James and/or Miranda.. the K1 is only for a fiance visa. If you are already married you have to go the K3 or CR1 route... We file for both and go with the one that is faster which tends to be the CR-1

What James and Miranda said LOL

Every case is different.. from K1, K3 to CR1.. and you never know if your file will be delayed for inaccurate or missing information.. In our case we were sent a request for additional information because the CIS needed my stepson's birth certificate. That delayed us about a month. So you just never know.

Also, I am not sure where you got the 4-6 from but there are a bunch of differnt "counts" that people do:

There are day counts from the time the case ARRIVES at the NVC and a case number is issued until the interview is scheduled... counts from when case LEAVES the NVC to the embassy... etc...

Your best bet is what everyone else said... check out the threads for London and check the lists.. they are good "guestimates"

Cari

Thanks Cari............was referring to the time from when the Packet 3 is returned. I don't see alot of K3's on that thread. You are right, I know it's different for every case..........NOA2 is taking long enough for a process that's supposed to be faster than K1. I just wanted to try (that's laughable) and put a rough marker on when this nightmare will be over.

Sorry I can't help with that... Our K-3 was dropped cuz the I-130 got approved first... So please pass go and forego the Packet 3 and go straight to the Interview for us LOL... But do check out the threads.. there are few people with K3 on there..

US Embassy and Consulate DiscussionLondon Embassy Interview Date
Hi.. It all depends... You can call the Dept of State yourself (202-663-1225) and ask if an interview has been scheduled (as soon as the Embassy schedules the date the DOS is notified so they are quite up to date).. If you have e-mailed the Embassy to ask a question they will e-mail you when the interview is scheduled. Thats what happened to us.. I went down for a smoke and came back to the best news in my life LOL.. otherwise they will send the Package 4 to your SO in England with all the information regarding the interview and the medicals

US Embassy and Consulate DiscussionPacket 4 questions

First thing you might wanna do is update your timeline so we know where you stand at. :) Use the link on my signature to see how you update your timeline.

You should probably have your fiance call the Embassy and inform the address change and that they need to send packet 4 again to the new address.
Can't she have the person living where she used to live send her the packet?

Yes, call the embassy and get the new address entered. There are a couple of forms in the packet, the interview letter and the form to pay for the interview. I don't think she can get into the embassy without the interview letter. Try calling this number: (632) 528-6300 Once you get into the system select the option for knowing the extension you want. When it asks for the extension enter 5184 or 5185. If the number is busy just re-enter it. The lady at 5184 was so very helpful for us when we went through the process. I would normally call around 8:00am Manila time and would usually get right through. Good luck

SHE MUST HAVE THE LETTER SCHEDULING THE INTERVIEW TO GAIN ENTRY INTO THE EMBASSY!! Call and also see if they can e-mail you as well. Good luck!!

K-3 Spouse Visa Process & ProceduresHelp Filling Out i864 Form!

Hi All,

My wife and I are confused about how to fill in the i864 form. Our situation is the following: I am an American citizen from Idaho and my wife is Vietnamese. We were married here in Vietnam almost 1 year ago and have already filed the i130 and are waiting for approval (it's been about 3.5 months since we submitted). Due to my status as a graduate student and to keep things simple, my grandmother will be the financial sponsor and needs to fill out the i864 form. From what I understand both she and I will fill this form in. What I am confused about is how to classify each of us in section 1. and 6. From what I understand I am the petitioner but does that also make me a joint-sponsor even though my grandmother is is the financial sponsor? What box do I check? And does my grandma as the sponsor check "I am the only joint sponsor" or "I am the first of two joint sponsors" with myself as the other joint sponsor?

For section 6. since I am the petitioner but not necessarily I think I don't need to fill in my financial information. Is this correct? Anyway guidance here would be greatly appreciated!

Thank you to any responses in advance.

Greg and Tuyen in Vietnam

you both have to fill out forms on your form you are the petitioner so you tick that box. your grandma is the joint sponsor if she is the only one helping with sponsorship she ticks the box that says only joint sponsor. you still have to fill out question 6 about your financial

US Embassy and Consulate DiscussionK-3 PACKAGE AT GHANA EMBASSY

I don't know about K3, but we are filing for a K1 from Ghana. First my fiance picked up package 3 and was told to return what ever they asked on any Wednesday. On that same Wed. they told him to come back at 2pm to get package 4. Package 4 had the interview date in it. I don't know though if yours is the same. Wish you luck

THANK YOU SOO MUCH!!!

US Embassy and Consulate DiscussionK-3 PACKAGE AT GHANA EMBASSY
Hello everyone!

I know it has been a few weeks since our NOA 2 on the 129-f, but I just received the letter from the USA embassy in Accra stating that my husband can come in any monday, tuesday or thursday to pick up a package regarding the K-3 process. My question is this: what will this package contain? Will we know the interview date once he picks it up?

I already have all of the information that he will need for the interview (I-134, pay stubs, etc.)

CAN SOMEONE PLEASE TELL ME WHAT THE PACKAGE WILL CONTAIN? I know it's packet 3 and 4...do you get both at the same time???

I appreciate all the help I can get...

YAY :-)

US Embassy and Consulate DiscussionPLEASE HELP!!!
HELLO EVERYONE!!!

I NEED SOME HELP REGARDING MY K-3 VISA. SO MY HUSBAND WENT TO THE EMBASSY IN GHANA TODAY TO PICK UP HIS K-3 VISA PACKET. IT CONTAINED ALL THE FORMS (DS-156, DS-230) AND A CHECKLIST. HE HAS TO HAND IN SOME FORMS FIRST, AND THEN HE WILL RECEIVE THE INTERVIEW DATE. MY QUESTION IS, DOES HE ONLY HAND IN THE DS-156 AND THE DS-230 TOMORROW AND THEN THE REST (POLICE REPORT, MEDICAL FORM, ETC.) WHEN HE GOES FOR HIS INTERVIEW?

I REALLY NEED TO KNOW THAT INFORMATION ASAP!!!

THANKS SO MUCH...

I APPRECIATE YOUR HELP!!!

US Embassy and Consulate DiscussionAffidavit of Support
I know this question has been asked before... but, when filing an affidavit of support for the K3 visa, do you use the I134 or the I184? I read in another post that it depends on where your spouse lives. If this is the case, does anyone know which form is required at the London Embassy?

Thanks.

US Embassy and Consulate DiscussionPacket 3 Forms

Thanks for the answers.

The problem with the date stamps are that they are ALL stamped on top of one another and you can't make out one date from the next! It's a complete mess...

I would look at calendars from the past 3 years and recall the dates he visited, I find looking at a calendar helps me figure out things like that.

We've done that. We're sort of nervous that the dates may not be exact. We've gone through emails to try to find exact dates of flying back and forth. Guess my next question is, how accurate do these dates have to be? Can they be rough estimates?

Thanks!

US Embassy and Consulate DiscussionPacket 3 Forms

26) PERMANENTLY
27) MARRIED TO A US CITIZEN AND RELOCATING TO THE USA
32) WITH WORK AUTHORIZATION, EMPLOYER UNKNOWN

Nothing wrong with the example form here, just reword it a little to meet the requirements of your K-3 visa.

http://www.visajourn...Form-DS-156.pdf

The dates should be in his passport, Entry/Exit stamps.

US Embassy and Consulate DiscussionPacket 3 Forms
I was looking at form DS156 today got a bit confused.

Can anyone share any experience on filling it in (I searched for a post, but found none).

Specific questions that are confusing:

26. How long do you intend to stay in the US. ?
27. What is the purpose of your trip?
32. Do you intend to work in the U.S. ?

I just don't want my husband to answer incorrectly...

I looked at the sample, but it didn't apply to K3 visa.

Thanks a million!

Kristina

Oh, also, my husband has been to visit me in the past 3 years at least 15 times... has anyone had trouble remembering exact dates?? Do we put estimates or is there a way to find out exacts??

US Embassy and Consulate DiscussionFilling out the I134

Yes I-134 is used in Non-Immigrant cases at the consulate, The K-3 is started by the I-129F, so you are correct by putting I-129F

See example form http://www.visajourn...xp-04-30-07.pdf

Thanks. Another question has come up.

For question 11 I would check 'do not ...' and write "N/A ( K1 visa process for permanent residence )

Hey everyone.

Just double checking...

On the Affidavit of Support, question 10, I put the I129F, not the I130 in that spot, correct? Also, for its date, I put the NOA date.

Thanks

US Embassy and Consulate DiscussionK3 interview date, I130 at embassy too
Hey.

If you want to contact the London embassy via email, you have to call first and get a reference number to put in the subject - otherwise they'll delete your email. You could try putting your case number in the subject of the email, I've heard that works for some, but it didn't work for me!

Lots of luck with the rest of your journey!

K-3 Spouse Visa Process & ProceduresWHAT IS MY STEP-SON FILES AS ON AN I-130?
The K visa for spouses *may* provide a major benefit for older stepchildren. Until now, a US Citizen would file an I-130 for the foreign spouse, and separate I-130 petitions for each child or step-child. Stepchildren would only be eligible if the marriage took place before the stepchild's 18th birthday. The revised I-129F will automatically include all children under 21, with no separate petition required, removing a major disparity between current K1/K2 and spousal immigrant visa processes. However, Although a separate I-130 petition is not required for the children to obtain a K4 visa, an approved I-130 petition is required before they may be approved for Adjustment of Status to permanent resident. The I-130 petition still states the U.S. Citizen petitioner may not file for a stepchild, unless the marriage took place before the stepchild's 18th birthday. This detail must be addressed, in order to prevent an older stepchild from moving here on a K4 visa, yet being denied approval of the I-130 petition.

this is what i was talking about, when they told me i need to file an i-130 for him although he came ni with his father on a k4.. so technically am i filing for him as my CHILD in the box options?

K-3 Spouse Visa Process & ProceduresWHAT IS MY STEP-SON FILES AS ON AN I-130?
Thanks for responding. I called USCIS yesterday and asked them in the morning. They gave me a whole layout telling me that if I have not filed an i-130 for him that if he came with my husband and my husband was approved that when i send both of their packages I must also send an i-130 for the child. Do you ave any info on that?

K-3 Spouse Visa Process & ProceduresWHAT IS MY STEP-SON FILES AS ON AN I-130?
Im posting this forum because I am a bit confused as to how im supposed to mark my stepson as on the i-130. My husband and his son are already here on their K3 and k4 visas respectively, I am not preparing the forms for Adjustment Of Status and found out that surpirze I have to pay more money for his son to file an i-130, on the i-130 though there is no stepson check mark on the top, how do I check mark him, as my Son or something else. Please advise. Thank you for your time and assistance, I trully appreciate it.

I hear that they are pretty quick - so if I were you I'd call them to see if they received the packet from NVC and start getting your stuff ready like affidavit of support, medical, police records, etc. I think after the interview it should be ready after a day or two.. we're still awaiting our NOA2s..

I'm still waiting for both petitions and that's why I went to my congresswoman's office today.. I met with the liason who IMMEDIATELY got on the phone and called USCIS and was able to tell me that my 129F was just put into the queue for processing 2 days ago. I was like "uh, OK, wasn't that where it was anyway?" And she said "no, it's finally ready to go into someone's hands for adjudication in the next few weeks so be patient and wait"... I've heard many people so far say to be patient and wait and I'm getting tired of it. But, this might be something real... Has anyone received any good news from congress that panned out?

K-3 Spouse Visa Process & ProceduresA MESSAGE TO VERMONT
I write this with the hope of catching someone's eye at Vermont. As you may or may not know, there are a number of us waiting for months and months to be with our spouses due to this wait for petition processing. Here on this site it is plain to see that engagement petitions are often approved within half the time it takes for those for actual spouses. I am not questioning fairness - but I am questioning logic. I am married - which means I ALREADY have made the commitment to place myself responsible for my spouse, both emotionally and financially. This responsibility is extremely difficult to honor from here overseas and I would spend this time with her waiting in her country if I could, however I am not independently wealthy so it would prove even more detrimental to our marriage than this distance. Not to mention that seperation from her is heartbreaking.I know there are many elements at play here - politics, bureaucracy, etc, - but take this as a plea for the consideration of the numerous families that are being kept apart during these long wait times for petition processing.

Thank you,

Lee L
