K-1 Fiance(e) Visa Case Filing and Progress ReportsFebruary 2010 Filers -- I-129F -- VSC

This has been a slow week for approvals. Might be the spring break thing. I had a lot of customers on vacation this week because their kids were out of school. I am looking forward to more approvals next week, getting us closer to our NOA2. I am just sitting back and relaxing. It is hard, but it is better then getting too obsessed with this crappy wait. It was good to see a couple of Feb filers get approved. I do hate it for the Dec. people that are still waiting. I am hoping to get a July interview in Kyiv. Luckily for those of us with Ukranian ties, it is only about a month from NOA2 until interview. I see some countries where it is still another three months plus for interview.

It is Friday folks. I hope everyone has a great weekend. I am back to turkey hunting and some bass fishing. Luckily for me Vika thinks it is great that I can go out and get our dinner. She says better than animals raised with drugs in them.

I hope that we have some people on this thread dancing here soon. I will be happy to dance my way all the way to Kharkov. The immigration officer at Boryspil will probably deny me entry when I am in the line "cutting a rug." Crazy Amerikanki. Tom, I hope that you are the first to dance. You are under a tight timeframe.

Thanks Kirk. I hope we all get our approvals... soon!!

aww S and T, that's pretty crummy that you can't stay longer then 30 days.

i'm grateful i'm from canada. joey drove 8hrs to come pick me up, we drove 8hrs back together. now i'm camping out at his house for the duration until our NOA2 comes up. it's made the wait far more bearable then had i'd stayed at my parents place in ontario. it was hard enough to leave him after our visit in january. so admittedly, i feel spoiled compared to some of our group. having to wait, separated and stuff. in truth i feel horrible but very lucky.

i've heard they've started the february petitions. so gonna keep my fingers crossed for everyone in our tiny group that they really start to hammer them out.

there's also rumours flying around in the US that the govt is trying to pass a bill to abolish the borders in north america. meaning citizens of Canada and Mexico can move to the US legitimately. anyone doing a north american move heard about this??

That rumor sounds like paranoid right-wing talk aimed at then uninformed, low information voter.... It will NEVER happen!

how are we checking "touches"?? every time i go to the uscis page and enter in our number, it just says the same ####### over and over again.

When the date changes on your USCIS page... you've been "touched". It's that simple. (We all hope it means someone is working on our file, but it can mean nothing at all!)

How are you finding there have been 3 approvals already for VSC for Fed filers?
Via timeline searches, or is there a quicker way?

At the top of the page, click on "Immigration Timelines" and then click on Igor's list. Then either choose CSC or VSC and choose all petitions. (WELCOME TO YOUR NEW OBSESSION!)

Well today was the first day I actually starting whining about how unfair it is that CSC has processed over 30% of Febs applications and we get 3! (so my plan wait patiently is officially out the window!!)

we haven't received ours either. no email or hard copy. i realize they've only had it for 4 days, but i've noticed that others have received their noa1's within the first few days of their arrival. i'm stressed :P

My NOA1 date was Feb 5, but I didn't get the hard copy until ( see below), so don't worry, it will come. Good luck and welcome to the 2010 Feb filers!

Heyas! Joey (American) and I (Canadian) are also February filers!

Good luck to everyone. We're super anxious ourselves :)

Quick question, would anyone know what forms I should begin to gather while we're waiting for the NOA's to bounce around? From what I've read so far (here and there) I'll need to have my police check and an extended birth certificate (not the typical wallet sized one). Any others I should be prepared to gather?

Thanks!!

Hey Feb, 2010 filers! Glad you found this post! .... We need to stick together!
GOOD LUCK to ALL!!

when it arrives at the VSC or CSC, no matter what you did, they disassemble it and put it in their own order and THEY use staples, but only after it is ordered how they want. Not to worry. It is important only that it all arrives.

Thank you to all! Everyone here has been fantastic!

I thought I had read all the instructions and then the suggestions.

What is the proper way to bind? I just put it in a manila folder and placed it inside a mailing envelope.

Thanks

Of course, I didn't see this until after I sent the package. However, I don't think it's a big problem.

a. Do not use binders or folders that cannot be easily disassembled.
b. Use ACCO fasteners to hold together thick or bulky applications or petitions. Two-hole punching the top of the material for easy placement in the file is appreciated.
c. The use of tabs assist in locating items listed as attachments. The tabs should be placed on the bottom and not the side for ease in filing.
d. Avoid using heavy-duty staples; instead use ACCO fasteners or heavy clips.
e. Avoid submitting originals unless specifically required (Forms I-94, Labor certifications, etc). Avoid submitting oversized documentation when possible.

You can look on the back of the cancelled check for your case number to look it up online. It could easily take a week or more to receive your NOA1 in the mail, some people never receive it.

Also, you can get a complete overview and instructions as to what to do next at the US Embassy of Ukraine web site and the K1 guides here. I think there is no need to hire an immigration lawyer at this point since you've already done 90% of the work. If you get a denial, then you might consider hiring one.

Why is the police clearance a major hurdle?  It's a pretty simple process in Ukraine. I think Christmas is really out of the question at this point. Also remember that everything closes down in Ukraine for the first two weeks in January. So you are most likely looking at the end of January or even February to get the visa in hand if all goes well.

IR-1 / CR-1 Spouse Visa Process & ProceduresTranslation of Birth Certificate

Hey all

I am getting everything ready for going to the US, getting married and starting the visa process! :D

For the DS-230 I need a translation of my birth certificate which is in Danish. Question is, can I make this translation myself, or can I have a friend of mine do it? Or does it have to be done by some sort of official? The wording is unclear to me:

"Translations. Any foreign language document must be accompanied by a full English translation that the translator has certified as complete and correct, and by the translator's certification that he or she is competent to translate the foreign language into English."

Thanks for your advice!

I think you are better off getting some sort of "official" translation done if possible. Although the instructions are vague on this and you might be able to use your friend , remember that you don't want anything to hold up your visa. Don't cheap out on these kind of things, it might come back to bite you. In Ukraine there is an official agency that does translations and we decided to use them instead of taking a chance with her friend who was fluent in English and Russian.

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed advice got SIF today - what to do.

I tried to log on to the NVC today January 20, 2011, and received "sign in failure". What do I do next? Do I wait for the embassy in Kiev to contact me? I understand that with the Kiev embassy we call in and set up an interview date. Can we call the embassy and set up an interview or wait until they receive the information packet from the NVC? Of course I have the KEV number, but I am thinking the documents have not been received at the Embassy? How long can we expect till the packet is received by the Kiev embassy? How long from the SIF until we can expect a interveiw date? Is it time to set up the medical appointment? any help would be appreciated, espically if someone has have an interview recently in Kiev Ukraine. Below is the message from the NVC.

Sign In Failed

Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please click on the Contact the NVC hyperlink if you believe that you have received this message in error.

It usually takes about a week to ten days from the time it leaves NVC until it arrives in Kiev.
Go to the website of our Embassy in Kiev and read the info concerning making an appointment. You will need to purchase a PIN number (instructions are on the web site) The list is updated once a week (each Monday I think, ) so if you are not in the system on Tuesday morning don't bother to call back until the following week.

K-1 Fiance(e) Visa Process & ProceduresHaitian Disaster, Impact on K-1 visa?

Hi GARY & Alla,

K-1 Fiance(e) Visa Process & ProceduresHaitian Disaster, Impact on K-1 visa?

The problem being that the service centers routinely ship overload to other centers. All the Haitian requests may go to CSC and CSC may send a few thousand I-129Fs over to Vermont. So while it will be absolutely TRUE that Vermont is not handling the Haitian requests, it could impact them. Not saying it will, but it could.

K-1 Fiance(e) Visa Process & ProceduresNo middle name but in Ukraine passport yes.

This is normal. Do not worry about it. Ukrainian international passports do not list the patrynomic. On all documents list her middle name (In Russian culture it is the "Patrynomic" not her middle name, but that is where it goes on the forms) The visa will be issued exactly as her name is in the international passport. When transliterating her name, any reasonable transliteration is accpetable (ie. Tatyana, Tatiana, etc) but the visa will be exactly as the international passport transliterates her name.

If her internal passport is recent, it is Ukrainian. Her international passport will be Ukrainian/English. You do not need the internal passport for this process.

Hmmmm. I didn't use Tanya's "Patrynomic" on the forms, I just left the middle name blank. I read these instructions literally, so when it said "other last names", I thought that's what they meant! I hope I'm not going to get a RFE over this.....

K-1 Fiance(e) Visa Case Filing and Progress ReportsChange of Address for US Petitioner

Also depending on your case if you are still dealing with the NVC they should be informed as well. In our case the beneficiary changed addresses not the petitioner. But the embassy should definitely be notified because at least in our case, they were responsible for sending all information to both the petitioner's and the beneficiary's addresses, and my Fiancé never received his info in Mexico, although this seems to be common due to Mexico's mailing system. Therefore I received everything in the U.S. Best of luck.

K-1 Fiance(e) Visa Case Filing and Progress ReportsChange of Address for US Petitioner

In our case, I called the embassy who was in charge of our case. They said once the case was registered in their system I could call them and give them the new address. I called back every week until they confirmed our case was in the system and gave them the new address over the phone. If your embassy won't do that you can always call and ask how you should or could provide them with the new address and I'm sure they'd know what to tell you. Best of luck.

congrats!!! any advice for the interview? were you down there during the interview? i know you can go in but i want to be there supporting my fiancee and i would like to know if me being there will help out at all in the interview. thanks!! goofy.gif

Yes I was there. I recommend going because they ask where your Fiancé is, and it always sounds better if your fiancé can respond, waiting outside. My advice is to have all your paperwork organized. Make sure your fiancé knows your phone numbers and address in the U.S. Make sure you have your DS 260 confirmation, invitation letter, consular appointment confirmation, and Fiancé's passport on hand. The doctor, ASC and consular interview ask to see them! Make sure to arrive to the ASC 10 minutes early, consular appointment at least 30 minutes early, and doctors appoint in the morning. It takes up to 2-3 hours and they stop seeing patients at 11 am. I wrote brief review under the Mexico section in the Embassy Review menu link above. If you need any other advice don't hesitate to contact me! Best of luck!
