I think 3 months is more than enough time!! Start now..

For instance...Does the USC have family and friends to help him/her? Everyone always says it's the "bride's" day...but if there were no groom.....*shrugs*..

So you just make sure that if you're the bride that's coming to the States, ( as I am ) get him involved!! Tim's sister will be my maid of honour, and she's now my eyes and legs as she's checking out patterns and material for the bridesmaids dresses. I've pick out my pattern, and when I'm there we'll make it. Tim has checked around for reception halls already, to find prices, and of course how many people can fit into it!! LOL...We are having a big wedding!! I mentioned the "civil" part...but got no response, so I don't think it sits well...

I'm fortunate that I can go to SC for a month, (pending boarder patrol, of course). But that's our plan. I know that's difficult for a lot of people. During that time we will decide on several issues, and just have our baskets floating in the air until we can secure a date. We filed in Jan. and HOPE that all goes well enough for a Summer wedding....That would include the months of June, July, August, possibly September. When the interview is set...We'll have everything almost locked in until we know for sure...then it will be some quick calls to secure halls, etc.

Oh..and as for invitations...They can be expensive. A friend of mine just lost her mother and at the funeral, I was impressed with the pamphlet she had. A nice coloured picture of her mom, and write up, all on nice printed card stock. I asked where she got them from, and she did it up on her computer!! Then she took them to Staples, and had them printed off on the stock. They really looked good, and wasn't that expensive at all!! I think about $30 or so. I think she said she used Word, so I'm going to have her come over and show me. That way, I can use a picture, write up...and when I know the date, add it, print it...go to Staples and get them in the mail! Tim is going to do invitations for State side, I'll do them for Canada side.

Good luck with all your planning...it really can be done. I'm sure if we can get most of it organized now..we could have a "big" wedding within 2 or 3 weeks of my arrival.

At first, I thought it would be about 2 months after entry, but I'm planning...( and praying like crazy) that I'll be allowed to pass the border for the month of April. During that time, we are going to make some major decisions. Tim needs a little work in his house, so we can do that, and my wedding dress made. We're going to decide on a list of places for a reception and photographers. Then, when we know the actual date, he can start calling them and whoever is available, we book them! We'll choose flowers, and decide how to decorate the church and hall, and pick out teams to help us. Basically, we want to know what we want during that month, and then...when we have the date, we can lock in everything. It's going to be a busy month!

When the interview finally takes place, ( and Tim is coming up here for that ) POE hopefully will be within a week, or less of that, and the actual wedding to take place within 2 or 3 weeks of arriving. Very tricky planning a wedding from 2500 miles away when you are the bride!! laughing.gif

I'm wondering whether or not you were planning an actual wedding, with guests, food, etc.? If you want to take some time to think about things, you DO have 90 days...and if you decided to go ahead with it all...then just get married. Later, you can plan a ceremony with your friends and family.

Although the 90 days may not be what some would deem a "get to know you stage"...it can be used for that purpose. I read quite a lot of information concerning the K-1 visa, and how it's changed a lot over the years. They eventually added the 90 days, to give the foreigner a chance to see whether or not they even liked living in the states, and whether or not the two people actually got along. Most people however, are pretty sure of it all, otherwise they wouldn't be spending that much money, but some people do end up with culture shock! As long as you either get married before that 90th day, or if you decide not to go through with it..he needs to leave. You could always apply later.

I'll be doing my own travelling soon too. March 20th I'm heading for NYC because I actually have a Greece tour that leaves JFK. On my way back from that (only a week in Greece), I'm going to SC for the month of April. I have NEVER been in the States that long before, however, last May we took a two week road trip down the coast from Washington to California. *Beautiful!!*. I'm sure at that time all they wanted to know what was I doing, where was I going, and when I'm returning to Canada. I must have said "boyfriend", and they didn't even flinch, nor asked to see any proof of ties. This time however, I am bringing some proof, ( letter from employer; the fact that I paid my bills for March and April only etc) just in case.

Best wishes and I hope everything clears up with USCIS. I'd be contacting a senator over that one. You SHOULDN'T have to pay again for something they admit to losing. But that's just my opinion.

I suppose I could have requested an earlier date, but I had "heard" that the Consulate was full until the end of June, so I faxed off my information right away. I was pleasantly surprised to see the 23rd!! biggrin.gif Wait until you get your letter from them, they'll explain everything they need, plus give you the medicals phone #, although it's voice mail only. I made my appointment with them online, and they'll show what vaccines they look for depending on age. ( I have to get some updates for that!!) The consulate will also ask when the proposed date of marriage is, so if you're hoping for say the middle of summer, then they may try to accommodate that, the med. office needs a couple weeks notice. Sorry for hijacking an answer laughing.gif...hope it helps the OP some wink.gif

We haven't used a lawyer yet, even though it was strongly suggested to me to do so, and everything has gone quite smoothly so far. My interview at the consulate is on June 23rd, and even the letter from them for everything that I need is very easy to follow. Like it's been suggested, read the guides so you know what to expect every step of the way, and therefore be prepared well ahead of time. That way..no surprises!!

I can appreciate that. Look into it very carefully before making final decisions. I think that you can get married, but not file AOS but the K3 or CR1 (which I've heard is much better and cheaper!) And I'd also like to say that if she came and you married and filed AOS, you need to prove her intent of visiting was NOT to get married. That may be hard to do. It was suggested to me to do that with Tim, instead of all the "other" paperwork stuff...but I figured that it was too risky and we went about the K-1 route. Best wishes for your plans!! kicking.gif

By the way. A Canadian can visit for 180 days. It's roughly like 6 months, but you need to watch the days, not months that she's visiting.

Yes, you're right about the time line. When she gets the visa, she has 6 months to cross the border. But once she crosses, then the visa is "activated" and she now only has 90 days to get married. It's almost June. I'd say get your things together, read the guides carefully and send it in!! Mine and Tim's took 3.5 months to the NOA2, but my interview at the Vancouver Consulate isn't until June 23rd, so basically, 6 months from the time we initially sent in the files. We used Vermont. Some Canadians have been sooner in approval, some later than us. One just never knows these things. If you send now, perhaps her interview will be around December. Depending on factors, she could move in April, which is still within her time limit.

I'm not sure if this has been mentioned or not. If you decided to marry in Canada, to go CR1 or K3..(heard CR1 is MUCH better, but may take longer), I'm wondering why the two of you still couldn't go international for a honeymoon. Europe for example. As long as when you return, she resides in Canada, you in the States...just a thought. Make sure that her boarding passes always match up to what her passport says too. I could be wrong about the trip.

Well, I'm certainly no expert, so keep reading the guides as they are quite helpful.

K-1 is for fiance/fiancee ONLY! You cannot be married to file this. It is a petition sent to either Vermont or California (depending on where you live). Read the guides as to what it entails. After USCIS approves the petition, it is moved to NVC and then the Consulate in her country where she will go for a medical, and interview. Again read the guides so she knows what to expect. Very hard to say what the time line is, but you can check out the Immigration timelines for her country and through the Service centre you would be using. This is the route I'm taking. When the visa is approved and received, she'll have up to 6 months to cross into US, and once she crosses, 90 days to get married. Once married she needs to stay in the US, and adjust status for permanent residency until she gets AP/ or GC to let her travel.

K-3, IR-1/CR-1 is for married couples. I've read that drop the K-3 and go directly for CR-1. One big reason..cheaper!! and on approval, she gets her GC as soon as she moves to the US. I really don't know too much about it, but again read the guides, and read some of the threads from that forum. It might take a little longer to process, but at least you don't need to adjust status.

She didn't wear a wedding dress, but looked beautiful. And they made promises to each other, that they will wed at a later date. Can't really remember all was said, but it was so nice. There was a cake, and pictures, you'd think it had been the real thing!! Later on they wed quietly, with no fanfare. I was hoping to do something like there here for my friends and family that can't make it to the wedding. However, Tim won't be able to come up as he hoped, crying.gif so that's out!! Tim and I will not live together until we are LEGALLY married as well, and we're middle aged!! All of that will be saved until after. I stay with his sister when I go visit. So please, once again accept my apologizes as I do know how important it is to you. Unfortunately, when dealing with the government, we need to follow their rules, whether we think it's fair or not!! There are lots of choices for you, you need to decided the right one for you, and pray that your family understands there is nothing you can do to change it.

Have you already started the K-1? I was a little unsure if you had.

You "could" have planned a real wedding, got married, and gone home while filing for K-3, or IR-1/CR-1 That petition takes a little longer. My niece, who lives in BC, got married in Oregon, but came home as he was moving to Canada, and so she started to file. They also did not have a big wedding, but within a year of their marriage, had the reception in Washington.

If you've started the K-1. I would agree that you wait for the approval, and have a civil ceremony and plan for a wedding party next spring, or depending on when the visa is granted, there is 6 months to cross the border, and 90 days to get married after you cross, so you've basically 9 months to plan. (but remember, they count days, not months, to expiry dates!)

Non-legal ceremonies are fine, btw, because there is NO marriage license involved. Nothing is signed or registered with anyone. But I would still wait until the visa was approved, and make your choices from that.

It seems that other Visa Journey members are able to follow the "touches" of their application, and know when it reaches the foreign consulate, etc., and am wondering why our case shows no updates on the USCIS website.

Exactly! I can only imagine how you feel right now, but very soon I, too, will be going through the same set of emotions. It's one thing that I had mentioned to Tim, way back in October when he first asked me to marry him, that I knew we were going to have an emotional rollercoaster from time to time. I told him that sometimes, I will cry and miss home, but to remember, that although I'm leaving something I love very much, I'm also entering into something I love very much.

Keep posting about your adventures. Be strong, but don't hesitate to let those tears flow. You are going forward into a brand new life. Celebrate it!

What country is the beneficiary from? It may help you to go to that countries forum, to find out what the consulates expect at interview time. For myself, I was in Vancouver Canada, and when she asked proof of ongoing relationship, I handed over a pile of pictures, and all she did was glance at the top one. She didn't even look at the emails we had, or the fact we talk on skype, or my boarding passes....etc. I think she could just pick up from talking with me, that Tim and I are indeed a couple in love... luv.gif

I had mine with me during my interview. Did I need it? No. Would I have, if I didn't bring it? Murphy's law.

Even if you have more than enough for the interview, it's ok. Every consulate and every consular is different. When reading the posts of those that went through it, questions, and proof of relationship, to financial matters seemed to vary from person to person. My consular hardly looked at anything. She asked for proof. I handed her a big stack of pictures, she took one look at the top one, and that was it. Didn't want to see anything more. But others may want to. I advise that you save EVERYTHING from your interview, and proof of relationship, until you are finally done with USCIS. For a few years, we live under their microscope. And even when it looks like your finished with them, keep it all anyways. It's not going to take that much room up in a closet or something.

It also depends on the country. From what I've read, some end up in AP after the interview. That too could take a while. I didn't, ( not that I know of), so we were able to set a tentative date once we got the NOA2. My interview came two months later, and when I heard those magic words, " I can approve this visa" I called Tim to let him know he could put deposits down on what we decided on.

You definitely want to wait until closer to the interview stage, but you could make those "tentative" plans after NOA2, depending of course AP.

Oh..keep in mind...sometimes approvals come faster than you think!! Ours was 3.5 months....but it could have been longer than that.

We were together when we found out. I was visiting Tim in SC for the month of April, and on the 16th, in the evening, he was at his computer, and he said to me..."look at this"....so I looked over his shoulder, and read the word..."approved"....and it took several seconds for it to sink in that I was reading THE EMAIL everyone waits for!!!!

Congrats on the NOA2!! It should be sent right away to NVC. A letter will be sent out that it was received, and sent to the consulate. Your case number will change so have him call the center and track it. Sometimes it stays in AP for a bit. Hard to say when it's forwarded to the consulate. You, yourself will receive a letter from there, saying that the processing of the K-1 application will begin, and what they expect you to bring to the interview and such.

Depending on holdups...I'd think you may hear something within a couple weeks or so, but someone from that area may be able to tell you better. Best wishes! star_smile.gif

yeah, definitely hard to say. Depends on the box your files get dropped into. I've noticed that every now and again, someone, and it seems like it doesn't matter from what country, gets approved so fast it makes your head spin!! wacko.gif

What exactly do you mean non-sponsorship? As in, not being dependent on someone else's income? Possible. In my case, I have a house I sold. If you were to get married, and resided in Canada while going through a CR-1 visa, then you can still work, collect your disability, and when the visa is issued, you will have your GC right away to continue working in the States. I guess your better off to read the guides for that as it seems like you want to be able to seek employment fairly quickly, or I could be wrong here. The K-1 will not let you do that. You would have to wait for EAD or GC which could take a few months. The down side to CR-1 is that you won't be able to live together until the visa has been issued.
