Hi,

If you go to the US embassy website in your country it should clarify that. I know many of the forms had to be filled out in English especially the online forms.Most times the specify it on the form. Your interview and documents that are brought to your interview can be in spanish. I would make sure that at least the forms you fill out like the I129F (petitioner form) and G325a petitioner and beneficiary must fill out) are in English. Aside from that, the 129F is for the USC petitioner and the petitioner should in theory provide the information regarding their Fiancé, but it is usually to check out the petitioner's information and information provided is valid. So your Fiancé should be able to help with the English aspect. The other documents like copies of the passport and stuff of the beneficiary can be in Spanish. When I sent in the proof and wrote on the backs and stuff of the pictures and tickets etc. I put that in English as well. Also the letters of intent should be in English. Again the initial petition is sent in by the USC petitioner so it should be in English. The steps after words you can bring in your documents and stuff in Spanish also. Best of Luck.

Yes, passport stamps and boarding passes are primary evidence of meeting face to face within the 2 years prior to filing. Photos are secondary. Chat and phone logs, Facebook messages and Skype logs are not really proof of meeting or even required with the I-129F petition. Those things show an ongoing relationship. It is not bad to put a few of those in with your I-129F petition, but they are not used to prove meeting, which is one of the main requirements of the I-129F.

A copy of the entire passport is not needed if you are sending in a copy of your birth certificate to prove citizenship because that is what the entire copy of your passport would be for. They want a copy of the birth certificate OR a copy of all pages of the passport. If you want to go ahead and make a copy of all the pages to show your stamps, you can but just a copy of your biographical page plus the pages with the stamps should be enough if not using the passport to prove your citizenship. Just copy them as clear and legible as you can make them.


Yes this is true. I sent in a copy of the passport and birth certificate but it's not necessary. I just added a lot of extra stuff in the original petition in case cause I was nervous. lol. You'll do great though!

=) I have all that other paperwork that the I-129F requires, as well as a few photos, emails, phone records, transcripts from when I was studying abroad there, etc. I just read that boarding passes and passport stamps are "primary" evidence and the rest only counts as secondary evidence. Since I didn't keep the boarding passes, it makes the passport stamps kind of important.

No problem. Any proof you have will serve, and it's better to send in more then receive a denial for not enough. I didn't send them any passport stamps from me entering and leaving the country, but I sent a copy of my passport with every page in it so if they needed it they saw it there. For proof of relationship my Fiancé and I had stamps from when we traveled together and I sent that too. I think you'll be just fine! Feel free to ask any questions you need! Hi,

For your proof of relationship if you have any photos you can write on the back explaining them. The passport stamps I would write on them, preferably in english explaining what they are and how they're proof of your relationship. Stamps for entering the country will serve as proof but they may not be enough. I would also send in the recommended letter of intent to marry signed by both the petitioner and the beneficiary as well. If you have phone records or emails, or facebook messages between you an your Fiancé, that will also serve as proof. Also, I wrote directly on the page and put arrows and things like that to show them what I was referring too, just don't cover the stamp, write below or wherever there's space. Best of luck-

While I wait, I'm wondering if i can gather anything to send to my fiancee only because its very hard for to get any information or documents. She lives in the countryside and doesn't have easy access to transportation. Can someone help me please? HI,

If you go to the embassy website in the area where your Fiancé will be having his/her interview there should be an instructions packet. Really for the second half of the interview the things she will need are your I-134 Financial affidavit, and on the back of the 134 there is a list of recommended documentation that you can send to her for the interview. She will also need either a copy of your birth certificate or passport, and your signed letter of intent to marry. Check out the links below, and they'll give you some more details. The information on these sites is general so it's important to check out the embassy/consulate website where the interview will take place as they may have specific instructions, and need specific documentation.

It can still be used as proof of relationship. For example, if your both on the rent contract etc. My Fiancé and I have memberships at the same gym, and We've used that as proof as well. So it's ok that you put the address. Just needs to be clarified on the form that your permanent address is in the USC if that's the case. But you can still use whatever proof necessary to show your relationship is valid. In our case my Fiancé and I've been traveling so much that I wasn't sure what to put either. You can even clarify it in a letter if necessary, and if for example, your registered US permanent address isn't actually your house, and it's your parents or something where you would be staying initially, they can write a letter as well. Don't worry. You'll be fine!

On all forms you should put your permanent address in the United States. If you are on a tourist visa you are not permanently living in Mexico. a good rule of thumb is if you have a contract, or receive bills and taxes, etc. where you're staying, however this isn't usually the case for tourist visas. I'm assuming you got the Notice of approval from USCIS or you wouldn't be doing the DS 260 form. Therefore, I'd still put your permanent address in the US, and your Fiancé/Spouse can always explain the situation if it comes up as a question in his/her interview. But if you put the Mexican address they may ask why you are requesting a visa if you're (USC) permanently living in Mexico. I'm on a tourist visa as well, waiting in Mexico with my Fiancé till his interview in may. I put my US address as recommended by my attorney. Since you are the USC you should put your permanent address in the states and if that is the address where the beneficiary will be residing as well, the same address should be put in as the beneficiary's address within the U.S. For the beneficiary's current address, you must put the one in Mexico. I have heard from many who recently went to Juarez that there have been no issues. Everyone just says to not talk to the people who are waiting outside and trying to offer you quick deals. They also say to not give your document to anyone who is not clearly a guard and even then he should just need a glimpse of it to let you in. You'll be fine. best of luck!

It doesn't need to say whether you will have a job in the future or not. It needs to state how long you've been working there for, which if it has been awhile shows job security. As long as you have the job when the approval is being given it shouldn't matter. You'll need a job afterwards obviously, but it's unrealistic for immigration officials to require something like that, especially since employers cannot make such guarantees. You do not need proof of the future, you only need proof of employment and proof that you can support for Fiancé/Family members/Spouse through your assets, life insurance, job, etc. For example the life insurance an assets could be used to support your family if you do lose your job in the future. The employer letter is just valid proof from your employer, and it backs up everything else you've put on the I-134 requiring your work and salary.

Ok. I thought it was a little crazy, but they were comments from 2011 so I wasn't sure if the system was still the same. I have everything that they seem to require I would just like to avoid an RFE, which people were saying happens if they need more proof of something, in most cases it was financial. It's my understanding that the employment letter is a must-have.  I could be wrong, and I'm sure SOME people have gotten through without it, but since so much depends upon your income and being able to prove that your income is ongoing (not just your past income), the employer letter should state that you are currently employed, thus giving proof that your income will continue.  Paystubs don't provide any proof of future income.

 

As for the bank letter, you need that ONLY if your income is below the poverty level.  I am including it, because my income is so variable and although it's good right now, it's been shaky in the past, so I'm using investment/bank accounts as a safeguard.  It took literally 5 minutes at a desk in the bank, and they printed it right out for me -- well worth the time, in my opinion.  But if you are comfortably and reliably above the poverty line on income, then you don't need the bank letter OR bank statements at all.

By any chance did you have to have two years worth of bank statements? I saw some people did, and others haven't mentioned. I have the bank letter which has everything from 2012 to now, and two bank statements from 2013. I'm above the poverty level as of 2012 I'm not sure if I was in 2011 or prior years, but I included the letter either way. Should I provide more bank statements or have the bank include in the letter the previous years as well? Thanks-

I have both a bank letter, two statements, and employer letter, pay stubs, W2 and any other necessary proof. You may not need the two letters, but it's better to be safe than sorry. The more proof you have may mean less questions or concerns in the interview process. My bank letter just stated how much is in checking and savings accounts, when I opened the account and how many deposits i've made in the last year. My employee letter included how long i've been employed, how many hours i work, job description, and salary. Best of luck.

ok but some people put K1-Visa

At this point in the process it is an 129-F Fiancé petition. At the embassy they begin referring to it as K-1 Visa. At least this was my experience. I would assume it would be the same thing, but I would recommend 129-F since that is the petition your are sending in and the visa is the second aspect. That's what I did, and we were approved all the way through. :-)

 yes that's correct. I check marked where it says other (specify) and put 129-F. If they give 129-F as an option than select that. This is the case for both the petitioner and beneficiary G325 forms.

They ask for the description of how you met on the 129F form. So you can explain it there. You can write none on the G325 if there has been no address outside of the US for the USC. and you can write the 129-F in the other section on both forms. Best of luck!

You each need a letter. On the letter you put your permanent address. We didn't have to attach any other information except for in the proof a relationship section. the letter should only say that you intend to marry each other, and that it'll be done within the 90 days given by the USCIS. Other stuff should be put in the proof of relationship section where you can put whatever you need to prove that you've met and been in a relationship with in the last 2 years. Good luck!

i just told you in the other thread.. that my wife, was given option to have a spanish speaker CO...  on arrival 12/31/2012.. she spent the night there.. cuz the immigration line was too long.. so she flew out to houston next morning.. 

 

the people at miami airport were more likely to speak spanish..  my wife was very comfortable there.. 

 

she felt that when she got flight to houston.. the people there.. were less likely to speak spanish.. or as she put it.. chose not to speak if they didn't have too..

My POE will also be at MIA in June. I also have my paperwork and visa ready, and I will be flying alone. I read some reviews too and they are not too recent as you have said. But I don't think that you should be worried. If you have the paperwork and everything settled then he must be fine at the airport smile.png Moreover, you will be there at his side.

I am a bit worried about how long I will need to wait at the immigration but oh well, what can we do? This airport is extremely busy, especially in summer so...yes, it can be 20 mins and 4 hrs as well... sad.png

My Fiancé and I are flying in together in June at Miami. He already has his visa and paperwork etc. I was looking through Miami POE reviews and they're all from 2012. Anyone have a 2013 recent experience they could share? I'll be with my Fiancé and go through the citizenship line together as most suggest. Does anyone know how strict the officials are with Spanish? My fiancé is still learning english and is at a low intermediate level, and while the officials always talk to me in Spanish, i'm not sure if they'll give him a hard time or not because his an entering immigrant. Any ideas? I've heard it can take from 20 minutes to 4 hours for the officials to process his paperwork and let him through. Is that true to? Hey guys my uncle in cosponsoring my fiance in bogota, what should he put in relationship to sponsor? Nephews fiance? 2. Since i dont make enough money at the end do i put do or dont intend 3. What is that line for about the signature on the right side? Initials?

I could be wrong, but my lawyer instructed me to put the I-134 with all my information. My parents are also helping us, as we'd be staying with them at first, but for example salary and all of that stuff was mine. I would assume that Nephew's Fiancé is fine, but again I'd look into this because I was told if family is going to help sponsor that should be put on the 1 864 when filing the AOS, but that the I-134 has to be all financials from the petitioner. If your uncle was the petitioner it would be different. Not sure if that works since you're the petitioner. You need to put that you do intend, as immigration may then see your fiancé as a liability if you don't end up getting married. If you have a job I recommend putting all of your own information and then having your uncle write a co-sponser letter or something, explaining the situation. Hopefully someone else has had a similar situation and can help you a little more. oh and the line I left blank, I only signed and put the date where they asked for the signature and that was fine. you can always initial if you like too. I still live at home with my mother, does that create a problem with this form? Also it asks for how much money I have in savings. Do i need to prove a bank statement showing what i have? I dont have much but its over 10,000. I make over 50,000 a year. Is that ok?

Hi, you need to make a salary above the poverty line, so you should be fine. It doesn't matter if you're living with your mom or not, what matters is that you have a place to live, and that you have enough to cover any necessities. They'll want bank statements from the end of 2012, and 2013, and a letter from the bank would always help, stating when you opened your bank account, how much you have deposited in the last year, and how much you have in your checking and savings accounts. Any information provided on the i-134 form will need back up. For instance you need to include tax returns, pay stubs and an original W2 form for 2012 and pay stubs from 2013 to support the salary you said u make on the I-134 form. I also recommend a letter from your employer stating your job responsibility and title, how long you've been working there how many hours u work a week and how much u get paid. Don't forget to include any proof of life insurance, assets and stocks as well. These are important because if you lose your job immigration wants to know that you can support the beneficiary through other means. For example your car is an asset, you can bring a copy of the title of ownership and a copy of your insurance, if you lose your job they know u can sell your car for money. Hope this helps. I am working on filling out the DS-260 form online and it asks for the addresses where my finance has lived since he was 16.  

 

Few places rural Mexico have actual addresses.  

 

Looking for advice on how others filled out this part of the form...

Hi, our attorney recommended only putting the addresses of where my Fiancé had lived for over a year, and was actually registered living (received mail, or had a contract and things like that). For certain time frames he put his mother's address as he didn't have an official address at some points due to travel and was still registered as being at his mothers. You can do the same if it applies. If not, just put the information that you can. For example the street name, and at least the state and county or town, or city nearby, but if he doesn't know the house number then don't put it. For zip codes we looked up the area online through Google Earth or Google Maps, because my fiancé wasn't totally sure about the exact zip code and like you said, sometimes there aren't real addresses in the rural areas. Just want to make sure I cover my basis for proof of relationship and having met in person also.

 

I spent 2 months in the Philippines. So I'm attaching bank statements from savings account for atm withdrawals and CC statement for purchases, plane tickets we both used to fly from Davao to Cebu, 2 hotel receipts 1 in her name and the other in my name. Then also the lease agreement we had on the town home we rented. With this 7 pictures at varying dates during the trip of us and also some with me and other family members.

 

This going to be good enough or anything else I should include? Should I also include a few statements from my vonage phone # for communications outside my trip dates? I don't want to miss anything and make sure everything goes smoothly and as quickly as possible.

That should be fine. Another option which is always good for secondary proof is you can also print out texts or messages through emails, Skype or Facebook, etc. between you two. Photos, tickets, hotel reservations, memberships, anything thing like that is very important. Also if you've traveled outside of the country together at all, copies of the passport stamps can be important. Your entry and exit stamps can be proof that you flew to see her, and if you traveled together some where and she has stamps as well as you do, you copy both passport stamps and write on  the copies explaining what is entry and exit and what trip it was for, etc.  Just some additional options. I read on the site here that it is about a year for a K-1 visa but because I do not know the language yet or k-1, I-29F, K-2, etc., so I was not sure if I was reading it correctly. I will wait any amount of time to be with her and if need be move there, but the U.S. is more financially promising. I have searched on the site here but as I stated I do not understand all the jargon and do not understand how to read the timelines.  I suppose that I just want some validation for thinking that if everything is filed correctly and all conditions are met that we should be together in about a year?

My husband just got approved for his i485, and we first applied for the i129f K1 in Aug 2012. The first part of the petition took about 7 months, Feb 2013 he was approved, and recieved the consulate packet in april at which point he went on his interview, and was approved and was in the states 2 months later. The whole process took about 10 months. We chose the interview date and his US arrival date to be later because of timing, but he could have gone on to the interview the same week he got the approval, and gone right to the states once he got the k1 visa in his hands if we wanted to.

 

We were married within 90 days upon his arrival to the US and he recieved his work visa about 3 months after we applied for both the i765 EAD and i485 Permanent Residency. Due to a delay at USCIS they took longer than usual to approve his GC, but waived his interview. He had his GC approved in 9 months.

 

We did all the paperwork ourselves without the help of an attorney. If you have any questions feel free to ask, but our K1 took 7-9 months, not even a full year. Keep in mind time varies depending on the number of applicants, but I would be suprised if your case took longer than a year. I'd be suprised if it took a full year even, assuming you send all information necessary, and followed the process verbatum. VJer's are helpful and helped us throughout the whole process. I am a filipina and will work in dubai UAE few months from now. my boyfriend and I are planning for fiancee visa, my question is, can we process the fiancee visa while I'm or will be working  in dubai or do i have to come back in the Philippines to do the whole processing?

As long as you have all of the legitimate documents to be working and living in Dubai it should be fine. When my husband started the K1 process we were in Argentina studying and he is from Mexico. You just have to determine if you will still be in Dubai by the time of the interview date. We applied in August 2012 and my husband has his interview in may 2013. We started the process in Argentina and finished it in Mexico since we new he'd be there in about 7 months. Therefore we applied as if he was permanently living in Mexico and gave all of the information from Mexico, while mentioning that he was studying in Argentina. If you will not be in Dubai in 5-7 months make sure you mention that, when filling out the documentation, and make sure you choose the appropriate embassy based on where you'll be in a few months since this process is not always a quick one. The first part of the K1 process I129-F focuses more on the US citizen, the petitioner, with only a few questions regarding the beneficiary (you), however your fiancé will need to provide proof of relationship among other things, which you can find on this website. You'll also need to provide a permanent residence address where they can send your information. In most cases they will send it to the US citizen and to the Beneficiary, but in my husbands case he never received them in Mexico and they went directly to my address in the U.S. Those are my recommendations. Look up the estimated wait time for K-1 visas I129F approvals and decide where you'll be based on that timeframe. Best of luck!

Hello again,

I think I was jumping ahead of myself it seems. So as we file our application, we are only required to submit an I-134. Then if the visa is approved we can start to look at the I-864a which is where the number of dependants on the father's income form is considered, plus me?

And I read that is would be 125% not 100% of the federal poverty line? Sorry if I seem muddled, but its nice to talk to someone who knows more than I do.

I have been reading the instructions and the form and I think I'm losing the plot! Thanks for the help :)

I've been reading the topics on this site for a long time now, and have read the guides quite a fair bit too. Thanks for all the information gathered so far, it has helped a lot.

I have a question relating to the co-sponsor form and the requirements for taxable income. I recently read another thread on the same sort of topic but found it too confusing. Basically it was a lot of "no it means this" "no it doesn't, it means this" arguing, so I thought maybe someone could answer it more clearly or point me in the way of an online guide that explains it better.

My fiance does not make enough to sponsor us, so we will be asking his Dad to fill out a co-sponsor form. My fiance lives at the same address as his Dad, his wife and child (over 21). If his Dad filled out the application, would he need to show enough income support for himself, me and my fiance? Or would it be himself, his wife, his child, my fiance and me?

My fiance is also considering filing for two other family members on his tax return this year. Am I correct in assuming that his Dad would need to cover those 2 aswell?

I'm sorry that this type of question has been asked before, but my brain is just swimming with different options at the moment. Thanks for reading.
