The deportation from Belgium would concern me, too, as I believe that one of the consular visa forms (maybe the DS-157) asks if one has ever been refused a visa, denied entry, or deported from any other country.

Nevertheless, if his hooligan days are well behind him, he might well be all right. But I think Tracy's given you sound advice, and to that I would add: Consult with a lawyer familiar with I-601 waivers for crimes involving moral turpitude and deportation as a result thereof. A lawyer would be able to tell you if he'll need a waiver and what his chances are of having it approved. Then, if he's denied at the interview, you can have the waiver ready to go right away.

if my fiance moves between the time we file 1-129F and sending in packet 3/4, are there any steps that i need to take in order to inform the uscis and/or consulate?

he lives in italy (with an expired work visa) but is an albanian citizen. he will be moving back to albania in order to conduct his interview at the embassy there, so the move is accounted for as far as the consular/embassy level is concerned.

my question is simply whether they will need to be notified when the move occurs

ALSO...if i move during the same time frame (between i-129F and packet 3) what do i need to do in order to let them know?

i just realized why i am confused on this...in the instructions for I-129F part 2 (d) it states the following:

"Translations. Any foreign language document must be accompanied by a full English translation that the translator has certified as complete and correct, and by the translator's certification that he/she is competent to translate the foreign language into English"

what does this mean if it doesnt mean that anything in a foreign language must be translated?

thanks...i think i know the difference, but i was just confused bc i thought it said in the instructions to have certified copies of all documents and supporting evidence...i could have read it wrong tho...if you submitted it with no problem then i will not have the train tickets translated...i will just translate his passport

the train tickets are pretty basic anyway (date, destination, time, etc)...i did think it was sort of ridiculous to pay in order to have such a simple document translated...

yea, the main concern is translating his passport...i have some friends in nyc who speak both albanian and english...can i have them do it for me?

i speak italian, can i translate the train tickets that are in italian as long as a i sign the statement? or should i get a disinterested party?

the train tickets are a pretty important piece of evidence in my case, so i would like them to be translated, those are the only two things tho

so you mean that i can get any native speaker of that language to translate the documents for me as long as they will sign that statement? do they have to translate everything the document says (ie: train tickets, hotel receipts) or can it just get the main points across...the important stuff???

for my g-325a i have made attachments for work/residencey over the past 5 years

do i need to include 4 copies of each attachment (since there are 4 pages of the g-325a that all go to different departments?

in other words...one of the forms is going to the consulate, and one is going to another place
if i say 'see attachment' and the only copy of my attachment went to the consulate, how will the others be able to access it?

Background info:
-My fiance has been living in Italy with an expired work visa for the past three years
-He is a citizen of Albania
-We met in Italy last summer, at which time his visa had already expired

My question is whether or not I have enough evidence to prove that HE was still in Italy at the time that we met (last summer). I have tons of evidence to prove that I was in Italy at that time (and three times since), but I want to make sure that they know HE was also there. It is a bit difficult due to his status (I can't show work records, checks, bank statements, etc)

In my I-129F (which I have not mailed yet) I have made an attachment where I admit honestly and openly that he had overstayed his work visa in Italy. I spoke to an immigration officer, and she said that they are not concerned with visas issued outside the US. She said that overstaying the visa in Italy would not affect whether or not our petition is accepted. Basically I need to prove that he didnt leave Italy when his visa expired in 2004. I need to prove that he is still in Italy.

Proof of Having Met in Person Within 2 Years (foreign fiance):
-copy of entire Albanian passport
------includes Italian work visa issued in Sept 2004, good for three months
------includes copy of exit stamp from Durres, Albania. He was not stamped when he came into Italy, I am not sure why. There is no other stamps present on his passport anywhere.
-copies of letters addressed to my fiance at his current address in Italy
-copies of 3 phone bills that show incoming calls from my fiance using his current telephone number in Italy (these date throughout the past year)
-various photos of us together
-train tickets and hotel reciept from one of our trips together (no names on them though)

I have made an attachment stating the following:
Since I have copied his entire passport, and there is only one stamp on there (an exit stamp from Albania), then this proves that he is still in Italy, and never left. The fact that the letters show an Italian address and the phone bills show an Italian phone number also prove that he is, in fact, still in Italy (Not to mention the fact that Packet 3 will be sent there)

Do you think they will go for this? Or do I have to think of some other ideas? If you dont think they will believe me, what other evidence could I submit, keeping in mind that my fiance is not legally residing in Italy (he doesnt have housing records, phone records, etc in his name)

I would appreciate any input that you may have concerning my situation, thanks to you all and best wishes!

i came over to see cari for christmas time , i was there with my son for 3 weeks, and i was in the system then,cr1 for my son and me before that i was over in july for a month for our wedding with son and father in tow,i never had any problems at the immigration desks ,when asked i told the truth the reason for my trip was to visit family,in fact ever time i came over even for the wedding my answer was the same apart from my first visit nov 2004 it was to visit my then girlfriend ;)

but every time i did come over i had a letter from my employer stating my return to work date just in case

If your parents have already agreed to sponsor Ollie and their income is well above the poverty line, you will be good to go. You'll need to submit information relating to your own finances too, of course, but your parents' sponsorship will seal the deal.

No federal agency would deny your petition, or your sweetie's visa application, solely on the basis of your disability, so don't worry about that, either. You sound like you've lined your ducks up well enough. :)

beneficiaries from the UK can self-sponsor for the K1 with surprising little assets. On the order of $5k in cash. Maybe less. There have been several on VJ who have done it.

That said, I'm a bit confused...you said you received a letter from the DHS? What letter? What are you applying for? You later mentioned the I-864. Is your fiance currently in the U.S. and applying for Adjustment of Status? A little more info please.


I'm confused, too. Let's try and sort this out, shall we?

First, you need to tell us what you're trying to do. Since you posted this in the K-1 forum, I'm going to work off the assumption that your fiance (not husband) is applying for a K-1. If that's not the case, correct me.

If your fiance is going to be applying for a K-1 visa, you do not need to file an I-864 for him (yet). That's about the only good news. The K-1 requires the I-134, which is a similar form, but is not legally binding in the way that the I-864 is. That said, it is NOT something to be taken lightly.

Gary mentioned the option of self-sponsorship. Theoretically, that can work, and has worked at least a few times that we know of for K-1 applicants in London. But to pursue this option would require that your fiance have access to liquid assets in the amount of several thousand pounds. Not many people have this (although if he'll be selling significant property in the UK, or cashing in bonds or the like, he may well have it). And also keep in mind that this option is not in black-and-white; it is probably subject to the discretion of individual COs and I would not feel comfortable telling you that SOLE self-sponsorship for a K-1 will get your fiance out the door with a visa. You will need to prove that you will have something to do with his support.

Which brings me to my next question. Since Yodrak hasn't dropped by, I'll throw this out: if you yourself are, as you say, not buying new clothes et al., barely getting by...how, exactly, will you support your fiance when he gets here if he is not independently wealthy? How do you plan to file an I-864, when you have to file one (and you will have to file one when he applies to adjust status) without a tax return, as this is required for the I-864? Your fiance will not be able to walk off the plane and into a job--you are likely looking at a stretch of at least a few months wherein your fiance will not be able to work. If you are working only intermittently and are barely making enough to make your own ends meet, how will you feed two mouths when he gets here?

The above are, inasmuch as I'm concerned, rhetorical questions. I don't expect you to share the intimate details of your finances here. But you do need to answer those questions for yourself and your fiance, and if your employment situation is unlikely to change, you need to find someone who will be willing to sign an affidavit of support for your fiance. It does not have to be a family member--it could be a close friend--but you'll need to find someone. I wouldn't say this to be unkind, nor, I suspect, would anyone else here who would say the same thing. VJ wants to see you succeed and be with your loved one, and if your chances don't look good, we want to help you to improve them. But you and your fiance need to figure some things out before you plunge into this process. Because the process itself is costly, too--the petition fee, the medical fee, the visa fee, fees for copies of documents you might need...the list goes on and on.
