Hey guys, we finally had our I-130 interview today and also submitted our RFE replies in Baltimore Field Office.

Our appointment was 11am. Though we got very close to Hopkins Plaza by 10:40am we made the mistake of driving away from the H. Plaza looking for a parking spot and we got too far to back up and it took us another 30mins to drive through traffic to get back to HOPKINS PLAZA. By the time we made it through security screening and got to wait in line to be processed at the USCIS office it was 11:20am. 

We saw a lot of people already sitting and waiting for their turn to be interviewed as well. Funnily after we got processed and i sat that with my wife and 11month old baby, we heard our name called in a less than 5mins.

The officer was warm and cordial. Her questions were:

1. May i have all your passport documents please? I said SURE and gave them to her.

2. Do you have any more documents for me? I said yes, originals or copies, she said copies for now if there was a need to see the originals she would ask for them.

So i gave her, lease agreement, our joint account bank statements/transaction journal in the US, notarized letters from 5 friends in the US, birth certificates, letters explaining why my wife did not have to pay income tax. My wife is the USC and i am the non resident beneficiary of IR-1 petition.

3.She asked if we had any pictures to show her. So we showed her our wedding album and introduced the photos to her. 

4. She asked if she could have some of the pictures. So we gave her a couple of pictures of our engagement, wedding and after the wedding.

5. Then she asked us some basic relationship questions like, date of birth, when did our wedding take place, how long our courtship was, what were the names of our father and mother inlaws, how did we meet, my residence address abroad, my wife's US address . In the end she returned our passports and asked if we had any questions for her. So i asked when should we expect to be approved? She said she would review our case file and we shall get a decision in the mail within a few weeks. She asked if we had any more questions and i asked her what her name was and she told us.

The whole session lasted for about 10mins and that was it. Thank you VJ for all the hints and tips. I'm postive we shall get NOA2 very very soon. biggrin.png 

For other October 2012 filers that are probably still waiting for case update after NOA1, KEEP YOUR HOPE AND FAITH ALIVE!!!

Let me get this right, please pardon my naivety. If we  filled $0 dollar as amount earned then  should  we include or exclude  the  2 month paystubs and letter from employer stating her gross earning till dat?

You are telling them on one had I earned money and the other hand we don't have to file because we didn't make enough. You have to make it plain to them. You needed to put $0.

 

Am I write people? NVC wants a tax return. They aren't tax people soi they have no clue what the guideline amount rewuired to file so you have everything submitted to them they are expecting a tax return.

They are askign because you put doen earning. Unless she made above the amount needed to file (i believe like $9000 or so) they you should have put $0. And than the letter attached would have explained it more to them. Since you reported earning they wantto see a tax return. So you need to explain it more.

Oh really? We included 4 of her paystub and the total earning was less than $2000. The annual report served as letter from her employer.

Unless I missed it, I didn't see anywhere where it stated about including 2012 tax returns. It does appear though that you didn't fill out the I-864 form correctly. Did you not fill out 13a-c?

If you check carefully you will where 2012 tax returned was mentioned. Of course we filled 13a-c to the best of our knowledge. I am reviewing what we filled to see if there was any error. Thanks

 On the I-864 form what you you put as amount? Did you put $0? Or leave it blank?

We filled her gross earning from July 16 2013 till September 19 2013 before we mailed it. The figure we quoted was same as the amount in her annual report

Dwheels the amazing thing is the CO didn't ask me to show any document or album. He just kept asking me questions and i kept answering while making direct eye contact the whole time.

You can imagine my surprise when I got the text message at 10:30 am saying we got approved!!! First of all I thought for sure we'd get an RFE because I didn't said any pictures of my passport stamps... Also I called VSC yesterday and they told me to call back in a month because they weren't processing anything beyond September 3!!!!

This is good hope for VSC for my fellow VSC filers/ October filers!!!:)

The truth is i won't know until the interview next month. However, from what I've read on the forum here, I've seen enough folks say it was required that I ordered one myself.

When I received it, i realized it was simply a photocopy of the original one on their paper. Since I'm in possession of my original birth certificate, I even asked the state if the original was acceptable instead of paying the $50 for the "long" form, and she said no.

My interview was six weeks out when i was first notified of the date. Hopefully that will give you enough time to get it. I got mine because i want to do everything possible to avoid admin processing - assuming one can actually do that . . .

i know it's not the same but . . .  i applied for an ir2 visa.  took 5 months to receive RFE, i took 3 months to reply.  I had an interview 3 months letter in the field office, 2 more months to receive reply from USCIS.  Never knew i needed to really follow up with a govt agency, but i learned the hard way.

 

case eventually sent to NVC, waited on them, they waited on me.  2.5 years later i got her visa (stepdaughters).

I had same issue back in May.  My original choice was Merida, and had wanted to switch to juarez.  They advised me that such a switch so close to the interview date could delay the package for up to 2 weeks or more.

 

Being this close to the interview, it may behoove you to wait in Juarez until the visa shows.  I was fortunate to fly back with my stepdaughter and was glad i did.  the wait in immigration in philly was 4 hours and since she spoke little english, there's no way she would have made it alone.  My guess would be if you changed it to her home address, you def run the risk of it not arriving in time before you have to be back at work.

if he's never been here before and has the documentation, shouldn't be a problem.  They don't deny folks just to deny them

 

He goes by himself.  There's a waiting room right next to the consulatie where you can wait.  My process took about 2-3 hours.

when you're at the interview, they usually tell you it takes up to 2 weeks to get your DHL package.

 

the reality is it's a few days.  The thing you need to watch for though is how close you are to your interview (and you can verity with consulate in Juarez.  they are really good about answering those type of questions.) 

 

but if you try to change the dhl location too close to the interview date it can make it longer to get to you.

 

i think if it's more than 2 weeks out your are okay.

 

in any rate, you could just have them hold it at the juarez location and she can pick up with an id.  if i'd known that before i would have done it at juarez rather than sending to her house.

i just saw your reply to the other post.  Yes you want to take one original and one copy of everything.  While they will have the file, I took the stuff i'd already sent anyway to cover my rear. that actually helped me down the road when i was at the POE in the Philadelphia airport.

 

I agree with you on the bank statement. That does nothing but help your situation because again, they are trying to establish that the two of you live together in the same residence for some time.

 

Here's what you want to remember.  They are trying to establish a bona fide (not perfect) marriage.  Just because things aren't the way we planned them (Finances etc) doesn't mean you're not going to get approved. I say be honest.  It worked for me.

If it helps. I know how you feel.  Even using a lawyer, it took me 2.5 years to get an IR-2 Visa for my stepdaughter.  I filed in December 2010, in May of 2011 they sent me an RFE, which i submitted by August of 2011.  In December of 2011, I was asked to interview at the local office.  My lawyer couldn't explain why they were calling me in.  I should have asked but i was too busy sweating bullets because, like you, i was worried they would deny the petition.

 

Now granted I filed an i-130 for a different type of visa (yours being different),  However, much like your case, I had to prove that my marriage was a real marriage. 

 

I happened to have a document they sent to me when they sent the RFE regarding what info to provide:

 

1.  a current letter from each spouses' employer- who is listed in case of emergency, and what date the employer was given the information, including dates started and positions occupied, beneficiary of life insurance etc.

2.  Letter from bank - i wonder if it wouldn't hurt to have it even if account is closed. then you can explain why you closed it.

3.  any id that you and your spouse have showing same family name and account number (credit cards, bill payment)

4.  Copies of bills or receipts with your names and same address showing (to show you are living together)

5.  Copy of lease agreement

6.  Photos of wedding and events where you are together.

7.  tax returns with w-2s

8.  Birth certificates of children (if applicable)

9.  Notarized statements from at least 3 people attesting to your current marital relationship. Include the affaint's (person writing on your behalf) name and address, as well as their status in US, relationship to you and your spouse, and how they know you.  At least one should be from a neighbor.  They should be detailed and informative statements, not general statements.

 

 And they swear you in on the interview so be prepared for that.

 

So why did the call me in? i think for 2 reasons.  #1, they asked me questions to which they already knew the answers and wanted to see if I would lie. 2nd) to make sure i was who i said i was.  Meaning, i feel if you show up, that's half the battle.

my 1st stephchild took a total of 2.5 years for an ir 2 visa. the noa2 took over a year to get but it's because i waited on RFE.

 

just filed for the 2nd.  it'll be 8 months before i get an answer from uscis, assuming i don't get another RFE

 

for the one that's been waiting over a year, i would start calling - just my opinion.  Unfortunately i discovered that while they tell you they're all about keeping families together, things do fall through the cracks.  In my case, it happened several times.

 

if it's been a year, just my opinion, but i would call.

Thanks MatthewMaria, the problem is like most here, when it's with our spouses, it's more difficult sometimes because one or the other gets depressed or anxious. For example, my wife had never ever been with anyone before, and so when we married and I had to come back to work and all that, it really hurts her, to the point where we just talk non stop on the phone...it just hurts man...

 

I feel ya.  I had to leave my wife for a year the day after we were married.  Longest year of my life . . . .

And that's the problem, I haven't heard of a single Feb filer getting approved yet, I'm losing my mind! ??

 

That's normal.  2nd time around for me (i have 2 stepdaughters) - my priority date is 1/31/14 so i joined feb filers.  Next month is when we should see some movement.  I know it's hard to wait but trust me, it all works out.

yes they do have bilingual reps.  Just make sure you have the case number etc when calling.  there's a 703 number for them so it's like making a domestic call.

 

the link in the above post for juarez is a big help.

 

the packet they mail is a next steps packet that they will mail to both the beneficiary and the petitioner/agent. even though it's an electronic process, they still will mail stuff.  and at the interview you'll be asked to bring the originals of all your "scanned" copies.  and you usually don/t get them back . . . 

 

Once your app goes to NVC, i believe they don't update the uscis website because ,well, it's no longer at the uscis.  Eventually you will be given another csc website where you can set up asc appointments if you want, select dhl etc (assuming you've sent in AOS)

 

I wouldn't hesitate to contact them with any doubts.  I used an atty and yet when i got nothing in the mail , they were like, oh yeah we sent that some time ago . . . .

There are several consulates in Mexico, but when it comes to family type visas, meaning for couples, kids, etc, where an interview is required, Juarez is the only place.

 

not sure what you'll find, but aeromexico was the cheapest for me.  flew from yucatan peninsula, connected in DF then to Juarez.  in 2013 i think round trip was $250 per ticket
