can be in it together...i sent my petition in today...if you do get a lawyer, and wouldnt mind sharing any valuable info that might be of assistance to us with illegal fiances lol thatd be great =)

adriano is usually calm, but thats because he usually doesnt have to do anything...i actually made him go get the italian police certificate today, and am so proud that he actually accomplished the task!! laughing.gif

he doesnt speak english, so i do all the paperwork and research and such...i try to inform him the best i can, but its so complicated that i know he doesnt really understand everything thats going on...

hes very nervous now, because he is returning to albania on friday to gather the required documents, and have his interview in tirana...he has been living in italy for about 4 years, and has made a life for himself there (steady work and very close friends who are like family to him)...if he doesnt get the visa, then he will be stuck in albania (he doesnt have a visa to return to italy)...i can understand the nervousness, but i constantly tell him that if we are prepared, then we wont get denied the visa...i hope im right!! blush.gif

the albanian docs dont need to be translated, its ok as long as everything is in english or albanian...

also, for the embassy in tirana, you have to mail EVERYTHING into the consulate...everything on that list i linked you to has to be sent to the consulate via mail...its not like most other consulates where you mail some and bring some...you have to mail all the original ds forms, original notarized 1-134, in addition to the police certificates, birth certificate, etc...im mailing in everything on the list and then bringing all of the i-129f documents to the interview with me

i have only been earning the required amount for the past 6 months...i have a letter of employment, pay stubs and bank statements for the past 6 months, but my past three tax returns all say amounts below the poverty guidelines because i was in school.

i dont know about the csc, but i went through vsc and have the same noa2 date as you...i have already recieved packet 3 from the consulate almost a week ago, so it is definitely possible...generally, however, the csc is much slower in sending the packets to the nvc...i would call the dos and find out what the heck is going on!!

That should put us in a good time frame.

In the meantime I will be here lurking for the most part, and enjoying the many BEAUTIFUL stories of distant, instant, and dedicated love! I must say that I feel my wait is not a burden, but a preparatory period. I am finishing my second degree and becoming a full member of the Catholic Church, which are as much for me as for US. This has been a wonderful time for personal development while anticipating our life TOGETHER!

you have to mail in all of the documents that they list in packet 3...since one of the forms that you have to send back (i think it was DS156K) says to include evidence of engagement to your fiance, i included my evidences with the packet as well...i will bring more evidence with me to the interview, and copies of what i sent them, but i did mail them in

tirana is a little bit different than most embassies because you have to mail them ALL of the documents (including i-134 financial documents, police and birth certificates) and THEN they will schedule your interview

Hello everyone,

I've read here under the K1 visa chart, that some port of entries will stamp your passport with a termporary work permit if you ask them.
It mentioned JFK and NY airports. Does anyone know if these are the only POE that will issue this, or are there any others. I fiance would be coming from Central America so most likely the POE would be Miami or Houston. Has anyone entered any of these and received this work permit.

No other airports that I know of give the work authorization stamp.


i have heard that jfk is the only one that issues the stamp...one option is simply to take a detour and make a connection in nyc...just make sure than jfk is the first airport that you enter on us soil...it might be worth the inconvenience (is that spelled correctly?)

I understand your feeling of frustration. That happened to me yesterday and hours later I was approved. I even called the USCIS yesterday to see what was going on. You should try to get your petition expedited. That's what I tried to do last Thursday and the Friday morning they emailed me letting me know that my expedition was denied because my petition was already with an adjudicator. So try getting it expedited. Whether or not you decide to do it, your petition will soon be approved.
