Received Biometrics appt. 09/05/2012. They are sending me to the wrong service center! I live in West Palm Beach and they are sending me to Ft. Myers.. a 2.5 hour trip one way! I'm going to do a walk-in at West Palm next week.
The same thing happened when we went for biometrics for AOS. It worked last time so I'm hoping it works this time.

I got in what I hope is a pretty decent submission today, so they'll have it on the day of the deadline. USCIS support said this is technically too late when I called them yesterday, so I added an explanation with some evidence. Thanks again for the advice.

Thanks. To be clear, the waiver is the one where the marriage ended through divorce. My divorce isn't final yet, but will be in a few months. My understanding, based on the memo here (http://www.uscis.gov...tion_3apr09.pdf) had been that I should file with a request for a waiver of the joint filing requirement, but without sending the divorce decree until the RFE (since I don't have the decree yet). Did I get confused?

I don't have a good idea of how I should be trading off making a hasty submission vs. being a few days late. If I'm going to have to send in the divorce decree later anyway, does that mean I'll have an opportunity to send more evidence of bona fides later regardless? Or is there a risk that they'll just reject it?


I really believe you are making a huge mistake not filing on time and something you are going to regret. I hope I'm wrong for your sake.

Hi. I'm wondering if anyone here can give me some insights:

I'm trying to file RoC by August 24th, with the waiver for divorce, with the intent to send the decree in response to a request for evidence. I've been separated from my wife since late April, but because of unexpected obligations with work, she's taken a long time in sending me the documents she promised to send, and the hassle over that and other things have prevented me from being well-prepared in time.

I'm receiving my documents only on the 22nd, and could still scramble to send them in in time. While making the deadline seems preferable, from what I've read on the forums, it doesn't seem like a few days late would be a real problem in practice, particularly given that I have a good explanation why it wasn't my fault. I'm not 100% sure though?

Also, I'm confused by some things it says in the instructions for the I-751. It seems to say affidavits are necessary, while on the internet I've mostly read that affidavits are only necessary if you don't have other documentation.

And under when to file (for the waiver case), it says the following:

"You may file this petition at any time after you are granted conditional resident status and before you are removed."

So does that mean that although removal proceedings theoretically start at the second anniversary, if you send it later than that, they can't fault you as long as you haven't actually been deported? Or does it only mean I could have sent it in before the 90-day window? I'm confused.

I've been trying to consult a lawyer about these things, but in the mean time, I'd greatly appreciate any answers people may have.


Why put yourself in the position to have to ask for a waiver? It seems crazy to me. I would file on time with whatever I had at the time and pay the fee. Then wait for a possible RFE. It's a much better "problem" than not filing on time!!
Send it overnight with tracking you you can prove you filed on time. I used USPS overnight since FedEx and UPS cannot deliver to a PO Box.

Thanks now I have two more if you guys know the answer.

We are applying for myself and my son. He will be on my i751 as he came at the same time. Do I write one check for 675? (505 for form then 85x2) or do I write two checks? (one for the 590 and then one for 85)

How did you attach the checks or what did you do to ensure they say put?


Read the I-751 guide for instructions and also read Gary and Alla's interview with the assistant director concerning i-751 filings. I found it to be really helpful.
Yes, $675 is the correct amount if you and your son are on the same application. I made out one check and attached it with a plain old paperclip. It's been cashed so I know it worked.

No problems for my wife. My stepdaughter had a hard time with the extension letter and expired Green card when she tried to board in Moscow to NY. the gate attendant for Aeroflot was not familiar with the letter and almost refused to let her board. At the last minute, after being threatened on the phone by me, he let her on. That's why it might be a good idea to have the stamp if you can get it.

You can do a walk-in biometrics appointment. I've done them every time without a problem.

You must bring the original extension paperwork with you when you travel to Ukraine.

If I remember correctly you lost her green card? If so, you will need to make an infopass and get her passport stamped if they will allow it. This might cause you a problem with the airlines however. Don't assume they know anything when it comes to immigration documents when it's outside the norm they are accustomed to seeing.

CanadaCashing Canadian Bank Checks In The US

To be honest I paid the fees. My last bank charged for any transaction that had a foreign participant. Although 7 USD is a lot more than I ever paid. I've heard most banks do this... the price of the charges vary depending on the bank I assume. I'm not sure of any other places.... sometimes a bank to bank money transfer can be cheaper... I started doing that for awhile because it was HSBC to HSBC, but either way there was still a charge. Hope you get a better answer than mine! Best of luck!

Hi Guys

 

I need a big help here.  I had submitted all necessary documents for the removal of conditional status of my spouse.  However, the USCIS came back saying they need more evidence.  What more information can I give them besides tax returns, bank stmts, life insurance, joint auto documents, travel documents such as air tickets etc.

I lost a copy of my old lease and we moved to a new place (have joint lease at the new one which I will provide a copy to them), can I provide them with a letter from the old management?  Can I provide photos of our various trips?

I packed up my apartment and left my job at the end of August 2012. My stuff has been in a PODS container in their warehouse since that time.
PODS.com/canada. The container is 16 feet long and about 8 feet wide and 8 feet tall. (they have smaller containers, but only the 16' ones are taken across the boarder). They delivered it to my apartment building parking lot and I had movers take my furniture down the elevator and load the container. The container was picked up the next day and taken to one of their warehouses (mine is in Toronto near the airport). I visit it every once in a while to take out/ put in seasonal clothes, etc. in the meantime, I have been either visiting my fiancé or staying with my parents. (Our processing got delayed for about 6 months for various reasons). PODS will transport the container to Florida. I have to cross the boarder first and provide documentation to PODS to go with the shipment. The container will go into a warehouse in Florida until I arrive there in October. (Spending the rest of the summer in New York). The container will then be delivered to our driveway for as many days as we require to empty it. They have cross boarder specialists to provide you with the necessary paperwork and logistics. They've told me to allow 7 days for it to reach Florida from Toronto.

We had considered driving a UHaul. It's two 12 hour days of driving, and with a UHaul we figured it would take 3 days. The down-side seemed to be long days, uncomfortable seats, additional costs for meals and hotels, etc. The extra cost seemed worthwhile, especially since I also needed my items stored, and it avoided having to load up and unload a storage locker, load up the truck, etc.

I also interpreted the Florida DMV site to indicate nothing can be done until my EAD has been approved. And my immigration lawyer confirmed that interpretation. In the meantime I have maintained my car insurance policy from Ontario.

Once you get in the front door, past security, and then up the elevator; it's first come first served. You stand in line after getting off the elevator to get a number. I think my appt. was for 9.30 or 10:00 and got there at 7:30 am  (there were others there before me, but they weren't VJ members and lined up on the wrong side of the door and were expecting to get out the wrong side of the elevator.)  Guess it's a toss up whether you want to wait for the outside doors to open, and then wait for the elevator to open vs.arriving later and waiting in the waiting room.  

I recall hearing about other fiances going to the interview.  i went by myself.  Double check the Mtl consulate website.

OK here is my question, on the Vaccination List that is required for K-1 and later for AOS, there is a vaccine called "influenza vaccine"...Today my family doctor came at my place (they were going to everybody's home in the area) and offered to get influenza vaccine...I'm not sure if I should agree to get it or not.. Normally, I'd rather eat fruits and vitamins to stay healthy, BUT I remembered that this vaccine is on the list of required vaccines..So, should I get it now so that I have more vaccines covered (for the future when I apply for AOS) or not, what do you think?? Thank ya'll!!

I just called the appointment phone Friday. The earliest appointment then was on June 18. I don't think I will be ready to make an appointment for another 2 weeks so I think that will put me sometime right after the 4th of July I think.

RE the info packet: That's the problem, they have the forms for the K-1 and K-3 mixed together in one packet and I think some of the forms are used for K-1 and some for K-3.

DS 230 and I-864 are not used for K visas in Kiev.
