IF your man has a conviction then he was arrested and charged and that is a CMT,as my wife said earlier in this post,I had several convictions of various types on my police record,from theft to assault and we got our waiver together a couple of months in advance as we was 99% sure we would need it,when I had interview in Vancouver(on a side note has anyone traveled farther for interview 5500 miles?)and the guy was pretty cool about it all looked at all my stuff and picked the last one,bit of a serious assault and denied me on that one alone so there you go but I am reminded of the case of Liam who got caught and charged with theft(4 cans of lager) and a breach of the peace I think and he got his visa only to be turned away at the POE and told to get a waiver for his crimes so if I was you I would prepare for the worst and if nothing happens then your home and dry,but if something does then you are ready there and then,but I strongly advise you NOT to hold anything back as it might come back and bite you later,anyways best of luck


What? Some periods could help.

We're not talking about a pattern of convictions for theft and assault. We're talking about what are more likely arrests and cautions, rather than convictions. I'm sorry you had to file a waiver, but don't induce panic in someone else whose situation is not comparable to your own. Plenty of applicants in the UK and Ireland have had similar spots on their police records, have subsequently disclosed the nature of the offenses at the interview, and have not had to file waivers.

Liam's case was one in a million, and not likely to be repeated. His situation was complicated by medical problems as well. There's no basis among these three cases--yours, Liam's, and the OP's--for a fair comparison.

Yes, this is a Crime of Moral Turpitude, any crime against a person is considered CMIT, Assault, robbery, rape --- you get the just here--- my husband and I just had our interview for his K3 in Vancouver Canada-- he had one conviction for Assault it was 22 years old --- he also had some petty things from earlier in his youth like stealing a chocolate bar. But never having served time or paid a fine is not the order of the law here. What is focused on is the maximum sentence for the crime -- Assault is 6 years I believe as the maximum sentence --- So, if I was you, I would do as we did, plan for a wiaver to be the process you will take and prepare it for submittal immediately after he is denied the visa for the CMIT ---

As you can see by the previous post of Irishgirls, not all crimes against a person are considered CMT. Simple assault is listed as not, as is fighting. The crime of assault includes a broad spectrum of misconduct, ranging from relatively minor offenses, e.g., simple assault, to serious offenses, e.g. assault with a deadly weapon. Simple assault and fighting are not CMT.


I would tend to agree with Lorelle here; if this was a simple scuffle of the type that many young men become involved with (and from what you've told us that sounds like what it was), I don't think you should lose too much sleep over preparing a waiver. The types of assault that constitute CIMTs would probably be aggravated, violent assaults or sexual assaults, not a few guys having too much to drink and exchanging some shoves or punches. Not that we want to encourage bar fighting. ;) But a lot of UK/Ireland applicants have posted about stuff like this, and from what I've read, it's not an issue.

Just make sure that Gavin knows that it's very important to come clean about it when he's asked (which he will be)! ;)

I'm confused as to how you could have lost your VWP privileges. That generally only happens if you're found to be abusing the VWP or if you've been convicted of a serious crime. Have you been told this outright, or do you just suspect it?

No way (unfortunately). It says very clearly on the I-864 that divorce does NOT resolve the obligation.

Hi all.

Just got a short little update. He called his other sister and had her email me. He said things went well and that He did have to file the waiver . He said they were very positive about it and they told him is should be around 8 weeks. HA HA HA to the 8 weeks. I think we all know that's not going to happen. :no: At least it's all done now and we just have to hunker down and wait to see what happens.

And Mary, I've been so worried for you and Tom...I just hate to see you still suffering over this whole situation. :( I'd love to see you fight it; it's absurd that convictions for violent offenses can be waived while non-violent drug offenses so many years in the past can't (and Tom wasn't even *actually* guilty, from what you've told us). Still, though, as everyone here has said, you'll make the decision that's best for both of you. We're still all behind you.

You may want ask MissLiss how she handled the denial of the I-601 in Ciudad Juarez. She got a lawyer, though. Apparently there's still something you can do, even if the waiver is denied, but I don't know how it works.

the interview other than that went very well...the consular officer asked him a lot of questions about our relationship (probably about 15-20 questions, i will post them later today in an embassy review), but he answered them all correctly and was able to provide evidences to back up his responses...he was just missing those two documents...they told him that once he has the documents and gets them notatized and translated that he should come back monday-thursday at 1pm...since our interview was wednesday, we came back the next day (thursday) at 1pm...they let him in with almost no wait at all, and he was out of there within a half an hour with the approval...they told him to come back the next day (friday) at 11:30 am to pick up the visa...and that was that! he will be here on the 25th biggrin.gif good luck to you!

my fiance received a 221(g) for missing court and district attorney certificates

he got both certificates, notarized and translated into english all within 24 hours...he was issued the visa the next day...its really easy...in albanian the certificates are called 'Vertetim di Drejtuesi I Prokurorise' and 'Vertetim di Kryetari I Gjykates', they cost something really small, like 100 lek a peice. He can get them at the 'Prokuriria' and 'Gjkaten'...honestly i dont know exactly what all that means in english, i think the gjkaten is the court house and the prokuriria, im not sure...if he asks someone where he lives, im sure he can find out...i could have you speak to my fiance about obtaining the documents in tirana, but i dont think that will help you since your fiance is kosovar...i wish you luck, and hope that helped you out.

I totally get what Tweety is saying and I don't think it's a matter of being selfish. Think about it if ppl are hired to take care of the backlogs then those who send in their petitions now will get approved in their given timeline and not face being backlogged and the ones that are now backlogged will get their approvals quicker.
I'm just thinking that right now case workers are going from backlogged cases to ones that they just received and so you have recent applications being approved before ones that are being backlogged.
They still have to take care of applications they just received so it's a little hard to concentrate on both.
I do agree on teamwork to get it done but I think it's not a bad suggestion

Most taxi drivers in Jamaica tends to get themselves mixed up with the school children, first to think about the music that they have in their car, most schoolas takes the car with the music, second they like the idea of getting quick cash, but mark this they are some little caniving schoolas out there that will make u think different as well.


You are so right and I've been told this by many. However, I cancelled my petition because I've learned that he was charged for rape and indecent behavior. Thank God I dodged a bullet. Hope his #### rots in jail. Next time I wont be so hasty. You really have to get to know a person before making such a drastic step. i feel very relieved.

You are so right. but honestly, he tries his best with the child support. He doesnt male much as a taxi driver who doesnt own his car. Also, he has an other child as well. It's not like he totally abandon taking care of his kid. I'm more concerned about the rape part. It devastates me that there would have been a possibility of me migrating a rapist to the U.S. I invested so much time and effort into this and now it's like i did everything in vain.

Wow you have a lot on your plate. I don't know much about you or your fiance other than what you typed here, but he has a lot going on. Is he telling you different things about the situation or did you get the information from someone else. The final decision is up to you...all some of us can do is advise you...by the sound of your post, I think you know what's up.



To be honest I havent even spoken to him since the night before getting arrested. I really dont know what to say or think. The officers arent releasing much info and some stories are very contradictory. I was thinking to reschedule the interview for now and once I get more info I will cancel the whole petition. Somethings are signs given from God. What a time for this to occur.

Here goes,

After working so hard to get an approved petition and an interview date everything is falling apart. My fiance's visa appointment was supposed to be on Nov 1st. On October 13th he went to get a police record and was told to pick it up on the 21st. However, he decided that he would have picked it up today along with his medical. However on friday night he was arrested due to warrants from traffic tickets and back up child support payments. Also, they say suspicions of rape. Now he was arrested two months ago for traffic tickets and when he paid the ticket they held him on suspcioins of rape and then they let him go because they said he wasnt the person they were looking for. He's been in jail for three days and I've been calling back and forth and keep hearing different information. Now if he is a rapist there is no question as to whether or not it's over. But, he hasnt been charged as yet and they say he will have to do an id line up to see if he will be picked as the culprit. I'm not sure what to think of this or what to do visa interview wise. Does anyone have any idea how the justice system works in Jamaica? And i really feel like cancelling this petition. I just dont know what to think or feel in this situation.

Thanks for the response guys. The thing about it is the USCIS says that once the money order is cashed that means that it was received. They dont have anything in the system in regards to my new receipt. All they have is my old receipt number. This is alarming to me. I'm beginning to think if something happened. And its not like they mailed anything to me because if they did then it would be updated in the system.

Hello,

I sent in my K1 petition 30days ago and haven't received any receipt number and when I call the USCIS it hasn't been updated in the system. But, they definitely cashed the money order within a week after I sent my petition. Has this ever happened to anyone? This is very frustrating to me because each time I call and speak to a Tier 2 customer service rep they say different time frames. One will say 30 days then another will say 30-45 days. This isn't my first time sending in a K1 petition and both times I received a response within 1 week or less. Now let's see, they say 4-5 months to make a decision, not including the time frame waiting for a receipt number. So in all reality this is an additional month that I will have to wait. Please someone tell me if this is normal because from looking at timelines I havent come across any who waited 30days for a NOA1.


P.S. Please dont respond with any negative comments. I'm asking a question about a NOA1 only!! Thanks.

Depending on where he goes, I know the overall medical is $90-$110 U.S. The shots he is required to have are : Mumps, Measles, Rubella, Polio, Tetanus, Diphtheria, Pertussis, Haemophilus influenzae Type B, Rotavirus, Hepatitis A&B, Meningococcal Disease, Varicella, Pneumococcal, and Influenza. So whatever he doesn't have from this list he will have to pay for. Last year he needed three shots and we paid about $250 all together.
