K-1 Fiance(e) Visa Process & ProceduresPOE - travel during K1 process
I had a difficult time at Philadelphia airport, without K1 petition, just on my visa waiver program. :crying:
and their service is so bad, and so slow.

the only good thing is there's a corner in the airport we can get free wifi.

For Number 4 and 5, is it true if the USC basic salary is well above the 'poverty line', she/he doesn't need to provide other documents: shares, bank statements, investments, retirement funds.???? Just show the pay stubs and employer letter is enough?

It normally takes around 3 business days for your payment to clear and show PAID online. You do not get an email that your payment has been accepted.

I don't think you can do much until the 20 business days have elapsed. Even your congressman will not do anything until they go over their timeline.

National Visa Center (Dept of State)People that still waiting for NVC case number

to all of us, i think we need to write a letter to our senators, legislators, attorney general, big wigs of USCIS and NVC and share to them our story. The big question is how long they will respond? or they will respond to their stakeholders who are us...so sad....

Anything we do now will not benefit us because bureaucracy works at a snails pace. Next years petitioner might see some changes if they are lucky but for us currently stuck in the mud it would do very little to help our case.

Also once people clear this hurdle they never look back. Things only get fixed if we keep pressing the issue but interest in this crusade dies once it does not affect us anymore. In all honesty I would not give it a second thought once I got passed it. I would look at it as something that I just had to deal with, unfortunately.

I am pleased to report that the NVC TeleOperator told me, on today's phone call, that the casefile is logged into the building (and of course to wait 10 to 20 business days afore they are ready for real stuff)

Yay !

Thanks Darnell, after calling the NVC today and getting another petition is not here reply I faxed my paperwork to my congressmans office. I also called but the USCIS liaison is off today so I did not get to speak with anyone. I will try again tomorrow. Maybe then I can start pushing them on my petition.

I'll post details in my monthly I-130 thread.

Darnell, how long did it take for the liaison to get in contact with you after you submitted your request?
I am going to go this route and I am curious if it will be another 15 business days wait.

My I-130 was approved on March 23,2012.... BUT still nothing at NVC yet!! keep calling, and I sent them a scanned copy of my NOA2 too!! They still tell me to wait. Anyone in the same boat as me? It would make me feel better if I wasn't the only one that's been waiting a month :(

You are not alone, my NOA2 was approved on the 21st of March and it is still in limbo.

National Visa Center (Dept of State)People that still waiting for NVC case number
I am on day 22 (16 business days) and the NVC still does not show my petition as received. I was told to send the NVC an email with a copy of my NOA2 and they would get a hold of the USCIC to see whats up. Of course this means 1 week for the NVC to actually look at the email and probably another week for the USCIC to answer it and yet one more week for the NVC to email me what they know. It took them 9 days to answer a previous email I sent them and they did not even read it.
I also called the USCIC today and asked if they could confirm that my petition had been sent to the NVC and of course I got the run around. She told me yes I have an approved petition notice but it's under appellate review. How can it be under review and approved at the same time? It's interesting how each rep you talk to gives you a different answer.

Anyway I am following timelines from those that got their NOA2's around the same time as me and not many are showing NVC received so I am not going into panic mode just yet....maybe next week :)

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Waiting Time Way longer then USCIS!

SEe I sent my CR1  IN FEB the last week.. and i got Approved in March (1 month) for USCIS.  They even said wait 60 days for any info and i got approved wayy quicker than that.

But then NVC got my file in like a week from uscis .. and nvc took almost a month to put my in there system.. then took like a week for them to send out a aos fee... then after i finished that.. IT took them almost a month to approve my AOS cause they where giving me this ####### about they switched aos forms and they couldnt approve mine til the got some guidelines for the new form... then i send my ds form took them about 3 weeks to check then the RFE me then it took them 1 month to finally aprove me and here i am... I called yesterday 7/15/2013 saying my case was done and im just wating for a interview scedual

You got lucky with the USCIS. Had you had to wait the actual 6 months like many have reading these forums then your wait with the NVC would have seemed fast.

Count your blessings :)

IR-1 / CR-1 Spouse Visa Process & ProceduresWhich tax software to use for first time ITIN filing?
Just enter a made up number like 900-90-9000 then once you are done printing, white out or cross out the bogus number. I actually wrote over it with "APPLIED ITIN". Once you get your ITIN number remember to update your software with the new number so it doesn't try to carry over the bogus numbers later on.

He/she is charging you that much just to file the W-7? or the W-7 and doing your taxes? Because the W-7 is not that hard to fill out, about the hardest thing about it is getting the documents or certified documents from your spouse.

IR-1 / CR-1 Spouse Visa Process & Proceduresjoint or single income tax

This site is very helpful. I have filed 130 for my wife and stepson. Now its time to file income tax. I am USC. Should I file single tax return, cause filling married jointly looks difficult, cause I have to get ITIN number then I will be able to file.my wife is in india and IRS procedure to get ITIN looks hard. Would that be a problem at visa interview, if i
filed single income tax return here.please help.

I just received an ITIN number for my wife yesterday. It is not hard especially this time of year when most are just filing their taxes. The form is straight forward enough and not difficult to fill out. They basically want to make sure your spouse/step children are foreign nationals and they require proof. You either need their passports OR birth certificate and a secondary ID. A Passport is the easiest route. You can either send in the original or get a certified copy made. Only the department that originally issued the passport can make a certified copy. Once you have your certified copy you send it in with your tax return then wait.

They say it can take up 6 weeks for them to issue an ITIN. It took me 14 days from the time I sent in my application to the time there was a letter in my mailbox with my wife's ITIN number. I am not saying it will take only 2 weeks but I was sure shocked it only did.

If you have your spouse print up a few prefilled W-7 forms you email her, sign them and send them back with the certified copies via express mail service it speeds things way. Especially if you are like me and are prone to making mistakes when filling out forms :)

Well the Embassy instructions say,

If you are applying for an immigrant visa, you must submit the following:

2. DS-230 Parts I and II: Application for Immigrant Visa and Alien Registration Forms. These forms are sent to applicants along with their appointment letters. Each family member applying for an immigrant visa is required to complete these forms.

Maybe it was just an error on their part but I definitely would. Just remember not to sign the second part.

Accredited works fine. Here is what they say about translations on the NVC portion of it.

Translation Requirements

All documents not written in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations and submitted to the NVC. The translation must include a statement signed by the translator stating that the:

IR-1 / CR-1 Spouse Visa Process & ProceduresUSCIS retaining my petition?

Well after about 3 1/2 weeks the NVC finally got a response from the USCIS regarding my approved petition which has not shown up at the NVC after around 47 days.

Dear Sir/Madam,

Please be advised that the National Visa Center (NVC) contacted U.S.
Citizenship and Immigration Service (USCIS) in regards to your approved
petition. USCIS has informed us that your petition will be retained at
the (SAN FRANCISCO FIELD OFFICE - SFR).  Please contact USCIS at

Has anyone gotten a response like this before?

I contacted the USCIS and talked to an ISO and all I got out of him was that I possibly entered the wrong city on item 22 on form I-130. I was at work at the time so I started to think that maybe I did but once I got home I checked my copy and it has the correct city where my wife's embassy is located. So now I know where my petition is but I cannot find out from anyone as to why it has been sitting there 1 week shy of 2 months. He submitted a help request or something like that to inquire about it but of course they told me I have to wait 30 days for a response before I can ask them about my petition again.

I am starting to get really frustrated with all the bureaucracy one has to deal with just to get a simple answer from the USCIS.

My senator's USCIS liaison said she would inquire about the status of my case-file. I just hope she can get a straight answer from someone soon.

I was in the same situation when we filed and it was accepted. Other than chat logs, hotel receipts and pictures of us together we didn't have a whole lot to send in. Our relationship only went back 8 months when we filed so your 3 years of pictures and logs should be more than enough.

IR-1 / CR-1 Spouse Visa Process & ProceduresAverage wait time at NVC

Great advice for somebody managing their own case.  However, the OP has everything going through an attorney.

Be pro-active and have your attorney submit your forms and pay your fees as soon as they are able to. I got mine done in 54 days and that's with a delay of 5 day in submitting my ds-230 which could have knocked off additional wait time. 17 of those days was just waiting to get invoiced.

Each form (I-864/DS-230) can take up to 20 business days to process IF no issues arise.

There, I fixed it smile.png

I have seen various people saying that you can email NVC rather than call. Is this more efficient? If not, is calling NVC better than calling the DOS first? I've called the NVC, but if it's more efficient to email, I'd prefer that. Thanks for the help!

Still waiting for a Case number.  I have called the Dos every day. Transsfered to NVC August 15 but not logged at NVC yet

Us too. We were approved August 1, shipped to NVC on August 15 and we don't have a case number yet. As someone said in a previous post, it takes mere days to get from NVC to another country, so why on earth does it take so long to get from Texas to New Hampshire?

TSC approved us on August 1, and I called NVC today. The lady was actually nice (maybe because it's Friday :) ) and said that they hadn't received it yet and to call back "periodically." I know that it was a long shot to call today, but because my approval letter was kind of vague, I wanted to see if there was a chance.

My approval letter said "This petition has been approved and forwarded to the consulate listed. You should contact the consulate for any questions." I thought that was strange and wanted to do some more investigating, but I don't think the NVC will be able to give me a solid answer on that.

US Embassy and Consulate DiscussionForm changes for London Embassy

The first sentence has been up a couple of weeks, and we have discussed it a bit in the UK forum because there was no link to the new form or explanation. It was just today (eleven days late) that they added the rest of it explaining the letter receipt is the deciding date. And they added the link to the form.

It has been taking London a long time to dish out packet 3 and interciews and visas before this change. London was a big mess well before the Sept new online form.

Glad to know it's not just me worrying alone! I guess after it got shipped from NVC, I thought we were on the way down and didn't have to stress as much, hence why I didn't worry about checking the forums and the site much. My fiance in London was the one that caught the change. We were about to send off everything anyway before we even got Packet 3 so that we could be ahead of the game. Glad we didn't!

Do you think this will help speed up London' processes a little or are they still experiencing growing pains?
