K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support
For the past three years my income has been above the required amount to sponsor, so I have three years of tax forms that qualify me. This past year, however, there has been a decrease in work (I work per an 8 wk contract) resulting in a substantial reduction in income that is now far below the financial requirement. I do have plenty of equity in my home (nearly paid for), some savings, etc., to more than make up the difference. Is this acceptable?

Thanks!

K-1 Fiance(e) Visa Process & ProceduresNo pictures with parents, what to do???

The New Delhi consulate tends to make up rules as they go. Family approval (and evidence of that approval) is very important when going through any of the Indian consulates.
You're right about the other evidence. I have the affidavits from some of my family members which hopefully will cover the lack of pictures.

I am an avid scrapbooker and I'm glad I found someone else who did this! Great idea!

I agree with you about evidence of family approval. However, my thought is that this applies more to the Indian family's approval due to the cultural preference for arrainged marriages. Do you hav pics of you with his family? If you don't, how about including a marriage consent form signed by his parents simply stating that they approve of the marriage?

K-1 Fiance(e) Visa Process & Proceduresrequest for more proof of relationship

My fiancee went through the same thing at the New Delhi embassy for the K1 visa, but got the visa after she submitted the documents, she was issued a white 221g that submit more documents, I believe they asked for seven items on the paper. You must have affidavits from your fiancees family in India stating the engagement took place and that they approve of her relationship with you, also that they have no objections that your fiancee will marry you in the US and not in India. Your parents here in the US must write a letter and get it notarized, the letter must state that your parents agree with your relationship and acknowledge that you were engaged. You need a fiance letter of intent for yourself and foreign fiancee which states you will marry each other within 90 days of entering the United States, you need voters list for the last 5 years and voter Id card, you need engagement photo album, phone records, emails, any mail you sent one another. I know for a fact that the new Delhi embassy gives a huge problem to K1 filers if they did not have a proper engagement ceremony in India. You will definitely need a guest list with names and phone numbers. If you did not have a ceremony then both you and your foreign fiancee need to explain that in writing and get it notarized. Also you need a letter that explains how you met and why you decided to get engaged, your foreign fiancee will need to do the same, and it has to be notarized, for the letter write as much detail as you can and express your feelings for one another, I did all this and my fiancees visa was pproved 3 days after we submitted all the information. Also do you have the State department phone number here in America, because after you submit all this you can call that number give them your case number abd they can tell you if the visa was issued.

Why is Delhi so concerned with an engagement ceremony, I've never even heard of one? Is an engagement ceremony expected in India? Can it be something small, just fiances immediate family? Thanks!

K-1 Fiance(e) Visa Process & ProceduresNo current tax return for K-1 Interview. Problem?

"I wish I knew if not having a 2010 Federal Tax Transcript at the Interview is absolutely disqualifying--or of having a Co-sponsor will negate this problem.

I don't know as a fact, but it seems to me that if you have a co-sponor that it will not matter that you don't have 2010, or any other year for that matter, as financial qualifications will be determined by your co-sponsors financial status.

Aside from calling NVC, is there another way we might find out if they've received our application, such as an email or letter saying that it has been sent to NCV or NVC has received it?

K-1 Fiance(e) Visa Process & ProceduresK-1 Interview
Yes, I went to the embassy to inform them of the situation with the passport office in Jaipur. They were totally understand and said I could contact them to reschedule the interview. We finally got the passport about two weeks ago, and we did pay an extra fee for them "expedite" it. The embassy didn't wait for me to contact them and rescheduled the interview for June 1st, so I had to cancel this one also. The interview has now been rescheduled for July 17th.

K-1 Fiance(e) Visa Process & ProceduresK-1 Interview

You cannot attend the interview without a passport with at least 6 months validity on it.

50 days? BS. This is India. Pay for "Tatkal" -- it should come within 7 days, more if you can grease a few palms.

We think it's BS too, but as you said, "this is India" and in my experience things do not happen fast here. We have greased many palms along the way and this is how far we've come since October. Maybe tatkaal is the answer, though the passport office themselves told us it is not possible right now. We'll see, we just submitted an online application.

K-1 Fiance(e) Visa Process & ProceduresK-1 Interview

If you are currently in Delhi just go to the embassy! It really is simple. Walk up to the table, flash your US passport and tell them you want to talk to a VO about a K1. Have his interview letter with you. Then go to the check in area in the visa section. Tell the same thing to the person handing out tickets. They will route you to the right part of the consulate.

You can typically go straight into the inner waiting area without sitting in the outdoor holding area since your a USC.

Wait for your number to be called and explain your situation to the Indian screener and ask specifically to speak to a VO. Then repeat it all to the VO including your concerns about not be present for a rescheduled interview. They should reschedule it right there and then including giving you a new interview letter.

If you aren't in Delhi currently -in your shoes - I 'd rearrange my schedule to do this. You do NOT need an appointment with them to go there...

Thanks for the info! I'm in Jaipur, so I can get to Delhi easily enough on an overnight bus and be there Monday morning. Up until yesterday we were of the understanding that the passport was being processed and we'd have it any day, but when we called the passport office to check on it they informed us that all passports were on hold due to an arrest of an administrator. As I've just spent six months in India it's unlikely that I'll be able to make it back again for another six months. So hopefully, we can make this come together somehow.

If he has to wait 50 days for a new passport, just reschedule the interview for when you are able to come back to the country and he has a new passport.

The application expires May 20th. Since I've just spent six months here I wouldn't be able to come back again for another six months. Can the application be extended for this length of time?

If he has to wait 50 days for a new passport, just reschedule the interview for when you are able to come back to the country and he has a new passport. Even if they did interview him and approve him subject to him bringing the passport, they're not giving him a visa without a passport to put it into, and they're not letting him travel to the U.S. without a passport.

Yes, interviewing and approving contingent upon submitting the passport is my hope. I wouldn't expect that they'd give him a visa without a passport, or let him travel to the US.

More likely they won't even let him in the building without proper documentation. Also they can't interview someone without being sure it's the right person.

He does have several other forms of identification.

K-1 Fiance(e) Visa Process & ProceduresK-1 Interview

No....just reschedule the interview for a later date.

I wish it were as simple as that, but it's not. I'm currently in India and plan on attending the interview with him, but my 6 month visa expires May 9th, so I have to leave the country then. If we rescheduled I would not be able to be here as I'm not allowed back into the country for two months. Since I am dealing with the Delhi Embassy it is critical to approval that I am here to attend.

I don't see it happening either; but .. I think the best thing you can do is contact the Embassy, and ask them about it. If you can do it by email, even better, so you get a printable reply (in the event they say YES) to take to the interview Posted Image

I already tried contacting the embassy. Essentially, they refuse to answer questions over the phone. They referred me to the helpline who I have contacted via email, however, haven't received a response. In the past they've simply responded by saying they've sent my email on to the embassy and will get back to me, but they don't.

After many months and many complications trying to obtain the documents for my fiance to obtain a passport we've been told that it will be another 50 days before he receives his passport. His interview is scheduled for May 1st. So my question is can he interview without the passport?

K-1 Fiance(e) Visa Process & Proceduresmuch older woman/younger man
Jai and I also have an 18 year age difference with him being younger. I have been with him in India for two months now and plan to be here through the interview, hopefully prior to May (when my visa is up). We have the full support of his family and usually get together with them for a meal everyday. I don't know if religion will be an issue. He's Hindu and I'm open to all religions, but committed to none. We just got NOA2 today! I guess we'll see where it goes from here. :)

221G is not necessarily a problem. We got it and still had the visa within a week.

K-1 Fiance(e) Visa Process & ProceduresInterview Visa Approved or denied?
My understanding is that you're supposed to leave the interview with a determination having been made, whether it be an approval, denial, or 221g. As far as I know there's a document for each and you should have received one of them. In our case were were issued 221g. On it they check the box for the item that they are requiring. Ours was contingent upon receipt of medical, which is essentially an approval (passport was shipped today!). Are you in India? If so, I would stop by the VFS office and and ask them. In my experience they have been useless via email or phone (men! ;), but in person the ladies at the window do a good job of answering questions.

I had a birth date wrong once , dont worry in this case u can just walk in and tell them that this is the problem ..
they will re-issue it pretyy quickly

Really, because they told us it would take another 7 business days, which is the same as the initial processing time, and we have to pay the processing fee again. This was over the phone. My fiance showed up in person (an overnight bus to Delhi!) yesterday to address it, but I haven't heard back yet since his cell doesn't work in Delhi. Hopefully they were more understanding and helpful.

It's definitely not him, and I know it needs to be returned and reissued if it's supposed to have a photo of him on it. I ask because I've never had a visa with my photo on it for any country I've been to and he could be describing to me a historic figure pic or something that goes on all the visas.

So, someone who has seen one, or has one, please confirm - a US visa does in fact have a photo of the passport holder on it?
