TimandJoyce just wanted to let you know, we have the charleston SC local office too and don't be surprised if you get things in the mail without an update online. We have our appointment notice for AOS and they have yet to update that online but have 'touched' it since than, interview in 2 days!

Wow!! :o You got your letter to say interview in 2 days, or you just didn't get an email to say one was scheduled? How long did you get the letter to the interview date? I'm suspecting we'll end up with an interview too. Tim's been trying to get my name on his bills, and who ever he talks with STILL has no idea and his bills don't have mine on it! I don't know about you, but I can't even get my name on his account without a State ID, and I can't get one of those without proving domicle!!Posted Image Oh well, we'll get there yet.

Best wishes for your interview, hope you post a review.

Good news about your EAD/AP Michael + Tracie! I can't wait for my EAD.....Posted Image

Great, thanks! Also for the AP form, what do you put for the "Intended date of departure" if you don't know it? Thanks!

Because we sent off my AOS near the end of October, I had put a date before Christmas stating that I'd like to go home for that. But because of my RFE everything got put on hold for a while anyways. Guess I should have just put "unknown" and state family emergencies. ( I did that anyway)

Best wishes for a speedy AOS!

I received an electronic case update that we have received an RFE crying.gif I have a feeling that it is because of the medical. Am gonna go hunt for a doctor who wont overcharge me for vaccine transcription and if anyone knows one in the Maryland area, please let me know.

So since Ive been given an RFE (and likely will get the physical paper tomorrow or Monday) for the I-485 application, does that mean they also hold my EAD and AP application too? I am hoping to work in the spring sad.gif

Oh such sad news for the New Year :/

My RFE had nothing to do with medical. I haven't had mine transcribed yet either. Mine was completely about our financial part. Our case is resumed once again, and hopefully my EAD will get approved soon!! I'm with you there...another income in this house would be great!

Great Maplestar!! I'll be staring at mine for a long time saying..." is this real? is this real?" And I can appreciate wanting to get home. I sure missed being around my family this Christmas, although I still had a great day as Tim's family is so much fun. ( And Southerners know how to eat!!....yikes...diet...here I come! ) laughing.gif

I sure hope at the very least you get EAD approval soon Joyce!

My AP came in the mail Xmas eve, at least I could have gone home if I needed to! My GC hopefully will come soon!

I'm debating whether to re consider my claim for EI, now that everythings been approved. I guess it depends on how quickly I can find a job. I've already applied for a few and excited to apply to 1 or 2 more! I'm giving myself a month! Can you still apply for EI with a GC? Since my EAD is now void!

Anyways hope everyone had a very merry Christmas!

I"d imagine you'll be ok with the GC because that's the *real* authority for residence, travel, and work, isn't it? EAD and AP lets you start early in the meantime.

I do want to work, but I'm just not sure what and where yet. A part time job though is what I'd like. I'm far to busy right now with other things for a full time job! I'm also debating on schooling for some upgrading or something. I need to contact EI about that as I know they offer incentives for upgrading and school, but I'm not sure if it applies to non residents of Canada. I did get a letter from them early on when I first applied, but it could have been one of those generic letters that everyone gets anyway. Would be nice to be able to collect or get help here in the US star_smile.gif

But we were on our way to have supper. One kid wanted Taco Bell, others were hungry, so we hit a mall food court so that everybody could have what they wanted. Then, we did some looking around for my father-in-law's Christmas gift, and then one kid needed pants, so we headed to the end of the mall to JC Penney...and then FINALLY (it seemed) got home so I could log on and read:

I really have no idea Joyce. I'm not sure that sending in a new I-864 would be the best idea, because then it might seem like you were working illegally (which WE know you weren't!) but then decided to deny if after they questioned it. I would suggest posting this question as a good topic either here or in the AOS forum, just because there are probably some people who could help you but don't see a need to read the AOS thread. If I remember correctly trailmix is the go to gal as far as the I-864 goes.

Thanks Huggles. I think I'll copy and paste it in the AOS thread and see what happens too. I plan to fully explain where the benefits come from, and send in proof for it, which I already had the first time around.

The other thought of course is an infopass, or getting the congressman or senator involved. You'd think claiming my survivors benefit wouldn't be a big deal. It IS income, just from Canada, and only because my husband died. And it's not like hundreds of $$$$$ a month or anything either. laughing.gif

CanadaAOS'rs...
......continuing from above post..and questions...

I'm thinking we'll fill out the affidavit of support AGAIN but this time leave off my benefits that I get. That way, USCIS will have two copies, one with it, and one without. *shrugs* I'm just kinda grasping at straws as how to fix this little problem...

Had the biometrics today, probably the easiest part of this whole process! After he took my picture, he asked if it was ok, and I said "it's fine, it looks like me. Course I wouldn't send it to Dad!" He laughed at that smile.gif

My RFE letter came in too!! Now...a couple of questions. We're wondering the best approach on this.

Tim is on disability and does not pay or file tax returns, so he doesn't have one for 2008. He did however send his 2007, and 2006 with the AOS package, and I guess assumed that they would see he's on disability, ( he sent the letter that shows what his monthly income would be). Any suggestions on what he should send in? I mentioned writing a letter and getting it notarized that he doesn't file taxes anymore.

There is also the part of the household member's income added to the yearly household income. I had added the fact that I receive a monthly (from Canada) survivors benefit. The instructions when filling out that part only stated that the income could be included if it was from the same source and continual, ( or something like that). Now of course they want proof that I'm authorized to work in the US, which of course I'm not at this time. So I can not send in any of the examples they list. I also included in with the AOS package from my taxes last year the amount that I received, so that they would see what benefit I was getting. Again, I thought of writing a letter explaining that I will receive that benefit, even though I'm married and live in another Country, and will do so till the day I die. I did not realize that it might not be allowed to be included with the household income. Ugh...what to do??? what to do??? wacko.gif We have 87 days to respond.

I can see an interview for sure with this mess now!! laughing.gif

Congrats cdneh!!!

Okay, so I totally jumped the gun on the reason for me receiving an RFE. Because it says this:

'For the household member's income to be included in the household income, the household membeer's income must have been from a lawful source and earned while the household member was authorized to work in the United States'

And then asks to submit blah blah blah to prove work authorization. Which is a piece of cake so over the weekend I'll copy the birth certificate proving US citizenship and ship it off. But do you think I should redo the I-864 or just provide the birth certificate?

lol I'm just happy its an easy fix and doesn't require a trip to the civil surgeon...yet.

Oh wow. Of course I've never been authorized to work in the States, (yet) but we did put down a source of income for me as I get a monthly survivor's benefit and will continue to do so until the day I die. It's Canadian, of course, but we added my tax return from last year so that they could see how much it was. I wonder if it will be accepted? I suppose if not, they'll recalculate the household income?

I did get my notice for biometrics. kicking.gif November 23. Talk about cutting it close, we're going away for two weeks, and should be home by the 21st. Well, now we WILL be home by then. Well, here's a strange one. I tracked my package we sent to Chicago, and it states "Delivered, October 25, 2009, 9:25 pm, CHICAGO, IL 60680" Does that mean USCIS has it. October 25th was SUNDAY and it was in the late evening. wacko.gif I'm so confused....

same with mine, was on sunday 4th oct, was picked up signed for and everything by USCIS. I would expect they have it haha. Not sure if they are pulling all nighters or what tho! but i got my stuff fairly soon after that as well.. about 8 days I think it was? they cashed the check and I got noa in the mail lol.

I don't know if mine was signed for or not, that part didn't say. Tim is sure it only got to the Post Office, which is still strange, being a Sunday night and all. I think I'll just say it was "delivered".. laughing.gif

Thanks! smile.gif

Thank you very much!

We are now filling our the I-131 and are not certain what the "Class of Admission" in part 1 refers to. Can someone please advise?

Thank you.

Well, I could probably be wrong, but I just put K-1 on mine, as that is the status that I was when I entered the States. ( Or whatever status someone is I guess)

I'm hoping that if I made *tiny* errors here and there, that it's not going to be major and can be easily corrected or interrupted the right way at there level. Worse case scenario, they send it back with an RFE.....

If you got certified mail with tracking, there should be a label number and you go onto USPS.com to register for it. I never got one until it was actually delivered! *sigh*

I hope everything goes smooth for you too!

For Charleston, SC: Go to the bottom of the link and look at local offices

http://www.visajourn...oslist.php?cfl=

Some of those look imcomplete, persons not updating their timelines, and that is annoying!

We got a Toy Fox Terrier on Monday, took him to the vet yesterday and he checked out good! 2 lbs 5 oz and 10 weeks old!

Move to NE+Wedding+Errands+AOS+new puppy= Exhausted. laughing.gif

Inky-Congrats on getting transferred to CSC before your biometrics!! That was fast!!! kicking.gif kicking.gif kicking.gif

Thanks. And yes..incomplete. The last entry was from 2008, but then maybe not a lot of traffic through Charleston? The first page showed 4 transfers, 2 interviews, and some that I have no idea what they did!! laughing.gif Guess it's going to be what it's going to be..... blink.gif

I got to the Post Office about 4:30...never doing that again.... long line!!

Delivered at 2:10pm today!! Signed up for email alerts via USPS....never got ONE!!

We just got a new puppy early this week and there is lots of wedding stuff still to be put away and organized....guess I will have lots of time! tongue.gif I'm exhausted!

I hope we get transferred to CSC! But I am really doubting the possibility given the local office stats and our situation. sad.gif

Great!! Ours is still, (at this time) in limbo..laughing.gif

What did you use for the email alerts? I was assuming we'd get a case # on the back of the cheque like last time.

I hope everything goes smooth for you. I have no idea about local office stats, (or where to look) but I won't be surprised to have an interview. It would probably be over the financial part, or they may RFE for more banking evidence. I included the sale of my house, (from the lawyers papers) and my account balance. My guess is that they'll want to talk with us a little more on that...

Have fun with that puppy!! What kind did you get? I'd love to get a little Yorkie, but we're not ready yet.

*whew* we got to the Post Office with just a few minutes to spare, but we mailed our application to Chicago!!! And you're right Minnew...it's a HUGE weight off my shoulders. So now I can concentrate on organizing this house better. There is so much to be done. Tim has lived alone for a very long time laughing.gif

*crossing fingers that everything was filled out right, and it gets transferred to CSC*..

We submitted an original copy (meaning, I had the certified copy in my hand as I placed it on the glass of the copier), and turned in the B/W copy version. At the AOS interview, we were asked for the original, and he verified/compared the copy I submitted to the original we brought with us and handed the original certified one back to us.

But, I believe at some point, we also submitted a certified version as well. It's all been a big blurrrrrr.....

Very good advice!!! Thanks..I wouldn't have thought of that!!! So we'll just get ONE copy and "copy" that....*smacks hand of forehead* too easy!! smile.gif

We will also get certified copies of our marriage license from the probate judges office, three in total: one for the I-485, one for the AP and one for EAD

Just out of curiousity does the marriage cert. copy you send with the packet have to be certified? I didn't see it say specifically it needed to be certified in the instructions, in fact I read just include a copy and they define copy as

QUOTE
Copies. Unless specifically required that an original document be filed with an application or petition, an ordinary legible photocopy may be submitted. Original documents submitted when not required will remain a part of the record, even if the submission was not required

Has anyone just sent in normal copies? I guess I'm just being cheep and don't want to shell out the extra cash if its not required.

Good point. I just read that on the actual instructions on the I-485. I had read in the guides here about the certified copy of the marriage license. *Step #8* in the section under "guides" and for AOS. Guess that was in my mind. I think though, ( depending on State of course) I'd rather send in the one from the actual probate judges office, rather that just the one they gave us that says "bride/groom" at the bottom. Tim was pretty sure the copies weren't that much...

*Then again..he's been wrong before*.. laughing.gif
