Start getting everything ready for AOS. You will need an original certified copy of your marriage license to include with the package so make sure you get one if you don't already have it. Read the AOS guides AND tips. Good luck!

If you are legally married you can't apply for K-1 visa,
If you say you are married, even if you are not, you run the risk that USCIS might take you at your word and you will be denied a K-1 Visa.

K-1 Fiance(e) Visa Process & ProceduresVISA delivery after interview?
There is a FedEx "tent" set up right outside the consulate. You will pay them for delivery of the visa. My wife (then Fiancee) waited in Kiev and picked it up at the FedEx location she specified because she lived in a very small village that was not serviced by FedEx.
Here is a link to a page at the consulate web site. You should read everything concerning the K-1 visa there. Let me know if you have any questions, I'll be glad to help.

It's my understanding that you should wait about a week before going to the SS office. But don't wait to long after that. If it gets to close to the date on the I-94 they won't issue one.

When I sent mine I used paper clips to hold each section together and then a large alligator clip to hold the whole thing together. Mine sailed right through without a RFE. As has been mentioned before in other forums, they will be taking it apart anyway to set it up in the way they want. I wouldn't be punching wholes in anything if I were you.

Age difference is not a factor at the Kiev Consulate. Tanya and I have a 12 year difference and I know plenty of people with more than ours that were approved with no problem. Culturally it's not uncommon.

K-1 Fiance(e) Visa Process & ProceduresImmigration Attorney

I've been working for several months without a day off, and I am still very unsure about doing the paperwork myself for a K-1 Visa. I've decided to hire an Immigration Attorney. I did a Google search and found several at prices ringing from $995 to $2495. I'm not certain who to use or who to trust. They all promise results.

If anyone can make a recommendation for an attorney, send it in a PM or email me at Hangernaid@gmail.com. I know this site is not for commercial purposes and I don't want to have a thread deleted by violating any rules.

I appreciate the recommendations.

Jim

Jim, Ukraine is an easy country to obtain a K-1. There is really no need for you to hire a lawyer as long as you are capable of filling out a form and collecting the proof you will need. Come on over to the Ukraine portal and we will help you through this from beginning to end.... You CAN do this. Please also read Gary's interview with the VSC director, it's very informative and I know it really helped me make up my mind that a lawyer was not needed. http://www.visajourn...ess-procedures/

No problem if your fiancee is a US citizen and free to marry on the date she applies.
The US only recognizes US citizenship. From the standpoint of the US you should be fine but you would need to check if you are allowed to get NZ citizenship while applying for K-1 visa with NZ government. When you apply you will be a UK citizen. You simply put that you are residing in NZ. You will need police certificates from the UK and NZ.

you have to be free to marry when you meet.

This is not accurate. I met my wife in person before my divorce was final (Nov 2009, not free to marry) Divorce final (Jan 30, 2010) Filed (Feb 2, 2010)
Both have to have met in person within 2 years be free to marry before the petition is filed.

K-1 Fiance(e) Visa Process & Proceduresconfused and angry

Do a search for VJ member "MCat" and read his posts. I am convinced it was all a fiction drama, our own little VJ soap opera

Long story short, MCAT was engaged to a Super HOT Ukrainian woman (nothing new there) who was a stripper. She got here and started stripping right away for cash...no EAD of course, and was having sex with everyone except her poor, long suffering finacee, MCat, who was forced to observe all this going on in his apartment...and he would keep asking what to do? What to do? No matter what, he did the wrong thing, something like...

"She is bringing men home and I can hear them having sex, but she does not have sex with me. What should I do?"

Everyone would tell him to dump her, send her back...next post

"Well we talked about it and she said if I marry her and file her AOS she will give me sex"

You just HAVE to read the posts. I am sure they are archived. For those of us who know, those of us with "the knowledge" that he chose a Ukrainian woman to play the part of his fiancee made it all, somehow, believable. :P They just fit well into James Bond movies, fashion modeling, sex scandals.

I miss MCat

K-1 Fiance(e) Visa Process & ProceduresDS-156, additional visits to US
Hello everyone!

I have a question about the DS 156 form. My Fiancé has a son, but due to personal reasoning with the mother, he has no contact with the son and therefore will not be petitioning for him now or ever. At the bottom of the from it says to bring the son's birth certificate. Is this necessary if the son will not be traveling with him? I assumed since he has no contact, and doesn't even know where the son is located, that it wouldn't be. Plus it's clear on the forms that he isn't bringing him along. Anyone had experience in this situation? Thank you.

Regards,

Roma

K-1 Fiance(e) Visa Process & ProceduresMedical exam vaccinations

Yes his visa was aproved. That form is not needed for a K-1 approval since vaccinations are not required for a K-1. They are required for AOS. You only need one in a series of MMR, Tdap/TD, varicella(or history of chickenpox), and a flu shot(only during flu season). If someone has all the required vaccinations properly marked off on the DS-3025 at the time of their K-1 medical, then they can just send a copy of that with their AOS paperwork and never need to see a civil surgeon in the US for the I-693. He can still get all the ones required for AOS and bring the records with him to have them transcribedqd onto the I-693 by a civil surgeon in the US. You will need to call around to find one that won't insists on a new medical and/or overcharge you. You can search here on VJ for more info about that.

Ok great. Thanks. My Fiancé already has the Tdap/ and flu shot, and he had the chicken pox as a child but doesn't have proof from a doctor so I assume he'll need that one and the MMR. I will make some calls once the time gets closer to see what doctors say. :-) Thank u

K-1 Fiance(e) Visa Process & ProceduresMedical exam vaccinations

Please know that Juarez typically does not give vaccinations for K-1 applicants or transcribe vaccinations onto the needed DS-3025. Someone recently went through and were made to pay for some vaccinations at the medical. Not all given were even required and they still gave no DS-3025 vaccination sheet.

Ok Thank you. We thought about going to a local doctor and having the doctor see what of the vaccinations on the recommended list would be appropriate. We've been told that K-1 doesn't need them, and that not all are required depending on age, and gender, but that my Fiancé will need them anyway when applying for a change of status so they recommend getting it before the interview. Was this couple approved for the visa even thought they didn't have the DS 3025? I find that strange as I assume the point of going to the doctor is having the proof that you're healthy, but maybe if you're healthy you don't need the form. :-) I'll have to call the embassy I assume to confirm. Thanks again!

K-1 Fiance(e) Visa Process & ProceduresMedical exam vaccinations

Not only is it acceptable it's usually cheaper to do so. Just make sure he brings a print-out showing he's had shots done and when.

Since the change the influenza/flu shot requirement (in season) still catches a lot of civil surgeons out and they don't realise everybody needs them. I wasn't given mine and didn't realise at the time I sent my AOS off, but thankfully wasn't given the RFE for it despite the fact technically I should have.

Thank you! I'll be making an appt at a local doctor's office then! Best of Luck!

K-1 Fiance(e) Visa Process & ProceduresMedical exam vaccinations
Hello all,

My Fiancé is from Mexico and will have his interview in a few months for the K-1 Fiancé visa. He will go for the medical exam, but we thought that maybe we could go to a local doctor to get at least some of the vaccinations ahead of time so he'd not being injected with a million all at once since the list is quite long. Does anyone know fi this is acceptable? Or do the vaccinations have to be from the US embassy doctor?

Thanks for your time.

K-1 Fiance(e) Visa Process & ProceduresConfusion about DS-156 form (Juarez) [edited title]
Hola,

My Fiancé is filling out the DS 156K now as we speak. It says on the form he needs to provide a birth certificate for his son, however his son will not be traveling with him now or in the future as they have no contact. Is the birth certificate still necessary considering they have no contact and the son will not be traveling with him? I appreciate your help.

K-1 Fiance(e) Visa Process & Procedurestranslate all proof?

I hope that is the case!! Trying to translate documents long distance is a huge pain, especially since he has no internet access and it all has to be over the phone.

If he does need to translate the embassy should have a list of approved translators or at least guidelines, within his country. He should be able to take it to a local translator and have them do it, as long as it's a legitimate translator. That's probably easier than getting a copy of all his stuff and bringing it to the states to translate, probably cheaper as well. Good luck!

I thought that at the interview stage everything had to be in English such as my fiancé's police report and medical records and civil status record. Posted Image Slightly confused here. I will go check out the Costa Rica embassy page again. Thanks everyone!

The embassy in costa rica may require it, but my Fiancé doesn't need to translate anything for his interview he's from Mexico. We were told in various countries that the interviews take place in the home language, and birth certificates and such things can be left in the spanish.

K-1 Fiance(e) Visa Process & Procedurestranslate all proof?

i found out that the letters do not need to be translate they can be send like that, the people at the embassy will be the one reading them not people form uscis

Yes you're right. If you are talking about the interview part or anything after the NOA2 the documentation can be in spanish as the interview and consulate is in your home country. It is only when you initially send the petition to USCIS that English is important for documentation purposes. It may be possible that once in the US your documentation may need to be translated. Regards.

K-1 Fiance(e) Visa Process & Procedurestranslate all proof?
Hi,

If you go to the US embassy website in your country it should clarify that. I know many of the forms had to be filled out in English especially the online forms. Most times the specify it on the form. Your interview and documents that are brought to your interview can be in spanish. I would make sure that at least the forms you fill out like the I129F (petitioner form) and G325a petitioner and beneficiary must fill out) are in English. Aside from that, the 129F is for the USC petitioner and the petitioner should in theory provide the information regarding their Fiancé, but it is usually to check out the petitioner's information and information provided is valid. So your Fiancé should be able to help with the English aspect. The other documents like copies of the passport and stuff of the beneficiary can be in Spanish. When I sent in the proof and wrote on the backs and stuff of the pictures and tickets etc. I put that in English as well. Also the letters of intent should be in English. Again the initial petition is sent in by the USC petitioner so it should be in English. The steps after words you can bring in your documents and stuff in Spanish also. Best of Luck.
