Hi Guys,

One thing to be aware of, with the new superannuation laws coming in July and you don't touch your superannuation the government can take your super if it is under $2000. Also I called my super company "Sunsuper" and they told me that if I didn't make a donation once a year the Government can take that as well because it will be classed as delinquent and nobody owns it and they take it. So the guy said just just make a donation to it once a year.

So just something to think about and put that in your diary one a year to out money into your super even the smallest amount.

I got my EAD and AP (combo card) today! :dance: can try to apply for CA driver's license soon

Questions:
1. So it's common that one receives EAD/AP before the interview day?
2. I cannot leave USA before the interview right?
3. Been reading some horror stories of failed initial interview for AOS, but i wonder is it mainly for people from 3rd world countries, or big age difference, etc?
4. I need to go back Aus pretty soon, my initial AOS interview is Sept 25, i wanna go back to AUS early Oct. But don't wanna leave it to the last minute, after interview to buy ticket. Should I wait or not? I wanna buy now.

HI guys

I haven't been on this forum for ages. all is going well, just waiting for the 'remove of conditions letter'.

 

The other day, we have to do car insurance forms, and the insurance company is asking for a record of my driving to see i'm a new driver or not (new driver has to pay more). So i'm contacting RTA to get a record. It cost $21 for an e-copy and $28 for a paper certified copy.

 

I thought we can get it for free, just by loggin into myRTA.com, but NO, you have to pay.

 

My NSW driver's license expired in March this year, I don't wanna extend it since I'm living in USA. and that prevented me to log into myRTA.

 

I wanted to call RTA, but their 132213 number is not reachable from outside Australia. then I got this number, just in case someone needs it in the future.

Later next month Sept 2014, my 2 year GC will expire, I'm doing the I-751 form to 'remove the condition' to get the 10 year GC. My Australian passport (in my maiden name) is gonna expire Jan 2015. I want to get a new passport in married name before I send my i751.

 

I'm an Australian by naturalisation (1998), birth certificate is from China. I have a Sydney NSW BDM for changing my first name in 2003.

I got married in San Francisco city hall in June 2012, then marriage certificate from contra costa county in California.

 

Just called San Francisco AUS consulate about this, they said with form PC8 alone is not enough to give me a new passport with married name. I need to get my California marraige certficate legalised. And I should call NSW BDM (i will later today) to ask if I need to officially change name with them, I may not have to since I haven't been living in Australia since 2011 or 2012.

1. Secretary of the state, something about notary, but seems notary at the bank is just one of the steps

2. Clerk and deputy clerks of federal courts

It seems like when Vanessa did hers, people born overseas, their non-AUS marriage certificate is enough as a proof to change to married name.

 

it sounds too complicated, doesn't it? Anyone in California changed their married name in the last year?

Ah it's my turn, originally I don't wanna change my surname but now I have to (don't ask why)

- Im an Aus citizen by naturalisation (in 1998)
- then in 2002 I officially changed my first name, so I got a NSW "Change of Name certificate" from RBDM. and later on changed every documents, except my birth certificate of course.
- Me getting married this month (June 2012) and will return to Australia for my wedding in Nov. and stay for 2-4 weeks then back to US for good.
- When I was in Sydney earlier this year, i renewd my NSW drivers licence for 1 year (since i won't be living in Aus)

We will be getting married next Monday in SF city hall. then i will apply for my SSN, AOS, EAD and AP under my new married name. in this county, we will have to buy the 'certified copy of marriage certificate' they don't give the original (e.g. in MA they do).

So after reading this wonderful thread (Thank you Vanessa again~ :oD) i'm thinking...
- this Nov when i go back, when booking ticket, i will use my maiden name.
- i'm not sure if i will change my AUS passport to my new name on this trip, i know it will be free. It originally will expire in Jan 2015, i shouldn't wait til 2014 right?
- If i don't change my passport during this Aus visit. I change it later (after 1 year) in US California, is showing the marriage cert enough as proof?
- Thought I will change my AUS bank card and Medicare card during this trip? With the certified marriage cert (CMC)?

- So there is absolutely no trouble to go back to US (after Nov) with my maiden name passport and new name AP?

- Later on i will do a master degree here in US under new name, and when applying to professional organisation, where i need to show my AUS bachelor degree document in my maiden name, I just need to send a copy of the CMC?
- what about transfering money from AUS to US, with paypal its not an issue? (Vanessa knows more about this I suppose)
- another thing, later on I got green card with new name, when I want to sponsor my dad from China to visit me, i need to show both the NSW change of name cert and the US CMC to prove that he is my dad?

I didn't change my name in Jan 2013, now i wanna get a new passport and have my married name on  there, then apply for ROC. It seems difficult now because rules have changed now. (see my post under Vanessa's "change of name" and my post about "changing name before ROC".

So assuming you were born in NSW, you fit criteria one. It's an "OR" situation for 1 OR 2 OR 3 so... I'm confused why if you were born in NSW that you don't think you can change your name.

If you weren't born in NSW but were born in another state of Australia then you change it in that state. If you were naturalised in Australia (born in another country) it's a difference process.

  • I got married in California, registered first, so i have my marriage certificate, it has my new name on it.
  • Then i applied for AOS, with new name, as it shows on my marriage certificate.
  • and same time as AOS, i applied and got SSN, so it's also in my new name
  • later on i got called to do the AOS interview, got greencard in new name
I don't have CA driver's license yet. I do have a combined bank account with my husband in the new name, we got it after we got married and with SSN.

ETA i don't need that now since I got my green card, but yeah it has my new name, but passport has my old name, I've been told as long as I bring my marriage certificate, US custom shouldn't be a problem. My ticket this time is still in my old name. I just don't know if this time i can't change my Aus passport, for the next few years when I exit/enter US would they question me. and I wonder when my Aus passport naturally expires in 2015 if i CAN change my name.

BUT I'VE BEEN TOLD BY THE AUSTRALIAN PASSPORT SERVICE (when i called few days ago from Sydney), I NEED AN AUSTRALIAN OFFICIAL 'CHANGE OF NAME' CERTIFICATE TO CHANGE MY PASSPORT, NO MATTER WHERE I AM IN THE WORLD.

Most people in my situation will change their Aus passport during this trip, but I can't as I got a valid visa for another country in my passport that I need to use for this year.

As you can see from my timeline, i got married in the US, and got my husband's surname on my SSN and green card already.

Now i'm back in Sydney for the wedding, i'm thinking of getting a change of name certificate so i can change the name on my Aus passport later (within 12 months) in the US.

But the NSW BDM requires me to have 'living' in Aus for the last 3 years as one of the criteria, and I don't qualify, i was overseas working for part of 2009, 2010 and 2011.

so i'm writing a letter to go with my application form, see what they say. The good thing is if i got declined they will still refund me the $166.

Just to let you guys know, or if you know any way around it.

isn it strange that criteria? it might mean I can NEVER change my Aus passport?????

and i confirmed with AUS Embassy in DC, the marriage certificate has to be apostilled by State Secretary, not notarized/certified/authenticated by any other way. I have to do the mail in then.

I don't think it matters whether you renew the passport before or after the I-751. You don't need to submit a copy of your passport for the I-751 application.

 

Is your green card in your old or new name?

 Yeah I gradually realised I don't need to renew the passport before the I-751.

 

Green card is in my new name, all US documents are in my new name.

 

now the hard part is getting the CA marriage license apostilled..... notary at the bank doesn't seem to be sufficient it seems.

My Australian passport is still my maiden name, and it will expire in Jan next year. My 2 year green card expires on late Sept this year. 

Should I renew my passport before I file the i-751 or after? Does it matter?

 

What if I want to change my first name in the passport too? Even it is just removing a - or a space? I read it is too difficult as I wasn't born in Australia but maybe.

May I add, as I did it in March 2012 , in Sydney, the best way to do it is online. and you don't need to choose P799 or P800.

1. https://npcoapr.poli...troduction.aspx enter the verification number and begin your online form!

2. Print out or note the document number when you finished this form.

3. Take this form with you to your local police, with your IDs (usually it's Passport, Driver's license and Medicare card) but it depends on which kind of ID you put on the form. And the payment and hopefully you can get your fingerprint taken then and there. If not you will have to keep calling them before you go, (before 9am is better), as they don't make appts for you, just depends on if they have someone in custody or not, as the fingerprint machine is in the same room.

4. Make sure they entered that you paid on the computer, then they send the fingerprints to Parramatta electronically, and noted all your IDs match.

5. Go home and relax and give them a working day then you can call to check if they got it on track! It can be as quick as one day I've been told.

6. They will send it to that address you nominated by normal post, takes 2-3 days.


# YES there is the option of sending it to your home address, or to another address. Which is good, but they use normal mail.

Definitely call over email. I have sent them 2 emails so far and it has been 6 days with no response. I called, waited like 20 minutes on hold and got my answer. The NVC website says they recommend you email over call but I think that is because it's more convenient for them, not the applicant. Just something else they can make you wait on without knowing what the status is.

It has been forty-seven (47) working days since receiving NOA 2 (3/12/2013) and NVC is still saying that they not received our (my wife & I) petition, anyone has any advice on how I should proceed.

 

I am in the same situation as you Volcar. It's been 56 days since I got my NOA2. I was at least successful at finding out where it is but that's as far the bureaucracy would let me go. Talking to the USCIS is pointless, their CS reps are clueless and even their Tier 2 ISO's are nothing more than call center reps that will give you a different answer each time you call them.

 

The NVC was the one that got me the location of our casefile but it did take them almost 3 weeks to get back to me. Just to give you  a timeline,

 

I sent the NVC a copy of my NOA2 on April 11th.

 

They got back to me on May 1st telling me that my case file was located at the San Francisco office.

 

I contacted my congressman and senator on May 3rd and they sent their first inquiry just to verify it was there.

 

The USCIS responded on May 13th saying yes it sure is here!

 

Currently I am waiting for them to respond as to why is an approved petition is still sitting at their office when it should have arrived at the NVC 6 weeks+ ago.

 

 

As you can see we are stuck playing by their rules. They say they have 90 days to get it to the NVC and apparently some person decided that there is no rush on their part to getting it there any sooner, in my case anyway.

Coincidentally I just got a response from and email I sent April 30th regarding my missing petition. Since they answer emails giving you the current status of your casefile, this is the response I got.

To continue processing your immigrant visa case, you will need to designate an agent by completing form DS-3032 (Choice of Address and Agent).  Upon receipt of the Ds-3032, we will send instructions for paying the immigrant visa application fee.  All future correspondence will be sent to the agent at the address selected on the DS-3032. 

If the principal applicant is under the age of sixteen, the principal applicant's parent or guardian may sign the form DS-3032.

Please email the completed form DS-3032 to NVCInquiry@state.gov, or you may also submit the form by mail to the address below:

Most congressman or senators have a link on their websites for immigration issues where you can download the consent form directly from them. Once you fill it out and fax it to them along with a copy of your NOA2. If you know where your petition is being held hostage this will speed things up immensely. Just make sure you have it on paper like an email from NVC stating it's location. After you have done that wait a day or 2 then call them. You are not the only one sending them stuff so depending on their work load it may take a few days more for them to get to your casefile. They usually have a person that only deals with USCIS issues and that will be your contact.

 

From personal experience do not settle for just your congressman. My congressman's office worked more like the DMV and everything took 2 weeks for this and 3 weeks for that. My Senator's office on the other hand took personal interest in my case and it only took 3 days for them verify my petitions location and another 10 business days or so for it to get moved to the NVC.

I hope that's the case...

 

Amazing case similarities :) So much for AP huh?

 

Too bad this is starting to become the norm with the USCIS. So much frustration and stress being caused by their unwillingness to pass along the petitions to the NVC in a timely manner. That and their CS reps making stuff up on the fly to placate petitioners is making life miserable for many.

 

Anyway, congratulations! You should know within a week or so if it arrived.

Ok, so here's an odd thing.... I talked to USCIS tier 2 this morning, and they said that my case hadn't been sent to NVC because it's still being reviewed in AP.

 

I thought AP happened at the NVC? is this BS?

 

Call the USCIS again and talk to another tier 2 and you will get a different answer, trust me on this. I just went through the exact same thing. There is no AP being done, it is just sitting there until the next batch of petitions are sent out to the NVC. I got the exact same email you did and I got all kinds of answers until my Senator's aide called the local office directly. Local offices are not used to handling petitions so they seem to have no urgency in getting them to the NVC in a timely manner. That and they for the most part only send their batches out once a month so if they missed one monthly shipment then it will just sit around for another month.

Hello Guys, calm down. We got approved on march of 25th, CSC, all lawyers say after approval it takes 2-4 weeks, i guess including delivery from USCIS. We have to wait 1 month and 7 days untill we got the case #. Just be patient, no stress, if you don't get it in a week, you just must call to NVC and say your NOA2 number. By the way all offices in USCIS theysend once in a month all approvals.

 

Today marks day 60 since our NOA2 was approved and it still has not been sent to the NVC. I will trade you my calm for your 1 month and 7 days case number # wait smile.png

Our letter was supposedly sent on the 22nd as well, and our interview is tomorrow and still don't have an actual letter. I was told that it's okay to not have one-they will have your name and appointment time on their list at the Embassy door. You'll have all of your other paperwork, including a copy of your DS 260, so you should be fine.

All done and received at the embassy a couple of weeks ago

 

Our December wedding date looks less and less likely, but reading how others have had their dates at fairly short notice gives me some hope smile.png

 

We sent it a copy of our venue rental with our wedding date on it with a nice letter asking for a sooner date. I don't know if that helped or not, but it seems to have since we have an interview a week from today. When you send in your Packet 3, send proof of your wedding date with it. It can't hurt to try!

Hello everyone!

My wife and I are getting our documents in order in preparation for the day when our NOA2 finally arrives. We seem to have everything in order with one exception, she does not have nor can she get a copy of her birth certificate. She has been to the Amphur where she was born and managed to get a letter from them stating they are unable to locate it. Unfortunately they want an original BC and I doubt this letter counts as one. From what I read on the NVC site she can your alternative documents such as an affidavit from her mother. This I cut and pasted from the NVC site.

"Unobtainable birth certificates

If your birth record is not obtainable for any reason, a certified statement must be obtained from the appropriate government authority explaining why your birth record is unavailable. You must also submit secondary evidence such as:

A baptismal certificate that contains the date and place of birth, as well as both parents names (providing the baptism took place shortly after birth)
An adoption decree for an adopted child
An affidavit from a close relative, preferably your mother, stating the date and place of birth, both parents names, and your mother?s maiden name.

Note: An affidavit executed before an official authorized to take oaths or affirmations must also be provided. More specific information is available from the NVC."

Now I know you can get the documents from the Amphur where her birth was registered at but what exactly do they want from there? If her mother makes and affidavit does it have to be given by an official or do you need 2 letters, one from the mother and another from the official? It would be so much simpler if I were to have someone that has gone through this explain it to me. When I try to tell my wife she has no idea what we need and the people at the Amphur do not seem to know as well.

Anyway I hope someone can help, thank you in advance!
