Hello,

I've been reading the topics on this site for a long time now, and have read the guides quite a fair bit too. Thanks for all the information gathered so far, it has helped a lot.

I have a question relating to the co-sponsor form and the requirements for taxable income. I recently read another thread on the same sort of topic but found it too confusing. Basically it was a lot of "no it means this" "no it doesn't, it means this" arguing, so I thought maybe someone could answer it more clearly or point me in the way of an online guide that explains it better.

My fiance does not make enough to sponsor us, so we will be asking his Dad to fill out a co-sponsor form. My fiance lives at the same address as his Dad, his wife and child (over 21). If his Dad filled out the application, would he need to show enough income support for himself, me and my fiance? Or would it be himself, his wife, his child, my fiance and me?

My fiance is also considering filing for two other family members on his tax return this year. Am I correct in assuming that his Dad would need to cover those 2 aswell?

I'm sorry that this type of question has been asked before, but my brain is just swimming with different options at the moment. Thanks for reading.

Ahh thankyou! I just found a part in the instrustions for the form that you can download from the website that says a passport in place of a certificate is acceptable. Think I just had my first mini-freak out, oh dear.

Hello,

 

We are compiling all the information and getting ready to send off the application. I have a question (one of many to come I'm sure) relating to the proof of citizenship.

 

My fiance was born in the Phillipines and moved over to the US when he was 6. He hasn't got his naturalization certificate and replacing it costs $345 according to the USCIS website! I was wondering if the photocopy of all the pages in his US passport would suffice? Or would it be sent back with an RFE for the certificate?

Hello,

 

I know we can visit and have had a read through the pinned topic at the top of the board but would like a couple of opinions on my situation...

 

We are sending off the K-1 today/ tomorrow (yippee!) and are bracing ourselves for the long wait. The plan at the moment is for me to visit him in the US in November but I have two possible options. 

1) I take two unpaid (I have used all my holiday allowance for the year) weeks off from work and come over to see him for his birthday and thanksgiving. I will take with me a letter from my boss saying my time off is approved and am expected back at work on this date. The past two visits I have taken this letter with me but I've never been asked for proof or sent to the interview room at customs.

 

2) I quit my job (I don't like it anymore) and visit for around seven weeks and return just before Christmas. I know this is risky as I wouldn't have a job, I live with my parents so no rent agreement and I don't really have any bills. I'm hoping if I did this then the previous five visits in two years would support me as I left when I said I would each time. I also didn't overstay my J1 so I hope they like that! I would have enough money to support myself over those weeks and I hope that if I did have to go to the interview area then my K1-in-progress would show I know how to legally move to the US and wouldn't risk overstaying as I am already applying legally for future residency.

 

Last year I was taken to an interview room because I spent all of April over there, had 6 weeks back in the UK (where I finished my degree) and then went back over for 3 weeks. I understand that it was a quite a quick turnaround to go back and probably having no more university and no job raised their suspicions. I did tell them I knew how to apply for a visa but we weren't at that stage yet which they seemed happy with...

 

Anyway, my question is am I completely crazy for wanting to do option 2? My fiance and friends are encouraging me to do option 2 but I'd like some outside input on how you all view this and what you would do in my situation?

Hello,

 

Just a quick question. Could someone please please please give me the correct address for the dallas lockbox to send my petition into. My fiance is at work so cannot get him to check which zip code was used and we received an email from UPS saying the postal code is wrong and cant be delivered. He sent it via three day shipping without it requiring a signature but I'm sure I put the correct zip code on it.

 

Already have a setback and the thing isn't even there yet to start being processed. I've got such terrible luck :(

You do not need immunizations to get a K1 visa. You need immunizations to get a greencard. But if you get every requirement met and documented at your visa medical on the immunization form DS-3025, that will suffice as proof for your AOS process. Otherwise you will have to pay a civil surgeon in the US to complete a new immunization form. That can be a huge hassle. I want you to read these two threads someone who did not get it done in advance and see their frustrations. It happens all the time when dealing with civil surgeons.

Do it before the visa and save the additional expense and frustration.

Heres the shots needed for 19 through 59 years of age: 
Td or Tdap - or  get DT, DTP or DtaP and it will be accepted for AOS also
MMR (if born in 1957 or later) Get a second shot 4 wks later if you have time before your medical.  It's two doses in your life, but if you get the first,  and 4 weeks haven't passed by your medical, they will waive the second dose for "insufficient time interval".
Varicella Not routinely given in the UK ;  a history of having chickenpox excuses you from the shot. They take your word for it at the visa medical exam. 
Influenza - During flu season only, October 1 through March 31. This was a new recommendation dated November 2010 for all ages over 6 months.  Older lists will say flu shots for over age 50. It changed.

For Australia, flu season will be different dates...winter, right? So The visa doctor there could mark the waiver "not flu season" (it's on the form) and you don't have to get a flu shot.












 

 

This is incredibly helpful! Thank you so much because I was wondering about sorting it all out before coming over. I haven't heard of the first one. Second one, I already had the shot years ago so don't know if it needs a top up? Third one, I have had chicken pox when I was a kid so I guess I don't need it and fourth one I will go get.

My package 3 was delivered to Montreal May 16, 2013. (K-1 Visa)
Received package 4 letter by email May 30th. 10:30 am
All day long the CSC website was showing "no appts available".
Called CSC near the end of the day, suddenly appts were available 42 days out.
My interview is scheduled for July 11, 2013.

Montreal seems to be the only consulate that requires the online form.
For the online version, my lawyer advised me to include the most recent visits as space permits (15 visits as I recall)

Similar to the above post, my prior visits also include time living there as a child on a green card.
My lawyer prepared a long list ( 3 pages ) of my best guesstimates which I signed and dated. It was attached as an addendum to DS-230.

The original documents will be in your file when you get there. They keep the original of the police certificate. They will give you back the original of the birth certificate and they want to keep a photocopy of it. Did you make a photocopy that you can provide them with? I don't know if there is a copier machine in their back office. ( you'd have to think so )

CSC is random as hell. If you look they have skipped a good deal of December filers while processing Jan/Feb.

VSC is slower, but only arbitrary. 100-120 days seems to be the norm nowadays.
While I understand your frustration (been there done that) you guys are getting angry way too soon.

Also looking at your signature.... 3 touches in 3 days. Might actually mean they have mailed out your NOA-2 and have not updated the website.

Happened to people in December group.

Possible but not likely. I tried to get an expedite because my fiancées daughter is going to age out. It was denied. I think that what the touches were. This is why I'm a little angry. I see CSC feb filers being approved left and right and I really need mine for a very valid reason. Hey while your here, I noticed that you are flying Aerosvit to Kiev. Have you flown them in the past? I'm thinking about using them.

I plan to have my Fiancée pick it up in Kiev at the FedEx office which should shave a few days off the delivery. I'm hoping to get it before the weekend (her interview is on a Tuesday) and then she can fly out Saturday. She lives in Donetsk and it's really inconvenient to say the least to have to go back to Kiev to fly out again. That's why we are trying to do it in one trip.

Don't worry ... I think you are fine. Since you used Express Mail (from USPS) they WILL deliver it to a PO Box. I have sent many Express mails and Priority mails to PO Boxes with no problem. You only have a problem if you try to use FedEx or UPS to a PO Box.

Respectfully ... no they are not saying anything of the sort.
You are free to marry anyone you want. But your spouse is bound by the laws of The United States of America and he or she needs a visa in order to enter legally. Let's try to remember that these visas are a benefit (not a right) of OUR citizenship and NOT a right that is given to our Fiancées or spouses. If they tried to apply for one themselves it would take years to get ... if ever.
We all remember the frustrations and pain of waiting for our loved ones. Keep your eye on the prize... the day will come. Once it does, all the frustration you feel towards USCIS will dissipate.
Then get ready for AOS! I found it a much easier process and the fact that your loved one is with you makes it a much less painful experience.

Yes four Feb filers have gotten approval. The first three look a though they were military expedites. One was just approved yesterday with an NOA-1 date near your date.

Click on this link then choose igor's list and then change to Vermont Service Center. It will show you the last 15 approvals at VSC. :clock:

It is nice to see a little bit of life here. Still no dirty dancing yet. I was off hunting and then my sons had a lacrosse tournament. Kept me busy, but now I see VSC has slowed to a crawl. Well, they can only get better from here. "Come on, you can do it. Yes you can." Just had to give them a little bit of encouragement. I wish I had an RFE, that meant our petition was actually in somebodies hands being worked on, not in the cafeteria underneath a table leg to keep the table from wobbling. From most of what I have seen, people are approved within a week of sending back their RFE. I hope this is the case with yours.

Tom, I am still wishing good things for you this week coming up.

I am going to go touch myself now. VSC won't do it, someone has to.

Airfares jump for Ukraine as much as $600 during the summer. I see it every year. I am sure a lot of destinations are the same.
Also, we will probably get bent over and have to pay the new higher visa fee of $350. It will be my luck. It will probably change the week of the interview. Who knows, the goverment might drag their feet on this one and I luck out.
Tom, where did you get that brass pole, or should I ask? You might want to disinfect it.

This has been a slow week for approvals. Might be the spring break thing. I had a lot of customers on vacation this week because their kids were out of school. I am looking forward to more approvals next week, getting us closer to our NOA2. I am just sitting back and relaxing. It is hard, but it is better then getting too obsessed with this crappy wait. It was good to see a couple of Feb filers get approved. I do hate it for the Dec. people that are still waiting. I am hoping to get a July interview in Kyiv. Luckily for those of us with Ukranian ties, it is only about a month from NOA2 until interview. I see some countries where it is still another three months plus for interview.

It is Friday folks. I hope everyone has a great weekend. I am back to turkey hunting and some bass fishing. Luckily for me Vika thinks it is great that I can go out and get our dinner. She says better than animals raised with drugs in them.

I hope that we have some people on this thread dancing here soon. I will be happy to dance my way all the way to Kharkov. The immigration officer at Boryspil will probably deny me entry when I am in the line "cutting a rug." Crazy Amerikanki. Tom, I hope that you are the first to dance. You are under a tight timeframe.
