so finally found out what my RFE is. My kids require all the same evidence of bonafide relationship that I have even though the RFE refers to the natural parents application, which has been suspended pending the outcome of the kids RFE? Also they want a divorce decree for my child that has no father listed on her birth certificate (was not ever married to him) and my marriage certificate 8 yrs later lists me as single at the time of marriage. I am so annoyed that they apparently can't read!! Rant over.

Yeah you have to submit one for each person, I have no idea how they split up an entire packet, they were all posted in the one envelope and it clearly says on the form are there any other people you are applying for. I am so frustrated

They have been telling my husband June 16 for the last 18 days. I got my NOA2 on 10 November (22 June file date), 2 of my children got RFE on 24 November and the third hasn't even been acknowledged. Everytime he calls they tell him, to wait 6 days and they are still processing June 16! I just don't understand how they can split a families application up and it end up being so far apart.

My husband (petitioner) has been having no end of trouble finding out what is going on with my sons missing visa application. After getting no where for 3 weeks he was finally told about INFOPASS. You access this service from the USICS and you make a time to go to your local office and see an immigration officer. This was fantastic. He went today and the woman couldn't stop apologising for how we had been treated, that the information the service centre people were giving was incorrect, that they could infact give us infomration they just chose not too!! She filed the request for service that the telephone service said couldn't be done and added notes to the case to "please explain" how the linked cases were seperated and she applied to expidiate the kids stuff.
The feeling of being listened to is amazing and my husband come away happy and insisting that I get on here and tell you all about INFOPASS.
Hopefully we should have some news soon (ps: I got my NVC number 2 days ago but am waiting for the kids stuff before sending anything in).

They didn't seem at all concerned by that when my husband called. did I say that they shouldn't be together? What I said was it is cruel to imply that she should just let her child go. I am certain that if the Brazilian healthcare system can take care of the child sufficiently to provide a feeding tube, medications and testing that they will be able to keep her alive, not optimal but doable. Having a sick child is stressful and the parents deserve to be together to support each other, neither one of them should have to suffer alone with this. I have been waiting for my visa for a long time also but i don't resent these parents for doing what ever they can to expedite there request and I don't understand why so many people here seem to think it is such a terrible thing. Arn't we supposed to support each other on this journey?

Are the people suggesting that she sends her six month old baby to the US without her parents?? As a mother (and yes I do have a sick child myself) I would be beside myself if I was seperated from my young baby indefinitely and even more so if she was sick and possibly having to under go medical proceedures! I'm not dismissing all the advice etc but I think it is cruel to tell a mother of young baby to suck it up and send your kid off by herself! The child is not in immediate danger in her country but would benefit from the better care in the US. I wouldn't part with my infant either. Have a heart people

i scanned the pictures and printed them out on plain white paper. i then wrote at the top what the photos related to eg: New York December 2011 and then under the photos said, Amanda and Josh @ Hard Rock Cafe NYC etc. if there other people in the pictures I would say - Our wedding - Amanda and Josh with Amanda's Grandma Beth Rxxxxxx. I did this for every trip that we have had back and forth, just a couple of photos from each trip and attached the boarding passes. Hope that helps

They recently changed the requirements for the chest xray (like in the last couple of weeks). I am pregnant and required a chest xray this week and I don't come from a high risk TB country. Now all adults must have one. You don't have to get your vaccinations though (I didn't need any though).

Don't want to make you panic or anything. I'm a midwife and I know is really dangerous for the baby to be x-rayed at that specific time. It could affect his/her development...even with the appropriate protection for your wife. Still can be dangerous. I will recommend you an ultrasound when she's about 11 to 12 weeks to find out if everything is OK with the baby. There are several test doctors can perform in ultrasound at that time...

I am also a midwife and disagree with this. A one off Xray doesn't place your baby at unacceptable risk, in fact she will be exposed to more radiation on the flight to the US. I am also pregnant myself and had an xray in the first trimester with a lead apron.

PhilippinesOriginal birth cert for interview?

Does my Pilipina Fiance need my original birth certificate with her for the interview. When I send her the NOA2 package with the K1 application and all documents do I include my original birth cert and mail it to the Philippines for her to use in the interview.

OR

Does she simply need her original birth cert from the Philippines which we have already? ("original" looks like a copy but its on green paper and looks official and is from NBI so I am assume that is there version of original).

Is there a different version she should have? Also should she have her cenomar with her or its really not needed

I'm jumping way ahead as I am still to file the petition this coming week. I need to package it all. Send to my family back in us. They will mail it in for me cause I need them to add the check (mom will write for me ) and forward package.

My original is foolscap size on a really thin (almost rice paper), however, I did request a copy from Cenomar (the green copy) and submit that copy with my Packet 3. This was accepted as it is an official copy. :) Hope that helps.

So, yesterday the member Celeste & C, told me that I should be receiving my NOA2 between September 28th and October 2nd (According to my timetine).

And guess what?!?! I logged into the USCIS site today, and it said we are approved as of yesterday!!
Woooooot!

We got NOA1 on July 9th and NOA2 on October 2nd. Pretty fast, isn't it?


So, all of you July filers... It is your time, very very soon.

Dr Waks sent mine directly to the Consulate on the 9th of October, I'm hoping this is OK that I didn't include them in the PKT 3 and that the Consulate received them OK and placed them with the rest of my documents until my interview.

Yeah I did post them with my packet 3. The doctor wouldn't do it for me and insisted I had to come pick the results up. But it's all good. At least I got a copy of the medical just in case. I've heard some people suggest to do this for the AOS part of the visa journey.

Just posted off my Packet 3 dox to the Sydney Consulate. Oh my gosh it is nerve racking. I went through everything about a hundred times checking it over to make sure it was all correct, signed and dated.... but you still have that feeling of Uugh, I hope I didn't make any mistakes. Finally forced myself to place it in the Xpost satchel and send it off, now I just have to wait. I am really hoping for a speedy turnaround at the Consulate so the kids and I can be there for Christmas. The last 3 and a half years have been a long road and I pray that we will be rewarded with an approval at the interview. We all want to be there so badly and finally begin our new lives together as a family....I will be praying hard the next few weeks!!!

I just received my Pkt 4 notifying me of my interview date and the checklist for required Documents. They have requested that I provide Supporting evidence for the Affidavit of Support, however they already requested that I send these in with the Pkt 3, which I did - 2 original copies signed and 2 original letters from my Fiances Employer. I don't have anymore copies of these documents and I am confused as to why they would ask for them again, when they were already submitted with my Pkt 3.

I am so relievded that I have my interview date, but really bummed that we won't make it to America in time to spend Christmas with my partner. Sooo nervous about the interview, can't believe it will all finally come down to that day.... praying so had for an approval!!!

Don't worry they asked me for proof of my citizenship (I'm a citizen by descent on my father's side). The reason they asked this is because all my Australian documents are missing one of the names on my Birth Certificate for the simple reason we couldn't fit them on the application form so I wonder how that will go :S. Oh, also, the photos I provided weren't American sized. ugh

We're so thankful to God that we've now moved from USCIS to NVC and now they've sent our application on to the Sydney Consulate. But I'm puzzled by NVC's notification: 

 

'Your case is in transit to the Consular Section. Your interview date was provided to you by the National Visa Center.'

 

Can someone help us: have NVC already talked to the Sydney Consulate and decided our interview date? I haven't sent any packet 3 documents to them yet.

I think this is a generic "next stage" message. As Adrian-Danielle said, you need to send in the Packet 3 documents which include the actual visa application form for them to get back at you with Packet 4. I would ring NVC, get your case number and start working on all those tips that were provided to you. Namely medical and police certificate. You're cutting it pretty close!

I got the I-797C NOA letter stating the I-129 has been received. I was excited thinking it will start to go quickly and hoping that within 6 months I will be bringing my fiancee here to the US. I just looked at the USCIS processing times and if I am reading it correctly it says 5 months to process!!! Is that correct?

If I understand it correctly all that has happened so far is that the acknowledged they have my I-129 packet. They gave me a receipt number to check at USCIS and it shows these grey round dots and one is blue, the one that says "initial review" is blue. So do I understand that they are going to review that packet for 5 months before deciding if we can move forward through the process?

This is very discouraging if it takes 5 months just to say "hey the packet looks good now we can continue the process".

So I do absolutely nothing until I hear form them 5 months from now? I am not good at just doing nothing, I need to feel like I am doing something to help this process.

Anyway, I am just seeking some clarification. Thanks!!! Wade



Hi Wade,

It is what it is.

The packet you send through is actually a petition for the beneficiary to apply for a visa. There is a couple more months of waiting on top of that.

You can not do anything at this stage at all except look towards the next stage and see what supporting documents you will need to collect in anticipation of Packet 3.

He should ring the NVC for an update. Sydney is usually quick with the interviews. Once he has his interview date and his file arrives at the Consulate he may be able to have it rescheduled. From memory, interviews are on a Tuesday.

And my interview date arrived a day after my case was completed.

They DID but they're seasonal :( I went to the Target in my area and the stock was pretty small. I only bought 3 packets and was planning to go back for more but unfortunately they were gone by the time I got there. I have one packet of unopened caramel tim tams and I'm not a fan (one packet I opened to try) so if anyone wants them...

I have to admit I struggle living here in the USA, especially since I had the baby. By the time I got my EAD and green card (arrived within a week of each other) I was 5 months pregnant. So that ruled out getting a job - no one seemed particularly keen on the foreign pregnant chick. Since she was born I have looked but with 2 children (my step daughter lives with us every 2nd week) and only one car it's just not worth the day care and 2nd car costs. So I work at home, doing some sub-contracting work but instead of my 60,000 Aussie paycheck I earn around $200 a week. I miss my family desperately and my baby is missing out on getting to know them.

Right now my life seems to be stuck in a vicious, depressing circle and it sucks. I agreed to come here as hubby didn't want to leave his daughter until she's 18. I respect that but some days are just too much. Then again I haven't slept in a couple of weeks due to the baby teething so perhaps that is why I feel like such a negative, grumpy person right now lol.


I know how you feel. The thing I struggle with is the inclement weather now that I have the baby. I find it isolating and the lack of sun is making my spirits wane. We just returned from 2 weeks in Fla and my mood change was evident the further North we got.

Sorry but I just had to set the record straight
Mining Boom in WA is huge...but nothing to that of QLD...and at least QLD has other economic industry booms that are pushing the country up....i.e Tourism, Agriculture, Gas, Cotton....etc etc...

EG.....In my industry 'Banking'...we only allowed 2 SNR managers operate and oversee the many business lending bankers organising industry lendings in WA..(and they still managed to go fishing in the arvo nearly every day)..in QLD we had 10....and our lends were through the roof!!! Allways making a profit.... Vic was picking up....NSW can never go wrong....SA was pretty useless...but licking NT ####### helped it to survive...and as for Tassie...well....we didnt have anyone there....I put my hand up to go oversee the situation a couple of times....but they kept giving it to some bloke in Vic - something about being closer??? So....youre right the housing market is ridiculous....geezzz...wish my house for the price I wanted...but its not just the WA minning boom that props up australia....may feel like that in WA as the only other decent money making business overthere is wine and its small compared to the rest of the wineries in Oz......consider living out west in QLD or outback nt for the bucks....


I have to agree with you, lyn.

WA has always been expensive compared to the rest of Aus because of its isolation. It costs more to eat out in Perth than it does in NYC. Australia values education just as much but we don't place all our stock in a bit of paper, knowledge and experience are just as important. For earning potential, the paper does matter but I love that it's still a country where you really can work your way up. I have an accounting degree and I did earn more than the lady who worked with me doing the exact same job with the same job title so that argument is invalid.

LynJer - Yeah there could be worse places to live in the states than on Long Island(Long beach), its really nice there - i saw another poster who moved from Aus to Buffalo Ny - ha if my girlfriend lived in buffalo - i wouldnt have moved there in a million years!!! Oh and Montreal to NYC is about 6-7 hr drive.


That would be me ... Buffalo isn't so bad :bonk: , it's only 45 mins to Ikea and an hour and a half to Toronto. We got married in Las Vegas and we did the CR-1. Suited both of us because I had so much to tie up in Aus with my house and job etc. and after adding up the time and money it would take for the K1, it was worth it. All up it was 11 months with us slowing it down at the NVC stage for about 2 months and we added a month because I wanted him to visit before I moved.

As for the electrical licencing, I know a friend of mine had issues because apparently in NY state each city issues its own. It's not statewide. Best of luck with your journey. :star:

I hear you ... it was one of the things most on my mind just before I made the move. DH is in the military and is only 18 months away from retirement so that's why I moved. Fortunately, his rank allows me to stay home and we don't have to worry financially but I fear for when he does retire. The only jobs I am really qualified for are usually with DoD contractors and I am not a citizen yet. I wonder if it will be worth it to file by then because he'll be so close to retirement. I'm lucky that he understands the way of life in Aus and how blessed I was that he is willing to move.

I gave up everything so he could finish out his career so he feels that he should reciprocate. I do believe that at some point in the future we will be heading back to Aus.

The Australian Govt. won't kick him out after 9 months, he will have to leave when the time is up because that's what they agreed to when they applied for that visa subclass.

It's sad but I'm sure this happens more than we realise. I feel for his son. I doubt they're not getting married over smoking ... I'm sure there's more to the story but bottom line, thank goodness Australia is not litigious. He can't sue because no one forced him to sell all his belongings and move half way around the world with a child. Best of luck to both of them and maybe they will work it out. :star:

I received the same when I did mine. Missing Police Cert ... it wasn't but they told me they would complete the case, forward it to Sydney and to have a copy of my PCC for the interview. I had a copy of it but they had it in my file at the interview and never asked for it.

You could always track your file and email the Consulate about it once they receive it. Best of luck ... :star:
