guys, thanks for all the answers!
Well, when I came here those times as a j1 holder I had no idea one day I would marry an american and move to the US! And had no idea I had to file taxes if I wasn't a resident! Hundreds of international students do Work and Travel every year and don't file taxes! We are completely clueless about it!

I was taking a look at both my W2's and here's what they say (both times I worked in Alaska):
2008: Gross pay - $8171.62; AK SUI (I don;t know what that is) - $40.86 and that's it! No federal income tax withheld!
2009: Gross pay - $3126.76; AK SUI - 15.63; Federal income tax withheld: $88.00!

I'm more confused than ever now! I emailed the HR lady of 2008 about the federal taxes and she responded "We don’t deduct those from J-1 paychecks automatically".
So now I don't know what it means... but I probably owe a lot of money.

And from what everyone responded me here, the best thing to do is actually to go ahead and file those tax returns, right?
And I'll probably need professional help, cuz this is all too confusing for me! I don't think I can file it on my own! This is frustrating!

Yes, I was issued a SS and I did receive a W2 from my employee!

1040EZ is your form, you file those taxes using the name you were using at the time. Standard deduction is around $9,500, if you earned less than that, won't owe a dime. Did you have an EAD and were you issued a SS number? Did you receive a W-2 from your employer? If none of the above, wouldn't worry about it, your earnings were never reported to the IRS.

Was just looking over my stepdaughters 1040EZ with part time jobs during college. We claimed her as a dependent since we were fully supporting her and paying her tuition. her standard deduction was $5,800 that she never could reach at a minimum wage part time job. So she received those few bucks of withheld state and federal income taxes back. But they do keep your FICA taxes, at a near 7% rate of your gross income, that is a lot of money for someone trying to earn a couple of extra bucks while going to college.

Even if you apply for US citizenship at the earliest possible date, should have no problems receiving three joint returns. Our AOS took 13 months, so we had four years of joint tax returns applying at the earliest possible date. That clock does not start ticking until you get that green card.

Well, you aren't required to file taxes if your income was below the amount required to file. Do you remember how much you made? Check IRS website for details about the income required to file (You should be able to find a table with details about the types of filings and the required amount). If you can document your income that would be more helpful (pay slips or any form of receipts). This was an advice to me by my immigration lawyer as I didnt file taxes for couple of years since I made less than the required amount (lived in a foreign developing country and got paid in local currency). I also kept my correspondence with IRS. I am applying for citizenship this month. I will update you about the outcome later. Email IRS now and inquire about the matter and present the correspondence with them later to USCIS if needed.

In the citizenship forms, you will have to answer this question: Have you ever failed to file a required income tax? Yes or No? Now, you need to make sure that you werent required to file, otherwise you need to justify your failure to do so or pay your over due taxes now (as someone indicated). I am not sure about the procedure of the latter.

My husband and I are going to file taxes jointly this month.
- Is it possible to file prior taxes along with this year's taxes?
- I was single back then, now I'm married. Does it mean I have to file the previous years separate from this years? How does it work?
- Since it's been 5 years since I came here as a J1 and didn't file taxes, does it mean I owe a lot of money?

Sorry if some of the questions make no sense. I don't understand ANTHING about filing taxes. I find this subject very difficult to understand!

Hi, I have a question about taxes and citizenship.
I came here in 2012 with a K-1 visa and have the intention to apply for citizenship when the time is right. I'm just really worried about something: in 2008 AND 2009 I came to the US as a J1 visa holder in a program we call Work and Travel. We would come to work seasonal jobs (ski resorts, casinos, etc) for about 4 months and then return to our country. Since I wasn't a resident or anything, I didn't think I had to file tax returns, so I didn't! Does anyone know if this could be a reason for denial when I apply for citizenship? Is there anything I could do about it?

Removing Conditions on Residency General DiscussionDenied I-751. What now?

I am sorry you are going through the same thing I went through.... and even more sorry I only read your post today... But if you check my timeline the worse happened to me because I was misinformed... so if I be of any help to you here is my best advice refile the I-751 include with it 3 affidavits of third parties having their names, address, date and place of birth how they know you and your wife and their testimonial that the marriage is in bona fide, also send a copy of the child in common birth certificate, send copies of health, car, house insurance and whatever else you have that shows both of your names on it please be aware that they do not like to see only recent records they prefer to have records from the time you two met to the latest which is todays... also send them a letter from the US citizen spouse ( which will be notarized as all the affidavits) explaining how you met, dated and married your wife, the same ask her to do it....
Here is the situation while you have an I-751 pending the alien is considered to be lawfully in the US... If you do not do that not only she will automatically go to removal proceedings as I did but she will start accruing unlawful presence from the day of the denial of the I-751 since the cause of denial was a late compliance to a request made by USCIS... This is a very bad scnerario because it can not only play against you both in deportation proceedings but even if she chooses voluntary departure to avoid deportation she would have acquired unlawful presence and therefore would be barred from reentering the country from 3 years ( if her unlawful stay which again it will start counting at the day of the denial letter, is more then 180 days and less then a year ) or 10 years ( if her unlawful stay is over 1 year)....
Now if you have a I-751 pending removal proceedings will continue but she will not accrue unlawful presence then in your hearing that you can call witnesses and bring all the documentation possible that the marriage is in bona fide... hopefully with that the judge grants the approval of the new I-751 ( since the judge will not have the juristication to overwrite the previous deision that is why you will also need a new petition pending)... if she is not favorable then she will grant the alien voluntary leave ( counting that the alien has a clean record) and you will then be able to get her back wuickly through refiling the I-130 and then an I-129F (K3 spousal visa)... which it is definetly not what we want see it happening ... but not the worse case ...
The worse case is for you to simply wait for removal proceedings, and the clock is tickinng each day that passes by works against you.
Be very serious about this and very carefull, a lost my whole life after being there for 12 years and we also have a son together, because we followed wrong advices from inexpirenced attorneys once our I-751 was denied....

I would like to share my interview with you all as well.

I went to the office with my husband. We waited on the waiting room for about 30 minutes until the lady officer called my name.
She had me sit, place my stuff (folder with documents and purse) on the chair and hand her my Green Card and driver’s license. Then she had me stand up and raise my right hand to swear I would tell the truth.
We finally sat down and she explained we would start with the test ‘to get it out of the way’.
I answered 6 questions – which she typed on the computer, then I did the reading and writing tests as well. Once those were done she went over my application.

There were 3 little things she corrected – and I also changed my name. She asked me the ‘have you ever’ questions and stamped the wonderful APPROVED word on my application. It was just like that.
I was tearing at the end of the interview as I was very happy and relieved. The lady was very pleasant as well and said that my husband had to take me for dinner to celebrate. I hadn’t been sleeping very well the couple of days before the interview, but it turned out to be a very good experience.

(and the huge folder with all documents remained closed throughout the interview)

Since the average time to get the NOA1 is 10 days, its been nearly 30 and for word from the California office. However they did cash my check on the 14th. I have not recieved my NOA1 and its worrysome. Any idea whats u with those people?

2-Main Menu
2-Additional Evidence
4-Additional Evidence
2, 1-Enter your case number

Speak to a representative from your service center!

Then you´ll be able to talk to an operator, otherwise you´ll just keep listening and listening and never talking to a real person... It worked for me!!

yeah, but last week I finally got to speak to an operator of the California Service Center and found out that they had sent my case to the NVC only in june 21st, that means that it took them 34 days just to send to the NVC!! and yesterday I got an email from the NVC stating they received my case and sending me my case number... so another 8 days for it to arrive at the NVC and get processed...
Hope it doesnt happen to you!
But I just explained that so you know that nothing went wrong with my case, so dont freak out if it happens to you (taking long to receive an answer from nvc)

Just called the CSC on the 880 number, and I got a realll nice operator who told me that even though I was approved on may 18th, they only sent my petition to the NVC last week, so it must be getting there next week, tops...
He told me to calm down that nothing was going wrong, it´s everything fine, just they took some time to send, but it will be at the nvc soon =)

I don't see any point whatsoever in talking to the USCIS customer service representatives. They don't know anything more than you would reading from your notice or email from CRIS.

Either try to get to an immigration officer from the service center servicing your case, or try DOS.




Anna, I called the 1-880-375-5283 and followed the numbers you told me, but after i dialed my case #, they said there were no operators available (I guess they work only till midday today) and then i was forwarded to the USCIS customer service...
do you think if i call again tomorrow I can get some more information??

I would do the RFE trick to get your respective service center to see if it left the building. I called the CSC and they told me it was moved to the loading area. It took 8 days after approval to leave for the NVC. After a week I called NVC everyday and they hadn't recieved it. Then one day (the next day again) I called and they not only recieved it but it was sent to the embassy. So be alittle patient. Also , to my suprise the embassies do not produce the interview dates the DOS does. You can call them (202-663-1225) to see when your interview is scheduled. Good luck all!!!!


hey billsafari, is that 202 number the CSC as well as the 800?? What´s the difference?

My permanent address i put the one in Brazil and the mail address i used family members address in Florida, but they got my brazilian zip code 54450-110 and matched up with as a US address and the nearest address to the zip code is in WI, they messed it up. I called USCIS and they said i can get it done at any Application Support Center in Florida, on that date and time of the notice. At the US embassy i work i have asked to the consular chief and she said they never got this done that they are not connected to USCIS....I guess i will have to be in States for all 3 appointment!!!!

Hi Everyone,

 

I sent my application on Jun 7 and on June 18,2013 USCIS sent my bio appointment. I'm current living in Brazil and working at US embassy.Im married to a US citizens and lived in US for the past 4 years. My questions is: it's possible to have my fingerprints taken at the embassy?? so i dont have to travel 3 times to US( fingerprints/ interview/oath)??? The crazy thing is i sent my app to Texas and they schedule my BIOmetrics appointment all the way in Wisconsin, how crazy is that? Please if any one can help me with this. I already tried to call USCIS but they give different histories, Once i called they said i can get everything done here in Brazil But the Oath, and today i called again and they said i have to be in the states for all 3 appointments?? so im getting confused....

07-08-2013 - Biometrics scheduled date

07-09-2013 - Reschedule letter sent out( because they schedule me to another USCIS location)

08-28-2013 - After almost 2 months, i haven't heard nothing about my reschedule biometrics, i went to US for fingerprints and had a walk-in biometrics

08-29-2013  - Fingerprints taken

09-03-2013 - the 2 letters i sent to change my foreign zip code arrived.

09-03-2013 - in line for interview

09-06-2013 - Interview letter sent

09-12-2013 - Interview notice received by mail(they schedule again wrong location.

09-12-2013 - Called USCIS to reschedule interview appointment, request to be interview in Florida.

09-13-2013 - Request was validated and i got email saying i'm in line to be interviewed again. We'll see if this time i'm schedule to right location

Thanks, That's what i thought. i was just chocked that they set up interview right after fingerprint, last then a week.super fast, i will check if there is anyway for me to get my Oath ceremony on the same week. I work for the government overseas and can't stay out of work for too long.

hello everyone, i would like to know if anyone here got schedule for oath ceremony for the month of October in Royal Palm Beach, FL. I will be having my interview on 10-22 and i would like to know if i can do the oath ceremony that week, because i'm working for the state department overseas and have to flight back to work right after interview. There is any way for me to find out when will be the Oath ceremony for that ASC center for the month of October? Where we can find this information?

you dont need the infopass sheet, just go the reception and give your name and time of appointment. They will be able to find out and give you a waiting number, once you number is call on monitor, it's your turn! I didn't take my Infopass sheet paper because i couldn't print it out, but it was no problem. i got there and were able to find that i had an appointment.
