Good ideas. Thanks! Unfortunately, here we live, we don't file taxes. As of now, neither of us has a will but we can certainly do them. No major assets to speak of o there hadn't been a need. I had assumed that only "official documents" would be accepted to prove the relationship and hadn't thought of cards and receipts. I will work on some of those. I have been added to his medical insurance and we have the same post office box. sadly, we don't even have street addresses here so we can't show physical residence at the same address. We don't even have utility bills since ours are covered by the company we work for. I'm not sure if I can add a non-US person as a beneficiary to my 401k accounts since he doesn't have a social security number yet. I'll give it a shot though! All of these other ideas are good ones and I'm holding on to as many as we can get!

Its stands to reason that the USC petitioning for anothers visa to enter the USA would be domiciled in the USA. In fact its a requirement.
If you are not employed in the USA you should seek a co sponsor.


I'm sure that is the most common scenario but I live and work outside the US, where I met and married my husband. Now we want to move back together. Are you sure it is a requirement? I wasn't under that impression. Confused now!

It seems that this whole visa process is designed around the assumption that the USC lives in the US. It's a little frustrating!

My mail service is very spotty on my small island. Sometimes mail from the US takes up to 2 months to get to me. Is there a way that I can use my mother's US address as my mailing address without the application showing that I live at that address? I want to make sure they realized that I, the USC, lives outside the US with my "alien" husband.

Does anyone know how to handle this situation? I'm putting our I-130 packet out with FedEx on Friday but I'm worried about whatever they want to send back to me.

Hi everyone,

We're doing our 110th check of the I-130 packet before sending it out tomorrow. I'm putting my US address on the I-130. My physical residence is outside the US and I have listed that where my husband and I live together as well as on my G-325A. Does this sound correct?

Also, on our passport photos, we used ballpoint pen, do we need to redo in pencil?

We have a letter from our employer explaining that we have no lease but have been living together for more than a year and also 2 affidavit from friends- do we send copies or originals of those?

I think we have everything else covered and once I read the directions for the millionth time it wasn't so complicated. I can't wait to get this out of the house!

We just mailed our packet today. In addition to the required forms we sent 1 page of pictures, 2 affidavits from friends, letter from employer stating that we relive together for 2 years (company provides our housing), form I sent to my 401k designating my husband as my benificiary and the form we will out to have joint health insurance coverage.

I hope it helps you! We spent a lot of time working on it....such a relief to get it out the door!

IMO, the 'date of issue' needs to be between 2 days to 6 months prior to the scheduled interview date, that interview at a US Embassy/Consulate Immigration Visa Unit.


In several cases he hasn't been back to these countries since he moved. So do you think waiting closer to interview date matters?

This response does not address the question being asked. Police reports should be exactly as requested and issued no longer than a year in advance of the visa interview. It's best to have them as recent as practical. If one has not lived in the specific country, an older police report will probably be accepted as long as it is the correct report.

How recent do his police records need to be? He has police reports from Saudi and Bermuda from when he applied for work permission here. Dowse need to get new reports again? Even though he hasn't been back to either place since he moved? Anyone have any experience with this?

when you write 'as little as 30 days' you really meant to say 'in as many as 30 days'
as
many of the I-130 petitions are being approved right at the 2nd week mark.

I'm actually happy that the adjudication queue got shifted now that DCF has been yanked.


Darnell, How can you see from a timeline where the USC is petitioning from? I've been looking, trying to see if there might be hope of faster processing for my petition but can't see how to tell where the petitioner is.

Thanks but I am just going to leave it at that. I shoul have never gotten way to excited about this but I'll wait. and I doubt that the approach was wrong. I was polite and they wouldn't even change my address. They said their system can't change the address to one that is overseas.


I understood the same thing that I had to use a US address on the I-130. So I did. They don't make it easy!

Would using my US address confuse the issue? I used the address to he property I own, where I still get mail as the address in an attempt to show intent to return. All of our supporting documentation shows that I work and live outside the country though. Do you think I confused the issue?

I understand that the faster processing for overseas applicants was only through DCF. Once you file through the lockbox, you're processed like everyone else. Sadly, We had to file through the lockbox as well since DCF is not an option for our country. I had hoped for speedier processing as well! You'll get there soon!

My Dad has been taking care of filing my taxes while I have been living in the UK over the past 5 years, but he said that he hasn't included my foreign income and foreign taxes over that time. My parents have agreed to be co-sponsors when we get to the AOS stage, but do you think this oversight on my taxes will matter when they look at my tax returns?


From what I understand, we have to declare our foreign income to the IRS but a certain amount each year is tax exempt. I've never made enough to be taxed. You may need to redo your past taxes. Please check IRS web site and do not take my word for it alone.

I'm getting ready to file my 2011 taxes but am wondering if anyone has been able to get turbotax or another software to understand that foreign income doesn't get a W2. I hadn't filed for the last couple of years, not knowing I was supposed to. Then I found an expat tax company to file the last 3 years for me so I am current. They were very nice and helpful but also expensive! What are other foreign residents using to fill out tax forms? Any advice?

Yeah...I saw that foreign applications are going much faster. I can only console myself with getting outed to Vermont at least. I looked at the change of address form but it says that I cannot change to a foreign address unless I'm military. But I'm not. So...now what??

Is it going to cause a problem that there are 2 different addresses? Potential RFE?

Hi everyone,

My husband and I are living outside the country and I put my current address on my G325 but on my I-130 I put my US address where I own property and receive mail. I do not actually live there and have not for 5 years. I'm kicking myself now because I'm guessing this may slow down our processing as the addresses do not match.

At this point, is it best to send in a change of address for my I-130 so that the addresses match? Or do you think they will figure it out? I don't want to get an RFE. I thought that using my US address would show my ties to the US and intent to return. I now realized that I didn't need to do that at that stage of the process. I'm feeling like I may have already made a mess of thins- a bit discouraged.

Any ideas on the best way to fix this?

Your joint sponsor does not need to live at the same address as you (I put joint sponsor in bold because that is proper term with the I-864). A joint sponsor can live in a different city or even a different State.
