If your girlfriend holds an Iranian passport she will need a visa to enter Australia. She won't qualify for the 90 day ETA. If you enter on the ETA, it works the same the world over. You can't be looking for work unless you already have a valid visa which will allow you to work and that is why you're enquiring about options for your girlfriend?

We didn't include my husband's military records (we're doing CR1). He is still active. We thought it was only the beneficiary who had to supply military records and not the USC. They've not requested his records at any stage either. I think if you request an expedite you'd have to send a copy of the current orders and for the AOS to show employment and income you'd have to provide the LES'.

Yes, definitely did not 'intend' to marry and a return ticket to Aus is what would be required.

Maybe I'm missing something but you go see a field officer who tells you how to adjust status but your fiance is not even in the country yet, so is there going to be a record somewhere that you enquired about this months before you even married?

You can get married while on the VWP, I did. I came back to Australia and we filed for CR1. It is a long process but we had no choice. It really was not planned and I could not stay in the US and do the adjustment of status. Before you run off and think ... cool ... she can hop on a plane and you get married and then file to adjust her status, you have to prove that there was no intent to immigrate.

You really should read all the guides on both visas. It is a lot to take in, once you've read it then post your questions. At this point in time don't confuse yourself with 'what if' scenarios.

The K1 process in Aus seems to be taking about roughly 5 months. Sydney is a quick Consulate for scheduling interviews for K1's. However, it is the petition sitting at USCIS for months that you will have NO control over.

I wrote on the form: SEE SEPARATE SHEET

On the separate sheet that I attached, I had:

Case number in the top right corner (if no case number then I would put name and DOB)
I typed the question and the question number that it related to (in your case copy the question and # for your employment history)
Then I added the additional information

I had no issues. I trust this helps. :)

Great news!! They have given me a new date for May 1st which is amazing. I now have to have my fingers crossed that I can pick up the visa from the consulate the day of the interview or the next day. Has anyone out there been able to pick there visa up on the day before???

The visa is mailed. You will have to leave your passport and it usually takes about a week. Although, someone recently had issues and it did take longer. It doesn't hurt to ask but I haven't heard of anyone, recently, that has been able to pick it up. Fingers crossed for you.

I did POE at LAX and it took soooo long for our luggage to arrive at the carousel (about 45 minutes). It took them even longer to stamp my visa in my passport because I dropped off my packet, they told me to get my luggage and when I returned I still had to wait.

Not to mention the terminal/gate changes etc. I would do 4 hours as a minimum.

Ok,so in the past few days I read so many times that you need to put 2 photos along with your G325A form.I would like of somebody could send me the link where it says that. On the IR1/CR1 guide here it specifically says 1 passport style photo of you and your husband/wife.On the UCIS i looked and it doesn't say any specific number of photos,so pleasseeee send me the link for this. Also,if it is 2 photos some administrator should change that info on this site.

We submitted 2 passport style photos each for the beneficiary and petitioner. We still got an RFE on one photo for the petitioner (they requested we send one more in)

so i just wanted to let people know of my experience today at anzac square medical centre.

to be clear, the form they email you says to bring australian-sized passport photos. do it.

i know in the whole process you've had to supply american photos but in this part, the state department provides them with forms that suit australian sized photographs.

DO NOT sign them before you get there, as they require you to do it in front of them. i took three american and three australian photos today in case i needed the other ones. i signed the american ones and they immediately :devil: :ranting: breathed fireballs :ranting: :devil: all over them (as mentioned in another review of this place by another member). i was so lucky that i took the australian ones because they are the ones they need and i didnt sign them til i got there.

they make you go pee in the sofitel restrooms. you gotta take three escalators up and walk to the far left right next to the check in counter. they give you a bag so it wont be obvious.

i had about a 15min wait and then i got to see dr taylor. he's really nice and answered all the questions i asked him. he first went through my vaccination checklist. i only had records of one vaccination, flu vac, which was recently. i gave a verbal declaration that i had chickenpox. everything except for Tdap and MMR were not age appropriate. so he gave me those two vaccines and then went ahead with the physical. probably took 15mins at the most. pretty run of the mill type one. checked height, weight, eyes, ears, throat, reflexes :bonk: . did a squat and touched my toes. he took a good look at my body including down there :blink: (only quickly) and noticed a mole on my back but quickly determined it was harmless and just caught his attention. i got dressed again after that.

i went back to the front desk and paid the remainder of the account ($445+$100 deposit made a few days ago. also includes the two vaccines, the chest xray and the blood test).

the ladies at the front gave me maps and details on how to get to the next two places. first up was sullivan nicolaides (sp?) at manor apartments on queen street (post office square, near the BoQ building).

i rocked up to a waiting room and simply took a number and sat. girl came and got me and i sat in the big grey chair and rolled up my sleeve. she took my forms and passport and the other girl got her jabby things ready. the needle hurt a bit because its different to the ones i usually get at other joints so that sucked after having two injections previously in the day. it was done in about three minutes so i got my stuff together and headed towards citiscan. this place is on the corner of queen and albert above that chemist the same side of the street as HJs.

waited for about ten minutes and got called in. really neat looking place, looks new-ish. stood up against the machine and she took her happy snap and signed my forms and saw my passport and sent me on my way. that was the easiest part of the day done.

note: if you aren't taking public transport then parking is in one of two places. cathedral square or the oracle building on your right as you head down ann street towards central. i was hit with 40 bucks for about two and a half hours parking at oracle - never again will i park there :( . i intended on taking the train but my go card had expired and so i just figured "f**k it" and drove in.

overall, it was alright i guess. i was pretty stressed out by the hustle and bustle of the city but you get that.

this was a quick review, but nevertheless i hope fellow brisbane-dwelling peeps find it helpful.

Also, I am finding there is no room to state the full employer name and address, I've read people have attached a seperate sheet of paper and listed this information, however, I am wondering, what reference they have put on this just in case it gets lost?

So I had a very distressing phone call with my superfund yesterday who informed me they wouldn't be able to release my funds into an american retirement fund. It would stay in Australia until preservation age. I'm 24 so thats not for at least another 3o years.

I saw another post from someone who said that if they surrendered their citizenship, they were able to have the funds released into a different investment? Can someone clarify this?

You can apply after you get married and get all of your documents together. Once you apply, should something unfortunate happen before you receive your EAD/AP (combo card issued now) then you can schedule an info pass with your local USCIS office and they should be able to help you.

Can I ask, do you have to have exact travel dates in order to apply for this?

Advance Parole is applied with AOS and takes about 3 months to be approved. Yes, they can expedite it for something serious like what you describe above. I would plan on marrying fairly soon after entry and have the AOS paperwork ready to go to send out the day after your marriage. Then you request expedite (I suppose you could also request it with the initial submission).

Just a general question regarding Advanced Parole. How quickly do they process this and how far in advance do they suggest you apply for this? Is there any way to expediate?

I know It's a little early for me to address Advanced Parole yet as we havn't even received my K1 Visa.

The reason I'm asking is because last Friday my father was diagonsed with terminal cancer and the doctors are unsure as to how long he will be around. He's absolutely adamant I still move over to USA and get married as he wants to be able to give me away at my wedding.

Don't forget the military has a USCIS hotline at their disposal.!

His uncle is an immigration lawyer (very handy) and we have everything sent c/- his immigration practice. He just emailed us and said that in our case it may pretain to either financials or birth credentials.

We got rfe in June . They sent another form of I-30 and another one was G something, biometric form . At first we worried that they would ask about sworn affidavit cuz we didn't send it. After a month later, we got our NOA 2.

I was expecting the rfe already. atvleast you know that they looked into ur case already, so its kinda a blessing in disguise. just wait for your hard copy. and dont forget to include the blue form as soon as you reply to the rfe :thumbs:

Hey Mate,

From what I've read, some doctors practises wont allow you to book the physical until you have the interview date. Once done,it is valid for a year.

I've heard here that people are verbally told ove their approval, however, are also advised that they will receive the paperwork within a possible two week period. You may be lucky to have it once you leave the consulate.

When we submitted evidence, I did a snapshot from every month that we were talking on skype. So 13 pages of skype conversations to prove that we were on-going.

I also did the same for viber/whatsapp text messages and screenshotted my iphone for calls.

Dont forget to also include a letter from each of you saying that you have intentions of marrying within 90 days of entering the country - we had an RFE on this.

We also included 2 x passport sized photos of each of us.

I would go with Fedex or DHL. The reason I say this is I've had extremely bad experiences with the Australia Post AND USPS namely with losing original documents and not being able to track them. At least with a private courier company they are a little bit more stringent with their services.

Statistically speaking you probably save more money by buying the tickets now than by loosing a change fee in the unlikely event that you don't have your visa within 24 days after the interview. The tickets might become expensive by more than the $300 change fee close to Christmas if you wait till the last minute.



The price goes up after the 8th/9th of December as this is when it's considered "peak season".

A lady I work with came here on a K1 visa from India and said it only took her 2 months. She said her son married someone and did the same thing. She said it was this quick because she used a lawyer.

Is this true? I'd never thought it was necessary to hire a lawyer for this if you can do the paperwork yourself. Why is there such a vast difference in processing times?

I'm majorly frustrated because I can't even start this process yet...am still suffering through custody battle/divorce hell. It'll likely be another year at least before I can bring my fiance here. : ( Anything to make it go faster once I'm free to apply is what I'm hoping for.


Maybe she meant the NOA2 to receiving visa stage?
