K-3 Spouse Visa Process & ProceduresA MESSAGE TO VERMONT
I write this with the hope of catching someone's eye at Vermont. As you may or may not know, there are a number of us waiting for months and months to be with our spouses due to this wait for petition processing. Here on this site it is plain to see that engagement petitions are often approved within half the time it takes for those for actual spouses. I am not questioning fairness - but I am questioning logic. I am married - which means I ALREADY have made the commitment to place myself responsible for my spouse, both emotionally and financially. This responsibility is extremely difficult to honor from here overseas and I would spend this time with her waiting in her country if I could, however I am not independently wealthy so it would prove even more detrimental to our marriage than this distance. Not to mention that seperation from her is heartbreaking.I know there are many elements at play here - politics, bureaucracy, etc, - but take this as a plea for the consideration of the numerous families that are being kept apart during these long wait times for petition processing.

One piece of advice.. keep calling the attorney regularly because the VSC has been known to send mail to the lawyer and not the actual petitioner. So, if your lawyer's really busy they may not let you know right away if something was sent out - evidence request, NOA, etc..

I am an April filer, and according to recent approvals it appears that VSC is busy with March filers. But according to timeline data there are a number of Feb K3 filers still waiting.. Is that the case or are people just blowing off this site after their approval and not updating?? If there are any K3 Feb filers still waiting please respond to this and if you have NOA2s PLEASE update - this would help us gauge where VSC really is with our applications.

Yes, I called and commented that I am past 6 months and the officer said I wasn't. I attempted to dazzle him with my math skills but he just said I was wrong. It feels like they will deny that the sky is blue on a sunny day - According to this guy they are still processing end of Feb I129Fs at VSC... #######!!

As one of the many petitioners waiting patiently for their spouses to be allowed into the country, please understand and believe me when I say that we're approaching the most difficult time of the year to be separated. For all of you working at VSC who have families - children, wives, and husbands - and get to come home every day after work to be with them and bask in the holiday glow together. To all of you at VSC who wake up each morning next to the love of your life, the reason for your existence. Just imagine this... imagine coming home to a dark, quiet house. Imagine waking up in the bed alone without your wife/husband. All because your country deemed them unsuitable to be allowed into your home until the completion of an eight month + waiting period. This is all I ask - please just think about it. If I could just ask for one thing this Xmas it would be an approval notice from VSC for Marcy 's visa. C'mon VSC, you could make so many people happy this month!!

I might be waaaaaaaaaayyy late with this, but as far as your mail goes, you can go on to the USPS web site and file a request for your mail to be held until you come back! I always had this done when I went to Scotland, because it was simply too inconvenient for my friends and family to truck up to my house.

I sincerely doubt the individual in question will be able to adjust status. If he does attempt it at all, it should be with a very well-qualified immigration attorney (whose assistance will not come cheaply) and without leaving the States.

I don't think anyone at VJ can, or even should, attempt to advise any further than that. We're dealing with something that is probably worse than EWI.

Yes, please do that. If nothing else, it will buy you time. You've been through a horrible experience and I think it's reasonable to expect that something can be done in your situation.

That's why I said she might have more luck once the case reaches the Consulate. They have more discretion to act than a USCIS service centre or the NVC.

Mainly I was telling the OP not to count on an expedite in Manila. It might happen, but I'm not going to tell her it definitely will. And she definitely shouldn't pay that lawyer one dime!

You might have some luck getting your case expedited once it hits the Consulate, but as you're going through Manila, I would not count on it. The only situation in which expedites are granted are for active-duty military petitioners facing imminent deployment.

I'm so sorry about your husband's mother, but I would not trust any lawyer who wants you to pay $400 for something he or she has no business promising. Your husband can try his Congresspersons, and he already pays their salaries in taxes. But I don't want you to get your hopes up, either; USCIS/DoS hear expedite requests all the time, and the only ones we know are regularly granted are for military personnel as I mentioned above.

I don't know that I would go about openly posting fraudulent circumstances on an Internet message board, that's for sure! :wacko:

Anyway, the beneficiary of a K-1 can only adjust status via marriage to the original petitioner. If violence was involved, she may qualify for VAWA relief with the I-360, but just with that alone, I would get a lawyer on the case. The fraudulent marriage + violence + new relationship=total paperwork disaster at the very least.

As far as entering the States while your K-3 is processing, I think some folks here have done that successfully. You can always present proof of your visa application (like an NOA) as pretty substantial evidence that you'll be returning to the UK, as you'll need to do your visa interview! :) It's never a sure thing, of course, but not out of the question either.

What you're suggesting is perfectly fine. People do it all the time. :)

If you're planning to marry in the States, you're wise to return home and wait out a spousal visa, in your circumstances. You're right that weddings and subsequent status adjustments can, and do, happen when the wedding is unplanned, but since you know you're getting married, the right track for you is to do exactly what you're doing.

I couldn't think of anything when I first posted this, but some things just came to mind:

1- he owns like 3 shirts and 2 pairs of jeans, compared to my 50 shirts and 10 pairs of pants
2- his clothes must be an expensive name brand, because he believes they are 'better quality'
3- everything he wears must be neatly pressed and there must not be one speck of lint on it, or it is 'disgusting'
4- it is very important to him that he is identified as being catholic, even though he knows next to nothing about the religion, nor attends church
5- he is definitely NOT afraid to speak his mind and will physically fight someone if he feels it is necessary, all in the name of 'respect'
6- police and other authority figures are like a joke to him
7- he thinks that he can talk his way out of anything
8- he is extremely proud of being albanian, yet makes fun of his country with almost every mention of it
9- nothing is more important than family

I just so happened to log in after not being around for a very long time. The short answer is yes, you need all of the documents. We went to the interview without having obtained everything, and had to go get the remaining documents and return for a second interview. You can check out my review of the interview in Tirana here. I go into great detail about the interview, and explain where to obtain the necessary documents. Hopefully that helps!

i am wondering who here has obtained an albanian police certificate, and how long it took? my fiance is convinced that he can obtain all of the necessary interview documents within one day...i tried to tell him that it took me weeks/months to get all of the info in order to send in my 129F, but he doesnt listen...maybe he just thinks im retarded and/or paranoid :no:

anyone obtain the district court and/or criminal record from the ministry of justice as well??? how long for those?

I have not been to Kosovo, but I have been to Albania, which is very similar and right next door. Your son will be fine, as the country has become very stable in recent years. The great news is that Albanians love Americans for our help with the war, so I would not be worried. I have heard that Kosovo is generally more beautiful than Albania, since it was part of Yugoslavia, and Albania was not. I hope your son enjoys his time there! I will let you know if my husband tells me any place in particular he thinks would be of interest.
