Today I got an email with that false RFE, saying they are waiting for my DS-230. Hopefully it wont take too long anymore till they have my case complete.
Or a real RFE, which I really dont want!!

champi, I just looked at my husband's form and he left it blank, and according to the operator we didn't get any RFE for the AOS packet, but she didn't sound so sure...

do you think they would give you a RFE for that? I don't know...

False RFE??? the whole process is screwed up

The IV bill was generated (and paid) on 4/9 --- status changed to paid on 4/10 --- cover page printed and DS-230 FedEx'd for Monday delivery 4/10

Yes, dont lose hope, your process is not screwed up. It happened the same thing to me, they gave me a RFE even with my IV packet already at NVC. Then I called and they said they were waiting for my DS-230, that what the RFE was about. But then the Ds230 entered into the system yesterday, and now Im waiting smile.gif

Only start worrying after you talk to an operator.

This is what most people do here, they send via e-mail and mail. For email you dont have to scan the actual form, just use this template

Im doing both K3 and CR1, but I will probably withdraw the K3 and im not going to the interview.
But I think you can get certified copies for both of them. For example I had my Marriage Certificate and didn't want to send that original I had, so I got a certified copy, which has the same value as the original, sent that one in and kept the first original for myself. You can do the same, send the certified copy to the NVC and keep the original to take with you to the K3 interview.

That just looks weird, for your timeline we can assume you haven't done anything yet and probably because you don't know it.

If it is what's going on, you have to still send a few documents and forms to the NVC before they get your case completed and before you have an interview date, Im sorry to tell you but your journey of sending documents still isn't over. Please read the link given above, it will help you to understand it.

Frila, what the users here were saying about the 6 months is true, but it's 6 months from the date you have a resident visa, not 6 months that you are residing in Brazil, get it? Like, my husband was here last year from February and we sent our I-130 in November, but we couldnt do the resident thing because he had a student visa only, if we wanted to do Direct Consular filling, he should have a resident visa for at least 6 months. So we just sent thing to USCIS. Other problem the resident card takes like 3 months to be issued, it's not very fast.

As for the difference, I don't think there is any, a friend of mine applied here and Brazil and her husband traveled back to the U.S while the process was going on at the embassy, he came back by the time of the interview, and then right after the interview they traveled together to the U.S.

But listen what Haole said above, your case is complex and you should get an immigration lawyer, for what I've seen you will need a Waiver, which I dont know much about and I can be wrong, but get a lawyer and try to see what your options are.

Hi Frila, I don't know what to tell you about your fiance being deported, I guess if he had only overstayed it would be different, but he was also deported, so I don't know.
But what I know is you can only do a Direct Consular Filing if you are a permanent resident in Brazil, and if you are then that's the best thing to do. If you don't have a permanent resident visa from Brazil you can only apply for a visa in the U.S.

For me it took 5 days till we got the AOS bill in the mail. 5 days counting from the date they generated the AOS bill in the system.
And the IIN it's really hard to get, when we tried to do that the operator said he didn't have permission to give us that info, so we didn't try again, it doesn't take too long tho to get that bill. smile.gif

Ok, I think I didn't notice something, actually I thought you would need to send the petitioner's birth certificate and passport biographic page if you have US naturalization, but the info from NVC is:

Applicants in the following visa categories are required to provide 1) an original or certified copy of their Petitioner?s birth certificate and 2) original or certified copy of their Petitioner?s marriage certificate from the Petitioner?s current and all previous marriages.

* Parent of a U.S. Citizen who is at least 21 years old (IR-5)
* Brothers and sisters of United States citizens (F4)


It doesn't say anything about naturalization tho, normally for the DS 230 and I-864 you don't send any petitioner's documents, such as birth certificate or passport copy.
You should contact NVC if it's still not clear, but I think you don't need to send those smile.gif

Ok, first I think it's two separate bills right? One for $400 and one for $70. If you say it's a bill of $470 it might confuse new users smile.gif
After that, are you planning to pay it online? it's really a good way to go, because you will need a cover letter with the barcode of your payment, and if you do it by normal mail you will have to wait till NVC sends you back that letter.

I don't know much about taxes so I can't help you with that, but I think your documents are fine. Ah, what I do know is that after April 15 NVC requires everybody to send their taxes return for 2008.

Only one detail, you have to send DS 230 part 1 and 2, but you only sign the first part. This is what I did.

Nope...Bogota embassy lists case # and interview date assigned by the 15th of the month before (May 15th for me)


Wait, so your interview is gonna be on the 15th? I didn't understand it very well... huh.gif WHat we know is that NVC will assing interview dates by the second week of May, but those dates will probably for June, and we might call back NVC to find out that date before it even gets to the embassy.

All people who are in the same situation as you, waiting for their cases to be completed.

After your DS230 in under review it usually takes 7 days till your case is completed, after that they assign an interview date, but NVC only does that on the second week of every month.

Look at my timeline and you will have an idea.

Your status is not gonna say "touched" on that site, the way you find out if it has been "touched" is by the last date it was update.
For example, a case was in the system on December 1st, I see that date there, then later when I log in and the updated day is for December 4th, that way I know that case has been touched, because it has a different last time updated date. smile.gif

You can't pay both at the same time because the IV fee bill is only generated after your choice of agent (DS3032) is accepted and the AOS fee is generate the same time your DS3032 is generated. And once is accepted don't pay too soon, it can complicate things for you later. Wait till you get an email saying the bill is ready to be paid.
I did get the email and NVC told me I paid too early, but I waited, it was their mistake tho!! And for some people who pay too early after a while the bill comes back to UNPAID, and NVC takes a few days to fix it, so it can really delay your whole process. smile.gif

Just relax, unfortunately is the season, everybody is waiting for the NOA1. I've file my on Apr, 20 (I-130) and still no NOA1. It's frustrating because we are just waiting for the NOA1 to file for the I-129!

Hey all that want to file an I-129F for K-3 with no receipt for I-130 (797)

I just received my I-797 for the I-129F. It said that it will take 60-180 days for them to process it. I filed it without the I-797 from my I-130 since I did not have it yet. I sent a copy of my check (received from my bank) front and back (shows date cashed and case number of I-130) with the online status form. Im so :innocent: I was having a rough day at work and loosing hope yesterday. I didnt even check the mail, like I did daily cause I was so sad cause I am tired of people asking me about my husband. It is hard to maintain a relationship afar. But I know that all this time and effort and of course money will be worth it when he is here with me :). Dont loose hope yall, you will make it through with your partner :innocent:

We filed for my I-130 on April and still no NOA1...we call USCIS and after long time waiting on line they told us they will send us another copy. It's been more then a month! I'm start to worry about this delay!!! I'm waiting for the NOA so I can file for the I-129... :angry: Anybody else waiting since april???

Yeah, a lot of people are in the same boat, it's annoying, but what can you do? I'm going to call them today and get another copy of the NOA1 sent out because I never got mine either, and I filed AGES ago.
