hello. i am new to this site. i have been enjoying following everyone's stories, journies, etc. i have a quick question. i am the us citizen and my husand is from ghana (in west africa). we are going the k-3 route and i was wondering, if the I-130 is approved before the I-129F, what comes next? Do i just continue to wait for the I-129f to be approved, because I don't think I want to go the CR-1 route. or, do i have to send out some other form once the I-130 is approved? i'm getting a bit confused and I would appreciate any support, because many people on this site have helped me tremendously!!!

HELLO ALL!!!

I am sooo happy to announce that my I-130 form was approved yesterday ( I received the email) and my I-129F was approved today, the very next day...I am sooooooo happy and i feel as if things are falling into place nicely. Both were approved without any RFE's, etc....life feels good. quick question. they have my husband's physical address, but not his p.o. box address where he actually receives mail. should i call or send a letter with this info ASAP, or do both?

our forms have just been approved, both the I-129f and the I-130. what shall we do now? Can my husband go to the embassy now and file for the K-3 visa or do we have to wait until the consulate in ghana receives the petition from the nvc? i am a bit confused and i want to get everything done as fast as possible. Thanks for the info. I tried to find that thread, but couldn't. I know it's probably going to be a wait, I'm just more concerened about who to change the address with. I'm begining to think I'm going to contact both...

When you received that email from NVC, how did they have your email address? Just curious if it's something you have to register like with the USCIS or if it happens automatically.

I feel like I'm asking a really stupid question, because I know we need to be assigned a case number at NVC, but ...

I originally called the USCIS to change my address and they informed me that the case was sent to the London Embassy and that is where I should change my address. I then said, "shouldn't I try the NVC first?" and the woman said, "not all cases are sent to the NVC before they're sent to the Consulate."

Could that be true?!? Or did I get an operater who doesn't know her stuff...

I have been calling the NVC once a day for 3 days, but they stil haven't gotten our case. It's only been 10 days since our NOA2, so I'm figuring it's on it's way there. I just don't want to miss changing our address if what she said is true.

Any thoughts ...

There was a previous thread about this when the Sept batch of NOA2 were released and several members were told the same thing by USCIC and NVC. I think the confusion is there is an electronic notification sent to the consulate the same day the case is sent tothe NVC. It took most of us a month to get notification from the NVC and even then their dates were al jacked up. I called on 11 Oct and they said they did not have my case yet. On 15 Oct I received an email from NVC telling me my case was received on 10 Oct and forwarded on 13 Oct. However their dates are obviously wrong becasue we received our first letter from the Embassy on 30 Oct stating they received our case on 11 Oct, which means NVC had it way before the dates they stated. Call the number again and press #1 (english) and #5 (operator). If they're very very busy, you'll hear something in spanish and then they'll send you back to the main menu. I just try the same thing again 2 minutes later and usually get an operator.

Give the operator your MSC receipt # and they'll let you know if your case has been received yet... etc.

We're in a similar boat. Our I 129F was approved on October 25th. NVC has nothing on our case yet. Some take longer than others, I guess. I have seen people who were approved after us who's cases are at the embassy. It appears to be random.

Unfortunately, NVC and the NOA2 say it can take up to 90 days, so there is nothing we can do, but wait.

No, you don't need to send them with I-130 nor with 129F, if it is for spouse. ONny those who are applying for K-1 (fiance) need to send those with I-129F.

Has anyone had to change their address during the K3 Visa process?

We have our NOA1 for the I129F (August 28th, 2006 date). Though I can still receive mail at old address (old roommate is happy to collect my mail), I'd have more peace of mind with it coming here. Only moved about 5 minutes from old place, so no state changes.

I guess my question is, does changing your address slow the process/cause hold ups? Anyone gone through this before?

Hi again.

After reading snowberrypie's post, it brought up an interesting question. Can my husband visit the US while his K3 Visa is pending?

We were under the impression that he could not (not sure where we got that from). I was planning on visiting him, but being a teacher, my schedule doesn't allow for long breaks. It's always easier for him to come to the US, as his job is more flexible.

My question is, can he come to visit the US? He'd only be visiting for 2 weeks or so... Also, how hard is it to enter/what should we expect?

I've read that if he does visit, he should bring proof of ties to the UK (bills in his name, lease, pay stubs, etc.)

If anyone has any input, that'd be really helpful. Reading these posts and comments always helps us to feel a little calmer and less alone.

I had asked this question a few days back. My husband is also living in London and I am here in the states.

We did a lot of research and really came out more confused than before we posed the question.

The best I can give you is that no where does it state that one cannot come over on the visa waiver program if their non-immigrant K3 visa is pending. On the USDOS website, there is a list of people not eligeable for the visa waiver program and having a pending visa status is not listed.

There is always the chance that he will be denied entrance at customs, so he should bring a lot of documentation showing that he has ties to the UK. People have suggested a lease, pay stubs/letter of employment, etc. In addition, he should travel with copies of the NOAs, so that he can prove is trying to immigrate legally.

That's the best advice I can give and it's basically made up of the advice given to me by others.

The K3 visa is also a non immigrant visa and is a temporary visa allowing your spouse to be in the US while you go through the process of AOS.

Since you've already applied for the K1, I'd stick with it. It's a totally case to case thing, but either way you're going to be waiting. With the K3 you'd have to marry, then file for a immigrant visa and then apply for the K3. You're better off sticking with the K1 because once your fiancee approved you have 90 days to marry and then you are together while you apply for AOS.

In addition, cancelling the K1 visa could be an annoying process for you as well...

As advised by the lovely visajourney.com crowd, we are going to wait until our case is sent to NVC to change our address. However, we were wondering how long it takes to process the change. If we were to call up and change the address after the case is transferred, is that enough time to ensure that packet 3 is sent to the right address? Oh and can we just call to change it, or do we have to fill out forms?

Do the copies you bring to the interview need to be notarized?

We notarized the copies of birth certificates, marriage license, etc., for the I129/I130 packets. Just wanted to know if we should notarize the copies my husband brings to his interview as well?

I know it's early to ask, but I'm going to England tomorrow and I want to bring the copes so that I don't have to mail them.

Hi everyone.

I'm curious about whether or not my husband (UK) and I (US) should use a new apartment lease as one of our evidence pieces (it sometimes feels so weird to throw things that are common, everyday relationship/marriage things into the 'evidence pile'!)

I had to move in September, so we decided to get the apt. together, even though he is still living in the UK awaiting the K3. Today it dawned on me that maybe the lease for the new apt., being in both our names, would be a good form of relationship proof. However, we did 'jump the gun' a bit on getting a place together since the visa application is still pending... not sure if it could hurt us in any way.

Just trying to be extra careful. Any thoughts?

Just sent K-3 last weekend and reached Chicago center last night.

Is there anyone just got K-3 approved recently? What was your NOA date? I checked USCIS site and it is showing the processing date is April 05 for K3. I just want to get some sense how fast I possibly could get my K-3 approved.

Aside from the timeline, as linked above.

There is a thread on here that is called 'where the k3 stands' if you click on the last page of that, you should be able to get an excellent idea of how long it has taken others.

However, as you probably know, it's appears to be pretty random. About every month one or two people don't get the approvals that others get...

Basically i'm putting questions in both places to help people out that might need that information. I'm currently going through the K3 process but have a friend who doesn't use the net who will be going through the k1 process, so i'm just trying to cover all bases really. hope this clears your confusion ;)

The long form Certificate includes your parent's details. If you do a google search for it, you can order yours online. That is what my husband did. It's a small fee.

Actually - funny thing - we saw an immigration lawyer at the start of the process. She gave us a fair amount of wrong advice (k3 doesn't require any affidavit, we should send proof of relationship with our 129F, etc...) and gave us a reference that was actually from VisaJourney.com. That's how we found this site!

We did not stick with her, needless to say. VJ is great help, but as others have stated, if your case is more complex than a lawyer who knows their stuff can be helpful.

I know. If you take the average, our interview date would probably fall on December 25th!! I'm also getting nervous because if you look at the NVC forum it seems like a lot of people are having trouble with their cases going from CIS to NVC...
