IR-1 / CR-1 Spouse Visa Process & ProceduresProof of Domicile

Your joint sponsor does not need to live at the same address as you (I put joint sponsor in bold because that is proper term with the I-864). A joint sponsor can live in a different city or even a different State.

Thanks for the clarification Ryan H!

This is a good start! Thanks!

I have the same basic question. I see the response above is specific to Canada. What if you're somewhere else? Also, does your co-sponsor have to live at the same address as you? My husband and I are waiting together outside the US. My mom has agreed to co-sponsor but we are planning to move to another city.

Fan our plan work? I don't want to leave my husband to setup house and prove income in advance if I don't want to. Can anyone help? He is German and we will interview in Barbados.

Thanks!

IR-1 / CR-1 Spouse Visa Process & ProceduresProving property ownership
Hi everyone,

We're getting ready to prove our financial worthiness. I own a property and my husband and I are buying another that we intend to move to when we get approval to move to the US. My question is, what documentation is suitable to show ownership and value? I hadn't even thought about this before. Not sure what I need to get and how challenging it may be from overseas.

Thanks for all your help!

IR-1 / CR-1 Spouse Visa Process & ProceduresFingerprints
Hi everyone,

A friend of mine mentioned today that for the visa for his wife she had to give fingerprints at one point. Now I am wondering at what point I will have to give fingerprints as this was the first time hat I actually heard of it. Will it be after the interview while I am still at the consulate?

Thanks for your help!

IR-1 / CR-1 Spouse Visa Process & ProceduresGot an RFE about proving US domicile - what to do?
Im just working on this myself. Im sending Us bank accounts, us drivers license, voter registration, 401k accts with US address, estimates for shipping belongings back to the US, quotes for shipping animals, quote for insurance for car we plan to purchase, There is a letter template in the nvc thread that is helpful. Maybe information about enrolling your kids in school, anything that shows you're setting up life and even better, any thing that shows you maintained ties while you were gone. Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 "All visits to the United States
Hi all,

We are filling out the DS-230 right now. Under question 35 I have to list dates of all my previous visits to the United States.
1. I only have my current passport, the older ones I don't ave anymore, so I can only estimate when I went and from when to when.
2. Does this include all transits?
3. What is this used for?

Please let me know if anyone has previous experience with this.

Thank you!

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 requirements
Hi all,

I have a question: one of the requirements for the IV package according to LingChe says: "police certificate is required for any place in their country of citizenship; the beneficiary has lived longer than six (6) months, after the age of 16."

I have my police certificate from Germany but there is only one certificate, there are no certificates for specific cities/ places. Since I lived in several cities in Germany since I was 16 I am worried that they want to see more certificates.

Any experiences with that?

IR-1 / CR-1 Spouse Visa Process & ProceduresASSET CONFUSION!!!!
We used the value of our home as an asset and investments. We showed the value through a recent appraisal and that it was not mortgaged as well as investment statements for the last 6 months showing that the account has history. I think if you want to show cash in the bank as an asset then you would need to show history of it being there so perhaps several months of statements showing a steady balance would suffice.

I'm sure that others will have more input.

Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresTo travel or not to travel? That is the question.
My husband and I visited the US several times during the process, even during NVC. We had all of our documents ready to prove ties to home but were never asked for anything. Go for it!

IR-1 / CR-1 Spouse Visa Process & ProceduresUSC petitioner living abroad
1. Country USC resides in: British Virgin Islands
2. USCIS field office or DCF?: NO
3. When did you file I130: February 2012
4. How long has the USC been living abroad: almost 5yr
5. Do you reside in the country legally: Yes. But I have nothing in my passport to show that- I was born here and don't need permission to work or stamps in my passport
6. What is the reason for your residence: employment
7.did you list your overseas address on I130? no
8. did you send the package from abroad? yes
9. did you include evidence of your residence abroad in your I130 package? YES, we included our company housing as we have no lease or utility bills
10. did you mention that you reside abroad in your cover letter? No, my cover letter was basically a table of contents. I hadn't seen any that were actual letters; didn't know it would be helpful
11. Has your case been auto expedited? How long between NOA1 and NOA2? No- we're at day 58....
12. which Service Centre? VSC

I wish you all knew how hard I'm kicking myself. I really thought that using my US address would help to establish intent to return since I own property. :(

We are waiting on this visa to leave to go back to the US. I'm wondering if it is worth filing a new petition for faster processing?? Or have I waited long enough that we should stay the course? Also, my husband is not from the country we are living in. Maybe that is also confusing??

K-1 Fiance(e) Visa Process & ProceduresGetting started on the K-1 journey
Is it true that if we get married and file for CR-1 that my fiance/husband won't be able to enter the US until the visa is approved? We live in the caribbean and for us it is virtually impossible to go anywhere without flying through the US. It will cause problems for his job if he cannot fly through because of the process. Any ideas on that aspect? I guess I have a bit more reading to do....feeling a bit discouraged. Thanks for your help!

I understand that we need to marry in the US. The plan is to get married, then return home to give notice at our jobs and then move together after we are married.

K-1 Fiance(e) Visa Process & ProceduresGetting started on the K-1 journey
Let me begin by saying that I know that only lawyer can give actual advice but given that many folks seem to have a bit of experience with all of this I would love some thoughts. My fiance and I both live outside the US and are planning to get a K-1 visa and once married, move to the US. So I have few questions that all boil down to wondering if I need a lawyer or if I can read all the fine print, follow directions and get through this process without. Many of the forms assume that I (the US citizen) am in the US- I'm not. I also have a challenge because once the visa is approved and we move to the US, my income will obviously change when I get a new job ( likely for the better). I've done lots of reading about all of it and downloaded the forms I think we'll be asked for and started collecting information. My fiance and I have been living together for a year and can easily prove our relationship, the question is just because our situation does not quite match the template that USCIS had in mind when they set up this intricate process. Also, if we start without a lawyer, can we hire one later if we run into trouble? Can anyone share any thoughts or similar experiences? Thanks in advance- I'm looking forward to starting the process!

K-1 Fiance(e) Visa Process & ProceduresThis is really annoying....

It's not that we can't make it through 5 or 6 months it's that we can't wait to be with each other. It's easy, having already received your approval to say that the process takes the proper amount of time when you're already with the person you love. I just think there should be more transparency throughout the process.

Furthermore, I don't think they extend the process time to test the strength of the applicants' relationships, I just think it's a bunch of lazy gov't employees taking their pretty little time because they could care less. I personally know social workers who tell me stories of how within their respective offices and departments how little they actually work.

As a former federal government employee I don't think you should lump all into one category as "lazy". Remember, they get THOUSANDS of petitions a day. How fast would you personally get through them all? It takes time. Even if each case is handled in 10 minutes, each one has to wait to get to the top of the stack.

We are all waiting. We all have situations. I hope that venting makes you feel better but do look at the realities of the amount of work being processed. We cannot all be processed at once.
