We recently completed this process at the BKK embassy.  Once we had the NVC case number, we did the medical, ( make sure you get that police check going now too ), paid the visa fee, and completed the DS 160.  If you have everything for package 3 you can send it in once you see it is at the IV unit.  Then you will have an interview appointment set for you shortly after they receive the package 3 from you.  You will probably want to get a single certificate as well from her local amphur, they will probably want to see that at the interview.  Good luck.

I previously applied for and received a K-1 visa for my then fiancee.  She came to the U.S. and we got married within the 90 days.  Then things got weird and we both decided it was best that she return to her country and get a divorce.  She was here about 1 month past the expiration of her visa ( I was preparing the AOS paperwork when she left).  She made it home and the divorce will be final in a few weeks.  My questions:  

If I petition for another K-1 Visa for a different woman will I have trouble just because I have done this once already?  I know about the 2 year rule and that you need to write a letter requesting an exception to process another application.  Do I need any kind of proof that she went home?  I don't have any hard evidence she went home, except for the charge on my credit card for the airfare.  The divorce papers do list her current address and that indicates she is in her home country (the documents she signed were notarized in her home country).  

What other things might I need to consider in preparing a new petition to have the best chance of a RFE free approval?

The new I-129f form a pile of new questions to answer.  Looking at the instruction sheet that can be read to help fill out the form ( Page 3 Part b. Available waivers ), applies to my situation.  I am a multiple filer.  I have previously applied for and received a K-1 visa less than 2 years ago.  The beneficiary came to the US, we married in the 90 days, but then for various reasons she returned home.  I have since divorced her which was not too complicated  given the fact we were married for only a short time.  I have met someone else that I feel is a better match for me in many ways and want to bring my new fiancee here to the US.  

The question then is in regard to requesting the waiver.  The instructions are asking me to explain why a waiver is appropriate and to provide evidence in support of the waiver.  Then the instructions give examples of "evidence" to supply... well none of the examples are appropriate for my case.  We just decided it was best if she went home and we not continue the relationship.  Not complicated at all.  So how do I explain this adequately in order to be granted a waiver?

The way I interpret that statement is that if your fiancee is using a name other than what is shown on the relevant documents ( paperwork supporting the petition ) then a document supporting the name change is required.  I would think then that the marriage certificate then would not be relevant, since she no longer goes by that name.

I'm finally assembling the K-1 petition for my fiancee.  On the G-325A form I have entered all of the names she has used over the years.  I have English translations of all of the name changes, except the one where she got married ( no marriage certificate ).  She has since changed her name a couple of times and has legal documents to support each one of the name changes.  Is it required to have the certificate included in the package showing the name change from maiden name to married name?  What to do?

I am filling out a new I-134.  This is my second K1 visa process.  The first one was successfully granted however that relationship didn't work out.  Anyway, that is a different story.  The question I have is in regard to answering this question on the I134, question 9, where it asks if I have previously submitted an I134 for someone else.  Yes, I did, but that person has returned to their home country and therefore the I134 is no longer in effect.  How do I answer the question?  Yes, but it is no longer meaningful or No, because it is not effective any more.

Sure, I'll let you know when we get an interview date.  Yes, we got the medical done about 10 days ago.  She went to Bumrungrad and was in and out in a couple of hours.  I know they gave her a few shots and she was sore for a few days after that.  Nok was in Bangkok today for a meeting and didn't mention anything about any civil unrest, so it must be localized.  Hopefully the situation doesn't get out of hand.

My fiancee's interview is next week which is great!  I noticed however on the CEAC visa status website, that our case was showing up with 2 case numbers ( an 01 and 02 ).  I emailed the consulate and they think I also applied for a K2 for her child.  I don't believe I did.  The interview letter ( email ) they sent out only showed her name as a traveler / interviewee.  I emailed them back and said well, no I didn't apply for a K2 as the child is not travelling with her, and will not be in the near future ( I don't believe the father would give permission  and the child seems quite happy living where he lives now ).  Has anyone else had this type of thing happen?  I sure don't want this to hold up the K1, since we had no intention of getting the K2.

You really should have called the NVC and gotten a case number for the consulate.  

If you fill out your timeline it might also be easier to help you out.  It's entirely possible your case has not even gotten to the NVC yet.

As long as you are legally able to be married when you file you are okay. My divorce was final for 2 days before I sent in my petition. I was approved in short order, and it was not an issue.

Yeah, that's very true. It's more the timing of me going to school, and the start of our relationship, that gives me pause, really. But, thank you, you've helped a lot. :)

 

Of course not!  Many people have student visas and later get a spousal visa.  That is not something to worry about.  It is weird to think that your future does rest in someone else's hands, but the adjudicators are professionals and do this every day.

 

I know that it's not uncommon to have a student visa and then get a spousal visa - really, if I could have, I would have done an AOS from F-1 to CR-1 at the time, had DOMA been gone then. Would have made our lives infinitely easier, these past couple of years, haha. Thank you!

 

I'm in the exact same situation, just with a male partner.  He's been down here for 2 years and is still attending school and were doing the AOS to CR-1.  

 

Like others said, Canada isn't a huge fraud country, so that helps.  The fact you made it here for an F-1 just shows you have no red flags, visa wise.

 

Did your relationship begin before he came to the US for school? It's the timing that I don't want to give pause. Of course, I legitimately got an F-1 for the sake of university, so I'm not worried about being pinned for fraud, but I just want to make sure I cross our t's and dot our i's. :) Thank you!

Hi all! Before I pose my question, I just wanted to say how much of a help all of you have been with regard to knowledge for US immigration. I had been dreading this process because I had been told nightmare stories of trying to secure a green card, but after researching the topic endlessly, it doesn?t seem as horrible as I had been imagining it!

 

In a post section-3-DOMA-is-gone-hooray world, my partner and I are preparing to file a CR-1 immigration visa. I?m a Canadian citizen, and she is of course American. We met in 2005, started a relationship in November 2007, became engaged in May 2011, and finally married on July 5th this year.

 

Now, within this timeframe, I lived in the US under F-1 status between October 2009 and May 2011 (she having proposed to me right before I left). Being Canadian, I did not have to attend a visa interview for the F-1, I really don?t remember anything special about driving over the border (I don?t even think they asked me many questions, just read through the material, and stamped me), and I don?t think they asked about any relation I may have had in the US, either. It really was an underwhelming experience.

 

So, in this time I attended school full time, did not work, but we did live together during this time. I was always open about our relationship when working with the representative at the university who reported to USCIS, and I have never outright lied when asked to a border patrol officer when going back and forth between Canada and the US. I had to leave the US originally because I was unable to maintain tuition payments any longer, and didn?t want to overstay my visa. At this point, we considered spousal immigration to Canada, but ultimately we both wanted to be together in the US, and she was unable to leave the US easily because she is the main caretaker for her father who suffered a stroke a number of years back. That, and it was about this time that the Obama administration stopped defending the constitutionality of DOMA; we had high hopes that section 3 would be gone sooner than later, and were waiting with baited breath all through June of this year while the decision was pending in SCOTUS.

 

Now, here we are!

 

So, my question is this. Will my past status as an F-1 effect my ability to receive a CR-1, and citizenship down the line, knowing that we had been dating during that time? I did not have immigrant intent under the F-1 (although of course I had wished and hoped and prayed that the laws would change when I was living there to even just <i>give</i> the option for permanent residency, so that when I knew for certain she was the one, we would have both of our countries at our disposal), and left the country when directed by the school and USCIS. I have every intention of being honest and forthright about any dates, particularly during the interview in Montreal, as well as about the time I was a student in the US. Our relationship is certainly bonafide, and I have numerous means of proving it.

 

Also, note (if it?s important): we have not hired an immigration attorney at this point, as we?re confident we can muddle through the process without it, but I will stress the importance if it?s needed.

 

I hope I?m just worried over nothing. We?ve been waiting so long for this that I?m worried sick over any obstacles that may hinder us.

I'm not looking forward to it, either. I was joking around with my wife that we should have just gotten married right after we became engaged, so that when DOMA fell, we'd be able to put in the paperwork right away and not worry about having a CR-1, haha. Oh well, hindsight and all. I'm honestly probably just going to get started on the paperwork for ROC when I'm there - it'll give me something to do while I'm job hunting.

Hahaha. That's pretty much where we are, too. Worst case scenario, if I somehow get myself kicked out of the US, at least we still have Canada!

 

(It also just occurred to me that it's completely pointless to quote you when we're the only two in the topic. OTL)

No your file isn't with the USCIS anymore.  You must be fairly young for those 9 months to have been less than 5 years ago.   I guess I was 22 when I had my daughter.  OMG I feel OLD!  LOL!!! 

 Hahaha. I'm turning twenty-five in a few days, so I'm not too young. :P But, thinking about it, you're absolutely right, the G-245A asked you to list your addresses for the past five years, I just put down since 2006 because that's when we moved into this house. :X (I'm amazed I didn't get checklisted.) I neglected to put Japan on the DS-260, when it asks you to list residences from the age of sixteen - I was in Japan between '06/'07, when I had just turned seventeen. 

 

I'm so glad all of this paperwork is over, my head is spinning with all of this information, hahaha.

Okay correctly you don't need the police certificate but mention at interview that you lived in Japan for 9 months and provide them with the address if needed.

Good evening, everyone!

 

I received a case complete on 5/1, and am currently awaiting my interview in Montreal to be scheduled. I was going through all of the various paperwork and packages, and realized that I made a completely stupid error on the G-325A, as well as the DS-260.

 

I spent nine months in Japan on an exchange when I was seventeen. I don't know how or what I was thinking when I was initially filling out the I-130, but it seems as though I completely neglected to mention that. Granted, it was not a permanent residence - I didn't so much as receive a piece of mail there - and for all intents and purposes I was on a really long vacation. But, now that I've realized it, I'm worried that it's going to cause me issues at the interview.

 

My thought is that I should refill out a G-325A, as well as have a print out from the NVC website stating a police record check is not needed unless I was there for over a year, but I'm wondering if anyone else either has experience with the same thing, or if there's something else I should do that I'm not thinking about. I don't know if there's anything I can do about the DS-260 at this point, since it's already completed and accepted, but... I really don't want to experience AP after the interview, for whatever dumb reason. :X
