If not, check out the partner visas. I worked with someone from the UK who came over on a SOL visa and he brought his partner (g/f) with him. Her visa was attached to his. Your best bet would be to speak with an immigration agent in the UK to find out what your options are.

How long do you have to wait to get into see Dr Miller?

Our lawyer told me that they take your fingerprints at the consulate..I was going to organize this but he said to wait till the interview.

If anyone else knows if this has to be done prior to the interview please let me know.

You should get rid of your lawyer. You organise the PCC before your interview. They do not do it at the Consulate. I'm doing CR1 so the process is a bit different but I'm pretty sure for K1 in Aus you send the PCC in when you return your P3.

Only assets that can easily be converted to cash can be used, so I'm not sure you can actually use assets that are not in the US.

I had to convert to cash and send it to my husband's US bank account before it would be considered. Wish I hadn't because we didn't end up needing it, but that's my experience.

It's tough but you're nearly over the biggest hurdle. The NVC process, depends on how organised you are. You could be done with NVC in 4 weeks. My USC and I looked into the Aus process as well but it is more expensive than the US process and it wasn't clear on some things. Like, they MIGHT request a bond and trying to find out income limits was a pain as well.

It was the same for us. I left my high paying job and had to get rid of my house to be with my USC. This did cause me lots of concern towards the end but the things we do. Hang in there. It will go quickly from this point forward and it does get better even though it doesn't seem that way right now. Make sure you have all your ducks in a row and are ready to go with NVC when your approval comes through. That's the best piece of advice I can give you.

Hi everyone,

First post from Australia. It seems like we are close to the end here, AOS and all info has been sent to the NVC via a lawyer, yesterday however we received an email requesting that I need to have a police clearance from QLD or NSW when I live in WA. I was born in NSW but have been here my whole life. Not sure if this means they have lost the Federal Police clearance?? Has anyone experienced this kind of problem? I am worried this will delay the process further and obviously we are anxious to get our Sydney interview scheduled so we can get over to America finally! We now have a case number allocated but they said they can't close the case until they receive this information....frustrating!

Any help would be much appreciated!

A similar thing happened to me. They requested my Qld PCC even though I sent it with my packet. They said it wasn't the correct one. I called and asked to speak to a Supervisor, asked for the reason and gave my explanation. They completed my case with instructions that I take a copy of the PCC to the interview. So, call and ask to speak with a Supervisor if you don't get anywhere with the operator.

I have read some posts on this form about adding your spouse to your tax returns and how to obtain the ITIN number. My question is, do I need to wait until next year when I file my 2012 tax returns in order to apply for ITIN number for my wife? or can I apply for it now?



You can do it now. If you wait to file for it with your tax return you'll to paper file. It will take about 8 weeks before you'll see your return.

I actually have a problem with this.

First I do not support anyone beating their wives. I do not want I am writting to make others think that.
What I am having a problem with is why would she want to stay?

I have seen many cases of fake abuse claimed in order to get a green card. My problem is she wants to stay. If she has an abusive husband then she should leave and go home.If he truly is abusive does she think moving to a new address here would make it stop? If he was this person she is claiming then he may even be more angry thinking she used him for a green card. I think that would put her in more danger.
When someone is so determined to stay and who has not been here long enough to build a life it seems fishy to me and I have seen several USC get screwed over by fake alligations of abuse because someone used them to get a green card.

If she is truly being abused it is obvious she needs to get away. But what is the desperation to stay? That part makes me think she married to get a green card to begin with.


People stay in violent relationships for a whole lot of reasons, it's not unique to immigrants. The cycle of domestic violence is a very hard one for the person it to recognise and to then get out of. I don't think it is up to any of us to judge somebody for not "getting out".

Do we send the police check with the Packet 3 forms? I had my medical on Friday, get the results tomorrow, and have been waiting almost four weeks for my police check to arrive. My fiance's i-134 should be arriving this week sometime too, and I know I send that in with the packet 3, correct? But do we send the police check too? 'cos if not, once I get the i-134 I can just send everything off. Only waiting on the police check and the i-134s D:


I am not sure for a K1 visa but for a CR1 yes you do need to send it in. I had my fingerprints done this morning and the officer told me it would take at LEAST 4 weeks to get them back. What part of Brisbane are you in? I am on the south side :-)

I am having trouble finding information on filling out forms for minor children. I am taking my 3 children with me on CR-2 visa's. I know I have to have their birth certificates, passport photocopied but do I have to send original marriage certificate and divorce (from their dad) certificates too or will a copy be ok because the originals will be in with my application. I tried to email Sydney and ask them but they sent me back an email saying that you send nothing with the DS 230, it should have been sent with the orignal application which I know is wrong! So please if anybody has done this with children can you walk me through it.

I think I am the dumbest person ever. We got an RFE for two of the kids (I am expecting the third soon) and of course it's on a holiday! I think it is because I didn't include my husbands biographic details and photo with the kids application because it said kids don't need one! DUH the kids might not but the applicant does. I am really mad at myself because we are already out of the 5 months and now I have held us up more :-( How long does it normally take to process after responding to the RFE?

so finally found out what my RFE is. My kids require all the same evidence of bonafide relationship that I have even though the RFE refers to the natural parents application, which has been suspended pending the outcome of the kids RFE? Also they want a divorce decree for my child that has no father listed on her birth certificate (was not ever married to him) and my marriage certificate 8 yrs later lists me as single at the time of marriage. I am so annoyed that they apparently can't read!! Rant over.
