If I remember correctly, the next step is that you will receive a letter from the NVC stating that your case will be forwarded to the consulate within one week. Soon after that you should get a letter saying it was actually sent.

There's no way to track your case at NVC by email updates like at the USCIS. Don't worry though, this should be one of the quickest parts of the process.

Most of what you bring to the interview will not be turned in, but you want to have a copy available if they request it. Just have your packet of everything ready to go (forms from packet 3, interview letter, police certificates, birth certificate, divorce decrees, financial support info, relationship evidence, etc.) . Make a duplicate copy of the entire packet in case they request a dupicate of any document.

Anyway, sounds like congratulations are in order. Although I do wonder how DOS was able to actually tell you the visa was issued. Usually the extent of info they can give you is that the check has been completed and sent back to the consulate.

Don't worry, I'm sure everything will be fine. Your fiance is most likely just in standard administrative processing, which means they have to run his name through the FBI database. It is a good sign they took his passport - he should be hearing something any day now.

You can call the Department of State at (202)631-1225 to enquire about his check. Most likely they will just tell you that his case is being processed and he will be notified by the consulate when processing is complete. At least it might make you feel like you're doing something...

Id like to know more about the suggestion of the statement about me being unemployed. Isnt saying ``unemployed´´ enough?

Yes. If you look at the form it even clearly states 'If NONE, state so'. Using 'None' though IMO would be entered if there was no employment at all in the 5 year time frame. If umemployed in between working one would just put umemployed ........with no need to verify such with any documentation.

Sponsorship (income) comes into play with the I-134. Keep in mind that the I-134 is only one thing that a Conof can use to determine if the applicant will or wont become a public charge.


We left gaps in my husband's employment record on the G-325A. No problems.

I think it's fairly obvious that if you weren't employed, then you were unemployed.

Yes, the guides are wrong. In fact, there is no consulate that requires the I-864, although it may be an option or strong suggestion for certain consulates.

You'll need the I-134 in London.

You have to be really careful getting travel insurance for someone immigrating to the USA. Most polices are based on "Home Country" and your home country changes when you immigrate. Coverage begins when you leave your home country and ends when you return to your home country. Now when does your home country change to the USA. When you arrive in the USA? When you get married? Who knows, but if the insurance company can deny it, they will. TravelGuard advised me NOT to use travel insurance for a K1.


When I returned to the USA after being an Italian resident for three years, I purchased travel insurance to be in force from the time I left Italy until the time that my U.S. job started - a total of 90 days. There was no stipulation that I return to Italy.

I'm failing to see how this is any different than, let's say an Italian K1 visa holder entering the U.S.

I'm sure your information is accurate, it must be that I was able to find a good deal...

I think you are being responsible here, and although my husband went 6 weeks without health insurance when he first arrived, I don't think anyone should advocate for not getting interim insurance.

The best solution might be a travel policy. Check out a local travel agent. I used to live in Italy and come home for the summers. My travel agency issued me an emergency only policy valid in the U.S.

It varies widely from case to case. In general, the duty of the interviewer is to verify that your marriage is genuine and was not entered into solely to obtain a green card.

You will have to show proof that you reside together, and have joint finances.

You must get married before April 19th if you have not done so already. Once you are married you can start the Adjustment of Status process (AOS). This process will allow you to get your conditional permanent residence (2 year green card).

Note: you probably will NOT need a lawyer.

You should have accurate current information on your I-134 at the time of the interview. If that means redoing your I-134, then that's what you'll have to do. You'll need a letter from your new employer, and definitely include as many pay stubs from the new job as you'll have. You can always send some pay stubs for your old job as well, with a cover letter explaining your recent transition.

Be careful. If your petition has expired, I would make sure your letters of intent are dated very close to the time of the interview. Read the following article:

K-1 and K-3 visas are odd fish. They are non-immigrant visas. Yet they e processed at consulates as IV’s . Not only that, K-1’s and K-3’s have definite life-spans. A K-1 for instance expires after four months. It normally takes more than four months from the time of DHS approval for a beneficiary to be interviewed at the consulate. Thus, by the time the beneficiary in our fact situation shows up at the window, the petition approval is no longer valid.

41.81 N6.2 Validity of a K-1 Petition (TL:VISA-581; 09-03-2003)

An approved K-1 visa petition is valid for a period of four months from the date of Department of Homeland Security (DHS) action and may be revalidated by the consular officer any number of times for additional periods of four months from the date of revalidation, provided the officer concludes that the petitioner and the beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary's admission into the United States. However, the longer the period of time since the filing of the petition, the more the consular officer must be concerned about the intentions of the couple, particularly the intentions of the petitioner in the United States. If the officer is not convinced that the U.S. citizen petitioner continues to intend to marry the beneficiary, the petition should be returned to the approving office of DHS with an explanatory memorandum. [See 9 FAM 41.81 PN7 for revalidation procedure.)

So in our fact situation above, let us assume the approval of her sponsor’s petition has lapsed at the time of the interview. And it will not be revalidated unless and until the consular officer is persuaded on the merits of her visa application.

Reading the above passage, the FAM seems to place a built-in presumption against the intentions of the couple if the processing time for the K-1 petition has been delayed, even for reasons beyond their control. That presumption grows more persuasive, the longer the petition is delayed. 9 FAM 41.81 N6.2 also mandates that if the consular officer does not believe the couple intentions, at the interview, he or she must return the already expired petition approval with an explanation to DHS.

What is the point of returning an expired petition to a DHS Service Center? It’s hard to say. Perhaps it’s simply an information exchange between the two agencies or perhaps it’s professional courtesy. But this is a part of the process that poses great danger for petitioners. This is the place in the process where a 212(a)(6)©(i)[1] Misrepresentation trap has been set by the FAM

Our beneficiary at this point is in danger of having a finding of misrepresentation entered into her record, even if neither she nor the petitioner have actually misrepresented anything.

When the check "clears", the bank of the payee withdraws the amount of the check from your account. If you have online access to your bank account, you can usually see an image of the check.

I had a representative intervene after our case had left the NVC and we still hadn't heard about an interview 10 weeks later. His office was very helpful and managed to find out our interview date.

He may not have actually expedited anything, but was useful in getting information that the consulate would not provide us.
